Application for Permission to Apply Directly for Environmental Permit

 

Project Title: Natural Terrain Hazard Mitigation Works at Study Area No. 12NW-C/SA1 Above Leung Fai Tin Along Clear Water Bay Road, Sai Kung

(Application No. DIR-225/2013)

 

 

Conditions Imposed under Section 5(12) of the Ordinance

for Permission to Apply Directly for Environmental Permit

 

 

1.          No works shall be carried out outside the Works Area boundary as indicated in Figure 3 of the Project Profile (No. PP-480/2013).

 

2.          All environmental mitigation measures described in the Project Profile (No. PP-480/2013) submitted with the application on 6 February 2013 shall be fully implemented.

 

3.          Plant species of conservation importance found within the Works Area (i.e. Aquilaria sinensis and Pavetta hongkongensis) shall be protected, retained in-situ and not be disturbed.

 

4.          The Applicant shall submit to the Director for approval, at least 6 weeks before commencement of construction, 3 sets of a Landscape and Compensatory Planting Plan showing details of compensatory plantings and protective measures for existing trees and plants during construction.  The Landscape and Compensatory Planting plan shall also indicate with the aid of figures, compensatory re-vegetation/planting by native shrubs/trees, and locations of re-vegetation of the existing disturbed ground plus other suitable areas within the Works Area.  All the proposed protective and compensatory measures recommended in the approved Landscape and Compensatory Planting Plan shall be fully implemented during construction.

 

5.          An independent checker shall be employed to audit the implementation of all mitigation measures recommended in the Project Profile (No. PP-480/2013) and the approved Landscape and Compensatory Planting Plan, and to confirm in writing in the monthly report full implementation of the mitigation measures during and upon completion of the construction works.

 

 

 

 

Note

 

Under section 17 of the EIA Ordinance, the Applicant may appeal to the Appeal Board against the above condition within 30 days of the receipt of this notice of the Director¡¦s decision.
