Pursuant to Sections 10 and 12 of the Environmental Impact Assessment Ordinance (the Ordinance), the Director of Environmental Protection (the Director) grants this Further Environmental Permit to Highways Department  (hereinafter referred to as the "Permit Holder") to operate the designated project described in Part B of this permit subject to the conditions specified in Part C of this Permit.

根據環境影響評估(條例 )第 10與 12 條的規定﹐環境保護署署長 (署長 ) 將本新的環境許可證批予 路政署 (下稱 "許可證持有人 ") ﹐以營辦B 部 所說明的指定工程項目，但須遵守C 部 所說明的條件。

Hereunder is the description of the designated project mentioned in Part A of this Environmental Permit (the Permit):
下列為本環境許可證(下稱許可證)A部所提及的指定工程項目的說明:

Infrastructural works for Cyberport Development at Telegraph Bay (excluding advance works) [ This designated project is hereinafter referred to as "the Project"]
鋼線灣數碼港發展的基礎設施工程(前期工程除外)【下文簡稱「工程項目」】。

Nature of Designated Project
指定工程項目的性質

Operation of roads, drains and roadside landscape works
營辦道路、排水道及路旁的景觀建設工作。

Telegraph Bay, Pokfulam.

Figure 1 attached to this Permit shows the locations of the proposed works.

Scale and Scope of Designated Project
指定工程項目的規模和範圍

The project is to operate infrastructural works for the Cyberport Development including primarily the following (except advance works*):

l      Road D1 (760m long) and Road D2 (160m long)

(*: The advance works for the project is covered by Environmental Permit No. EP-032/1999 issued on 13 August 1999)

本工程項目是為數碼港發展工程營辦基礎設施，主要包括(前期工程除外)*:

l      D1號幹路(760米長)及D2號幹路(160米長)

(*: 鋼線灣數碼港發展的前期工程已包括在一九九九年八月十三日發出的環境許可證編號EP-032/1999)

 

 

 C部（許可證條件）

1. 一般條件

1.1   許可證持有人必須確保完全符合本環境許可證的全部條件。如有不符合本許可證的情況，可能構成違反《環境影響評估條例》（第499章）的規定，並可按適用情況作為採取執法行動或取消許可證的確切理由。

 

1.2    本許可證並不免除許可證持有人須符合現行法例的責任，例如 《噪音管制條例》（第400章）、《空氣污染管制條例》（第311章）、《水污染管制條例》（第358章）、《海上傾倒物料條例》（第466章）、《廢物處置條例》（第354章）；及其他條例。

 

1.3        許可證持有人須將本許可證的一份副本交予有關工地的負責人。

  

1.4     許可證持有人須依據本許可證B部的工程項目說明來營辦工程項目。

 

1.5        許可證持有人須確保工程項目的設計、建造及營辦，符合環評報告009（登記冊編號：AEIAR-009/1999）所載的資料及建議。

 

1.6    所有按本許可證規定存放的文件，須在接到署長的意見（如有者）起計一個月內或按署長另行指定，根據其意見作出修正。

 

1.7        所有按本許可證規定提交的文件定稿，在署長要求下須公開給公眾人士知道，方法是將有關文件副本存放於環境影響評估條例登記冊辦事處或署長所指定的任何地方，或採取署長所指定的任何其他方法，以供公眾查閱。因此，許可證持有人須提供足夠數量的文件複本。

 

 

2.       工程項目營辦期間須採取的措施

 

2.1    為保護各期住宅發展項目免受過量交通噪音影響而設置的路邊隔音屏障，須在居民入住該期發展項目任何住宅單位期間予以妥善維修保養。有關詳情載於圖2及附錄1。

 

2.2    如圖2所示，許可證持有人須妥善維修保養D1號幹路部分路面的低噪音鋪路物料。

 

2.3    許可證持有人須如附錄2所述，妥善維持佔地至少達2.2公頃的補償植樹帶。

 

註：

 

1.       本許可證共有3部，即A部（許可證主要部分）；B部（指定工程項目的說明）及C部（許可證條件）。任何援引本許可證的人士須就《環境影響評估條例》（「條例」）的法律含意徵詢獨立法律意見，下述註解只供一般參考用。

 

2.       許可證持有人可根據條例第13條的規定向署長申請更改本許可證的條件。

 

3.       承擔指定工程項目整項或部分工程的責任的人，在承擔責任之前，可根據條例第12條的規定向署長申請新的環境許可證。

 

4.       根據條例第14條的規定，署長可在環境局局長的同意下暫時吊銷、更改或取消本許可證。

 

5.           如本許可證在工程項目進行期間取消或交回，則在繼續工程項目之前，必須先根據條例規定取得另一份環境許可證。根據條例第26(1)條的規定，任何人在沒有有效環境許可證的情況下營辦條例附表2第I部所列明的指定工程項目，即屬犯罪。

 

6.           如任何人在違反本許可證的條件下進行工程項目，根據條例，即屬犯罪—

 

(i)           一經循公訴程序首次定罪，可處罰款200萬元及監禁6個月；

         (ii)      一經循公訴程序第二次或其後每次定罪，可處罰款500萬元及監禁2年；

         (iii)     一經循簡易程序首次定罪，可處第6級罰款及監禁6個月；

(iv)     一經循簡易程序第二次或其後每次定罪，可處罰款100萬元及監禁1年；及

 (v)     在任何情況下如該罪行屬連續性質，法院或裁判官可就其信納該罪行連續的每一天另處罰款10,000元。

 

7.           許可證持有人可在接獲本許可證後30天內，根據條例第17條就本許可證的任何條件提出上訴。

 

8.         上述註解只供一般參考用，欲知有關詳情，許可證持有人須參閱環評條例及徵詢獨立法律意見。

附錄 1

 

 

住宅發展項目的分期詳情及相應設置的隔音屏障

 

在每期住宅發展項目的住宅單位入伙期間，與該期發展項目有關的隔音屏障須妥善設置。隔音屏障須按圖2所示設置，並須符合存放在環境影響評估條例登記冊辦事處有關提交文件的規定。上述住宅發展項目的分期詳情及相應設置的隔音屏障表列如下：

鋼線灣數碼港發展的補償植樹計劃

 

（摘錄自環評報告第1B冊附錄9.6）

 

 

本附錄載述可用作進行補償植樹計劃的面積及位置，並附上地圖顯示建議進行補償植樹計劃的位置。

 

建議進行補償植樹計劃的範圍包括位於鋼線灣、瀑布灣及碧瑤灣對下的削土斜坡。補償植樹計劃亦可在建議用作分隔七號幹線及建議的鋼線灣發展計劃的緩衝區四周進行。此外，作為景觀美化設計的一部分，發展項目內一些路旁的位置，亦將用作進行補償植樹計劃。
