ENVIRONMENTAL IMPACT ASSESSMENT (FEES) REGULATION

(Made under section 32 of the Environmental Impact Assessment
Ordinance (9 of 1997) after consultation with the
Advisory Council on the Environment)

  1. Commencement

    This Regulation shall come into operation on a day to be appointed by the Secretary for Planning, Environment and Lands by notice in the Gazette.

  2. Fees for applications under the Ordinance

    The fees specified in the Schedule shall be the prescribed application fees for the purposes of sections 5(2)(d), 6(2), 10(1)(e), 12(5) and 13(6) of the Ordinance, as may be applicable.

  3. Waiver of fees

    No fee specified in the Schedule shall be payable by any Government department which does not operate under a trading fund within the meaning of the Trading Funds Ordinance (Cap. 430).

    Application fees were revised under the Schedule under the EIA (Fees) Regulation (Cap 499 sub. leg.) as stipulated in Legal Notice 311 of 2000 dated 6 Nov 2000

Explanatory Note

The purpose of this Regulation is to prescribe the application fees that are payable for the application for an environmental impact assessment study brief, approval to apply directly for an environmental permit, approval of an environmental impact assessment report, an environmental permit, a further environmental permit and a variation of the conditions of an environmental permit as required under the Environmental Impact Assessment Ordinance (9 of 1997), and to grant a waiver of the fees to the Government.
