Pursuant to Section 10 of the Environmental Impact Assessment Ordinance, the Director of Environmental Protection (the Director) grants this environmental permit to the REGIONAL HIGHWAY ENGINEER / NEW TERRITORIES REGION, HIGHWAYS DEPARTMENT (the "Permit Holder") to construct and operate the designated project described in Part B subject to the conditions described in or attached to Part C. The issue of this environmental permit is based on the documents, approvals or permissions described below:

Scale and Scope of Designated Project(s)

(a) the widening of the section of Fo Tan Road between Yuen Wo Road and Kwei Tei Street to provide an additional traffic lane in each direction, including the construction of separate elevated structures over the Fo Tan Nullah, the KCR Railway track and Tai Po Road;

(b) the reprovisioning of footpaths along Fo Tan Road and across the nullah;

(c) the associated improvement works at the following junctions along Fo Tan Road:

    (i) Sui Wo Road;
    (ii) Tsung Tau Ha Road;
    (iii) Min Fong Street;
    (iv) Lok King Street;
    (v) Tai Po Road; and
    (vi) Yuen Wo Road.

(d) the construction of the following new roads in Fo Tan:

    (i) extension of the existing Sui Wo Road by construction of a new 2-lane road of 6.75m wide between Fo Tan Road and Au Pui Wan Street and another 1-lane road of 5.5m wide between Au Pui Wan Street and Kwei Tei Street;
    (ii) extension of the existing 7.3m wide Tat Yip Lane to Kwei Tei Street; and
    (iii) provision of a new 2-lane elevated link of about 130m long and 7.3m wide 2-lane carriageway from Tsung Tau Ha Road to Min Fong Street.

(e) the associated modification to existing subways at the junction of Fo Tan Road / Yuen Wo Road and at the two slip roads linking to Tai Po Road;

(f) the replacement of the existing footbridge over the nullah;

(g) the reconstruction of existing pavement / footbridge within the project limit; and

(h) the associated electrical, mechanical, drainage, landscaping, lighting works and environmental mitigation measures.

(a) 擴 闊 介 乎 源 禾 路 與 桂 地 街 之 間 的 火 炭 路 , 以 便 在 每 個 方 向 加 設 一 條 行 車 線 , 包 括 建 造 分 別 橫 跨 火 炭 明 渠 、 九 廣 鐵 路 路 軌 和 大 埔 公 路 的 高 架 路 段 ;

(b) 重 建 沿 火 炭 路 和 橫 跨 明 渠 的 行 人 路 ;

(c) 修 建 改 善 工 程 於 以 下 沿 火 炭 路 的 道 路 交 界 處 :

    (i) 穗 禾 路 ;
    (ii) 松 頭 下 路 ;
    (iii) 麵 房 街 ;
    (iv) 樂 景 街 ;
    (v) 大 埔 公 路 ; 及
    (vi) 源 禾 路 。

(d) 於 火 炭 建 造 以 下 新 道 路 :

    (i) 延 長 現 有 的 源 禾 路 , 以 提 供 一 段 闊 6.75米 的 雙 線 路 段 , 由 火 炭 路 延 伸 至 坳 背 灣 街 , 以 及 另 一 段 闊 5.5米 的 單 線 路 段 , 由 坳 背 灣 街 延 伸 至 桂 地 街 ;
    (ii) 延 長 現 有 闊 7.3米 的 達 業 里 以 連 接 桂 地 街 ; 及
    (iii) 築 建 一 條 長 130米 、 闊 7.3米 的 雙 線 道 路 , 把 松 頭 下 路 連 接 至 麵 房 街 。

(e) 修 築 火 炭 路 與 源 禾 路 交 界 處 的 現 有 行 人 隧 道 , 以 及 兩 條 連 接 大 埔 公 路 的 連 接 路 ;

(f) 取 代 現 有 橫 跨 明 渠 的 行 人 天 橋 ;

(g) 在 工 程 項 目 範 圍 內 重 建 現 有 的 行 人 路 / 行 人 天 橋 ; 及

(h) 修 築 電 力 、 機 械 、 渠 務 、 環 境 美 化 、 照 明 工 程 和 環 境 紓 緩 措 施 。

PART C (PERMIT CONDITIONS)

1. General Conditions

1.1 The Permit Holder shall ensure full compliance with all conditions of this environmental permit. Any non-compliance may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap.499) and shall be definite ground for enforcement action or permit cancellation where applicable.

1.2 This permit shall not remove the responsibility of the permit holder to comply with any legislation currently in force such as the Noise Control Ordinance (Cap.400), Air Pollution Control Ordinance (Cap.311), Water Pollution control Ordinance (Cap.358), Dumping at Sea Ordinance (Cap.466), the Waste Disposal Ordinance (Cap.354), and others.

1.3 The Permit Holder shall make copies of this permit available at all times for inspection by the Director at all the sites covered by this permit.

1.4 The Permit Holder shall give a copy of this permit to the person(s) in charge of the site(s).

1.5 The Permit Holder shall display a copy of this permit on the construction site(s) at all vehicular site entrances/exits or at a convenient location for public information at all times. The Permit Holder shall ensure that the most updated information about the environmental permit, including any amended permit, is displayed at such locations. If the Permit Holder surrenders a part or the whole of the permit, the notice he sends to the Director of Environmental Protection shall also be displayed at the same locations as the original permit.

1.6 A copy of the EIA Report and the EM&A Manual shall be kept in the Engineer's office and another copy shall be kept in the Contractor's office on site for reference.

1.7 The Permit Holder shall construct and operate the Project in accordance with the project descriptions in Part B of this permit.

1.8 The Permit Holder shall ensure that the Project is designed, constructed and operated in accordance with the information and recommendations contained in the EIA Report and the EM&A Manual (Register No. EIA-139/BC).

1.9 All deposited submissions as required under this Permit, shall be rectified in accordance with the comments, if any, made by the Director, within one month of the receipt of the Director's comments or otherwise specified by the Director.

1.10 The Permit Holder shall release all finalized submissions, as required under this Permit, to the public, if requested by the Director, by depositing copies in the Environmental Impact Assessment Ordinance Register Office or any other places or by any other means as specified by the Director for public inspection. For this purpose, the Permit Holder shall provide sufficient copies of the submissions.

2. Submissions or Measures before Commencement of Construction

2.1 The Permit Holder shall revise the Environmental Monitoring and Audit (EM&A) Manual to include the monitoring programme of the construction works as indicated in items (f) and (g) of Part B of this Environmental Permit. The Permit Holder shall deposit 5 copies of the revised EM&A Manual with the Director before the commencement of construction of the Project. Additional copies may be required by the Director.

2.2 An Environmental Team (ET) shall be established before the commencement of construction of the Project, and shall not be in any way an associated body of the Contractor. The ET shall be headed by a team leader who has at least 7 years experience in environmental monitoring and auditing or environmental management. The ET leader shall be responsible for the implementation of the EM&A programme in accordance with the EM&A requirements as contained in the revised EM&A Manual.

2.3 The Permit Holder shall deposit 3 sets of landscape plan(s) and tree transplantation proposals of the Project of scale 1 to 1000, or other appropriate scale, with the Director before the commencement of construction of the Project. It shall also include a management and maintenance schedule of the landscape areas to be managed and maintained. The submission shall be verified by the ET leader and approved by the Engineer as conforming to the information and recommendations contained in Sections 14 and 16 of the EIA Report. Additional copies may be required by the Director. All measures recommended in the deposited landscape plan(s) and tree transplantation proposals shall be fully implemented.

2.4 The Permit Holder shall deposit 3 sets of design drawings showing the locations and details of the noise barriers of scale 1 to 1000, or other appropriate scale, with the Director before the commencement of construction of the Project. The design drawings shall show (including a note in every drawing) that noise barriers be continuous structures throughout without any gap, hole, or opening, including the interface with the edge parapet or the ground itself. The submission shall be verified by the ET leader and approved by the Engineer as conforming to the information and recommendations contained in Sections 8 and 16 of the EIA Report. Additional copies may be required by the Director. All measures recommended in the deposited noise barrier design drawings shall be fully implemented.

2.5 Any changes to the measures shall be verified by the ET leader and approved by the Engineer as conforming to the information and recommendations contained in the EIA Report before implementation. The verified changes shall be documented in the immediately following monthly EM&A report.

3. Measures for Construction and Operation of the Project

3.1 The landscaping works and reinstatement planting on the slopes shall be constructed and implemented in accordance with the landscape plan(s), tree transplantation proposals, and the management and maintenance schedule, as specified by Condition 2.3 above. All landscaping works and reinstatement planting shall be completed before the Project comes into operation.

3.2 The noise barriers shall be constructed and implemented in accordance with the design drawings as specified by Condition 2.4 above. The construction of the noise barriers shall be completed before the Project comes into operation.

3.3 Any changes to the measures shall be verified by the ET leader and approved by the Engineer as conforming to the information and recommendations contained in the EIA Report and revised EM&A Manual before implementation. The verified changes shall be documented in the immediately following monthly EM&A report.

4. Environmental Monitoring and Audit

4.1 The EM&A programme shall be implemented in accordance with the requirements as contained in the revised EM&A Manual as specified by Condition 2.1. Any changes to the programme shall be justified by the ET leader and approved by the Engineer before submission to the Director for approval.

4.2 The actions described in the Event/Action Plans of the revised EM&A Manual shall be carried out, in accordance with the time frame set out in the Event/Action Plans, or as agreed by the Director.

Notes:

1. This environmental permit consists of three parts, namely, PART A (Main Permit), PART B (Description of Designated Project) and PART C (Permit Conditions).

2. The permit holder may apply under section 13 of the Ordinance to the Director for a variation of the conditions of this environmental permit. The permit holder shall replace the original permit displayed on the construction site by the amended permit.

3. A person who assumes the responsibility for the whole or a part of the designated project may, before he assumes responsibility of the designated project, apply under section 12 of the Ordinance to the Director for a further environmental permit.

4. Under section 14 of the Ordinance, the Director with the consent of the Secretary for Planning, Environment and Lands, may suspend, vary or cancel this environmental permit. The permit shall be removed from the display on the construction site.

5. If this permit is cancelled or surrendered during the construction or operation, an environmental permit must be obtained under the Ordinance before the construction or operation of the project could be continued. It is an offence under section 26(1) of the Ordinance to construct or operate a designated project without an environmental permit.

6. All submissions as required under this Permit shall be deposited in the Environmental Impact Assessment Ordinance Register Office on the 27/F of Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong.
