Reference of the Approved EIA Report in the Register : AEIAR-143/2009

Condition of Approval under Section 8(3) of the EIA Ordinance (the Ordinance)

 

The EIA Report as exhibited under Section 7(1) of the Ordinance is approved by the Director of Environmental Protection (DEP) with the following conditions:

  

(1)               one month before any tree felling, the Project Proponent shall submit a tree planting and landscape plan, including the compensatory woodland, in consultation with the Planning Department and Agriculture, Fisheries and Conservation Department, for approval by DEP;

(2)               before the commencement of any tunneling or soil excavation works, the Project Proponent shall provide DEP with an updated hydrogeological impact assessment to reaffirm the findings of the EIA report with respect to the extent of the environmental impacts as a result of the potential hydrology and groundwater level changes.   Moreover, before, during and after the soil excavation or tunneling works, the Project Proponent shall conduct groundwater level monitoring, in particular in the ecologically sensitive areas, in consultation with relevant stakeholders to verify the predictions in the EIA report;

(3)               before the commencement of any tunneling or soil excavation works, the Project Proponent shall submit a contingency plan to deal with any unforeseeable incidents which might affect the groundwater level;

(4)               the Project Proponent shall prohibit the disposal of any construction and demolition (C&D) materials generated by the project at the landfills, with the exception of the non-inert C&D wastes and the small amount of properly treated contaminated wastes;

(5)               the Project Proponent shall take action to restore any fly-tipping sites found to be dumped with C&D materials generated by the project;

(6)               the Project Proponent shall submit an updated C&D material management plan to DEP within three months of the commencement of the construction works;

(7)               before the commencement of construction works, the Project Proponent shall set up community liaison groups comprising representatives of concerned and affected parties, including local committees, residents and schools in the affected areas along the railway alignment, to facilitate communications, enquiries and complaints handling on all environmental issues. A designated complaint hotline shall also be set up for the project to address such concerns and complaints in an efficient manner; and

(8)               the Project Proponent shall amend the fixed plant noise calculation in Appendix 5.6 and the maximum sound power levels in Table 5.21 of the proposed ventilation building in Mai Po to ensure consistency with the area sensitivity ratings in Table 5.6 of the EIA Report. The Project Proponent shall submit the amended pages to DEP for placing on the EIA Ordinance's Register within 2 weeks of the approval of the EIA Report.
