Penalty

If the Environmental Protection Department has reason to believe that a person is committing or has committed the following offences at the time of the sale:

(i) Failed to charge the customer an amount not less than $1 for each PSB, or each pre-packaged pack of 10 or more PSBs, provided by the seller directly or indirectly to the customer ; or
(ii) Offered rebate or discount to the customer with the effect of directly offsetting the amount or any part of the amount charged for each PSB or each pre-packaged pack of 10 or more PSBs provided by the seller directly or indirectly to the customer,

the Environmental Protection Department may issue the person (the seller / retailer) a fixed penalty notice a fixed penalty notice requiring the person to pay a fixed penalty of $2,000.

For breaches of serious nature such as repeated or systemic contraventions, the Environmental Protection Department may initiate prosecution through criminal proceedings and the offender is liable on conviction to a maximum fine of $100,000 on the first occasion and $200,000 on each subsequent occasion.
