Project Title : Improvement to the Ngong Ping Stream

 

Conditions Imposed under Section 5(12) of the EIA Ordinance

for Permission to Apply Directly for Environmental Permit

 

1.      All measures described in the Project Profile submitted by the Applicant on 23 December 2005 shall be fully implemented.

 

2.      The Environmental Monitoring and Audit (EM&A) programme for the Tung Chung Cable Car project shall be extended to cover the project. Environmental performance of the project shall be monitored and audited by the EM&A personnel including Environmental Team Leader, Independent Environmental Checker and ecologist. Remedial actions shall be taken in case of non-compliance with the information and recommendations of the Project Profile.

 

3.      Effectiveness of the rock pools, natural or created, between the diverted Ngong Ping Stream at the Cable Car Terminal upstream and the project site upon completion of the project, particularly in the following wet season, shall be monitored. The monitoring shall include observation on the water holding capacity of the pools, the connectivity of the pools with continuous flow and the utilization of the pools by stream fauna. An ecologist shall be engaged to carry out the work.

 

4.      In case of negative ecological performance of the rock pools, rectification plan shall be prepared and implemented. An ecologist shall be engaged to provide recommendations on the rectification plan.

 

5.      Prior to the construction works, detailed survey of any stream fauna, including Leaf Litter Toad and Reeves’ Terrapin, shall be conducted, and any found Leaf Litter Toad and Reeves’ Terrapin shall be translocated to other nearby suitable habitats. The fauna survey and translocation shall be conducted by an ecologist.

 

 

 

Note

Under Section 17 of the EIA Ordinance, the applicant may appeal to the Appeal Board against any of the above conditions within 30 days of the receipt of this notice of the Director’s decision.
