Pursuant to Section 10 of the Environmental Impact Assessment Ordinance, the Director of
Environmental Protection (the Director) grants this environmental permit to the
AGRICULTURE AND FISHERIES DEPARTMENT (the "Permit Holder") to construct and
operate the designated project described in Part B subject to the
conditions described in and attached to Part C. The issue of this
environmental permit is based on the documents, approvals or permissions described below:

To remove the sediment at the seabed of Sham
Wan Fish Culture Zones by grab dredging. The estimated volume of sediment to be dredged is
0.13 million m3. The full details are given in
the Project Profile [Register No. :
PP-038/1998]. [ This designated project is hereinafter referred as " the Project" ] 使 用 抓 挖 式 機 械 ， 清 除 在 深 灣 魚 類 養 殖 區 海 床 中 的 沉 積 物 。 預 計 需 要 清 除 的 淤 泥 數 量 約 為 十 三 萬 立 方 米 ； 有 關 工 程 的 詳 細 資 料 已 在 工 程 項 目 簡 介 內 列 明 [登 記 冊 編 號 : PP-038/1998]。(本 指 定 工 程 項 目 以 下 將 簡 稱 為 " 該 工 程 " )。 |
PART C (PERMIT CONDITIONS)
1 General Conditions
1.1 The Permit Holder shall ensure full compliance with all conditions of this permit. Any
non-compliance with this permit may constitute a contravention of the Environmental Impact
Assessment Ordinance (Cap. 499) and shall be definite ground for enforcement action or
permit cancellation where applicable.
1.2 This permit shall not remove the responsibility of the Permit Holder to comply with
any legislation currently in force such as Noise Control Ordinance (Cap.400), Air
Pollution Control Ordinance (Cap.311), Water Pollution Control Ordinance (Cap.358),
Dumping at Sea Ordinance (Cap.466), Waste Disposal Ordinance (Cap.354) and others.
1.3 The Permit Holder shall make copies of this permit available at all times for
inspection by the Director at all sites covered by this permit.
1.4 The Permit Holder shall give a copy of this permit to the person(s) in charge of the
site(s).
1.5 The Permit Holder shall display a copy of this permit at the dredging and relocation
sites, or at the nearest convenient locations for the public's information at all times.
The Permit Holder shall ensure that the most updated information about the environmental
permit, including any amended permit, is displayed at such locations. If the Permit Holder
surrenders a part or the whole of the permit, the notice he sends to the Director shall
also be displayed at the same locations for displaying the original permit.
1.6 A copy of Project Profile shall be kept in the Resident Engineer's office and another
copy shall be kept in the Contractor's office on site for reference.
1.7 The Permit Holder shall construct and operate the Project in accordance with the
project descriptions in Part B of this permit, the details in the Project Profile and the
conditions of the Director's permission.
1.8 The Permit Holder shall ensure that the Project is designed, constructed and operated
in accordance with the information and recommendations contained in the Project Profile or
as approved by the Director.
1.9 All deposited submissions, as required under this Permit, shall be rectified in
accordance with the comments, if any made by the Director within one month of the receipt
of the Director's comments or otherwise specified by the Director.
1.10 All finalized submission, as required under this Permit, shall be released to the
public if requested by the Director, by depositing copies in the Environmental Impact
Assessment Ordinance Register Office or any other places or by any other means as
specified by the Director for public inspection. For this purpose, the Permit Holders
shall provide sufficient copies of submissions.
2. Specific Conditions
Submissions Before the Commencement of Dredging
2.1 The Permit Holder shall revise the Environmental Monitoring and Audit (EM&A)
Manual for the Project to include the Director's comments in Annex 1
attached to this Environmental Monitoring and Audit of this Environmental Permit and shall
deposit four copies of revised EM&A Manual with the Director before commencement of
dredging.
2.2??The Pemit Holder shall deposit four copies of the Baseline Monitoring Report enclosed
with derived Action and Limit Levels for monitoring during dredging and verified by the ET
Leader with the Director before the commencement of dredging work. Additional copies of
Baseline Monitoring Report may be required by the Director.
Measures for the Operation of the Dredging
2.3 The Permit Holder shall before commencement of dredging remove all the fish rafts from
the project site to the approved temporary relocation site at Ko Tang Hau for the dredging
work at Sham Wan Fish Culture Zones as shown in Fig. 1.2a of the Project Profile. In case
of emergency, the fish rafts can be relocated to Nam Fung Wan and the Permit Holder shall
inform the Director within 24 hours of such emergency move. There shall be no mariculture
activities at the Project site during dredging.
2.4 There shall be no more than two grab dredgers working at the same time for the
dredging operation at the Sham Wan Fish Culture Zones.
2.5 Closed grab dredgers working within silt curtains enclosing immediate grabbing areas
as described in Section 2.8.1 - Environmental Monitoring & Audit Manual attached to
the application (ref: AEP-019/1999).
2.6 Barges shall be fitted with tight-fitting seals to their bottom openings to prevent
leakage of materials.
2.7 Freeboard shall be installed on barges to ensure that decks are not washed by wave
action.
2.8 The relocated fish rafts shall be returned to their original position in Sham Wan Fish
Culture Zone not later than 4 weeks following the completion of dredging works and not
later than 4 months after the initial relocation, unless otherwise approved by the
Director.
3. Environmental Monitoring and Audit
3.1 The EM&A Manual as attached to the application (ref: AEP-019/1999) shall be
revised in accordance with the comments in Annex 1 attached to this
Environmental Permit and the Applicant shall deposit four copies of the revised EM&A
Manual to the Director before the commencement of dredging.
3.2 The EM&A programme shall be implemented as set out in the revised EM&A Manual.
Any changes to the programme shall be justified by the ET Leader as conforming to the
requirements set out in the revised EM&A Manual before submission to the Director for
approval.
3.3 Samples and measurements for water quality monitoring shall be taken in accordance
with the requirements of the revised EM&A Manual by:
a) conducting baseline water quality monitoring at the specified locations and frequencies;
b) conducting impact monitoring on water quality at the specified locations and frequencies;
c) in cases where specified criteria in the revised EM&A Manual are exceeded, carrying out remedial actions in accordance with the Event/Action Plan, as set out in the revised EM&A Manual; and
d) logging and keeping records of the details of (a) and (b) above, within 3 working days of the collection of data or completion of remedial action, for the purposes of preparing and submitting the EM&A Reports and to make available the information for inspection on site.
3.4 Four copies of Monthly EM&A Report verified by the ET Leader shall be submitted
to the Director within 10 working days from the end of the reporting month or by other
means as specified by the Director. Additional copies of the Monthly EM&A Report may
be required by the Director.
3.5 Four copies of the Final EM&A Summary Report verified by the ET Leader shall be
submitted to the Director within 30 working days from the end of the post-dredging
monitoring. Additional copies of the Final EM&A Summary Report may be required by the
Director.
3.6 The submitted reports as required in this part of the permit shall be rectified in
accordance with the comments made by the Director within one month of receipt of the
Director's comments, or otherwise specified by the Director.
3.7 The actions described in the Event/Action Plans of the revised EM&A Manual shall
be carried out, in accordance with the time frame set out in the Event/Action Plans, or as
agreed by the Director.
Notes
1. This environmental permit consists of three parts, namely, PART A (Main Permit), PART B
(Description of Designated Project) and PART C (Permit Conditions).
2. The Permit Holder may apply to the Director under section 13 of the Ordinance for
variation to the conditions of this environmental permit. The Permit Holder shall replace
the original permit displayed at the construction site by the amended permit.
3. A person who assumes the responsibility for the whole or a part of the designated
project may, before he assumes responsibility of the designated project, apply under
section 12 of the Ordinance to the Director for a further environmental permit.
4. Under section 14 of the Ordinance, the Director with the consent of the Secretary for
Planning, Environment and Lands, may suspend, vary or cancel this environmental permit. In
that event, this environmental permit and its copies shall cease to be displayed at the
dredging and relocation sites.
5. If this permit is cancelled or surrendered in the course of dredging, an environmental
permit must be obtained under the Ordinance before dredging works at the project site
could continue. It is an offence under section 26(1) of the Ordinance to construct or
operate a designated project without an environmental permit.
ANNEX 1 - Comments on EM&A Manual
1. The co-ordinate of the new station located between the dredging site and relocation
site shall be given. Furthermore, the two Control Stations shown in Table 2.4 in page 8
shall be relocated as follows:-
Station C1:?? 835300 (Northing); 854800 (Easting)
Station C2:?? 832250 (Northing); 854300 (Easting).
2. The Environmental Team (ET) as described in the section 1.4 in page 3
of the EM&A Manual and Fig 1.4a of the Project Profile shall be established before the
commencement of dredging and shall not be in any way an associated body of the Contractor.
The Environmental Leader shall be responsible for the overall implementation and
management of the EM&A programme in accordance with the EM&A requirements as
contained in the revised EM&A Manual.
3. Correlation curve between turbidity and suspended solid for the additional water
quality monitoring station between dredging site and relocation site in Fig 1.2a of the
EM&A Manual shall be provided in the Baseline Monitoring Report.
4. Table 2.6 in page 12 about the Action and Limit Levels shall be replaced with the
following:-

Remarks:
1. "Depth-averaged" value is calculated by taking the arithmetic mean of
replicate monitoring data for all three depths.
2. For DO, non-compliance of water quality limits occurs when monitoring result is lower
than the limits.
3. For SS and Tby, non-compliance of the water quality limits occurs when monitoring
results is higher than the limits.
4. All the figures given in the table are used for reference only and EPD may amend the
figures whenever it is considered as necessary.
5. A reporting requirement on the monthly utilization of pellet fish feed during the
relocation of the fish culture activities at the relocation site shall be added to Section
3 of the EM&A Manual.

1. 一 般 條 件
1.1 許 可 證 持 有 人 必 須 確 保 完 全 符 合 本 許 可 證 的 全 部 條 件 。 如 有 不 符 合 本 許 可 證 的 情 況 ， 可 能 構 成 違 反 環 境 影 響 評 估 條 例 (第 499章 )的 規 定 ， 並 可 按 適 用 情 況 作 為 採 取 執 法 行 動 或 取 消 許 可 證 的 確 切 理 由 。
1.2 本 許 可 證 並 不 免 除 許 可 證 持 有 人 須 符 合 現 行 生 效 的 法 例 的 責 任 ， 例 如 ： 噪 音 管 制 條 例 (第 400章 )； 空 氣 污 染 管 制 條 例 (第 311章 )； 水 污 染 管 制 條 例 (第 358章 )； 海 上 傾 倒 物 料 條 例 (第 466章 )； 廢 物 處 置 條 例 (第 354章 )； 及 其 他 條 例 。
1.3 許 可 證 持 有 人 須 複 印 本 許 可 證 的 副 本 ， 以 供 署 長 任 何 時 間 內 在 本 許 可 證 所 涵 蓋 的 所 有 工 地 查 閱 。
1.4 許 可 證 持 有 人 須 將 本 許 可 證 的 一 份 副 本 交 予 有 關 工 地 的 負 責 人 。
1.5 許 可 證 持 有 人 須 在 挖 泥 及 遷 徙 地 點 或 最 近 方 便 的 地 點 展 示 本 許 可 證 的 副 本 ， 以 供 公 眾 任 何 時 間 內 閱 覽 。 許 可 證 持 有 人 須 確 保 在 這 些 地 點 展 示 關 於 環 境 許 可 證 的 最 新 資 料 ， 包 括 經 修 改 的 許 可 證 。 如 果 許 可 證 持 有 人 交 回 許 可 證 的 部 分 或 全 部 ， 須 將 其 送 交 署 長 的 通 知 書 ， 在 備 有 原 本 許 可 證 的 各 處 相 同 地 點 展 示 。
1.6 駐 工 地 工 程 師 辦 事 處 須 存 放 一 份 工 程 項 目 簡 介 ， 位 於 工 地 的 承 建 商 辦 公 室 須 放 另 一 份 工 程 項 目 簡 介 ， 以 供 參 考 。
1.7 許 可 證 持 有 人 須 依 據 本 許 可 證 B部 的 工 程 項 目 說 明 、 工 程 項 目 簡 介 及 署 長 批 准 的 條 件 ， 建 造 及 營 辦 有 關 工 程 項 目 。
1.8 許 可 證 持 有 人 須 確 保 工 程 項 目 的 設 計 、 建 造 及 營 辦 ， 符 合 工 程 項 目 簡 介 所 載 或 署 長 批 准 的 資 料 及 建 議 。
1.9 所 有 按 本 許 可 證 規 定 存 放 的 文 件 ， 須 在 收 到 署 長 的 意 見 (如 有 者 )後 一 個 月 內 或 按 署 長 另 行 指 定 ， 根 據 署 長 的 意 見 加 以 修 正 。
1.10 所 有 按 本 許 可 證 規 定 提 交 的 文 件 定 稿 ， 須 公 開 給 公 眾 人 士 知 道 ， 方 法 是 將 有 關 文 件 副 本 存 放 於 環 境 影 響 評 估 條 例 登 記 冊 辦 事 處 或 署 長 所 指 定 的 任 何 其 他 地 方 或 採 取 其 指 定 的 任 何 其 他 方 法 ， 以 供 公 眾 查 閱 。 因 此 ， 許 可 證 持 有 人 須 提 供 足 夠 數 量 的 文 件 副 本 。
2. 特 定 條 件
展 開 挖 泥 工 程 前 提 交 的 文 件
2.1 許 可 證 持 有 人 須 修 訂 工 程 項 目 的 環 境 監 察 及 審 核 手 冊 ， 以 載 入 署 長 在 本 許 可 證 環 境 監 察 及 審 核 手 冊 附 錄 I所 作 的 意 見 ， 並 須 在 展 開 挖 泥 工 程 前 ， 向 署 長 存 放 4份 經 修 訂 的 環 境 監 察 及 審 核 手 冊 。
2.2 在 展 開 挖 泥 工 程 前 ， 許 可 證 持 有 人 須 向 署 長 存 放 4份 基 線 監 測 報 告 ， 並 夾 附 經 由 環 境 小 組 組 長 核 證 的 挖 泥 期 間 監 察 行 動 及 規 限 水 平 資 料 。 署 長 可 要 求 額 外 的 基 線 監 測 報 告 副 本 。
挖 泥 作 業 的 適 用 措 施
2.3 許 可 證 持 有 人 須 在 展 開 挖 泥 工 程 前 ， 把 工 程 地 點 的 所 有 魚 排 遷 徙 至 高 塘 口 的 認 可 臨 時 遷 徙 地 點 ， 以 便 在 工 程 項 目 簡 介 圖 1.2a所 示 的 深 灣 魚 類 養 殖 區 進 行 挖 泥 工 程 。 在 緊 急 情 況 下 ， 漁 排 可 遷 徙 至 南 風 灣 ， 但 許 可 證 持 有 人 必 須 在 進 行 這 項 緊 急 遷 徙 行 動 後 24小 時 內 通 知 署 長 。 在 挖 泥 期 間 ， 工 程 地 點 內 不 可 有 任 何 魚 類 養 殖 作 業 。
2.4 不 得 使 用 超 過 兩 具 抓 挖 式 機 械 在 深 灣 魚 類 養 殖 區 同 時 進 行 挖 泥 工 程 。
2.5 在 挖 泥 區 內 ， 須 使 用 隨 申 請 書 (編 號 ： AEP-019/1999)夾 附 的 環 境 監 察 及 審 核 手 冊 第 2.8.1段 所 述 的 閉 合 式 抓 挖 機 械 ， 並 以 淤 泥 浮 壩 圍 起 最 接 近 挖 泥 作 業 範 圍 。 ，
2.6 駁 船 的 底 部 開 口 須 有 緊 密 的 封 閉 裝 置 ， 以 免 漏 出 物 料 。
2.7 駁 船 須 裝 有 擋 板 ， 確 保 甲 板 不 會 被 海 浪 沖 刷 。
2.8 除 署 長 另 有 規 定 外 ， 由 挖 泥 工 程 完 成 日 期 起 計 4星 期 內 ， 或 在 首 次 遷 徙 漁 排 後 4個 月 內 ， 須 把 遷 徙 的 漁 排 移 回 深 灣 魚 類 養 殖 區 的 原 來 地 點 。
環 境 監 察 及 審 核
3.1 隨 申 請 書 (編 號 ： AEP-019/1999)夾 附 的 環 境 監 察 及 審 核 手 冊 ， 須 按 本 環 境 許 可 證 附 件 1載 列 的 意 見 加 以 修 訂 。 在 展 開 挖 泥 工 程 前 ， 申 請 人 須 向 署 長 存 放 4份 經 修 訂 的 環 境 監 察 及 審 核 手 冊 。
3.2 環 境 監 察 及 審 核 計 劃 須 按 經 修 訂 的 環 境 監 察 及 審 核 手 冊 實 施 。 該 計 劃 如 有 任 何 改 動 ， 在 提 交 署 長 批 准 前 ， 環 境 小 組 組 長 須 提 出 理 據 ， 證 明 改 動 符 合 經 修 訂 的 環 境 監 察 及 審 核 手 冊 所 載 規 定 。
3.3 水 質 監 測 樣 本 及 測 量 工 作 ， 須 按 經 修 訂 的 環 境 監 察 及 審 核 手 冊 的 規 定 抽 取 和 進 行 ， 方 法 是 ：
3.4 須 在 報 告 月 份 的 完 結 日 起 計 10個 工 作 天 內 或 按 署 長 另 行 指 定 ， 向 署 長 提 交 4份 經 環 境 小 組 組 長 核 證 的 每 月 環 境 監 察 及 審 核 報 告 。 署 長 可 要 求 額 外 的 每 月 環 境 監 察 及 審 核 報 告 副 本 。
3.5 在 挖 泥 工 程 之 後 的 監 察 工 作 完 結 日 起 計 30天 內 ， 須 向 署 長 提 交 4份 經 環 境 小 組 組 長 核 證 的 最 終 環 境 監 察 及 審 核 報 告 撮 要 。 署 長 可 要 求 額 外 的 最 終 環 境 監 察 及 審 核 報 告 撮 要 副 本 。
3.6 須 在 收 到 署 長 的 意 見 後 一 個 月 內 或 按 署 長 另 行 指 定 ， 根 據 署 長 的 意 見 ， 修 正 按 本 許 可 證 C部 規 定 提 交 的 報 告 。
3.7 經 修 訂 的 環 境 監 察 及 審 核 手 冊 內 事 件 /行 動 計 劃 所 載 的 行 動 ， 須 按 事 件 /行 動 計 劃 訂 明 的 時 限 或 署 長 同 意 的 時 限 執 行 。
註 :
1. 本 環 境 許 可 證 共 有 3部 ， 即 ： A部 （ 許 可 證 主 要 部 分 ） ； B部 （ 指 定 工 程 項 目 的 說 明 ） ； 及 C部 （ 許 可 證 條 件 ） 。
2. 許 可 證 持 有 人 可 根 據 條 例 第 13條 的 規 定 向 署 長 申 請 更 改 本 環 境 許 可 證 的 條 件 。 許 可 證 持 有 人 須 將 經 修 改 的 許 可 證 ， 替 換 在 施 工 地 點 內 展 示 的 原 有 許 可 證 。
3. 承 擔 指 定 工 程 項 目 的 整 項 或 部 分 工 程 的 責 任 的 人 ， 在 承 擔 指 定 工 程 項 目 責 任 之 前 ， 可 根 據 條 例 第 12條 的 規 定 向 署 長 申 請 新 的 環 境 許 可 證 。
4. 根 據 條 例 第 14條 的 規 定 ， 署 長 可 在 規 劃 環 境 地 政 局 局 長 的 同 意 下 暫 時 吊 銷 、 更 改 或 取 消 本 環 境 許 可 證 。 在 這 情 況 下 ， 在 挖 泥 地 點 和 遷 徙 地 點 不 得 再 展 示 本 環 境 許 可 證 。
5. 如 果 本 許 可 證 在 進 行 挖 泥 期 間 取 消 或 交 回 ， 則 在 工 程 地 點 繼 續 進 行 控 泥 之 前 ， 必 須 先 根 據 條 例 規 定 取 得 環 境 許 可 證 。 根 據 條 例 第 26(1)條 的 規 定 ， 任 何 人 在 沒 有 環 境 許 可 證 的 情 況 下 建 造 或 營 辦 指 定 工 程 項 目 ， 即 屬 犯 罪 。
附 件 I-對 環 境 監 察 及 審 核 手 冊 的 意 見
1. 須 註 明 挖 泥 工 地 與 遷 徙 工 地 之 間 的 新 控 制 站 座 標 ； 此 外 ， 第 8頁 表 2.4所 示 的 兩 個 控 制 站 ， 須 遷 徙 至 下 列 位 置 ：
