Pursuant to Section 10 of the Environmental Impact Assessment Ordinance (the Ordinance), the Director of Environmental Protection (the Director) granted the Environmental Permit No. EP-349/2009 to MTR Corporation Limited (hereinafter referred to as the “Permit Holder”) on 16 October 2009.  Pursuant to Section 13 of the Ordinance, the Director amends the Environmental Permit No. EP-349/2009/D based on the Application No. VEP-352/2012.  The amendments, described below, are incorporated into this Environmental Permit No. EP-349/2009/E.  This Environmental Permit as amended is for the construction and operation of the designated project described in Part B of this Permit subject to the conditions specified in Part C of this Permit.

根據《環境影響評估條例》(條例)第10條的規定,環境保護署署長(署長)於20091016將環境許可證編號EP-349/2009批予 香港鐵路有限公司(下稱許可證持有人”)。根據條例第13條的規定,署長因應更改環境許可證的申請編號VEP-352/2012修訂環境許可證編號EP-349/2009/D。以下修訂已包含在本環境許可證編號EP-349/2009/E內。本經修訂的環境許可證,只適用於建造營辦本許可證B所說明的指定工程項目,並須遵守本許可證C所列明的條件。

PART B (DESCRIPTIONS OF DESIGNATED PROJECT)

B (指定工程項目的說明)

 

Hereunder is the description of the designated project mentioned in Part A of this environmental permit (hereinafter referred to as the “Permit”):

下列為本環境許可證(下稱許可證”)A所提述的指定工程項目的說明:

Nature of Designated Project

The Project is a designated project (DP) under the Ordinance with the following DP elements:

根據條例,本工程項目包含了下列屬於指定工程項目的元素:

-          A railway and its associated stations (Item A.2 of Part I of Schedule 2 of the Ordinance);

-          鐵路及其相聯車站(條例附表2IA.2)

-          A railway siding and maintenance workshop (Item A.4 of Part I of Schedule 2 of the Ordinance);

-          鐵路側線及維修工場(條例附表2IA.4)

-          A railway tunnel more than 800m in length between portals (Item A.7 of Part I of Schedule 2 of the Ordinance); and

-          入口之間的長度超過800米的鐵路隧道(條例附表2IA.7項);及

-          Project includes works partly or wholly in a country park or special area, a conservation area, and a site of special scientific interest (Item Q.1 of Part I of Schedule 2 of the Ordinance).

Scale and Scope of Designated Project(s)

指定工程項目的規模和範圍

Construction and operation of the following key elements:

 建造和營辦以下的主要部份:

-          Approximately 26km of underground railway running from the terminus in West Kowloon to the boundary at Huanggang;

-          長約26公里的地下鐵路,從西九龍的總站伸延至皇崗邊界;

-          A terminus in West Kowloon, and its associated building elements such as ventilation facilities, public transport interchange, traction sub-station, and seawater cooling facility;

-          位於西九龍的總站及其附屬建築物,例如通風設施、公共交通交匯處、變電站和海水冷卻設施;

-          Seven tunnel ventilation buildings at Mai Po, Ngau Tam Mei, Pat Heung, Shing Mun, Kwai Chung, Nam Cheong and Mong Kok West respectively; and an Emergency Access Point (EAP) at Tai Kong Po;

-          七座隧道通風樓,分別設於米埔、牛潭尾、八鄉、城門、葵涌、南昌和旺角西,以及設於大江埔的緊急救援入口;

-          Stabling sidings and maintenance facilities located at Shek Kong (Shek Kong Stabling Sidings (SSS)) to provide for train stabling, minor maintenance and cleaning;

-          位於石崗的列車停放處及維修設施(石崗列車停放處),為鐵路提供臨時停泊、小型維修和清潔服務;

-          An emergency rescue sidings (ERS) located next to the SSS; and

-          位於石崗列車停放處旁的緊急救援處(石崗緊急救援處);及

-          Supporting works areas, access roads, barging facilities, site explosive magazine and nursery sites during the construction of the Project.

PART C (PERMIT CONDITIONS)
C部(許可證條件)

 

1.         General Conditions

           一般條件

 

1.1        The Permit Holder and any person working on the Project shall comply with all conditions set out in this Permit. Any non-compliance by any person may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499) and may become the subject of appropriate action under the Ordinance.

            許可證持有人及任何從事工程項目的人士必須完全符合本許可證載列的全部條件。任何人士如有不符合本許可證的情況,可能違反環境影響評估條例 (499) 的規定,而當局可根據條例採取適當行動。

 

1.2               The Permit Holder shall ensure full compliance with all legislation from time to time in force including but without limitation to the Noise Control Ordinance (Cap. 400), Air Pollution Control Ordinance (Cap. 311), Water Pollution Control Ordinance (Cap. 358), Waste Disposal Ordinance (Cap. 354), Occupational Safety and Health Ordinance (Cap. 509), Factories and Industrial Undertakings Ordinance (Cap. 59) and Dangerous Goods Ordinance (Cap.295).  This Permit does not of itself constitute any ground of defence against any proceedings instituted under any legislation.

  許可證持有人須經常確保完全符合現行法例的規定,包括但不限於噪音管制條例 (400);空氣污染管制條例 (311);水污染管制條例 (358);廢物處置條例 (354) ;職業安全及健康條例 (509);工廠及工業經營條例 (59)及危險品條例 (295)。根據任何法例提出的法律程序,本許可證本身不能作為任何抗辯理據或視為其法例所默許。

 

1.3    The Permit Holder shall give a copy of this Permit to the person(s) in charge of the Project site(s) and ensure that such person(s) fully understands all conditions and all requirements incorporated by the Permit. The Project site(s) refers to site(s) of construction and operation of the Project and shall mean the same hereafter.

            許可證持有人須把本許可證的一份複本交予有關工地的負責人,並確保這些人士完全明白本許可證的所有條件與規定。工地是指建造及營辦工程項目的工地,下文所提及的工地亦屬同一意思。

 

1.4    The Permit Holder shall make copies of this Permit together with all documents referred to in this Permit or the documents referred to in Part A of the Permit readily available at all times for inspection by the Director or his authorised officers at all Project site(s) covered by this Permit.  Any reference to the Permit shall include all documents referred to in the Permit and also the relevant documents in the Register.

許可證持有人須印製本許可證的複本,連同本許可證所述的所有文件或本許可證A所述文件,以供署長或獲授權人何時間內在本許可證所涵蓋的所有工地查閱。凡提述本許可證,須包括本許可證所述的所有文件及登記冊內的相關文件。

 

1.5          The Permit Holder shall display conspicuously a copy of this Permit on the Project site(s) at all vehicular site entrances or at a convenient location for public’s information at all times.  The Permit Holder shall ensure that the most updated information about the Permit, including any amended permit, is displayed at such locations. If the Permit Holder surrenders a part or the whole of the Permit, the notice he sends to the Director shall also be displayed at the same locations as the original Permit. The suspended, varied or cancelled Permit shall be removed from display at the Project site(s).

許可證持有人須在工地的所有車輛入口或一處方便地點,顯眼地展示本許可證的複本,以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於本許可證 (包括任何經修訂的許可證) 的最新資料。許可證持有人如交回許可證的部分或全部,必須把其送交署長的通知書,在備有原有許可證的各處相同地點展示。遭暫時吊銷、更改或取消的許可證必須從工地的展示地點除下,不再展示。

 

1.6               The Permit Holder shall construct and operate the Project in accordance with the project descriptions in Part B of this Permit.

  許可證持有人須依據本許可證B的說明,建造及營辦工程項目。

 

1.7               The Permit Holder shall ensure that the Project is designed, constructed and operated in accordance with the information and all recommendations described in the EIA Report (Register No.: AEIAR- 143/2009), the application documents for an environmental permit including all attached documents (Application No. AEP-349/2009), the applications for variation of an environmental permit including all attached documents (Application Nos. VEP-323/2010, VEP-334/2010, VEP-336/2011, VEP-346/2011 and VEP-352/2012), other relevant documents in the Register, the information or mitigation measures described in this Permit, mitigation measures to be recommended in submissions that shall be deposited with or approved by the Director as a result of permit conditions contained in this Permit, and mitigation measures to be recommended under on going surveillance and monitoring activities during all stages of the Project. Where recommendations referred to in the documents of the Register are not expressly referred to in this Permit, such recommendations are nevertheless to be implemented unless expressly excluded or impliedly amended in this Permit.

         許可證持有人須確保工程項目的設計、建造及營辦,按照下述資料及措施辦理:環評報告(登記冊編號:AEIAR-143/2009)所說明的資料及建議;申請環境許可證文件包括全部附件(申請書編號:AEP-349/2009)所有更改環境許可證申請文件包括全部附件(申請書編號:VEP-323/2010 VEP-334/2010, VEP-336/2011, VEP-346/2011VEP-352/2012);登記冊內的其他相關文件;本許可證所說明的資料或緩解措施;根據本許可證內載的條件須向署長存放或獲署長批准的提交文件所建議的緩解措施;以及在工程項目各階段進行的持續監及監察工作所建議的緩解措施。登記冊文件所述建議如沒有在本許可證明確表示,則仍須實施這些建議,除非獲本許可證明確豁除或默示修訂。

 

1.8        All deposited submissions, as required under this Permit, shall be rectified and resubmitted in accordance with the comments, if any, made by the Director within one month of the receipt of the Director’s comments or otherwise as specified by the Director.

 所有按本許可證規定提交的文件,須在接獲署長的意見 (如有者) 後一個月內 (除非署長另行指定),根據署長的意見加以修正並再向署長提交。

 

1.9               All submissions approved by the Director, all submissions deposited without comments by the Director, and all submissions rectified in accordance with comments by the Director under this Permit shall be construed as part of the permit conditions described in Part C of this Permit. Any variation of the submissions shall be approved by the Director in writing or as prescribed in the relevant permit conditions. Any non-compliance with the submissions may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499).

            署長批准的所有提交文件、署長沒有給予意見的所有存放文件、或根據本許可證規定由署長給予意見修正的所有提交文件,均須詮釋為本許可證 C說明的許可證條件的一部分。提交文件如有任何修訂,均須獲署長的書面批准,或符合有關許可證條件訂明的規定。如有不符合提交文件的情況,可能違反環境影響評估條例 (499) 的規定。

 

1.10            All submissions or any variation of the submissions shall be certified by the Environmental Team (ET) Leader and verified by the Independent Environmental Checker (IEC) referred to in Conditions 2.1 and 2.3 below, before submitting to the Director under this Permit.

所有提交文件或提交文件的任何修訂本,均須由按下文條件第2.12.3項所述的環境小組組長核證及獨立環境查核人核實,然後才按本許可證規定向署長提交。

 

1.11            The Permit Holder shall release all finalised submissions as required under this Permit, to the public by depositing copies in the Environmental Impact Assessment Ordinance Register Office, or in any other places, or any Internet websites as specified by the Director, or by any means as specified by the Director, for public inspection. For this purpose, the Permit Holder shall provide sufficient copies of the submissions.

 許可證持有人須把所有按本許可證規定提交的文件定稿公開給公眾人士知道,方法是把有關文件複本存放於環境影響評估條例登記冊辦事處,或署長指定的任何其他地方,或署長指定的任何互聯網網站,或採取署長指定的任何其他方法,以供公眾查閱。因此,許可證持有人須提供足夠數量的複本。

 

 

 

1.12      All submissions to the Director required under this Permit shall be delivered either in person or by registered mail to the Environmental Impact Assessment Ordinance Register Office (currently at 27/F, Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong). Electronic copies of all finalised submissions required under this Permit shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF) (version 1.3 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hardcopies.

本許可證規定向署長提交的所有文件,須親身送交或以掛號方式郵寄至環境影響評估條例登記冊辦事處 (現址為:香港灣仔軒尼詩道130號修頓中心27)。所有按本許可證規定提交的文件定稿的電子版本,除非另獲署長同意,均須以超文本標示語言 (HTML) (4.0或較後版本) 和便攜式文件格式 (PDF) (1.3或較後版本) 製作,並須與硬複本同時提交。

 

1.13      The Permit Holder shall notify the Director in writing the commencement date of construction of the Project no later than one month prior to the commencement of construction of the Project. The Permit Holder shall notify the Director in writing immediately if there is any change of the commencement date of the construction.

            許可證持有人須在工程項目的建造工程展開前,至少提早一個月以書面方式把建造工程的施工日期通知署長。施工日期如有任何更改,許可證持有人必須立即以書面方式通知署長。

 

1.14      For the purpose of this Permit, “commencement of construction” does not include works related to site clearance and preparation, or other works as agreed by the Director.

 為執行本許可證,「工程項目的展開」不包括有關工地清理和預備的工程,或署長同意的其他工程。

 

1.15      The Permit Holder shall notify the Director in writing the commencement date of operation of the Project no later than two months prior to the commencement of operation of the Project. The Permit Holder shall notify the Director in writing immediately if there is any change of the commencement date of the operation.

            許可證持有人須在工程項目的營辦開前,至少提早兩個月以書面方式把工程的開始營辦日期通知署長。開始營辦日期如有任何更改,許可證持有人必須立即以書面方式通知署長。

 

2          Special Conditions 

          特定條件

 

Employment of Environmental Monitoring and Audit (EM&A) Personnel

聘用環境監察及審核(環監)人員

 

2.1        An Environmental Team (ET) shall be established by the Permit Holder no later than one month before the commencement of construction of the Project. The ET shall not be in any way an associated body of the Independent Environmental Checker (IEC) for the Project. The ET shall be headed by an ET Leader. The ET Leader shall be a person who has at least 7 years of experience in environmental monitoring and auditing (EM&A) or environmental management.

            在工程項目的建造工程展開前,許可證持有人須至少提早一個成立一個環境小組。環境小組不得與工程項目的獨立環境查核人有任何聯繫。環境小組須由一名環境小組組長帶領。環境小組組長須在環境監察及審核 (環監) 或環境管理方面至少有7年經驗。

 

2.2        The ET and the ET Leader shall be responsible for the implementation of the EM&A programme in accordance with the EM&A requirements as contained in the EM&A Manual of the Project. The ET Leader shall keep a contemporaneous log-book of each and every instance or circumstance or change of circumstances, which may affect the compliance with the recommendations of the EIA Report and this Permit. The ET Leader shall notify the IEC within one working day of the occurrence of any such instance or circumstance or change of circumstances. The ET Leader’s log-book shall be kept readily available for inspection by all persons assisting in supervision of the implementation of the recommendations of the EIA Report and this Permit or by the Director or his authorized officers. Failure to maintain records in the log-book, failure to discharge the duties of the ET Leader as defined in the EM&A Manual or failure to comply with this Condition would entitle the Director to require the Permit Holder by notice in writing to replace the ET Leader. Failure by the Permit Holder to make replacement, or further failure to keep contemporaneous records in the log-book despite the employment of a new ET Leader may render the Permit liable to suspension, cancellation or variation.

            環境小組及環境小組組長須按環監手冊內所載的環監規定,執行環監計劃。環境小組組長須保存一本記錄冊,同時記載可能會影響符合環評報告的建議及本許可證的情況的每宗事件、每種情況或每次情況變化。環境小組組長須在發生任何類似事件、情況或情況變化後一個工作天內通知獨立環境查核人。存放環境小組組長的記錄冊的地方,須可供協助督導執行環評報告的建議及本許可證的所有人士、署長或獲授權人員隨時查閱。環境小組組長如未能在記錄冊保存記錄、未能執行環監手冊所列明的環境小組組長職務或未能符合本條件的規定,署長有權以書面要求許可證持有人撤換環境小組組長。許可證持有人如未能安排人選替補,或在聘用新環境小組組長後仍未能在記錄冊保存同期的記錄,可導致許可證遭暫時吊銷、取消或更改。

 

2.3        An Independent Environmental Checker (IEC) shall be employed by the Permit Holder no later than one month before commencement of construction of the Project. The IEC shall not be in any way an associated body of the Contractor or the ET for the Project. The IEC shall be a person who has at least 7 years of experience in EM&A or environmental management.

            在工程項目的建造工程展開前,許可證持有人須至少提早一個月聘用一名獨立環境查核人。獨立環境查核人不得與工程項目的承辦商或環境小組有任何聯繫。獨立環境查核人須在環監或環境管理方面至少有7年經驗。

 

 

 

2.4               The IEC shall be responsible for duties defined in the EM&A Manual and shall audit the overall EM&A performance, including the implementation of all environmental mitigation measures, submissions required in the EM&A Manual, and any other submissions required under this Permit. In addition, the IEC shall be responsible for verifying the environmental acceptability of permanent and temporary works, relevant design plans and submissions under this Permit. The IEC shall verify the log-book(s) mentioned in Condition 2.2 of this Permit. The IEC shall notify the Director by fax, within one working day of receipt of notification from the ET Leader of each and every occurrence, change of circumstances or non-compliance with the EIA Report and/or this Permit, which might affect the monitoring or control of adverse environmental impacts from the Project. In the case where the IEC fails to so notify the Director of the same, fails to discharge the duties of the IEC as defined in the EM&A Manual or fails to comply with this Condition, the Director may require the Permit Holder by notice in writing to replace the IEC. Failure to replace the IEC as directed or further failure to so notify the Director despite employment of a new IEC may render the Permit liable to suspension, cancellation or variation. Notification by the Permit Holder is the same as notification by the IEC for the purpose of this Condition.

            獨立環境查核人須執行環監手冊所列明的職務,以及審核整體環監工作的表現,包括實施所有環境緩解措施、提交環監手冊規定的文件,以及提交本許可證所要求的其他文件。此外,獨立環境查核人須核實永久及臨時工程在環境上的可接受程度、相關的設計圖則和根據本許可證提交的文件,並須核實本許可證第2.2項條件所述的記錄冊。在每次出現事故或情況、或情況變化、或不符合環評報告或本許可證的情況,而可能會妨礙工程項目所造成的不良環境影響的監察或控制工作時,獨立環境查核人須在接獲環境小組組長通知後一個工作天內以傳真方式通知署長。獨立環境查核人如未能通知署長有關情況,未能執行環監手冊所列明獨立環境查核人的職務或未能符合本條件的規定,署長可以書面要求許可證持有人撤換獨立環境查核人。如未能按指示撤換獨立環境查核人,或在聘用新獨立環境查核人後仍未能通知署長有關情況,則或會導致許可證遭暫時吊銷、取消或更改。為執行本條件,許可證持有人作出的通知等同獨立環境查核人作出的通知。

 

2.5               All documents to be submitted or deposited as required under this Permit shall be certified by the ET Leader and verified by the IEC as conforming to the information, requirements and recommendations set out in the EIA Report.

           所有按本許可證的要求而提交或存放的文件,須由環境小組組長核證,並由獨立環境查核人核實,證明其符合環評報告所載資料、規定及建議

 

Management Organization of Main Construction Companies

主要建造公司管理架構

 

2.6               The Permit Holder shall, no later than one month before the commencement of construction of the Project, inform the Director in writing the management organization of the main construction companies and/or any form of joint ventures associated with the construction of the Project.  The submitted information shall include at least an organization chart, names of responsible persons and their contact details.

在工程項目的建造工程展開前,許可證持有人須至少提早一個月把與工程項目的建造工程相關的主要建造公司及 / 或任何形式的合營企業的管理架構,以書面方式通知署長。提交的資料須至少包括一份組織圖、負責人的姓名及聯絡資料。

 

Community Liaison Groups

2.7        The Permit Holder shall set up Community Liaison Groups comprising of representatives from the relevant concerned and affected parties, including owners’ corporations, management offices, local committees and schools of affected areas, to facilitate communication, enquiries and complaints handling on all environmental issues. The Permit Holder shall set up Community Liaison Groups before the commencement of construction of the Project and maintain the Community Liaison Groups up to the first 12 months of the operation of the Project. The Permit Holder shall notify the Director the date of setting up the Community Liaison Groups, the membership, the terms of reference and the contact details.

            許可證持有人須成立多個社區聯絡小組,由相關及受影響團體代表組成,包括受影響地區的業主立案法團、管理公司、地區委員會及學校,以便就所有環境問題加強與有關人士的溝通,及處理有關的查詢和投訴。許可證持有人須在工程展開前成立社區聯絡小組,並維持該等小組至工程項目的營辦開始後的首12個月。許可證持有人須通知署長社區聯絡小組的確實成立日期、成員名單、職權範圍及聯絡詳情。

 

2.8        The Permit Holder shall set up a designated complaint hotline for the Project to address the environmental concerns and complaints in an efficient manner before the commencement of construction of the Project and maintain the designated complaint hotline up to the first 12 months of the operation of the Project.

            許可證持有人須為工程項目設立特定電話投訴熱線,迅速回應及處理公眾關注的環境事宜及投訴。特定電話投訴熱線須在工程展開前成立,並須維持運作至工程項目的營辦開始後的首12個月。

 

 

Submission of Works Schedule

2.9               The Permit Holder shall, no later than one month before the commencement of construction of the Project, deposit with the Director a construction programme showing the commencement and completion dates of major items of construction works, including dates of taking possession of and subsequent exit from the works sites. The Permit Holder shall inform the Director in writing in case of any subsequent changes of items contained in this submitted construction programme.

            在工程項目的工程展開前,許可證持有人須至少提早一個月向署長存放詳細的工程項目施工時間表。時間表須顯示各種主要工程項目分項的展開及完工日期,並包括進佔及退出工地日期。已提交的工程項目施工時間表其後如有任何項目更改,許可證持有人必須以書面方式通知署長。

 

 

Measures to Mitigate Ecological, Landscape and Visual Impact

生態、景觀及視覺影響的緩解措施

 

2.10   Before the commencement of any tunneling or soil excavation works, the Permit Holder shall deposit with the Director an updated hydrogeological impact assessment to reaffirm the findings of the EIA Report with respect to the extent of the environmental impacts as a result of the potential hydrology and groundwater level changes. Before, during and after the soil excavation or tunneling works, the Permit Holder shall conduct groundwater level monitoring, in particular in the ecologically sensitive areas, in consultation with relevant stakeholders to verify the predictions in the EIA Report.

            在展開任何開挖隧道或挖土工程前,許可證持有人須向署長存放最新的地下水文影響評估,以確證環評報告內有關水文及地下水位潛在變化對環境影響的程度的研究結果。在挖土或開挖隧道工程之前、期間及之後,許可證持有人須監察地下水位,特別是在生態易受破壞的地區,並諮詢相關人士和團體的意見,以核實環評報告的預測結果。

 

2.11   Before the commencement of any tunneling or soil excavation works, the Permit Holder shall deposit with the Director a contingency plan to deal with any unforeseeable incidents which might affect the groundwater level.

            在展開任何開挖隧道或挖土工程前,許可證持有人須向署長存放緊急應變計劃,以處理任何可能影響地下水位但無法預見的事故

 

2.12      The Permit Holder shall, no later than one month before the commencement of construction at the respective works areas of the Project, deposit with the Director the following submissions:

            在相關工地展開工程項目的建造工程前,許可證持有人須至少提早一個月向署長存放以下文件:

 

(i)                  An Ecological Habitat Management Plan agreed by the Director of Agriculture, Fisheries and Conservation. The Ecological Habitat Management Plan shall contain the details of implementation schedule and construction programme of the mitigated stream habitat to be provided in-situ within the works area of the SSS and the ERS;
經漁農自然護理署署長同意的生態環境管理計劃。該計劃須載有實施時間表,以及在石崗列車停放處及石崗緊急救援處工程範圍內原址建造緩解河流生態環境的計劃詳情;

(ii)                A Monitoring and Emergency Response Plan agreed by the Director of Agriculture, Fisheries and Conservation, in relation to potential impacts on fishponds in Mai Po Area due to noise or vibration;
經漁農自然護理署署長同意,有關在米埔範圍的魚塘可能受噪音或振動造成的潛在影響的監察及緊急應變計劃;

(iii)               A Vegetation Survey Report conducted for the magazine site at Tai Shu Ha Road West for formulating effective mitigatory planting proposal in the site.

2.13      Vegetation located within the Project site(s) shall be protected and preserved as far as practicable. No more than 5,500 trees shall be felled. Detailed tree felling application and compensatory planting proposal shall be submitted to seek approval from other authorities.

           生長於工程項目工地內的植物須加以保護及盡量保留。砍伐的樹木不得超過5,500株。詳細的砍伐樹木申請及補償種植建議須提交其他有關當局批准。

 

2.14            No later than one month before any tree felling, the Permit Holder shall submit a Tree Planting and Landscape Plan, including the compensatory woodland, in consultation with the Planning Department and Agriculture, Fisheries and Conservation Department, for approval by the Director.

           許可證持有人須諮詢規劃署及漁農自然護理署的意見,並在砍伐任何樹木前至少一個月,提交植樹及景觀美化計劃,包括補償性植林計劃,以供署長批准。

           

2.15      The Permit Holder shall appoint a Certified Arborist for the Project to advise on, monitor and ensure proper implementation of measures for protecting trees affected by the Project. Before the commencement of any work which may affect any tree, the Permit Holders shall deposit with the Director a Tree Protection Plan prepared by the Certified Arborist, detailing the requirements and measures for the proper protection and monitoring of trees affected by the construction of the Project. The Tree Protection Plan prepare by the Certified Arborist shall cover all Project site(s) and shall include:

            許可證持有人須委任一名認可樹藝師,以就工程項目提供意見、進行監察及確保各項保護受工程項目影響的樹木的措施能妥善執行。在任何可能影響樹木的工程展開前,許可證持有人須向署長存放由認可樹藝師擬備的樹木保護計劃,詳述妥善保護及監察受工程項目建造工程影響的樹木的規定和措施。由認可樹藝師擬備的樹木保護計劃須涵蓋工程項目的所有工地及包括以下項目:

 

(i)                  detailed working method statement for the protection of trees;

(ii)                tree transplanting proposal including final location for transplanted trees that will be affected by the Project and are trees of high to medium survival rate;
樹木移植建議,包括將會受工程項目影響的樹木的最終移植地點,而移植樹木的存活率須為中至高度;

(iii)               compensatory tree planting proposal including location of trees to be planted as compensation to trees to be felled;

(iv)              an audit report proposal on the tree protection activities to be implemented throughout the construction period.

2.16      The Permit Holder shall maintain continuous discussions with the West Kowloon Cultural District Authority and in consultation with the Planning Department so as to further refine the scale, location, disposition, design and integration strategies of the ventilation shafts within the West Kowloon Cultural District to minimize their visual impacts. 

            許可證持有人須與西九龍文化區管理局繼續進行磋商,並諮詢規劃署,以便進一步優化西九龍文化區內通風井的規模、位置、規劃、設計及融合策略,務求盡量減低對視覺造成的影響。

 

2.17      The Permit Holder shall consult relevant government departments including Planning Department on the reprovisioning and restoration of the public open space affected by the Project. The Permit Holder shall, no later than two months after the commencement of operation of the Project, deposit with the Director the record of the public open space reprovisioning and restoration.

            許可證持有人須就重置及修復受工程項目影響的公眾休憩用地徵詢規劃署及其他有關政府部門的意見。許可證持有人須在工程項目開始營辦後兩個月內,向署長存放重置及修復公眾休憩用地的記錄。

 

Waste Management

廢物管理

 

2.18   Inert construction and demolition (C&D) materials shall be separated from non-inert C&D waste on site. The Permit Holder shall prohibit the disposal of any C&D materials generated by the Project at the landfills, with the exception of the non-inert C&D wastes and the small amount of properly treated contaminated wastes.

            惰性拆建物料與非惰性拆建物料須作即場分隔。許可證持有人須禁止有關人員在堆填區棄置工程項目產生的任何拆建物料,但非惰性拆建物料和少量經妥善處理的受污染廢物除外。

 

2.19      Inert C&D materials shall be reused on site as far as possible, in order to minimize the disposal of such materials to public fill reception facilities. The Permit Holder shall deposit with the Director an updated C&D Material Management Plan within three months of the commencement of the construction works.

            惰性拆建物料須盡可能即場循環使用,盡量減少運往公眾填料接收設施的有關物料量。許可證持有人須在建造工程展開後的三個月內,向署長存放最新的拆建物料管理計劃。

 

2.20   The Permit Holder shall control the disposal of C&D materials through a trip ticket system. The Permit Holder shall take action to restore any fly-tipping sites found to be dumped with C&D materials generated by the Project.

            許可證持有人須利用運載記錄制度規管拆建物料的棄置。如發現工程項目產生的拆建物料被傾倒於指定地點外,許可證持有人須採取行動回復傾倒地點的原貌。

 

2.21            The Permit Holder shall carry out further site investigation regarding potential land contamination in accordance with the EIA Report. Site inspection shall be carried out when individual site access is granted to ascertain contaminative sources and hotspots of contamination. The Permit Holder shall submit to the Director for approval a revised Contamination Assessment Plan (CAP) with sampling and testing schedule updated based on respective site condition. If contamination is found, the Permit

Holder shall submit to the Director for approval a Remediation Assessment Plan (RAP). No work on the identified potentially contaminated sites shall be carried out unless and until the CAP and RAP submitted under this condition are approved by the Director.

許可證持有人須根據環評報告就潛在的土地污染作進一步實地勘測。實地勘測須於個別工地容許進入時進行,以確定污染源頭和熱點。許可證持有人須向署長提交經修訂的污染評估計劃,連同因應相關地盤狀況作出更新的取樣及測試作業表,以供批准。如發現污染情況,許可證持有人須向署長提交補救評估計劃,以供批准。有關人員不得在識別為潛在受污染土地進行任何工程,直至根據本條件提交的污染評估計劃及補救評估計劃獲得署長批准。

 

Measures to Mitigate Construction Noise Impact

2.22      The construction stage ground-borne noise impact at the time of tunnel boring machine operation shall be monitored to confirm the ground-borne noise levels.  If it is envisaged that the noise criteria will be exceeded at the nearby sensitive receivers, reducing rotational speed and scheduling of works or other alternatives shall be adopted to reduce noise impact in consultation with the affected parties.

            須監測建造階段隧道鑽挖機操作期間所產生的地層傳導噪音影響,以確定地層傳導噪音水平。如預計附近噪音感應強的地方的噪音水平會超出標準,須與受影響者商議,減慢鑽挖機轉速、安排工程時間或採用其他替代措施,以減低噪音影響。

 

Measures to Mitigate Operational Ground-borne Noise Impact

營辦期間地層傳導噪音影響緩解措施

 

2.23     Within six months of the commencement of the construction of the Project, the Permit Holder shall deposit with the Director a Performance Test Plan for the verification of the Line Source Response assumed in the EIA Report. The Performance Test Plan shall include the result of the vibration borehole testing to be carried out at two carefully selected locations along the tunnel alignment before the commencement of the construction of the Project and the knowledge of the ground vibration conditions to be obtained during the construction stage of the Project.

           在工程項目的建造工程展開後的六個月內,許可證持有人須向署長存放表現測試計劃,以核證環評報告所採用的線狀振源傳遞性。表現測試計劃須包括建造工程展開前沿隧道走兩處小心選擇的地方的振動鑽孔測試的結果及在建造工程中得到的地層振動情況知識。

 

2.24     The Permit Holder shall arrange testing of the Force Density Levels of the trains for the Project as soon as possible, but in no case later than six months before the commencement of operation of the Project.

           許可證持有人須盡快,並不得遲於工程項目開始營辦前六個月,安排列車的力密度水平測試。

 

2.25     Prior to the final design of the trackform, the Permit Holder shall deposit with the Director an updated ground-borne noise prediction report, with additional mitigation measures as necessary, to demonstrate that the operation of the Project will be within the predicted noise levels in the EIA Report.

          在路軌最終設計完成前,許可證持有人須向署長存放有關階段的最新地層傳導噪音預測報告,並包括所需額外緩解措施,證明其營辦符合環評報告所載的預測噪音水平。

 

2.26     The train operation shall be confined within 0600 to 2400 hours daily with operation details given below:

2.28      The Permit Holder shall maintain continuous discussion with the Housing Department regarding the layout and foundation design of the future development at Site 6 in West Kowloon such that the predicted ground-borne noise level will not be exceeded.

          為了日後西九龍第六區的發展不會超逾地層傳導預測噪音的水平,許可證持有人須與房屋署繼續進行磋商有關該地區建築佈局及地基的設計。

 

2.29      The Permit Holder shall maintain continuous discussion with the West Kowloon Cultural District Authority regarding the future noise sensitive development in the West Kowloon Cultural District to ensure the effectiveness of the provision of low noise trackform at the terminus in West Kowloon.

            許可證持有人須與西九文化區管理局繼續進行磋商有關在西九文化區裏的未來噪音感應強的地方,以確保在西九龍的總站的低噪音軌道的效用。

 

2.30   Flexibility in the design for the implementation of further noise mitigation measures including extending low noise trackform to deal with any unforeseeable impact to any noise sensitive receiver shall be allowed.

            設計須具彈性,容許實施進一步的噪音緩解措施,包括延長低噪音軌道的路段,以處理任何噪音感應強的地方受到任何無法預見的影響。

 

Measures to Mitigate Noise Impact from ERS and SSS

石崗緊急救援處及石崗列車停放處噪音影響緩解措施

 

2.31     Sound absorption treatment shall be provided at the interior walls of the ERS.  The treatment shall have a height of 13m located at 3m above top of rail on both sides and for full length of the ERS in accordance with the EIA Report.

           石崗緊急救援處的內牆須根據環評報告作吸音處理,有關處理設施於路軌頂部以上3,高13,設於石崗緊急救援處全線兩側。

2.32     A 8m high noise barrier shall be installed along the access road on the eastern side of the SSS in accordance with the EIA Report.

          須根據環評報告沿石崗列停放處東面通道設高8的隔音屏障。

 

2.33     A 5.5m high noise barrier shall be installed along the western boundary of the SSS in accordance with the EIA Report.

            須根據環評報告於石崗列車停放處西面界線部分沿線裝設高5.5的隔音屏障。

 

2.34    Flexibility in the design for the implementation of further noise mitigation measures including installation of additional noise absorptive panels at the ERS and extension of noise barriers at the ERS and the SSS to deal with any unforeseeable impact to any noise sensitive receiver shall be allowed.

          設計須具彈性,容許實施進一步的噪音緩解措施,包括於石崗緊急救援處安裝額外吸音板及延長石崗緊急救援處及石崗列車停放處的隔音屏障,以應付任何噪音感應強的地方受到任何無法預見的影響。

 

Measures to Mitigate Noise Impact from Ventilation Buildings

通風樓噪音影響緩解措施

 

2.35     The design of the ventilation buildings shall comply with the maximum sound power levels determined in the EIA Report and the amended pages of the EIA Report submitted in accordance with the Approval Condition (8). The noise emitted from the ventilation buildings shall be free of the characteristics of tonality, impulsiveness and intermittency.

           通風樓設計須符合環評報告和批准條件(8)所提交的經修訂的分頁所限定的最高聲功率級。通風樓的噪音須沒有音調、脈衝及斷續特徵。

 

Noise Commissioning Test prior to Operation

開始營辦前測試

 

2.36     The Permit Holder shall, no later than two weeks before the commencement of the operation of the Project, deposit with the Director a Commissioning Test Report to confirm the compliance of the operational air-borne and ground-borne noise levels in accordance with the EIA Report.

          不少於工程項目營辦開始前兩星期許可證持有人須向署長存放試行運作測試報告,證明其符合環評報告內載的營辦期間經空氣傳導及經地層傳導的噪音水平。

 

Cultural Heritage

文化遺產

 

2.37   The Permit Holder shall, no later than one month before the commencement of construction at the works area of SSS, Tai Kong Po Emergency Access Point (TPP) or Tse Uk Tsuen (TUW), deposit with the Director an Archaeological Action Plan agreed by the Antiquities and Monuments Office. The Archaeological Action Plan shall include:

            許可證持有人須於石崗列車停放處、大江埔緊急救援入口或謝屋村工地範圍的建造工程展開前至少提早一個月向署長存放經古物古蹟辦事處同意的考古行動計劃。有關計劃須包括:

 

(i)                  a detailed plan for further archaeological investigation at SSS and TPP;
在石崗列車停放處及大江埔緊急救援入口工範圍作進一步考古勘查的詳細計劃;

(ii)                a detailed plan for rescue excavation at the southern portion of SSS;
在石崗列車停放處工地範圍的南面部分作搶救發掘的詳細計劃;

(iii)               a contingency plan to address possible arrangement when significant archaeological findings are unearthed during the further archeological investigation and rescue excavation; and
制訂應變計劃,應付當進一步考古勘查及搶救發掘進行期間有重大考古發現時的可能安排; 以及

(iv)              a detailed plan for Archaeological Watching Brief for the identification of any historical finds during the construction works at TUW.

2.38          The Permit Holder shall appoint a licensed Archaeologist to conduct the further archeological investigation in the works area at SSS and TPP, to conduct rescue excavation to preserve any archaeological remains, and to undertake the Archaeological Watch Brief in the works area at TUW in accordance with the EIA Report.

                許可證持有人須委任持牌考古學家,根據環評報告在石崗列車停放處及大江埔緊急救援入口工地範圍作進一步考古勘查、進行搶救發掘以保存任何考古遺物,以及承擔在謝屋村工地範圍的考古觀測摘要的工作。

 

2.39          Before the commencement of any tunneling work which may affect the ex-Lai Chi Kok Hospital, the Permit Holder shall consult the Antiquities and Monuments Office and other relevant parties on the installation of vibration monitoring device for the ex-Lai Chi Kok Hospital.

                在展開任何可能影響前荔枝角醫院的開掘隧道工程前,許可證持有人須就於前荔枝角醫院安裝振動監察裝置,徵詢古物古蹟辦事處及其他有關團體的意見。

 

 

Stockpiling of Materials at To Kau Wan Works Area

在倒扣灣物料存放處堆存物料

 

2.40     The Permit Holder shall ensure that the To Kau Wan Works Area is only used for proper stockpiling of fill materials generated from the Project suitable for use by the Hong Kong - Zhuhai - Macao Bridge project office. The stockpiling height shall not exceed 8m from ground level. The stockpiling amount shall not exceed 350,000m3.

            許可證持有人須確保倒扣灣物料存放處只可恰當地用作堆存由工程項目產生,適合港珠澳大橋工程辦事處使用的填料。堆存物料的高度不得高於地面8。堆存物料的數量不得多於350,000立方米。

 

2.41      The Permit Holder shall continue to operate the To Kau Wan Works Area until the works area together with the stockpiled materials is allocated to the Hong Kong - Zhuhai - Macao Bridge project office.

            許可證持有人須持續營辦倒扣灣物料存放處,直至該物料存放處連同堆存物料被港珠澳大橋工程辦事處接管為止。

 

2.42      The Permit Holder shall, no later than one month before the commencement of construction at the To Kau Wan Works Area, deposit with the Director a landscape plan prepared for the works area.  The landscape plan shall include the design details, implementation schedule, and drawings in appropriate scale showing the landscape and visual mitigation measures.

            在倒扣灣物料存放處的建造工程展開前,許可證持有人須至少提早一個月向署長存放為該物料存放處擬備的景觀美化計劃。景觀美化計劃須包括設計詳情、實施時間表及合適比例的圖則,顯示景觀及視覺緩解措施。

 

 

Mong Wing Street Works Area

2.43      An additional concrete paving of not less than 200mm thickness shall be provided and properly maintained throughout the entire period of use of the Mong Wing Street Works Area so that the soil underneath will not be disturbed or exposed.  Prior to the Permit Holder’s exit from the works area, the Permit Holder shall submit to the Director for approval a soil and groundwater contamination assessment report for the works area.

許可證持有人須在望榮街物料存放處的整個使用期間,於整個地面附加舖設及妥善保養不少於200毫米厚的混凝土,以確保底下的泥土不會受擾亂或露出。許可證持有人在撤離物料存放處前,許可證持有人須向署長提交物料存放處的土壤及地下水污染評估報告,以供批淮。

 

Obstruction Removal Works at Sham Shui Po New Ferry Pier at Nam Cheong

2.44      The Permit Holder shall monitor the types and quantities of wastes that would be generated from the obstruction removal works at Sham Shui Po New Ferry Pier to confirm the assessment result for the works.  If any marine sediment is encountered, the Permit Holder shall ensure the disposal in accordance with the updated C&D Material Management Plan under Condition 2.19.

            許可證持有人須監察在深水埗新碼頭的障礙物移除工程所產生的廢物類型及數量,以確定該工程的評估結果。若發現任何海牀底泥,許可證持有人須確保其棄置符合條件2.19的最新的拆建物料管理計劃。

 

Environmental Monitoring and Audit (EM&A) Requirements

 環境監察及審核(環監)規定

 

2.45      The Permit Holder shall implement the EM&A programme in accordance with the procedures and requirements as set out in the EM&A Manual. Any changes to the programme shall be justified by the ET Leader and verified by the IEC as conforming to the information and requirements contained in the EM&A Manual before submission to the Director for approval.

            許可證持有人須按環監手冊所載的程序及規定執行環監計劃。計劃如有任何更改,須由環境小組組長提出充分理由,並由獨立環境查核人核實,證明其符合環監手冊所載資料及規定,方可提交署長批准。

 

2.46      Samples, measurements and necessary remedial actions shall be taken in accordance with the requirements of the EM&A Manual by:

            取樣、測量及採取所需的補救行動,均須按照環監手冊的規定進行:

 

(a)                conducting baseline environmental monitoring;
進行環境基線監

(b)                conducting impact monitoring;
進行影響監察;

(c)                carrying out remedial actions described in Event/Action Plans of the EM&A Manual in accordance with the time frames set out in Event/Action Plans, or as agreed by the Director, in case where specified criteria in the EM&A Manual are exceeded; and
如超逾環監手冊內指定的標準,則按照環監手冊內的事件/行動計劃所訂明的時限或署長所同意的時限,執行事件/行動計劃所說明的補救行動;以及

(d)                logging and keeping records of details of (a) to (c) above for all parameters within 3 working days of collection of data or completion of remedial action(s), for the purpose of preparing and submitting the monthly EM&A Reports and to make available for inspection on site.
在收集數據或完成補救行動的3個工作天內,須記錄及備存上文(a) (c)項各參數的詳情,用作擬備並提交每月環監報告,並備妥有關資料以供在工地查閱。

 

2.47      The Permit Holder shall deposit with the Director six hard copies and one electronic copy of the Baseline Monitoring Report at least one month before commencement of construction of the Project. Additional copies of the submission shall be made available to the Director upon his request.

            在工程項目的建造工程展開前,須至少提早一個月向署長提交基線監察報告的六份硬複本及一份電子版本。如署長要求,則須提交額外複本。

 

2.48      The Permit Holder shall deposit with the Director six hard copies and one electronic copy of monthly EM&A Report within 10 working days after the end of the reporting month. The EM&A Reports shall include a summary of all non-compliance (exceedances) of the environmental quality performance limits (Action and Limit Levels). A summary and progress update of the Project Implementation Schedule (Table 18.1 of the EIA Report) shall also be included in each EM&A Report. Additional copies of the submission shall be provided to the Director upon request by the Director.

            在規定提交報告的月份結束後10個工作天內,須向署長提交每月環監報告的六份硬複本及一份電子版本。環監報告須包括各種不符合(超出)環境質素表現規限(行動及極限水平)情況的摘要。所有環監報告須包括工程項目實施安排(環評報告表18.1)的摘要及進度更新。如署長要求,則須提交額外複本。

 

2.49    The Permit Holder shall, no later than three months after the commencement of operation of the Project, deposit with the Director an Environmental Monitoring and Audit report on the implementation of the mitigation measures for operation stage of the Project in accordance with the EIA Report and the submissions required under of this Permit.

            許可證持有人須在工程項目的營辦開始後三個月向署長提交環監報告報告按照環評報告及本許可證要求而提交的文件於工程營階段的緩解措施的實施情況

 

 

 

 

Electronic Reporting

電子匯報

 

2.50      To facilitate public inspection of the documents to be submitted or deposited as required under this Permit, the Baseline Monitoring Report and EM&A Reports via the Environmental Impact Assessment Ordinance Internet Website and at the Environmental Impact Assessment Ordinance Register Office, the Permit Holder shall prepare electronic copies of these documents and Reports in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF) (version 1.3 or later) or other format agreed by the Director, and shall submit the electronic copies at the same time as the hardcopies. For the HTML version, a content page capable of providing hyperlink to each section and sub-section of these documents and Reports shall be included in the beginning of the document. Hyperlinks to all figures, drawings and tables in these documents and Reports shall be provided in the main text from where the respective references are made. All graphics in these documents and Reports shall be in interlaced GIF format unless otherwise agreed by the Director. The content of the electronic copies of these documents and Reports must be the same as the hardcopies.

            為方便公眾透過環境影響評估條例互聯網網站及在環境影響評估條例登記冊辦事處查閱按照本許可證的要求而提交或存放的文件基線監察報告及每月環監報告,許可證持有人須以超文本標示語言(HTML)(第4.0或較後版本)及便攜式文件格式(PDF)(第1.3或較後版本)或其他獲署長同意的格式,製作文件及報告的電子版本,與硬複本同時提交。關於HTML的版本方面,可與文件及報告各節及小節作出超文本連結的目錄須在文件開端加入。文件及報告內各類圖表須在載有相關資料的正文內作出超文本連結。除非另獲署長同意,文件及報告內所有圖形均須以交錯存取的GIF格式制定。文件及報告的電子版本內容,必須與硬複本的內容一致。

 

2.51     The Permit Holder shall set up a dedicated Internet website and notify the Director in writing the Internet address where the environmental monitoring and project data are to be placed, within six weeks after the commencement of construction of the Project. All environmental monitoring data described in Conditions 2.45 to 2.49 above shall be made available to the public via a dedicated Internet website to be set up by the Permit Holder in the shortest possible time and in no event later than 2 weeks after the relevant environmental monitoring data are collected or become available, unless otherwise agreed with the Director.

            許可證持有人須在工程項目的建造工程展開後六個星期內,設立特定互聯網網站存放環境監察數據及工程項目資料,並以書面通知署長互聯網網址所在。上文條件第2.452.49項說明的所有環境監察數據,除非另獲署長同意,均須盡快透過由許可證持有人設立的特定互聯網網站供公眾閱覽,在任何情況下均不得遲於有關環境監察數據的收集或可供閱覽後的2個星期。

 

2.52      The Internet website as described in Condition 2.51 above shall enable user-friendly public access to the monitoring and project data including the EIA Report, the amended pages of the EIA Report submitted in accordance with the Approval Condition (8), the environmental permit(s) and the project profile of the Project. Unless otherwise agreed with the Director, the Internet website shall have features capable of:

           上文條件第2.51項說明的互聯網網站,必須方便用戶使用,讓公眾容易接達環境監察數據及工程項目資料,當中包括工程項目的環評報告、根據批准條件(8)而提交的經修訂的分頁、環境許可證及工程項目簡介。除非另獲署長同意,互聯網網站須具備部件,提供下述功能:

 

(a)               providing access to all environmental monitoring data collected since the commencement of works;
接達工程展開後所收集的全部環境監察數據;

(b)               searching by date;
按日期搜尋;

(c)               searching by types of monitoring data (noise, water and air quality); and
按監察數據類別(噪音、水質及空氣質素)搜尋;以及

(d)               hyperlinks to relevant monitoring data after searching.
在搜尋後與相關的監察數據作出超文本連結。

1.        This Permit consists of three parts, namely, PART A (Main Permit), PART B (Description of Designated Project) and PART C (Permit Conditions).  Any person relying on this permit should obtain independent legal advice on the legal implications under the Ordinance, and the following notes are for general information only.

     本許可證共有三個部分,即A(許可證主要部分);B(指定工程項目的說明)及C(許可證條件)。任何援引本許可證的人士須就條例的法律含意徵詢獨立法律意見,下述註解只供一般參考用。

 

2.        If there is a breach of any conditions of this Permit, the Director or his authorized officer may, with the consent of the Secretary for the Environment, order the cessation of associated work until the remedial action is taken in respect of the resultant environmental damage, and in that case the Permit Holder shall not carry out any associated works without the permission of the Director or his authorized officer.

如違反本許可證的任何條件,署長或獲授權人員可在環境局局長的同意下勒令停止相關工程,直至許可證持有人為所造成的環境損害採取補救行動為止。在此情況下,許可證持有人未經署長或獲授權人員同意,不得進行任何相關工程。

 

3.        The Permit Holder may apply under Section 13 of the Ordinance to the Director for a variation of the conditions of this Permit.  The Permit Holder shall replace the original permit displayed on the Project site(s) by the amended permit.

許可證持有人可根據條例第13條的規定向署長申請更改本許可證的條件。許可證持有人須把經修改的許可證替換在工地內展示的原有許可證。

 

4.        A person who assumes the responsibility for the whole or a part of the designated project may, before the person assumes responsibility of the designated project, apply under Section 12 of the Ordinance to the Director for a further environmental permit.

承擔指定工程項目整項或部分工程的責任的人,在承擔責任之前,可根據條例第12條的規定向署長申請新的環境許可證。

 

5.        Under Section 14 of the Ordinance, the Director may with the consent of the Secretary for the Environment, suspend, vary or cancel this Permit.  The suspended, varied or cancelled Permit shall be removed from display at the Project site(s).

根據條例第14條的規定,署長可在環境局局長的同意下暫時吊銷、更改或取消本許可證。遭暫時吊銷、更改或取消的許可證必須從工地的展示地點除下,不再展示。

 

6.        If this Permit is cancelled or surrendered during construction or operation of the Project, another environmental permit must be obtained under the Ordinance before the Project could be continued.  It is an offence under section 26(1) of the Ordinance to construct or operate a designated project listed in Part I of schedule 2 of the Ordinance without a valid environmental permit.

如果本許可證在工程項目建造或營辦期間取消或交回,則在繼續進行工程項目之前,必須先根據條例規定取得另一份環境許可證。根據條例第26(1)條的規定,任何人在沒有有效環境許可證的情況下建造或營辦條例附表2I部所列明的指定工程項目,即屬犯罪。

 

7.        Any person who constructs or operates the Project contrary to the conditions in the Permit, and is convicted of an offence under the Ordinance, is liable:-

       如任何人在違反本許可證的條件下建造或營辦工程項目,根據條例,即屬犯罪

 

(i)            on a first conviction on indictment to a fine of $ 2 million and to imprisonment for 6 months;
一經循公訴程序首次定罪,可處罰款200萬元及監禁6個月;

(ii)          on a second or subsequent conviction on indictment to a fine of $ 5 million and to imprisonment for 2 years;
一經循公訴程序第二次或其後每次定罪,可處罰款500萬元及監禁2年;

(iii)         on a first summary conviction to a fine at level 6 and to imprisonment for 6 months;
一經循簡易程序首次定罪,可處第6級罰款及監禁6個月;

(iv)        on a second or subsequent summary conviction to a fine of $1 million and to imprisonment for 1 year; and
一經循簡易程序第二次或其後每次定罪,可處罰款100萬元及監禁1年;以及

(v)          in any case where the offence is of a continuing nature, the court or magistrate may impose a fine of $ 10,000 for each day on which he is satisfied the offence continued.
在任何情況下如該罪行屬連續性質,法院或裁判官可就其信納該罪行連續的每一天另處罰款10,000元。

 

8.       The Permit Holder may appeal against any condition of this Permit under Section 17 of the Ordinance within 30 days of receipt of this Permit.

許可證持有人可在接獲本許可證後30天內,根據條例第17條就本許可證的任何條件提出上訴。

 

9.       The Notes are for general reference only and that the Permit Holder should refer to the Ordinance for details and seek independent legal advice.
