Conditions Imposed under Section 5(12) of the Ordinance
for Permission to Apply Directly for Environmental Permit



1. The seabed location lying within 10m on both sides of each of the two cable alignments that also fall within the 500m radius around the Fat Tong Chau Old Chinese Customs Station, shall be checked by qualified marine archaeologist for any possible archaeological remains to the satisfaction of the Director before the construction commences. Any archaeological findings detected shall be reported to the Director.

2. The submarine cable shall be laid in a trench of width up to 0.3m and a depth up to 1.5m. All measures including laying methods, as described in the Project Profile submitted with the application on 30 June 2000, together with the above condition, shall be fully implemented.

Note:
Under section 17 of the EIA Ordinance, the applicant may appeal to the Appeal Board against any of the above conditions within 30 days of the receipt of this notice of the Director's decision.
