Conditions Imposed under Section 5(12) of the Ordinance
For Permission to Apply Directly for Environmental Permit

1. All measures described in the Project Profile submitted by the Applicant on 28 March 2001 shall be fully implemented.

2. The Applicant shall submit, prior to or at the same time as application for Environmental Permit, a plan (within the boundary of the Hong Kong SAR) with reference coordinates, showing the alignment of the proposed cable routing.

3. The Applicant shall submit, prior to or at the same time as the application for Environmental Permit, information which demonstrate that the cable alignment will not encroach upon any important habitat and habitat for species of conservation importance.

4. No cable laying work shall be carried out for the initial 500m of submarine cable from the manhole at Tong Fuk, during the bathing season from 1 March to 30 October inclusive.

Note :

Under section 17 of the EIA Ordinance, the applicant may appeal to the Appeal Board against any of the above conditions within 30 days of the receipt of this notice of the Director's decision.
