ENVIRONMENTAL PERMIT TO CONSTRUCT AND OPERATE DESIGNATED PROJECT(S)

Pursuant to section 13 of the Environmental Impact Assessment Ordinance, the Director of Environmental Protection (the Director) amends the Environmental Permit No.EP-003/1998 granted to the TERRITORY DEVELOPMENT DEPARTMENT (the "Permit Holder") on 2 September, 1998. This amended environmental permit is for constructing and operating the designated project described in Part B subject to the conditions described in and attached to Part C. The environmental permit No.EP-003/1998 is hereby replaced by this amended environmental permit.

The issue of this environmental permit is based on the documents, approvals or permissions described below :-

根據環境影響評估條例第13條的規定,環境保護署署長(署長)現修訂於一九九八年九月二日批予拓展署(許可證持有人)的環境許可證編號EP-003/1998。許可証持有人可根據本經修訂的環境許可証建造及營辦B部所說明的指定工程項目﹐但須遵守C部所說明或附載的條件。環境許可証編號EP-003/1998已被本經修訂的環境許可証所取代。

Main Drainage Channels for Ngau Tam Mei, Phase 1 :

A drainage channel of width less than 100m. The scope of the project includes construction of i) diversion of Ngau Tam Mei Main Drainage Channel from Castle Peak Road near Yau Mei San Tsuen to the new 60CD Main Drainage Channel near Tai San Wai. The channel will have concrete lined bed with grasscrete sides; ii) an ancillary road system; Iii) associated pumping facilities; and iv) landscaping works.

牛潭尾主要排水道第一期工程:

排水道的寬度少於100米。範圍包括下列建造工程:i)牛潭尾主排水道由青山公路近攸美新村改道至新的60CD主排水道近大生圍。排水道底部中間將砌襯混凝土,底部兩旁則鋪砌草面物料; ii)一個附屬道路系統; iii)相連的泵水設施; iv)景觀美化工程。

Main Drainage Channels for Ngau Tam Mei, Phase 2 :

A drainage channel of width less than 100m. The scope of the project includes construction of i) a main drainage channel from Ngau Tam Mei to connect with the Phase 1 Channel mentioned above near Yau Mei San Tsuen. The bed and lower slopes of the channel will be concrete lined with grasscrete upper slopes; ii) an ancillary road system; and iii) landscaping works.

牛潭尾主要排水道第二期工程:

排水道的寬度少於100米。範圍包括下列建設工程:i)一條主排水道,由牛潭尾伸展至近攸美新村以連接上文提及的第一期排水道。排水道的底部和下斜坡將砌襯混凝土,而上斜坡則鋪砌草面物料;ii)一個附屬道路系統;iii)景觀美化工程。

PART C (PERMIT CONDITIONS)
C部 (許可證條件)

1. General Conditions
一般條件

1.1 The Permit Holder shall ensure full compliance with all conditions of this environmental permit. Any non-compliance may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499) and shall be definite ground for enforcement action or permit cancellation where applicable.
許可證持有人必須確保完全符合本環境許可證的全部條件。如有不符合的情況,可能構成違反環境影響評估條例(第499章)的規定,並可作為採取執法行動的理由,而導致按適用情況根據條例第14條的規定暫時吊銷、更改或取消環境許可證,或根據條例第24條的規定發出終止工作的命令。

1.2 This permit shall not remove the responsibility of the Permit Holder to comply with any legislation currently in force such as the Noise Control Ordinance (Cap.400), Air Pollution Control Ordinance (Cap.311), Water Pollution Control Ordinance (Cap.358), Dumping at Sea Ordinance (Cap.466), the Waste Disposal Ordinance (Cap.354) and others.
本許可證並不免除許可證持有人須符合任何有關環境保護及防止污染的法例的責任,包括:噪音管制條例(第400章);空氣污染管制條例(第311章);水污染管制條例(第358章);海上傾倒物料條例(第466章);及廢物處置條例(第354章)。

1.3 The Permit Holder shall make copies of this permit available at all times for inspection by the Director at all sites covered by this permit.
許可證持有人須複印本許可證的副本,以供署長任何時間內在本許可證所涵蓋的所有工程項目場地處所查閱。

1.4 The Permit Holder shall give a copy of this permit to the person(s) in charge of the site(s).
許可證持有人須將本許可證的一份副本交予有關場地的負責人。

1.5 The Permit Holder shall display a copy of this permit on the construction site(s) at all vehicular site entrances/exits or at a convenient location for public information at all times. The Permit Holder shall ensure that the most updated information about the environmental permit, including any amended permit, is displayed at such locations. If the Permit Holder surrenders a part or the whole of the permit, the notice he sends to the Director shall also be displayed at the same locations as the original permit.
許可證持有人須在有關建造工地的所有車輛進出口展示本許可證的副本,以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於環境許可證的最新資料,包括經修改的許可證。如果許可證持有人交回許可證的部分或全部,須將其送交環境保護署署長的通知書,在備有原本許可證的各處相同地點展示。

1.6 The Permit Holder shall construct and operate the Projects in accordance with the project descriptions in Part B of this permit.
許可證持有人須依據本許可證B部的工程項目說明來建造及營辦指定工程項目(下稱工程項目)。

1.7 The Permit Holder shall ensure that the Projects are designed, constructed and operated in accordance with the information and recommendations contained in the EIA Report.
許可證持有人須確保工程項目的設計、建造及營辦,符合本許可證A部所述環評報告的細節及建議。

1.8 All deposited submissions, as required under this permit, shall be rectified in accordance with the comments, if any, made by the Director within one month of the receipt of the Director's comments or otherwise specified by the Director.
所有按本許可證規定存放的文件,須在接到署長的意見(如有者)起計一個月內或按署長另行指定,根據其意見作出修正。

1.9 All finalised submissions, as required under this permit, shall be released to the public if requested by the Director, by depositing copies in the Environmental Impact Assessment Ordinance Register Office or any places or by any other means as specified by the Director for public inspection. For this purpose, the Permit Holder shall provide sufficient copies of submissions.
所有按本許可證規定提交的文件定稿,在署長要求下須公開給公眾人士知道,方法是將有關文件副本存放於環境影響評估條例登記冊辦事處或署長所指定的任何地方或採取其指定的任何其他方法,以供公眾查閱。許可證持有人須提供足夠數量的文件副本。

2. Submissions or Measures before Commencement of Construction
展開建造工程前的措施

2.1 An Independent Environmental Checker shall be employed prior to the commencement of construction of the Projects. The Independent Environmental Checker shall have at least 7 years experience in environmental monitoring and auditing or environmental management. The Independent Environmental Checker shall verify the overall environmental performance of the Projects, including all the implementation of environmental mitigation measures, submissions relating to environmental monitoring and auditing, and any other submissions required under this permit.
在展開建造工程之前,須聘用一名獨立環境查核人。該名獨立環境查核人須在環境監察及審核或環境管理方面至少有7年經驗。獨立環境查核人須核證工程項目的整體環境表現,包括實施環境緩解措施、提交與環境監察及審核有關的文件、以及提交本許可證所要求的任何其他文件。

2.2 An Environmental Team shall be established prior to the commencement of construction of the Projects. The Environmental Team shall be headed by a team leader who has at least 7 years experience in environmental monitoring and auditing or environmental management.
在展開建造工程之前須先設立一個環境小組。該環境小組須由一名在環境監察及審核或環境管理方面至少有7年經驗的組長帶領。

2.3 The Permit Holder shall deposit with the Director 3 sets of 1 to 1000 scale layout drawings showing the works boundaries, drainage channel, ancillary road alignments and any other facilities assessed in the EIA Report; the locations of environmental mitigation measures recommended in the EIA Report; and an explanatory statement. The layout drawings, the locations of environmental mitigation measures and the explanatory statement so provided shall be verified by the Engineer, as conforming to the information and recommendations contained in the EIA Report, before the commencement of construction of the relevant section of the Projects. The Projects shall be constructed in accordance with the information and recommendations contained in the EIA Report.
許可證持有人須向署長存放下列文件,計有:3套1:1000比例的設計規劃圖則,顯示工程界線、排水道、附屬道路的路線及環評報告所評估的任何其他設施;環評報告所建議的環境緩解措施的地點;以及一份解釋說明。所提供的設計規劃圖則、環境緩解措施地點及解釋說明,須經由工程師核證其符合環評報告所載的資料和建議,然後才可展開建造工程項目的有關部份。工程項目須按照環評報告所載的資料及建議來建造。

2.4 Three sets of 1 to 1000 scale layout drawings showing the locations of environmental mitigation measures to be adopted during the construction works as recommended in the EIA Report, and an explanatory statement shall be submitted for the approval of the Director before the commencement of construction of the relevant works of the Projects. The layout drawings and the explanatory statement so provided shall be verified by the Independent Environmental Checker as conforming to the information and recommendations contained in the EIA Report. The Projects shall be constructed in accordance with the information and recommendations contained in the EIA Report
在展開建造有關工程之前,須向署長提交3套1:1000比例的設計規劃圖則,顯示按照環評報告的建議在建造工程期間採取環境緩解措施的地點以及一份解釋說明,以待批准。所提供的設計規劃圖則及解釋說明,須經由獨立環境查核人核證其符合環評報告所載的資料及建議。工程項目須按照環評報告所載的資料及建議來建造。

2.5 Three sets of 1 to 1000 scale layout drawings showing the areas to be revegetated and planted within the works boundaries, and the programme for their implementation and 3 sets of 1 to 1000 scale layout drawings showing the abandoned stream segments to be retained, shall be deposited with the Director before the commencement of construction of the relevant works of the Projects. In particular, the following requirements, among others, shall be included.
在展開建造有關工程之前,須向署長存放下列文件,計有:3套顯示在工程界線範圍內需要重新植被和栽種植物的地方及其實施計劃的1:1000比例的設計規劃圖則;以及3套顯示須保留的廢棄河段的1:1000比例的設計規劃圖則。

  1. sites on embankment slopes and surplus spoil disposal areas outside the embankments shall be revegetated by hydroseeding and planting with trees and shrubs. Native species shall be included in the planting list and native shrub seeds shall be added to the hydroseed mix; and
    位於堤圍斜坡上的工地及堤圍範圍外的廢棄泥石棄置區,須用水力播種方式重新植被及種植樹木和灌木。栽種植物的名單須包括本地的品種,而水力播種的混合種子中亦須有本地灌本的種子。

  2. all the stream segments to be cut-off from the main drainage channel during construction of the Projects shall be retained with downstream reconnection to the drainage channel.
    在建造工程期間,所有須從主要排水道截流的河段,須透過在下流重新接駁入排水道方式予以保留。

2.6 Three sets of a method statement for the dredging, stockpiling and transportation of sediment; and the stockpiling and transportation of construction waste and excavated material from within the works boundaries shall be deposited with the Director before the commencement of construction of the relevant works of the Projects. The submission to the Director shall be verified by the Independent Environmental Checker. All mitigation measures arising from the approved method statement shall be fully implemented.
在展開建造有關工程之前,須向署長存放3套關於工程界線內沉積物的浚挖、堆存及運送,以及建築廢料和挖出物料的堆存及運送的方法說明,以待批准。提交予署長的文件須經由獨立環境查核人核證。所有在該核證方法說明內的緩解措施,必須全部實施。

2.7 Cofferdam works, if proposed, during periods of high flow (wet season - May to August) shall be verified by the Independent Environmental Checker and submitted for the approval of the Director before the commencement of construction of the relevant works of the Projects.
如擬議在五至八月的雨季期間進行圍堰工程,須經由獨立環境查核人核證,並在展開建造有關工程項目之前提交署長批准。

2.8 Three sets of 1 to 1000 scale layout drawings for the following shall be verified by the Independent Environmental Checker and deposited with the Director before the commencement of the construction of the relevant works of the Projects:
在展開建造有關工程之前,必須經由獨立環境查核人核證,並向署長存放3套下列項目的1:1000比例設計規劃圖則,:

  1. permanent drainage channels showing the incorporation of sediment basins or traps and baffles to enhance deposition; and
    顯示裝有沉積池或沉積物捕集和阻隔裝置以加強沉積作用的永久排水道;

  2. perimeter channels at the site boundaries to intercept storm run-off from off-site.
    在工地邊界以阻截工地範圍外流入的雨水徑流的周邊排水道。

2.9 The Projects described in Part B of this permit shall incorporate noise impact mitigation measures detailed in sections 8.2.5, 8.2.6 and 8.2.7 and tables 8.2d and 8.2v of the EIA Report. Three sets of the noise impact mitigation design specifications shall be verified by the Independent Environmental Checker and deposited with the Director before the commencement of construction of the relevant works of the Projects.
本許可證B部所說明的工程,須加入環評報告所載的噪音影響緩解措施[詳載於第8.25、8.26及8.27條及表8.2d及8.2v內]。在展開建造有關工程項目之前,須向署長存放3套經由獨立環境查核人核證的噪音影響緩解措施設計規格,。

2.10 The Permit Holder shall submit an Implementation Schedule for the Projects to the Director for approval. The Implementation Schedule shall be verified before submission to the Director.
許可證持有人須向署長提交工程的實施時間表,以待批准。實施時間表在提交署長之前須先經核證。

3. Measures during the Construction Period
建造期間內的措施

3.1 All design or construction measures described in the submissions approved or deposited under section 2 above shall be properly implemented.
所有在獲批准的提交文件或根據上文第2條存放的文件內說明的設計或建造措施,必須妥善執行。

3.2 Odorous permitted stockpiled material shall be placed remote from air sensitive receivers. Any odorous stockpiled material left in excess of two days shall be covered with tarpaulin sheets.
任何帶有難聞氣味的容許堆存物料,須放於遠離易受空氣污染影響的地方。任何帶有難聞氣味的堆存物料,堆存多於2天,必須以防水帆布蓋好。

3.3 Fish ponds temporarily occupied by works areas shall be reinstated back to fish ponds.
應把工程範圍暫時佔用的魚塘恢復原狀。

3.4 For dredging works, only mechanical dredgers with bucket-type closed-grabs shall be used for the dredging of river bed or ponds. Where tight dredging depth tolerances are required to dredge contaminated materials the bucket-type closed-grab dredger shall incorporate a visor. Closed mechanical grabs for dredging shall be maintained to avoid spillage and shall seal tightly while being lifted.
進行挖泥工程時,只可使用密封抓斗式的機械挖泥機,以挖掘河床或塘底的淤泥。在挖掘受污染物料時,若嚴格規定了挖泥深度容限,則密封抓斗式的挖泥機應設置一個護罩。應使用密封式機械抓斗,以免物料濺溢,並於提起時保持抓斗密封。

3.5 For land based excavators to be used in removing wet material from small and narrow channels, which are not accessible to grab dredgers, tightly sealed closed grab excavators shall be used.
當要清除細小而狹窄的水道內的濕物料時,因抓斗式挖泥機不能進入,便需使用地面挖土機,即密封式的抓斗挖土機。

3.6 Diversion of the channels and cofferdams shall be used to minimize potential disturbance to water bodies, to limit adverse impact on water quality at downstream and to contain sediments.
應把水道或圍堰改道,以減少對水體可能造成的擾動,以盡量避免對下游的水質造成不良影響及挖到沉積物。

3.7 To mitigate environmental impacts from site run-off, the following shall be implemented:
為減輕工地徑流對環境的影響,應執行下列措施:

  1. the boundaries of earthworks shall be marked and surrounded by dykes or embankments. Temporary ditches such as channels, earth bunds or sand bag barriers shall be provided to facilitate run-off discharge into stormwater drain, via a silt retention pond;
    應標明土方工程的界線,以及用土堤或堤圍加以圍繞。應挖掘臨時壕溝如水道、土堤或放置沙包防護屏障,以利便徑流通過淤泥隔濾池才排入雨水渠;

  2. sediment traps and channels shall be cleaned and maintained on a regular basis. Daily inspections of these facilities is required;
    應定期清理和修護沉積物捕集裝置和水道,並每天進行檢查;

  3. perimeter channels shall be provided at the site boundaries to intercept storm run-off from off-site. These channels shall be constructed before site formation works and earthworks;
    應在工地界線設置周邊水道,以阻截從工地範圍外流入的雨水徑流,這些水道應於進行工地開拓和土方工程之前建好;

  4. manholes shall be adequately covered or temporarily sealed;
    沙井應覆蓋好或暫時封閉;

  5. material storage stockpiles shall be covered with tarpaulin or similar fabric to prevent material washing away;
    積存物料應以防水帆布或類似質地的布塊蓋好,以防物料被沖走;

  6. exposed soil areas shall be minimised to reduce the potential for increased siltation and contamination of run-off; and
    應盡量減少外露泥土的範圍,以減低徑流造成淤塞及污染的機會;及

  7. earthwork final surfaces shall be well compacted and subsequent permanent work should be performed immediately.
    土方工程最後完工的表層應堅實完好,並應即時進行隨後的永久工程。

3.8 To mitigate environmental impacts from wastewater due to construction activities, the following shall be implemented:
為減輕建造工程排出廢水所造成的環境影響,應執行下列措施:

  1. water used for water testing, boring, drilling works, concrete batching and precast concrete casting shall be recirculated and reused;
    用作水測試、鑽孔、探鑽工程、混凝土配料及預製混凝土鑄件的水,應循環再用;
  2. online standby sump pumps shall be provided to prevent wastewater overflow from any water recycling system;
    應設置聯機操作的備用水倉泵,以防廢水由水循環使用的系統溢出;

  3. wastewater from concrete batching and precast concrete casting shall be treated for pH adjustment and silt removed prior to discharge into stormwater drains;
    經混凝土配料及預製混凝土鑄件工序流出的廢水,應進行酸鹼調節處理,並經清除淤泥後才排入雨水渠;

  4. washwater from wheel washing facilities shall have sand, silt or other materials removed before discharge into stormwater drains; the access road sections between site exits and the public roads shall be, paved with backfall to prevent site run-off from entering the public roads; and
    由輪式清洗設施流出的廢水,應先清除內含的沙粒、淤泥或其他物料,然後才排入雨水渠;而在工地出口及公共道路之間的通道部分,應鋪築山坡以防工地的徑流流入公共道路;及

  5. drainage of groundwater shall be discharged into stormwater drains after removal of silt.
    由應先清除地下水中的淤泥,然後才排入雨水渠。

3.9 All fuel tanks and fuel storage areas shall be provided with locks and sited on bunded sealed areas of a capacity equal to 110% of the storage capacity of the largest tank.
所有燃料缸及燃料貯存區應可上鎖,並設於以堤圍密封的範圍;其容量應相等於最大的燃料缸的貯存量的1.1>倍。

3.10 Portable toilets shall be provided for the on-site construction workforce.
應設置流動廁所,供場地的建造工作人員使用。

3.11 Transport of dredged materials (not used as filling materials for the Projects) shall be by water tight trucks/vessels to the marine barging points or designated marine disposal grounds.
應使用有防水設備保護的貨車/船舶把挖掘出的物料(工程項目未有用作填料者)運往海上載駁點或指定的海上卸泥場。

3.12 All barges and hoppers, if utilized for marine transportation of dredged materials, shall have tight fitting seals to their bottom openings to prevent leakage of material.
所有用作海上運送挖掘物料的駁船及底卸式駁船,應在底部開口處設置牢固的密封裝置,以防漏出物料。

3.13 Loading of barges and hoppers, if utilized for marine transportation of dredged materials, shall be controlled to prevent splashing of dredged materials to the surrounding water.
用作海上運送挖掘物料的駁船及底卸式駁船,在裝載物料時應小心操控,以防挖掘物料濺入周圍的水中。

3.14 Barges and hoppers, if utilized for marine transportation of dredged materials, shall not be filled to a level which will cause overflow of material or polluted water during loading or transportation.
用作海上運送挖掘物料的駁船及底卸式駁船,所裝載的物料不應過滿,以免物料或污水在裝載或運送期間溢出。

3.15 All waste materials, excluding river and pond sediment, shall be segregated into categories covering: excavated material or construction waste suitable for reuse on-site, reclamation or fill, construction waste for disposal at public dump or landfill, chemical waste, and general refuse.
除河流及塘底的沉積物之外,所有廢物應予分類,可包括:適合原地再用、用作填海或填料的挖掘物料或建築廢料;棄置於公眾傾卸場或堆填區的建築廢料;化學廢物;以及一般垃圾。

3.16 General refuse shall be collected daily.
普通垃圾應每天收集。

3.17 Waste storage areas shall be regularly maintained and cleaned.
存放廢物的地方應定期修護及清洗。

3.18 Waste shall be stored in suitable containers/receptacles.
廢物應存放在合適的容器/貯藏器內。

3.19 To mitigate noise impact during construction:
下列措施可減輕建造期間造成的噪音影響:

  1. quiet equipment shall be used at all times and all locations;
    在任何時間及任何地點均應使用低噪音的設備;

  2. purpose built, permanent or moveable noise barriers shall not have openings or gaps, to ensure the required noise attenuation effect;
    不論是特別設計、固定或流動的隔聲屏障,皆不應有任何開口或缺口,確保能達至規定的消減噪音效果;

  3. noise barriers shall be erected close to, but no further than 20 metres distant from, plant in operation; and
    隔聲屏障應建立在運作中的設備附近,但距離不可超逾20米;及

  4. the noise mitigation measures approved under condition 2.9 of this permit shall be fully implemented.
    應全面執行本許可證第2.9條下批准的噪音緩解措施。

3.20 To mitigate noise impact during excavation works:
下列措施可減輕挖掘工程期間造成的噪音影響:

  1. 3.5 metre high purpose built noise barriers shall be erected between the plant in operation and nearby noise sensitive receivers, where noise sensitive receivers are generally closer than 60 metres to the works;

  2. no more than 3 pieces of plant shall operate simultaneously in any one area or location, where noise sensitive receivers are generally closer than 60 metres to the works;

  3. the excavation mitigation measures as detailed in Annex A, attached to this permit shall be used at locations where the works are closer than 100 metres to the nearest noise sensitive receivers, but 180 metres for schools; and
    當工地與最接近的噪音感應強的地方相距少於100米而與學校相距少於180米時,應在那些地點採用環評報告第8.2.7條所列的挖掘工程緩解措施;及
  4. 3 metre high purpose built, noise barriers shall be erected between the plant in operation and nearby noise sensitive receivers, where noise sensitive receivers are at distances of between 60 and 100 metres from the works.

3.21 To mitigate noise impact during access road construction:
下列措施可減少在建造通道期間造成的噪音影響:

  1. the access road construction mitigation measures as detailed in Annex A, attached to this permit shall be used at locations where the works are closer than 100 metres to the nearest noise sensitive receivers, but 180 metres for schools;
    當工地與最接近的噪音感應強的地方相距少於100米而與學校相距少於180米時,應在那些地點採用環評報告第8.2.7條所列的通道建造工程緩解措施;
  2. 4 metre high purpose built noise barriers shall be erected between the plant in operation and nearby noise sensitive receivers, where noise sensitive receivers are generally closer than 60 metres to the works;
    當噪音感應強的地方通常與工地相距少於60米時,應把4米高特別設計的隔聲屏障建立在運作中的設備與附近噪音感應強的地方之間;
  3. 3 metre high purpose built noise barriers shall be erected between the plant in operation and nearby noise sensitive receivers, where noise sensitive receivers are at distances of between 60 and 100 metres from the works; and
    當噪音感應強的地方與工地相距60至100米時,應把3米高特別設計的隔聲屏障建立在運作中的設備與附近噪音感應強的地方之間;及
  4. no more than 2 pieces of plant shall operate simultaneously in any one work site or location, where noise sensitive receivers are generally closer than 60 metres to the works.

3.22 To mitigate impact during river bed construction:
在建造河床期間減少影響的措施:

  1. the river bed road construction mitigation measures as described in Annex A, attached to this permit shall be used at locations where the works are closer than 100 metres to the nearest noise sensitive receivers, but 180 metres for schools;
    當工地與最接近的噪音感應強的地方相距少於100米而與學校相距少於180米時,應在那些地點採用本許可證附件A所說明的河床道路建造緩解措施;
