Conditions of Approval under Section 8(3) of the EIA Ordinance (the Ordinance)
The EIA Report as exhibited under Section 7(1) of the Ordinance is approved by the Director on the condition that the following amendments shall be incorporated into the EIA Report and shall form part of the approved EIA report:
1. The enhanced environmental monitoring frequency relating to the dioxin emission monitoring and the odour level monitoring shall be governed by the licence conditions under the Air Pollution Control Ordinance, and would not be repeated in the Environmental Permit to be issued under the EIA Ordinance.
2. The environmental monitoring data and results relating to the environmental monitoring and audit programme described in the EIA report and any enhanced environmental monitoring for the Project, shall be released to the public in the form of environmental monitoring and audit reports through a project web site set up by the Applicant. Such a requirement to release the environmental monitoring data and results to the public shall be specified as one of the conditions in the Environmental Permit to be issued under the EIA Ordinance.
Under section 17 of the EIA Ordinance, the
applicant may appeal to the Appeal Board against any of the above conditions
within 30 days of the receipt of this notice of the Director’s decision.
