Pursuant to Section 10 of the Environmental Impact Assessment Ordinance (EIAO), the Director of Environmental Protection (the Director) grants this environmental permit to ENVIRONMENTAL PROTECTION DEPARTMENT- Environmental Infrastructure Division (hereinafter referred to as the “Permit Holder”) to construct and operate the designated project described in Part B subject to the conditions specified in Part C. The issue of this environmental permit is based on the documents, approvals or permissions described below:

 

根據環境影響評估條例(環評條例) 10條的規定,環境保護署署長(署長)將本環境許可證批予環境保護署 環境基建科(下稱許可證持有人”)以建造營辦B所說明的指定工程項目,但須遵守C列明的條件。本環境許可證是依據下列文件、批准或許可而簽發﹕

Hereunder is the description of the designated project mentioned in Part A of this environmental permit (hereinafter referred to as the “Permit”):

 

下列為本環境許可證(下稱許可證”)A所提的指定工程項目的說明﹕

Located between the existing WENT Landfill and the Black Point Power Station at Nim Wan, Tuen Mun.  The location of the Project is shown in Figure 1 of this Permit.

Scale and Scope of Designated Project

指定工程項目的規模和範圍

 

Construction and operation of a landfill extension on the western side of the existing WENT Landfill of about 200 hectares and a filling capacity of not more than: (i) 81 million cubic metres if the proposed Integrated Waste Management Facilities Phase 1 are to be located in the middle Tsang Tsui Ash Lagoon; or (ii) 88 million cubic metres if the proposed Integrated Waste Management Facilities Phase 1 are not to be located in the middle Tsang Tsui Ash Lagoon, including:

 

(i)                 Site formation and preparation;

(ii)               Relocation of existing landfill infrastructures including leachate treatment plant, landfill gas management plant, power generators, workshops and site offices;

(iii)              Installation of a liner system;

(iv)             Installation of leachate collection, treatment and disposal facilities;

(v)               Installation of gas collection, utilization and management facilities;

(vi)             Realignment of a section of Nim Wan Road;

(vii)            Provision of utilities and drainage;

(viii)          Landfilling operation;

(ix)             Restoration and aftercare in subsequent stages;

(x)               Implementation of measures to mitigate environmental impacts as well as environmental monitoring and audit; and

(xi)             Decommissioning of the Pulverized Fuel Ash Lagoons at Tsang Tsui.

在現有新界西堆填區的西面建造及營辦佔地約200公頃的堆填區擴建工程,而目標容量不多於: (i) 8,100萬立方米若擬建的第一期綜合廢物管理設施位於曾嘴煤灰湖中間;(ii) 8,800萬立方米若擬建的第一期綜合廢物管理設施不位於曾嘴煤灰湖中間包括

 

(i)             工地平整及預備工程;

(ii)            遷移現在堆填區內的基礎建設,包括滲濾處理廠、堆填氣體管理設施、發電機、工場及工地辦事處;

(iii)          裝設防滲漏層系統;

(iv)         裝設滲濾污水收集、處理及排放設施;

(v)           裝設堆填氣體收集、應用及管理設施;

(vi)         稔灣路改道;

(vii)        提供公用設施及排水渠改道;

(viii)      堆填區的營運;

(ix)         繼後的修復及修復後的護理工程;

(x)           實行環境影響緩解措施及進行環境監察及審核;及

(xi)         解除處置粉狀的燃料灰的廢物處置設施。

 


PART C (PERMIT CONDITIONS)

C部 (許可證條件)

1.         General Conditions

     一般

 

1.1       The Permit Holder and any person working on the Project shall comply with all conditions set out in this Permit. Any non-compliance by any person may constitute a contravention of the Environmental Impact Assessment Ordinance (EIAO) (Cap. 499) and may become the subject of appropriate action being taken under the EIAO.

            許可證持有人及任何從事工程項目的人士必須符合本許可證載列的全部條件。任何人士如有不符合本許可證的情況,可能違反環境影響評估條例 (「環評條例」) (499) 的規定,而當局可根據條例採取適當行動。

 

1.2       The Permit Holder shall ensure full compliance with all legislation from time to time in force including, without limitation to, the Noise Control Ordinance (Cap. 400), Air Pollution Control Ordinance (Cap. 311), Water Pollution Control Ordinance (Cap. 358), and Waste Disposal Ordinance (Cap. 354). This Permit does not of itself constitute any ground of defence against any proceedings instituted under any legislation or imply any approval under any legislation.

            許可證持有人須經常確保完全符合現行法例的規定,包括但不限於噪音管制條例(400);空氣污染管制條例(311);水污染管制條例(358);以及廢物處置條例(354)。本許可證本身不會就根據任何法例提起的法律程式構成任何抗辯理由,或根據任何法例默示任何批准。

 

1.3       The Permit Holder shall make copies of this Permit together with all documents referred to in this Permit and the documents referred to in Part A of the Permit readily available at all times for inspection by the Director or his authorised officers at all sites/offices covered by this Permit. Any reference to the Permit shall include all documents referred to in the Permit and also the relevant documents in the Register.

            許可證持有人須印製本許可證的複本,連同本許可證所述的所有文件及本許可證A所述文件,以供署長或獲授權人員任何時間內在本許可證所涵蓋的所有工地 / 辦事處查閱。凡提述本許可證,須包括本許可證所述的所有文件及登記冊內的相關文件。

                             

1.4       The Permit Holder shall give a copy of this Permit to the person(s) in charge of the site(s) and ensure that such person(s) fully understands all conditions and all requirements incorporated in the Permit. The site(s) refers to site(s) of construction and operation of the Project and shall mean the same hereafter.

            許可證持有人須把本許可證的複本交予有關工地的負責人,並確保這些人士完全明白本許可證的所有條件與規定。工地是指建造及營辨工程項目的工地,下文所提及的工地亦屬同一意思。

 

1.5       The Permit Holder shall display conspicuously a copy of this Permit on the Project site(s) at all vehicular site entrances/exits or at a convenient location for public’s information at all times. The Permit Holder shall ensure that the most updated information about the Permit, including any amended Permit, is displayed at such locations.  If the Permit Holder surrenders a part or the whole of the Permit, the notice he sends to the Director shall also be displayed at the same locations as the original Permit.  The suspended, varied or cancelled Permit shall be removed from display at the Project site(s).

            許可證持有人須在工程項目的工地的所有車輛進出口或一處方便地點,顯眼地展示本許可證的複本,以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於本許可證 (包括任何經修訂的許可證) 的最新資料。許可證持有人如交回許可證的部分或全部,必須把其送交署長的通知書,在備有原有許可證的相同地點展示。遭暫時吊銷、更改或取消的許可證必須從工程項目的工地除下,不再展示。

 

1.6       The Permit Holder shall construct and operate the Project in accordance with the project description in Part B of this Permit.

            許可證持有人須依據本許可證B的工程項目說明,建造及營辨工程項目。

 

1.7       The Permit Holder shall ensure that the Project is designed, constructed and operated in accordance with the information and all recommendations described in the EIA Report (Register No.: AEIAR-147/2009), the application documents including all attachments (Application No. AEP-393/2010), other relevant documents in the Register; and the information or mitigation measures described in this Permit, and mitigation measures to be recommended in submissions that shall be deposited with or approved by the Director as a result of permit conditions contained in this Permit, and mitigation measures to be recommended under on going surveillance and monitoring activities during all stages of the Project. Where recommendations referred to in the documents of the Register are not expressly referred to in this Permit, such recommendations are nevertheless to be implemented unless expressly excluded or impliedly amended in this Permit.

            許可證持有人須確保工程項目的設計、建造及營辦,按照下述資料及措施辦理:環評報告(登記冊編號:AEIAR-147/2009) 所說明的資料及各項建議、申請文件包括所有附件(申請書編號: AEP-393/2010);登記冊內的其他相關文件;本許可證所說明的資料及緩解措施;根據本許可證內載的條件須向署長存放或獲署長批准的提交文件所建議的緩解措施;以及在工程項目各階段進行的持續監察及監測工作所建議的緩解措施。登記冊文件所述建議如沒有在本許可證明確表示,則仍須實施這些建議,除非獲本許可證明確豁除或默示修訂。

 

1.8       All deposited submissions, as required under this Permit, shall be rectified and resubmitted in accordance with the comments, if any, made by the Director within one month of the receipt of the Director’s comments or otherwise as specified by the Director.

            所有按本許可證規定存放的文件,須在接獲署長的意見 (如有者) 1個月內 (除非署長另行指定),根據署長的意見加以修正並再向署長提交。

 

1.9       All submissions approved by the Director, all submissions deposited without comments by the Director, or all submissions rectified in accordance with comments by the Director under this Permit shall be construed as part of the permit conditions described in Part C of this Permit. Any variation of the submissions shall be approved by the Director in writing or as prescribed in the relevant permit conditions. Any non-compliance with the submissions may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499).  All submissions or any variation of the submissions shall be certified by the Environmental Team (ET) Leader and verified by the Independent Environmental Checker (IEC) referred to Conditions 2.1 and 2.2 below, before submitting to the Director under the Permit.

            署長批准的所有提交文件、署長沒有給予意見的所有存放文件及根據本許可證規定由署長給予意見修正的所有提交文件,均須詮釋為本許可證C 說明的許可證條件的一部分。提交文件如有任何修訂,均須獲署長的書面批准,或符合有關許可證條件訂明的規定。如有不符合提交文件的情況,則可能違反環境影響評估條例 (499) 的規定。所有提交文件或提交文件的任何修訂本,均須按下文條件第2.12.2項所述由環境小組組長核證及獨立環境查核人核實,然後才按本許可證規定向署長提交。

 

1.10     The Permit Holder shall release all finalized submissions as required under this Permit, to the public by depositing copies in the EIAO Register Office, or in any other places, or any internet websites as specified by the Director, or by any other means as specified by the Director for public inspection. For this purpose, the Permit Holder shall provide sufficient copies of the submissions.

            許可證持有人須把所有按本許可證規定提交的文件定稿公開給公眾人士知道,方法是把有關文件複本存放於環境影響評估條例登記冊辦事處,或署長指定的任何其他地方,或署長指定的任何互聯網網站,或採取署長指定的任何其他方法,以供公眾查閱。因此,許可證持有人須提供足夠數量的複本。

 

1.11     All submissions to the Director required under this Permit shall be delivered either in person or by registered mail to the EIAO Register Office (currently at 27/F, Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong). Electronic copies of all finalized submissions required under this Permit shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF version 4.0 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hard copies.

            本許可證規定向署長提交的所有文件,須親身送交或以掛號方式郵寄至環境影響評估條例登記冊辦事處 (現址為:香港灣仔軒尼詩道130號修頓中心27)。所有按本許可證規定提交的文件定稿的電子版本,均須以超文本標示語言 (HTML) (4.0或較後版本) 和便攜式文件格式 (PDF) (4.0或較後版本) 製作,除非另獲署長同意,並須與硬複本同時提交。

 

1.12     The Permit Holder shall notify the Director in writing the commencement date(s) of construction of the Project at least 1 month prior to the commencement of construction of the Project. The Permit Holder shall notify the Director in writing immediately if there is any change of the commencement date of the construction.

            許可證持有人須在工程項目的建造工程展開前,至少提早1個月以書面方式把建造工程的施工日期通知署長。建造工程的施工日期如有任何更改,許可證持有人必須立即以書面方式通知署長。

 

1.13     For the purpose of this Permit, “commencement of construction” does not include works related to site clearance and preparation, or other works as agreed by the Director.

            為執行本許可證,「建造工程的展開」不包括有關工地清理和預備的工程,或署長同意的其他工程。

 

2        Specific Conditions

特定條件

 

Submissions or Measures before Commencement of Construction

施工前須提交的文件或採取的措施

Employment of Environmental Monitoring and Audit (EM&A) Personnel

聘用環境監察及審核(環監)人員

2.1       An Environmental Team (ET) shall be established by the Permit Holder no later than 1 month before the commencement of construction of the Project.  The ET shall not be in any way an associated body of the Contractor or the Independent Environmental Checker (IEC) for the Project.  The ET shall be headed by an ET Leader. The ET Leader shall be a person who has at least 7 years of experience in environmental monitoring and auditing (EM&A) or environmental management.  The ET and the ET Leader shall be responsible for the implementation of the EM&A programme in accordance with the EM&A requirements as contained in the EM&A Manual of the Project.  The ET Leader shall keep a contemporaneous log-book of each and every instance or circumstance or change of circumstances, which may affect the compliance with the recommendations of the EIA Report (Register No.: AEIAR-147/2009) and this Permit.  The ET Leader shall notify the IEC within one working day of the occurrence of any such instance or circumstance or change of circumstances.  The ET Leader’s log-book shall be kept readily available for inspection by all persons assisting in supervision of the implementation of the recommendations of the EIA Report (Register No.: AEIAR-147/2009) and this Permit or by the Director or his authorized officers.  Failure to maintain records in the log-book, failure to discharge the duties of the ET Leader as defined in the EM&A Manual or failure to comply with this Condition would entitle the Director to require the Permit Holder by notice in writing to replace the ET Leader.  Failure by the Permit Holder to make replacement, or further failure to keep contemporaneous records in the log-book despite the employment of a new ET Leader may render the Permit liable to suspension, cancellation or variation.

            在工程項目的建造工程展開前,許可證持有人須至少提早1個月成立一個環境小組。環境小組不得與工程項目的承辦商或獨立環境查核人有任何聯繫。環境小組須由一名環境小組組長帶領。環境小組組長須在環境監察及審核 (「環監」) 或環境管理方面至少有7年經驗。環境小組及環境小組組長須按工程項目的環監手冊內載的環監規定,執行環監計劃。環境小組組長須保存一本記錄冊,同時記載可能會影響環評報告 (登記冊編號:AEIAR-147/2009) 的建議及本許可證的符合情況的每宗事件、每種情況或每次情況變化。環境小組組長須在發生任何類似事件、情況或情況變化後1個工作天內通知獨立環境查核人。存放環境小組組長的記錄冊的地方,須可供協助督導執行環評報告 (登記冊編號:AEIAR-147/2009) 的建議及本許可證的所有人士、署長或獲授權人員隨時查閱。環境小組組長如未能在記錄冊保存記錄、未能執行環監手冊所列明的環境小組組長職務或未能符合本條件的規定,署長有權以書面要求許可證持有人撤換環境小組組長。許可證持有人如未能安排人選替補,或在聘用新環境小組組長後仍未能在記錄冊保存同期的記錄,或會導致許可證遭暫時吊銷、取消或更改。

 

2.2               An IEC shall be employed by the Permit Holder no later than 1 month before the commencement of construction of the Project.  The IEC shall not be in any way an associated body of the Contractor or the ET for the Project.  The IEC shall be a person who has at least 7 years of experience in EM&A or environmental management.  The IEC shall be responsible for duties defined in the EM&A Manual and shall audit the overall EM&A performance, including the implementation of all environmental mitigation measures, submissions required in the EM&A Manual, and any other submissions required under this Permit.  In addition, the IEC shall be responsible for verifying the environmental acceptability of permanent and temporary works, relevant design plans and submissions under this Permit.  The IEC shall verify the log-book(s) mentioned in Condition 2.1 of this Permit.  The IEC shall notify the Director by fax, within one working day of receipt of notification from the ET Leader of each and every change of circumstances or non-compliance with the recommendations of the EIA Report (Register No.: AEIAR-147/2009) and this Permit, which might affect the monitoring or control of adverse environmental impacts from the Project.  In case the IEC fails to so notify the Director of the same, fails to discharge the duties of the IEC as defined in the EM&A Manual or fails to comply with this Condition, the Director may require the Permit Holder by notice in writing to replace the IEC.  Failure to replace the IEC as directed or further failure to so notify the Director despite employment of a new IEC may render the Permit liable to suspension, cancellation or variation.  Notification by the Permit Holder is the same as notification by the IEC for the purpose of this Condition.

在工程項目的建造工程展開前,許可證持有人須至少提早1個月聘用一名獨立環境查核人。獨立環境查核人不得與工程項目的承辦商或環境小組有任何聯繫。獨立環境查核人須在環監或環境管理方面至少有7年經驗。獨立環境查核人須執行環監手冊所列明的職務,以及審核整體環監工作的表現,包括實施所有環境緩解措施、提交環監手冊規定的文件,以及提交本許可證所要求的其他文件。此外,獨立環境查核人須核實永久及臨時工程在環境上的可接受程度、相關的設計圖則和根據本許可證提交的文件,並須核實本許可證條件第2.1項所述的記錄冊。在每次出現事故、情況變化或不符合環評報告 (登記冊編號:AEIAR-147/2009)的建議及本許可證的情況,而可能會妨礙工程項目所造成不良環境影響的監察或控制工作時,獨立環境查核人須在接獲環境小組組長通知後1個工作天內以傳真方式通知署長。獨立環境查核人如未能通知署長有關情況、未能執行環監手冊所列明的獨立環境查核人職務或未能符合本條件的規定,署長可以書面要求許可證持有人撤換獨立環境查核人。如未能按指示撤換獨立環境查核人,或在聘用新獨立環境查核人後仍未能通知署長有關情況,則或會導致許可證遭暫時吊銷、取消或更改。為執行本條件,許可證持有人的通知等同獨立環境查核人的通知。

 

 

Management Organization of Main Construction Companies

主要建造公司的管理架構

2.3               The Permit Holder shall, no later than 2 weeks before the commencement of construction of the Project, inform the Director in writing the management organization of the main construction companies and/or any form of joint ventures associated with the construction of the Project.  The submitted information shall include at least an organization chart, names of responsible persons and their contact details.

許可證持有人在工程項目的建造工程展開前,須至少提早2個星期把主要建造公司及  或以任何形式與建造工程相關的合營企業的管理架構,以書面通知署長。提交的資料須至少包括一份組織圖、負責人的姓名及聯絡資料。

 

Setting up of Community Liaison Group

成立社區聯絡小組

 

2.4               To enhance transparency and communication with the public, the Permit Holder shall, within 3 months before the commencement of construction of the Project, set up a Community Liaison Group involving relevant stakeholders and shall take a proactive approach to disseminate information to the local community, promote community cooperation and participation and implement suitable local environmental enhancement works.  All relevant information of the project including the detailed design, the progress of construction and operation and environmental monitoring and audit results shall be provided to the Community Liaison Group.  The Permit Holder shall inform the Director in writing the membership and terms of reference of the Community Liaison Group.  The Permit Holder shall make the minutes of the Community Liaison Group meetings and all papers and documents available to the public through a website.

為提高透明度和加強與公眾溝通,在工程項目的建造工程展開前3個月內,許可證持有人須成立包括有關持份者的社區聯絡小組,並須採取積極主動的做法,向當地社區傳遞信息、推廣社區合作和參與,並進行適當的地區環境改善工程。工程項目的所有相關資料,包括詳細設計、建造及營辦進度、環境監察及審核結果,均須提供予社區聯絡小組。許可證持有人須將社區聯絡小組的成員名單及職權範圍以書面通知署長,並須把社區聯絡小組的所有會議記錄及相關文件,上載至網站供公眾閱覽。

 

Submission of Landscape Plan

提交景觀美化計劃

 

2.5               At least 1 month before the commencement of the construction of the Project, 3 hard copies and 1 electronic copy of landscape plan shall be submitted to the Director for approval. The landscape plan, with drawings in the scale of 1:1000 or other appropriate scales showing the landscape and visual mitigation measures of the Project, shall include at least the following information/specifications:

在工程項目的建造工程展開前,須至少提早1個月向署長提交景觀美化計劃的3份硬複本及1份電子版本,以供審批。景觀美化計劃須連同以比例1:1000或其他合適比例繒製的圖則,以展示工程項目的景觀及視覺緩解措施,並須至少包括下述資料/規格:

 

(i)         a detailed vegetation survey which shall cover the affected habitats located within the Project area for the purpose of updating, identifying and recording the location and number, health condition and suitability for transportation of the affected individual plant species;

            詳盡的種植調查報告,而報告須涵蓋工程項目範圍內的受影響生境,以便就受影響的個別植物品種的位置、數目、健康狀況及是否適宜移植而更新、鑑辨及記錄資料;

 (ii)      locations, size, number and plant species of trees to be transplanted and their final transplanting locations;

            計劃移植樹木的位置、大小、數量及品種,以及樹木的最終移植地點

(iii)       locations, size, number and plant species to be felled;

計劃砍伐的植物位置、大小、數量及品種;

(iv)       locations, size, number and plant species of compensatory plantings; and

            補償種植的植物位置、大小、數量及品種;以及

(v)        implementation programme, maintenance and management schedules.

            實施計劃、保養及管理時間表。

 

Before submission to the Director, the landscape plan shall be certified by the ET Leader and verified by the IEC as conforming to the recommendations contained in the approved EIA report (Register No.: AEIAR-147/2009).

景觀美化計劃在提交署長前,須由環境小組組長核證及獨立環境查核人核實,證明其符合核准環評報告(登記冊編號:AEIAR-147/2009)內載的建議。

 

All landscape and visual mitigation measures recommended in the approved landscape plan shall be fully and properly implemented and maintained for the Project in accordance with the approved landscape plan.

須按核准景觀美化計劃,徹底妥善執行及維持核准景觀美化計劃就工程項目建議的所有景觀及視覺影響緩解措施。

 

Submission of Habitat Creation, Transplantation and Management Plan (HCTMP)

提交生態再造、移植及管理計劃

 

2.6               At least 1 month before the commencement of construction of the Project, 3 hardcopies and 1 electronic copy of the HCTMP shall be submitted to the Director for approval.  The HCTMP shall contain at least the following details on provision of freshwater ponds and transplantation:

(i)                  The size of each freshwater pond shall be at least 0.5 ha and shall contain suitable habitat characteristics for Little Grebe as shown in Figure 2;

(ii)                The total size of all the freshwater ponds shall be at least 8 ha;

(v)                The transplantation details, including transplanting locations and procedures, of Pitcher Plant (Nepenthes mirabilis), Bamboo Orchid (Arundina graminifolia), Incense Tree (Aquilaria sinensis) and other plants of conservation interest to be affected by the Project shall be included.

In preparing the HCTMP, the Director of Agriculture, Fisheries and Conservation shall be consulted.  Before submission to the Director, the HCTMP shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved EIA report (Register No. AEIAR-147/2009).

在擬備生態再造、移植及管理計劃時,須徵詢漁農自然護理署署長的意見。生態再造、移植及管理計劃在提交署長前,須由環境小組組長核證及獨立環境查核人核實,證明其符合核准環評報告(登記冊編號:AEIAR-147/2009)內載的資料及建議。

Submission of Contingency Plan on Non-compliance with Odour Criteria

提交未能符合氣味標準的應變計劃

 

2.7               At least 1 month before the commencement of construction of the Project, 3 hardcopies and 1 electronic copy of a contingency plan for coping with non-compliance of the odour criteria shall be deposited with the Director.  The contingency plan shall include actions of relevant parties and mitigation measures to be taken for any possible exceedances of the Action and Limit Levels of odour impact as stipulated in the EM&A Manual, such as reducing the number of tipping areas, moving tipping areas further away from concerned sensitive receivers and increasing the thickness of covering soil.  Before submission to the Director, the contingency plan shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved EIA report (Register No.: AEIAR-147/2009).

Submission of Total Suspended Particulates Monitoring Plan

2.8               At least 1 month before the commencement of construction of the Project, 3 hardcopies and 1 electronic copy of a monitoring plan for Total Suspended Particulates (TSP) level shall be deposited with the Director.  The monitoring plan shall include the monitoring frequency and mitigation measures to be taken for any possible exceedances of the TSP Action and Limit Levels, including stoppage of works if necessary.  The sampling frequency for 24-hr TSP monitoring shall be at least twice in every 6-day; while that for the 1-hr TSP monitoring shall be at least 6 times in every 6-day.  Before submission to the Director, the monitoring plan shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved EIA report (Register No.: AEIAR-147/2009).

Submission of Detailed Landfill Gas Hazard Assessment Report

2.9               At least 1 month before the commencement of construction of the Project, 3 hard copies and 1 electronic copy of a detailed landfill gas hazard assessment shall be submitted to the Director for approval.  The landfill gas hazard assessment shall include a review of the preliminary qualitative risk assessment in the approved EIA report, preparation of a detailed qualitative risk assessment, preparation of detailed design of gas protection measures and the establishment of maintenance and monitoring programmes to ensure the continued performance of the proposed control measures.  Before submission to the Director, the assessment shall be certified by the ET Leader and verified by the IEC.

在工程項目的建造工程展開前,須至少提早1個月向署長提交詳盡的堆填氣體風險評估報告的3份硬複本及1份電子版本,以供審批。堆填氣體風險評估報告內容須包括檢討核准環評報告所載的初步定質風險評估、擬備詳盡的定質風險評估、擬備堆填氣體保護措施的詳情,並制訂維修及監測計劃,以確保擬議的保護措施可持續發揮成效。評估報告在提交署長前,須由環境小組組長核證及獨立環境查核人核實。

          Submission of Archaeological Action Plan

2.10           At least 1 month before the commencement of construction of the Project, 3 hardcopies and 1 electronic copy of Archaeological Action Plan shall be deposited with the Director.  The Plan shall detail the actions required to mitigate the potential impacts on archaeological deposits in Tsang Tsui Archaeological Site and shall include at least the following:

Measure to Mitigate Construction Noise Impact

建築噪音影響緩解措施

 

2.11           To mitigate construction noise impacts, a noise bund of 3.5m tall shall be constructed along the north eastern seafront of the existing landfill as shown in Figure 3 prior to the commencement of construction.  The noise bund shall be properly maintained during the construction of the Project.

為緩解建築噪音的影響,在建造工程展開前,須如3所示,沿現有堆填區東北面的海濱建造3.5米高的隔音堤壆。隔音堤壆須在工程項目施工期間予以妥善維持。

 

In case of any change of the design of the noise bund from that described in the approved EIA report (Register No.: AEIAR-147/2009), 3 hardcopies and 1 electronic copy of the revised noise bund design shall be submitted to the Director for approval at least 1 month before commencement of construction of the noise bund.  Before submission to the Director, the revised noise bund design has to be certified by the ET Leader and verified by the IEC as conforming to the requirements set out in the “Technical Memorandum on Environmental Impact Assessment Process”.

2.12           At least 1 month before the commencement of operation of the Project, 3 hardcopies and 1 electronic copy of a contingency plan on accidental leakage of leachate shall be deposited with the Director.  The contingency plan shall cover design of contingency actions for both groundwater contamination and surface water contamination.  Before submission to the Director, the contingency plan shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved EIA report (Register No.: AEIAR-147/2009).

2.13           At least 1 month before the commencement of operation of the Project, 3 hardcopies and 1 electronic copy of a detailed design of the leachate treatment plant shall be deposited with the Director.  The detailed design shall include schematic drawing(s) showing the treatment process and deodourisation system.  Before submission to the Director, the detailed design shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved EIA report (Register No.: AEIAR-147/2009).

Measures to Mitigate Water Quality Impacts during Construction of the Project

2.14           At least one wheel washing facility shall be provided at every construction site exit.  The facility has to be properly maintained during the construction of the Project.

須在每個工地的出口至少設置一套車輪清洗設施。在工程項目施工期間,有關設施須予以妥善維修保養。

 

2.15           On-site storage of excavated materials shall be covered with tarpaulin or similar materials.

存放在工地的挖掘物料須以防水布或類似物料覆蓋。

 

Implementation of Surface Water Drainage System

設置地面排水系統

 

2.16           A temporary surface water drainage system shall be provided to manage runoff during the construction and operation stages.  The system shall consist of the following features:

在工程項目的建造及營辦階段期間,須安裝臨時地面排水系統以管理調控徑流。系統須包括以下特點:

 

(i) Channels shall be constructed around the perimeter of the site area to collect surface water from the areas of higher elevations to those of lower elevations and ultimately to the point of discharge;

在地盤周邊建造排水道,以收集由高地流向低地的地面水,並最後排放至排水口位置;

(ii)        A silt fence shall be erected around the soil stockpile areas to avoid sediment entering into the system.  Regular cleaning shall be carried out to prevent blockage of the passage of water flow in silt fence;

            在泥土堆積處圍建淤泥圍欄,以防止沉積物進入排水系統,並須定期進行清潔,避免淤泥圍欄蔽塞,以致水流無法暢通;

(iii)       Intermediate drainage system shall be installed for filled cell/phase to prevent the clean surface water run-off from the filled phases coming into contact with the waste mass in active cell and to prevent excessive surface water infiltration through the intermediate cover, thus increasing the volume of leachate.  The intermediate drainage system shall collect the clean surface water run-off and divert it to the permanent discharge channels connected to the public drainage system; and

            在已覆蓋的堆填範圍裝設輔助排水系統,以防止來自已覆蓋堆填範圍的潔淨地面水徑流與運作中的堆填範圍的廢物接觸,並防止過量的地面水滲入中期覆蓋層,以致滲濾污水量上升。輔助排水系統須收集潔淨的地面水徑流,並分流至與公共排水系統相連的永久排水道;以及

(iv)       Surface flow from haul roads, especially near wheel washing facilities, shall be collected to a dry weather flow interceptor and conveyed to the on-site leachate treatment plant for further treatment.

2.17           The treated leachate shall be finally discharged via the existing submarine outfall at Urmston Road into marine waters.

經處理的滲濾污水,最終須經由位於龍鼓水道的現有海底排污渠口排放入海。

 

2.18           The leachate treatment plant shall be properly maintained during the operation of the Project.

在工程項目營辦期間,滲濾污水處理廠須妥善維修保養。

 

Measures to Mitigate Odour Emissions

氣味逸散的緩解措施

 

2.19           Waste receiving activities shall be carried out on site between 8:00am to 8:00pm everyday.

廢物接收活動須於每日上午八時至晚上八時期間在堆填區內進行

 

2.20           The inactive tipping areas without ongoing tipping activities shall be covered with at least 300mm thick of soil or an impermeable liner.

沒有持續進行廢物傾倒的非使用中傾倒範圍,須以至少300毫米厚的泥土或不透氣墊層加以覆蓋。

 

2.21           The size of each active tipping face with ongoing tipping activities shall not exceed 60m x 30m and shall be covered with at least 150mm thick of soil at the end of each working day (i.e. after 8:00pm).

每個持續進行傾倒廢物的使用中廢物傾卸面,其面積不得超過60x 30米,並須在每個工作日結束工作時(即晚上八時後)蓋上至少150毫米厚的泥土。

 

2.22           A maximum of two active tipping faces shall be allowed to work simultaneously within the Project site.  Should the two active tipping faces be lying entirely within either Phase 1 or Phase 3 or Phase 4 of the Project site, one of these active tipping faces shall be located outside the hatched area of that particular phase as shown in Figures 4, 5 and 6 respectively.

工程項目工地內最多只容許兩個使用中的廢物傾卸面同時運作。如兩個使用中的廢物傾卸面同時整個位於工程項目第一期、第三期或第四期的工地範圍時,其中一個使用中的廢物傾卸面須因應所屬的分期工程,設於456分別所示的斜線範圍以外位置。

 

2.23           The exposed area of the leachate storage and treatment tanks at the on-site leachate treatment plant shall be installed with covers and deodourizers.  The covers shall be air tight to prevent release of odour from the facilities into atmosphere.  Foul air underneath the covers shall be drawn through deodourizers and be discharged after treatment.  The deodourizers shall be designed for odour removal efficiency of at least 99% or otherwise agreed by the Director.

堆填區內的滲濾污水處理廠,其滲濾污水蓄水及處理缸的外露部分,須裝設上蓋和除臭機。上蓋須密不透氣,以免設施產生的氣味滲入空氣,而覆蓋下的臭氣須抽出並經除臭機處理後排放。除臭機的設計,須至少配備99%或經署長同意的除臭效能。

 

2.24           No sewage sludge shall be disposed of at the Project site.

不得在工程項目的工地棄置污水淤泥。

 

Provision of Landfill Gas Collection and Management System

裝設堆填氣體收集和管理系統

 

2.25           A landfill gas collection and management system shall be implemented to eliminate any off-site migration of landfill gas.

須設置堆填氣體收集和管理系統,以減少堆填氣體遷移到堆填區外。

 

2.26           Landfill gas protection measures shall be implemented at all new buildings on site to prevent the ingress of landfill gas and mitigate any potential risks posed by landfill gas migration in accordance with the recommendations of the approved detailed landfill gas hazard assessment to be submitted under Condition 2.9.

須按條件第2.9項提交並已核准的詳細堆填氣體風險評估報告的建議,在堆填區內所有新樓宇採取堆填氣體保護措施,以防堆填氣體侵入,並緩解堆填氣體遷移所造成的潛在危險。

 

 

3        Environmental Monitoring and Audit Requirements

環境監察及審核規定

           

3.1         The EM&A programme shall be implemented in accordance with the procedures and requirements as set out in the approved EM&A Manual or as approved by the Director. Any changes to the programme shall be justified by the ET Leader and verified by the IEC as conforming to the information and requirements contained in the EM&A Manual before submission to the Director for approval.       

環監計劃須按照核准的環監手冊或署長同意的程序及規定執行。計劃如有更改,須由環境小組組長提出充分理由,並由獨立環境查核人核實,證明其符合環監手冊內載的資料及規定,然後才提交署長批准。

 

3.2       Samples, measurements and necessary remedial actions shall be taken in accordance with the requirements of the EM&A Manual by:

 

(i)                  conducting baseline environmental monitoring;

(ii)                conducting impact monitoring;

(iii)               carrying out remedial actions described in the Event/Action Plans of the EM&A Manual in accordance with the time frame set out in the Event/Action Plans, or as agreed by the Director, in case where specified criteria in the EM&A Manual are exceeded; and

(iv)              logging and keeping records of the details of (i) to (iii) above for all parameters within 3 working days of the collection of data or completion of remedial action(s), for the purpose of preparing and submitting the monthly  EM&A Reports and to make available the information for inspection on site.

   取樣、測量及採取必要的補救行動時,均須按照環監手冊的規定進行:

(i)    進行環境基線監測;

(ii)   進行影響監測;

(iii)  如超逾環監手冊內指定的標準,則按照環監手冊內的事件 / 行動計劃所訂明的時限或署長所同意的時限,執行事件 / 行動計劃所說明的補救行動;以及

(iv)  在收集數據或完成補救行動3個工作天內,須記錄及備存上文(i)(iii)項各參數的詳情,用作擬備並提交每月環監報告,並備妥有關資料以供在工地查閱。

 

3.3       All EM&A results submitted under this Permit shall be true, valid and correct.

            根據本許可證提交的所有環監數據,均須有效及真實無誤。

 

3.4       3 hard copies and 1 electronic copy of Baseline Monitoring Report shall be submitted to the Director at least 2 weeks before the commencement of construction of the Project.  The submissions shall be certified by the ET Leader and verified by the IEC as having complied with the requirements as set out in the EM&A Manual before submission to the Director.  Additional copies of the Baseline Monitoring Report shall be provided upon request by the Director.

            在工程項目建造工程展開前,須至少提早2個星期向署長提交基線監測報告的3份硬複本及1份電子版本。文件在提交署長前,須由環境小組組長核證及獨立環境查核人核實,證明符合環監手冊所載的規定。如署長要求,則須提交基線監測報告的額外複本。

 

3.5       3 hard copies and 1 electronic copy of Monthly EM&A Reports for the construction stage of the Project shall be submitted to the Director, within 2 weeks after the end of the reporting month.  The monthly EM&A Reports shall include a summary of all non-compliance (exceedances) of the environmental quality performance limits (Action and Limit Levels).  The submissions shall be certified by the ET Leader and verified by the IEC as having complied with the requirements as set out in the EM&A Manual before submission to the Director.  Additional copies of the Monthly EM&A Reports shall be provided upon request by the Director.

            在規定提交報告的月份結束後2個星期內,須向署長提交工程項目建造階段的每月環監報告的3份硬複本及1份電子版本。每月環監報告須包括各種不符合(超出)環境質素表現規限(行動及極限水平)情況的摘要。文件在提交署長前,須由環境小組組長核證及獨立環境查核人核實,證明符合環監手冊所載的規定。如署長要求,則須提交每月環監報告的額外複本。

 

 

4        Electronic Reporting of EM&A Information

環監資料的電子匯報

 

4.1       To facilitate public inspection of the Baseline Monitoring Report and Monthly EM&A Reports via the EIAO Internet Website and at the EIAO Register Office, electronic copies of these Reports shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF version 1.3 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hard copies as described in Conditions 3.4 and 3.5 above of this Permit.  For the HTML version, a content page capable of providing hyperlink to each section and sub-section of these Reports shall be included in the beginning of the document. Hyperlinks to all figures, drawings and tables in these Reports shall be provided in the main text from where the respective references are made.  All graphics in these Reports shall be in interlaced GIF format unless otherwise agreed by the Director.  The content of the electronic copies of these Reports must be the same as the hard copies.

為方便公眾透過環評條例互聯網網站及在環評條例登記冊辦事處查閱基線監測報告及每月環監報告,以超文本標示語言(HTML)(第4.0或較後版本)及便攜式文件格式(PDF)(第1.3或較後版本)製作的報告的電子版本,除非另獲署長同意,須與本許可證條件第3.43.5項所說明的硬複本同時提交。關於HTML的版本方面,可與報告各節及小節作出超文本連結的目錄須在文件開端加入。報告內各類圖表須在載有相關資料的正文內作出超文本連結。除非另獲署長同意,報告內所有圖形均須以交錯存取的GIF格式制定。報告的電子版本內容,必須與硬複本的內容一致。

 

4.2       The Permit Holder shall, within 6 weeks after the commencement of construction of the Project, set up a dedicated Internet web site and notify the Director in writing the Internet address where the environmental monitoring data and project information is to be placed.  All environmental monitoring data described in Condition 4.1 above shall be made available to the public via the abovementioned dedicated Internet web site in the shortest possible time and in any event no later than 2 weeks after the relevant environmental monitoring data are collected or become available, unless otherwise agreed with the Director. 

許可證持有人須在工程項目的建造工程展開後6個星期內,設立特定網站存放環境監察數據及工程項目資料,並以書面通知署長互聯網網址所在。除非另獲署長同意,上文條件第4.1項說明的所有環境監察數據及報告,均須盡快透過由許可證持有人設立的特定網站供公眾閱覽,在任何情況下均不得遲於有關資料在收集或可供發放後的2個星期內上載至該特定網站。

 

4.3               The Internet web site as described in Condition 4.2 above shall enable user-friendly public access to the environmental monitoring data and project information including the Project Profile and this Environmental Permit.  The Internet web site shall have features capable of: 

(i)          providing access to all environmental monitoring data of this Project collected   since the commencement of construction;

(ii)        providing access to all finalized submissions as required under this Permit;

(iii)       searching by date;

(iv)      searching by types of monitoring data (air and water quality); and

(v)        hyperlinking to relevant monitoring data after searching;

or otherwise as agreed by the Director.

文條件第4.2項說明的互聯網網站,必須方便用戶使用,讓公眾容易接達環境監察數據及工程項目資料,當中包括工程項目簡介及本環境許可證。除非另獲署長同意,互聯網網站須具備部件,提供下述功能:

(i)      接達建造工程展開後所收集的全部環境監察數據;

(ii)      接達本許可證內要求提交的所有文件的定稿;

(iii)     按日期搜尋;

(iv)     按監察數據類別 (空氣質素及水質) 搜尋;以及

(v)      在搜尋後與相關的監察數據作出超文本連結。

1.         This Permit consists of three parts, namely, Part A (Main Permit), Part B (Description of Designated Project) and Part C (Permit Conditions).  Any person relying on this permit should obtain independent legal advice on the legal implications under the EIAO, and the following notes are for general information only.

            本許可證共有3部,即A (許可證主要部分)B (指定工程項目的說明) C (許可證條件)。任何援引本許可證的人士須就環評條例的法律含意徵詢獨立法律意見,下述註解只供一般參考用。

 

2.         If there is a breach of any condition of this Permit, the Director or his authorized officer may, with the consent of the Secretary for the Environment, order the cessation of associated work until the remedial action is taken in respect of the resultant environmental damage, and in that case the Permit Holder shall not carry out any associated works without the permission of the Director or his authorized officer.

            如違反本許可證的任何條件,署長或獲授權人員徵得環境局局長的同意後勒令停止相關工程,直至許可證持有人為所造成的環境損害採取補救行動為止。在此情況下,許可證持有人未經署長或獲授權人員同意,不得進行任何相關工程。

 

3.         The Permit Holder may apply under Section 13 of the EIAO to the Director for a variation of the conditions of this Permit. The Permit Holder shall replace the original permit displayed on the Project site by the amended permit.

            許可證持有人可根據環評條例第13條的規定向署長申請更改本環境許可證的條件。許可證持有人須將經修改的許可證替換在建造工地內展示的原有許可證。

 

4.         A person who assumes the responsibility for the whole or a part of the Project may, before he assumes responsibility of the Project, apply under Section 12 of the EIAO to the Director for a further environmental permit.

承擔工程項目整項或部分工程的責任的人,在承擔責任之前,可根據環評條例第12條的規定向署長申請新的環境許可證。

 

5.         Under Section 14 of the EIAO, the Director may with the consent of the Secretary for the Environment, suspend, vary or cancel this Permit.  The suspended, varied or cancelled Permit shall be removed from display at the Project site.

根據環評條例第14條的規定,署長可在環境局局長的同意下暫時吊銷、更改或取消環境許可證。遭暫時吊銷、更改或取消的環境許可證必須從工程項目工地除下,不再展示。

6.         If this Permit is cancelled or surrendered during construction or operation of the Project, another environmental permit must be obtained under the EIAO before the Project could be continued.  It is an offence under Section 26(1) of the EIAO to construct or operate a designated project listed in Part 1 and 2 of Schedule 2 of the EIAO without a valid environmental permit.

如果本許可證在工程項目建造或營辦期間取消或交回,則在繼續營辦工程項目之前,必須先根據環評條例規定取得另一份環境許可證。根據環評條例第26(1)條的規定,任何人在沒有有效環境許可證的情況下建造或營辦環評條例附表212部所列明的指定工程項目,即屬犯罪。

 

7.         Any person who constructs or operates the Project contrary to the conditions in the Permit, and is convicted of an offence under the EIAO, is liable:

(i)                  on a first conviction on indictment to a fine of $2 million and to   imprisonment for 6 months;

(ii)                on a second or subsequent conviction on indictment to a fine of $5 million and to imprisonment for 2 years;

(iii)               on a first summary conviction to a fine at level 6 and to imprisonment for 6 months;

(iv)              on a second or subsequent summary conviction to a fine of $1 million and to imprisonment for 1 year; and

(v)                in any case where the offence is of a continuing nature, the court or magistrate may impose a fine of $10,000 for each day on which he is satisfied the offence continued.

如任何人在違反本許可證的條件下建造或營辦工程項目,根據環評條例,即屬犯罪—

(i)       一經循公訴程序首次定罪,可處罰款200萬元及監禁6個月;

(ii)      一經循公訴程序第二次或其後每次定罪,可處罰款500萬元及監禁2年;

(iii)    一經循簡易程序首次定罪,可處第6級罰款及監禁6個月;

(iv)    一經循簡易程序第二次或其後每次定罪,可處罰款100萬元及監禁1年;及

(v)      在任何情況下如該罪行屬持續性質,則法院或裁判官可就其信納該罪行持續的每天另處罰款10,000元。

 

8.         The Permit Holder may appeal against any condition of this Permit under Section 17 of the EIAO within 30 days of receipt of this Permit.

許可證持有人可在接獲本許可證後30天內,根據環評條例第17條就本許可證的任何條件提出上訴。

 

9.         The Notes are for general reference only and that the Permit Holder should refer to the EIAO for details and seek independent legal advice.
