Pursuant to Section 10 of the Environmental Impact Assessment Ordinance (the Ordinance), the Director of Environmental Protection (the Director) granted the Environmental Permit No. EP-085/2000 to the HIGHWAYS DEPARTMENT (hereinafter referred to as the "Permit Holder") on 28 December 2000.  Pursuant to Section 13 of the Ordinance, the Director amends the Environmental Permit No. EP-085/2000/C based on the Application No. VEP-257/2008.  The amendments, described below, are incorporated into this Environmental Permit No. EP-085/2000/D.  This Environmental Permit as amended is for the construction and operation of the designated project described in Part B of this Permit subject to the conditions described in and attached to Part C of this Permit.

 

根據環境影響評估條例(條例)10條的規定,環境保護署署長(署長)於20001228日將環境許可證編號EP-085/2000批予路政署(下稱「許可證持有人」)。根據條例第13條的規定,署長因應更改環境許可證的申請編號VEP-257/2008修訂環境許可證編號 EP-085/2000/C下述修訂項目已包括在本環境許可證編號EP-085/2000/D內。此經修訂的環境許可證,適用於建造及營辦本許可證B部所說明的指定工程項目,但須遵守本許可證C部所說明及附載的條件。

Hereunder is the description of the designated project mentioned in Part A of this Environmental Permit:

PART C (PERMIT CONDITIONS)

C (許可證條件)

 

1.         General Conditions

          一般條件

 

1.1        The Permit Holder shall ensure full compliance with all conditions of this environmental permit. Any non-compliance may constitute a contravention of the Environmental Impact Assessment Ordinance and may become the subject of appropriate action being taken under the Ordinance.

許可證持有人必須確保完全符合本環境許可證的全部條件。如有不符合本許可證的情況,可能構成違反環評條例的規定,而當局可根據條例採取適當行動。

 

1.2       The Permit Holder shall ensure full compliance with all legislation from time to time in force including without limitation the Noise Control Ordinance (Cap. 400), Air Pollution Control Ordinance (Cap. 311), Water Pollution Control Ordinance (Cap. 358), Dumping at Sea Ordinance (Cap. 466) and Waste Disposal Ordinance (Cap. 354).  This Permit does not of itself constitute any ground of defense against any proceedings instituted under any legislation.

許可證持有人須時常確保完全符合現行法例的規定,包括但不限於噪音管制條例(400);空氣污染管制條例(311);水污染管制條例(358)、海上傾倒物料條例(466)及廢物處置條例(354)。本許可證本身不會就根據任何法例提起的法律程序構成任何抗辯理由。

 

1.3       The Permit Holder shall make copies of this Permit together with all documents referred to in this Permit or the documents referred to in Part A of the Permit readily available at all times for inspection by the Director or his authorized officers at all sites/offices covered by this Permit.  Any reference to the Permit shall include all documents referred to in the Permit and also the relevant documents in the Register.

許可證持有人須印製本許可證的複本,連同本許可證所述的所有文件或本許可證A部所述文件,以供署長或獲授權人員任何時間內在本許可證所涵蓋的所有工地/辦事處查閱。凡提述本許可證,須包括本許可證所述的所有文件和登記冊內的相關文件。

 

1.4       The Permit Holder shall give a copy of this Permit to the person(s) in charge of the site(s) and ensure that such person(s) fully understands all conditions and all requirements incorporated by the Permit.

            許可證持有人須將本許可證的一份複本交予有關工地的負責人,並確保這些人士完全明白本許可證的所有條件與規定。

 

1.5       The Permit Holder shall display conspicuously a copy of this Permit on the construction site(s) at all vehicular site entrances/exits or at a convenient location for public information at all times.  The Permit Holder shall ensure that the most updated information about the Permit, including any amended permit, is displayed at such locations. If the Permit Holder surrenders a part or the whole of the Permit, the notice he sends to the Director shall also be displayed at the same locations as the original Permit. The suspended, varied or cancelled Permit shall be removed from display at the construction site.

            許可證持有人須在有關建造工地的所有車輛進出口或一處方便地點,顯眼地展示本許可證的複本,以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於本許可證(包括任何經修訂的許可證)的最新資料。如果許可證持有人交回許可證的部分或全部,須將其送交署長的通知書,在備有原本許可證的各處相同地點展示。遭暫時吊銷、更改或取消的許可證必須在建造工地除下,不再展示。

 

 

1.6       The Permit Holder shall construct and operate the Project in accordance with the project descriptions in Part B of this Permit.

            許可證持有人須依據本許可證B部的說明,建造及營辦工程項目。

 

1.7       The Permit Holder shall ensure that the Project is designed, constructed and operated in accordance with the information and all recommendations described in the EIA Report (Register No. AEIAR‑018/1999); the Supplementary Information; and other relevant documents in the Register; and the information or mitigation measures described in this Permit, or mitigation measures to be recommended in submissions that shall be deposited with or approved by the Director as a result of permit conditions contained in this Permit, or mitigation measures to be recommended under on going surveillance and monitoring activities during all stages of the Project.  Where recommendations referred to in the documents of the Register are not expressly referred to in this Permit, such recommendations are nevertheless to be implemented unless expressly excluded or impliedly amended in this Permit.

許可證持有人須確保工程項目的設計、建造及營辦,按照下述資料及措施辦理:環評報告說明的資料及所有建議;補充資料; 登記冊內的其他相關文件;及本許可證所說明的資料或緩解措施,或根據本許可證內載的條件須向署長存放或獲署長批准的提交文件所建議的緩解措施;或在工程項目各階段進行的持續監察和監測工作所建議的緩解措施。 如登記冊文件所述建議沒有在本許可證明確表示,則仍須實施這些建議,除非獲本許可證明確豁除或默示修訂。

 

1.8       All deposited submissions, as required under this Permit, shall be rectified and resubmitted in accordance with the comments, if any, made by the Director within one month of the receipt of the Director’s comments or otherwise as specified by the Director.

所有按本許可證規定存放的文件,須在接獲署長的意見(如有者)後一個月內(除非署長另行指定),根據署長的意見加以修正及提交文件

 

1.9       All submissions approved by the Director, all submissions deposited without comments by the Director, or all submissions rectified in accordance with comments by the Director under this Permit shall be construed as part of the permit conditions described in Part C of this Permit. Any variation of the submissions shall be approved by the Director in writing or as prescribed in the relevant permit conditions.  Any non-compliance with the submissions may constitute a contravention of the Environmental Impact Assessment Ordinance.

署長批准的所有提交文件、署長沒有給予意見的所有存放文件,或根據本許可證規定由署長給予意見修訂的所有提交文件,均須詮釋為本許可證C部說明的許可證條件的一部分。 提交文件如有任何修訂,均須獲署長的書面批准或符合有關許可證條件訂明的規定。 如有不符合提交文件的情況,可能構成違反環境影響評估條例的規定。

 

1.10     The Permit Holder shall release all finalized submissions, as required under this Permit, to the public by depositing copies in the Environmental Impact Assessment Ordinance Register Office, or in any other places, or any internet websites as specified by the Director, or by any other means as specified by the Director for public inspection.  For this purpose, the Permit Holder shall provide sufficient copies of the submissions.

許可證持有人須把所有按本許可證規定提交的文件定稿公開給公眾人士知道,方法是將有關文件複本存放於環境影響評估條例登記冊辦事處,或署長指定的任何其他地方,或署長指定的任何互聯網網站,或採取其指定的任何其他方法,以供公眾查閱。證持有人須提供足夠數量的複本。

 

1.11     The Permit Holder shall notify the Director in writing the commencement date of construction of each Phase of the Project no later than 2 weeks prior to the date of commencement of construction of the Project. The Phases of the Project are shown in Figure 1 of this Environmental Permit. The Permit Holder shall notify the Director in writing immediately if there is any change of the commencement date of the construction.

許可證持有人須在展開建造工程之前,至少提早2個星期以書面方式把每期建造工程的施工日期通知署長。每期的建造工程載於本環境許可證圖1。如施工日期有任何更改,許可證持有人必須立即以書面方式通知署長。

 

1.12     All submissions to the Director required under this Permit shall be delivered either in person or by registered mail to the Environmental Impact Assessment Ordinance Register Office (currently at 27/F, Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong).

本許可證規定向署長提交的所有文件,須親身送交或以掛號方式郵寄至環境影響評估條例登記冊辦事處(現址為:香港灣仔軒尼詩道130號修頓中心27)

 

2.         Submissions or Measures for the Construction of the Project

建造工程項目所需提交的文件或採取的措施

 

2.1       An Environmental Team (ET) shall be established no later than 2 months before the commencement of construction of the Project. The ET shall be headed by the ET Leader who shall have at least 7 years' experience in environmental monitoring and audit (EM&A) or environmental management. The ET Leader shall be responsible for the implementation of the EM&A programme in accordance with the EM&A requirements as contained in the EM&A Manual. In addition, the ET Leader shall be responsible for certifying the environmental acceptability of permanent and temporary works, relevant design plans and submissions under the Permit.

在展開建造工程前,須至少提早兩個月成立一個環境小組。環境小組須由一名在環境監察及審核或環境管理方面至少有7年經驗的環境小組組長督導。環境小組組長須依據環境監察及審核手冊內載的環境監察及審核規定,實施有關環境監察及審核計劃。此外,環境小組組長須核證永久及臨時工程在環境上的可接受程度、相關的設計圖則和本許可證所要求提交的文件。

 

2.2       An Independent Environmental Checker (IEC) shall be employed no later than 2 months before the commencement of construction of the Project. The IEC shall have at least 7 years' experience in EM&A or environmental management. The IEC shall audit the overall EM&A programme including the implementation of all environmental mitigation measures, submissions relating to EM&A, and any other submissions required under this Permit. In addition, the IEC shall be responsible for verifying the environmental acceptability of permanent and temporary works, relevant design plans and submissions under this Permit.

在展開建造工程之前,須至少提早兩個月聘用一名獨立環境查核人。該名獨立環境查核人須在環境監察及審核或環境管理方面至少有7年經驗。獨立環境查核人須審核整體的環境監察及審核計劃,包括實施所有環境緩解措施、提交有關環境監察及審核的文件,以及提交本許可證所要求的其他文件。此外,獨立環境查核人須核實永久及臨時工程在環境上的可接受程度、相關的設計圖則和本許可證所要求提交的文件。

 

2.3       The Permit Holder shall, within 4 weeks after the commencement of construction of each Phase of the Project, inform the Director in writing of the management organization of the main construction companies and/or any form of joint ventures associated with the construction of the Project. The submitted information shall include at least an organization chart, names of responsible persons and their contact details.

許可證持有人須在每期建造工程展開後4個星期內,把主要建築公司及/或與工程項目相關任何形式的合營企業的管理架構,以書面通知署長。提交的資料須至少包括一份組織圖、負責人的姓名及聯絡資料。

 

2.4       Three sets of Waste Management Plan for the construction stage of the Project shall be submitted to the Director for approval no later than 4 weeks after the commencement of construction of each Phase of the Project. The Plan shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the EIA Report and the Supplementary Information. The Plan shall describe the arrangements for avoidance, reuse, recovery and recycling, storage, collection, treatment and disposal of different categories of waste to be generated from the construction activities and shall include the recommended mitigation measures on waste management in Section 7.9 and Section 11 of the EIA Report. Such a Plan shall include the designated of areas for segregation and temporary storage of reusable and recyclable materials. All measures in the approved Plan shall be fully implemented throughout the construction period.

每期建造工程展開後,許可證持有人須不得遲於4個星期內把3套工程項目建造階段的廢物管理計劃提交署長批准。計劃須由環境小組組長核證及獨立環境查核人核實,證明其符合環評報告補充資料內載的資料及計劃。計劃須說明建造作業所產生各類廢物的避免產生、再使用、回收、循環再造、貯存、收集、處理及棄置安排,並須包括環評報告第7.911節所建議的廢物管理緩解措施。計劃須包括劃定再用及再造物料的分隔及臨時貯存地方。在整段建造工程期間,須完全執行獲准計劃內載的所有措施。

 

2.5       The Permit Holder shall conduct a traffic study of the Shell (Hong Kong) and Caltex (Hong Kong) Ltd depots exist at Sai Tso Wan and the Sai Tso Wan Road/Tsing Yi Road Junction to investigate the traffic flow and improvement required to reduce risks due to Liquified Petroleum Gas (LPG) tanker movements. The Permit Holder shall obtain agreement from the Director on the scope, approach, methodology and programme of the study before commencement of the aforesaid study. Based on the findings of the study, the Permit Holder shall prepare a proposal for carrying the improvement work and submit three copies of the proposal to the Director for approval no later than 8 weeks before commencement of construction work for any part of the Project other than Phase 1. The proposals shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the aforesaid study.

許可證持有人須為設於西草灣及西草灣路/青衣路交匯處的蜆殼(香港)有限公司車廠及加德士(香港)有限公司車廠進行一項交通研究,以計算交通流量及為減輕石油氣運油車行駛引致的風險所需的改善工作。許可證持有人須就研究範圍、取向、方法及計劃方面先獲署長同意,然後才能展開上述研究。在工程項目(1期除外)任何部分的建造工程展開前,許可證持有人須至少提早8個星期,依據研究結果擬備有關實施改善工程的方案,並把三份複本提交署長批准。有關方案須由環境小組組長核證及獨立環境查核人核實,證明其符合上述研究所載的資料及建議。

 

2.6       The Permit Holder shall carried out a detailed analysis to identify the requirement for Boiling Liquid Expanding Vapour Explosion (BLEVE) walls at the Route 9 to protect the road users.  The Permit Holder shall obtain agreement from the Director on the scope, approach, methodology and programme of the analysis before commencement of the aforesaid analysis. Based on the findings of the analysis, the Permit Holder shall prepare a proposal for carrying the recommendations and submit three copies of the proposal to the Director for approval no later than 8 weeks before commencement of construction work for any part of the Project other than Phase 1. The proposals shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the aforesaid analysis.

許可證持有人須進行一項詳細分析,以確定是否需要在九號幹線設置可阻隔沸騰液汽化膨脹爆炸(BLEVE)的牆壁,以保障道路使用者。許可證持有人須就研究範圍、取向、方法及計劃方面先獲署長同意,然後才能展開上述分析。在工程項目(1期除外)任何部分的建造工程展開前,許可證持有人須至少提早8個星期,依據分析結果擬備有關實施提議的方案,並把三份複本提交署長批准。有關方案須由環境小組組長核證及獨立環境查核人核實,證明其符合上述建議所載的資料及建議。

 

            Measures to Mitigate Water Quality Impacts during Construction

            在建造工程採取的水質影響緩解措施

 

2.7       To protect the water quality of the stream at the Eastern Portal of the Nam Wan Tunnel, all surface run-off from Phase 2 of the Project shall be collected, treated by silt traps and oil and grit interceptors and discharged into storm drains. No discharge to the stream shall be allowed.

為保障南灣隧道東面入口處的河溪水質,第2期工程產生的所有地面徑流均須妥為收集、流經隔泥池、油及砂礫截流裝置作處理,然後才排入雨水渠,不得排入河溪。

 

 

2.8       To prevent spilled oil, fuel and chemicals from reaching the receiving waters, all vehicle and plant servicing, vehicle wash bays and lubrication bays shall be sheltered from rain water and the drainage in these areas shall be connected to storm drains via a petrol interceptor.

為免溢出的油、燃料及化學品接觸接收水體,所有車輛及設備維修設施、清洗池及加潤滑劑的坑道均須可以遮擋雨水,而這些地方的排水系統須先接上截油器然後才接駁至雨水渠。

 

2.9      To mitigate environmental impacts due to site runoff and other potential water pollution caused by construction activities, mitigation measures described in Appendix A shall be implemented throughout the construction period.

為減輕工地徑流及建造作業所可能造成的其他水污染問題的環境影響,須在整段建造工程期間執行附錄A說明的緩解措施。

 

Measures to Mitigate Risk associated with nearby LPG Facilities during Construction

            在建造工程期間緩解與鄰近石油氣設施相關風險的措施

 

2.10     The Permit Holder shall submit three sets of procedures and event action plans to the Director for approval no later than 8 weeks prior to construction of Phase 2 of the Project. The procedures and event plans shall cover rapid cessation of construction activities due to major accidents at the nearby oil terminals and LPG facilities. The procedures and event action plans shall be fully implemented throughout the construction period.

許可證持有人須在第2期建造工程展開前,至少提早8個星期把三套程序及事件行動計劃提交署長批准。程序及事件計劃須涵蓋因鄰近油庫及石油氣設施發生嚴重事故而引致建造作業立刻停工。程序及事件行動計劃須在整段建造工程期間完全執行。

 

3.         Submission or Measures for the Operation of the Project

            營辦工程項目所需提交的文件或採取的措施

 

Measures to Mitigate Noise during Operation

            營辦工程項目期間的噪音緩解措施

 

3.1       The following measures shall be constructed prior to the operation of the Project

            在營辦工程項目前須執行下述措施:

               

(i)       low noise surfacing on all the new roads except the Route 9 sliproads linking to Container Terminal 9 at Tsing Yi Island and Stonecutters Bridge.

在所有新路鋪築低噪音路面,連接青衣九號貨櫃碼頭的一段九號幹線支路及昂船洲大橋則除外。

 

(ii)      noise barriers of 3 metres high and along the main carriageways as shown in Figure 2 and 3.

          圖23所示沿主要行車道設置3米高的隔音屏障。

 

(iii)     noise barriers of 5.1 metres high with 2.8 metres cantilever noise barriers and along the main carriageways as shown in Figures 4 and 5.

          圖45所示沿主要行車道設置5.1米高連2.8米高懸臂式的隔音屏障。

 

 

    Measures to Mitigate Risk associated with nearby LPG Facilities during Operation

            營辦工程項目期間鄰近石油氣設施構成危險的緩解措施

 

3.2       The measures recommended in the approved proposal submitted under Condition 2.5 of this Permit shall be fully implemented prior to operation of the Project.

            根據本許可證條件第2.5項規定提交並獲批准的建議所提出的各項措施,須在營辦工程項目前完全執行。

 

3.3       The measures recommended in the approved proposal submitted under Condition 2.6 of this Permit shall be fully implemented prior to operation of the Project.

根據本許可證條件第2.6項規定提交並獲批准的建議所提出的各項措施,須在營辦工程項目前完全執行。

 

3.4       The Permit Holder shall prepare emergency response plans and submit three copies each of the plans to the Director for approval no later than 8 weeks before operation of the Project. The plans shall include traffic management measures to close Route 9 in case of emergency of major accidents at the nearby oil and LPG terminals. The plan shall be fully implemented during operation of the Project.

許可證持有人須在營辦工程項目前,至少提早8星期擬備緊急應變計劃及把每項計劃的3份複本提交署長批准。計劃須涵蓋萬一鄰近油庫及石油氣庫發生嚴重緊急事故而須封閉九號幹線的相應交通管理安排。這計劃須在營辦工程項目期間完全執行。

 

4          Environmental Monitoring and Audit (EM&A) Requirements during Construction of the Project

建造工程期間的環境監察及審核

 

4.1       An EM&A programme shall be implemented as set out in the EM&A Manual which forms part of the EIA Report (Register No. AEIAR-018/1999). Any change to the programme shall be justified by the ET Leader as conforming to the requirements set out in the EM&A Manual and information contained in the EIA before submission to the Director for approval.

環境監察及審核計劃須按環評報告(登記冊編號AEIAR-018/1999)的環境監察及審核手冊的規定執行。計劃如有任何更改,須由環境小組組長提供充分理由,證明其符合環境監察及審核手冊的規定及環評報告的資料,然後才提交署長批准。

 

4.2       Samples and measurements shall be taken in accordance with the requirements of the EM&A Manual by :

            須依據環境監察及審核手冊內載規定,進行採樣和量度工作:

 

(i)                  conducting baseline environmental monitoring as set out in the EM&A Manual; and

            進行環境監察及審核手冊所載的環境基線監測;及

 

(ii)        conducting impact environmental monitoring as set out in the EM&A Manual.

            進行環境監察及審核手冊所載的環境影響監測。

4.3       The remedial actions described in the Event/Action Plans of the EM&A Manual shall be fully and properly carried out, in accordance with the time frame(s) set out in the Event/Action Plans, or as agreed by the Director.

環境監察及審核手冊的事件/行動計劃所說明的補救行動,須按照事件/行動計劃所訂明的時限或如署長所同意,完全及妥善執行。

4.4       Records of measurements and remedial actions taken under Conditions 4.2 and 4.3 respectively of this Permit shall be logged and kept, within 3 working days of the collection of data or completion of remedial action, for the purpose of preparing and submitting the EM&A Reports and making the information available for inspection on site.

在收集數據或完成補救行動後3個工作天內記錄及保存本許可證條件第4.24.3項的詳情,用作擬備和提交環境監察及審核報告,並備妥有關資料以便在工地查閱。

4.5       Two hard copies and one soft copy of the Baseline Monitoring Report shall be submitted to the Director no later than 2 weeks before the commencement of construction of each Phase of the Project. The submissions shall be certified by the ET Leader and verified by the IEC. Additional copies of the submission shall be provided to the Director upon request by the Director.

每期工程項目的建造工程開展前,須至少提早2個星期向署長提交基線監測報告的兩份硬複本和一份軟複本。報告須由環境小組組長核證及獨立環境查核人核實。如署長要求,須把報告的額外複本送交署長。

 

4.6       One hard copy and one soft copy of monthly EM&A Report shall be submitted to the Director within 2 weeks after the end of the reporting month. The EM&A Reports shall include a summary of all noncompliance (exceedances) of the environmental quality performance limits (Action and Limit levels). The submissions shall be certified by the ET Leader and verified by the IEC. Additional copies of the submission shall be provided to the Director upon request by the Director.

在須提交報告的月份結束後兩個星期內,須向署長提交每月環境監察及審核報告的一份硬複本和一份軟複本。環境監察及審核報告須包括所有不符合(超出)環境質素表現規限(行動及極限水平)個案的摘要。報告須由環境小組組長核證及獨立環境查核人核實。如署長要求,須把報告的額外複本送交署長。

4.7       All environmental monitoring and audit data submitted under this Permit shall be true, valid and correct.

根據本許可證提交的所有環境監察及審核數據,均須真實無誤。

4.8              The Permit Holder shall relay all environmental complaints regarding construction works to the Environmental Team.

許可證持有人須把所有有關建造工程的環境問題投訴,轉介環境小組。

 

5.         Environmental Monitoring and Audit Requirements during Operation of the Project

營辦工程項目期間的環境監察及審核規定

 

 

5.1       The Permit Holder shall undertake an Operational Noise Monitoring Programme as set out in the operational monitoring plan as per Section 9.1.2 of the EIA report and in the EM&A Manual.

許可證持有人須按環評報告第9.1.2節規定的營辦工程項目監察計劃及環境監察及審核手冊所載,執行營辦工程項目噪音監測計劃。

 

 

6.         Electronic Reporting of EM&A Information

                環境監察及審核資料的電子匯報

 

6.1       To facilitate public inspection of the Baseline Monitoring Report and monthly EM&A Reports via the EIAO Internet Website and at the EIAO Register Office, electronic copies of these Reports shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF version 4.0 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hard copies as described in Conditions 4 and 5 of this Permit. For the HTML version, a content page capable of providing hyperlink to each section and sub-section of these Reports shall be included in the beginning of the document. Hyperlinks to all figures, drawings and tables in these Reports shall be provided in the main text from where the respective references are made. All graphics in these Reports shall be in interlaced GIF format unless otherwise agreed by the Director. The content of the electronic copies of these Reports must be the same as the hard copies.

為方便公眾透過環評條例互聯網網站和在環境影響評估條例登記冊辦事處查閱基線監測報告及每月環境監察及審核報告,以超文本標示語言(HTML)(4.0或較後版本)和便攜式文件格式(PDF)(4.0或較後版本)製作的報告的軟複本,除非另獲署長同意,須與本許可證條件第45項所說明的硬複本同時提交。關於HTML的版本方面,可與這些報告各節及小節作出超文本連結的目錄須在文件開端加入。報告內各類圖表須在載有相關資料的正文內進行超文本連結。除非另獲署長同意,報告內所有圖形均須以交錯存取的GIF格式製定。報告的軟複本內容,必須與硬複本的內容一致。

6.2       All environmental monitoring data contained in the EM&A Reports submitted under Conditions 4 and 5 of this Permit shall be made available to the public via internet access in the form of a website, in the shortest possible time and in no event later than two weeks after the relevant environmental monitoring data are collected or become available, unless otherwise agreed with the Director. The Permit Holder shall notify the Director in writing at least 2 weeks before the commissioning of each Phase of the Project the internet address where the environmental monitoring data are to be placed. The internet website shall be made accessible to the public via a hyperlink at the EIAO Internet Website.

本許可證條件第45項規定提交的環境監察及審核報告內載的所有環境監察數據,均須盡快以設立網站方式供公眾透過互聯網接達,在任何情況下均不得遲於有關環境監察數據收集或可供瀏覽後的兩星期,除非另獲署長同意。許可證持有人須在每期工程項目營辦後2個星期內,以書面通知署長將會存放環境監察數據的網址所在。互聯網網站須透過超文本連結方式設於環評條例互聯網網站,供公眾查閱。

6.3       The internet website required in Condition 6.2 of this Permit shall enable user friendly public access to the monitoring data and with features capable of :

本許可證條件第6.2項所規定的互聯網網站,必須方便用戶使用,讓公眾容易接達監察數據,並具備部件,提供下述功能:

 

(i)         providing access to environmental monitoring data collected since the commencement of works;

(iii)       searching by types of monitoring data (air quality, water quality and noise, etc.); and

1.         This Permit consists of three parts, namely, PART A (Main Permit), PART B (Description of Designated Project) and PART C (Permit Conditions).  Any person relying on this permit should obtain independent legal advice on the legal implications under the Ordinance, and the following notes are for general information only.

            本許可證共有3部,即:A部(許可證主要部分);B部(指定工程項目的說明)及C部(許可證條件)。任何援引本許可證的人士須就條例的法律含意徵詢獨立法律意見,下述註解只供一般參考用。

 

2.         The Permit Holder may apply under Section 13 of the Ordinance to the Director for a variation of the conditions of this Permit. The Permit Holder shall replace the original permit displayed on the construction site by the amended permit.

            許可證持有人可根據條例第13條的規定向署長申請更改本許可證的條件。許可證持有人須將經修改的許可證,替換在建造工地內展示的原有許可證。

 

3.         A person who assumes the responsibility for the whole or a part of the designated project may, before he assumes responsibility of the designated project, apply under Section 12 of the Ordinance to the Director for a further environmental permit.

            承擔指定工程項目的整項或部分工程的責任的人,在承擔指定工程項目責任之前,可根據條例第12條的規定向署長申請新的環境許可證。

 

4.         Under Section 14 of the Ordinance, the Director may with the consent of the Secretary for the Environment, suspend, vary or cancel this Permit.  The suspended, varied or cancelled Permit shall be removed from display at the construction site.

            根據條例第14條的規定,署長可在環境局局長的同意下暫時吊銷、更改或取消環境許可證。遭暫時吊銷、更改或取消的許可證必須從建造工地除下,不再展示。

 

5.         If this Permit is cancelled or surrendered during construction or operation of the Project, another environmental permit must be obtained under the Ordinance before the Project could be continued. It is an offence under Section 26(1) of the Ordinance to construct or operate a designated project listed in Part I of Schedule 2 of the Ordinance without a valid environmental permit.

如果本許可證在工程項目建造或營辦期間取消或交回,則在繼續進行工程項目之前,必須先根據條例規定取得環境許可證。根據條例第26(1)條的規定,任何人在沒有有效環境許可證的情況下建造或營辦條例附表2I部所列明的指定工程項目,即屬犯罪。

 

6.         Any person who constructs or operates the Project contrary to the conditions in the Permit, and is convicted of an offence under the Ordinance, is liable: -

            如任何人在違反本許可證的條件下建造及營辦工程項目,根據環評條例,即屬犯罪—

 

(i)              on a first conviction on indictment to a fine of $ 2 million and to imprisonment for 6 months;

                      一經循公訴程序首次定罪,可處罰款200萬元及監禁6個月;

 

(ii)            on a second or subsequent conviction on indictment to a fine of $ 5 million and to imprisonment for 2 years;

                      一經循公訴程序第二次或其後每次定罪,可處罰款500萬元及監禁2年;

 

(iii)     on a first summary conviction to a fine at level 6 and to imprisonment for 6 months;

一經循簡易程序首次定罪,可處第6級罰款及監禁6個月;

 

(iv)     on a second or subsequent summary conviction to a fine of $1 million and to imprisonment for 1 year; and

一經循簡易程序第二次或其後每次定罪,可處罰款100萬元及監禁1年;及

 

(v)      in any case where the offence is of a continuing nature, the court or magistrate may impose a fine of $ 10,000 for each day on which he is satisfied the offence continued.

7.         The Permit Holder may appeal against any condition of this Permit under Section 17 of the Ordinance within 30 days of receipt of this Permit.

Measures to Mitigate Environmental Impacts due to Site Run-off and Other Potential Water Pollution During Construction

建造工程期間工地徑流和其他潛在水質污染物的環境影響緩解措施

(a)        Surface Runoff

                地面徑流

(i)         Surface run-off from the construction site shall be directed into adequately designed sand/silt removal facilities such as sand traps, silt traps and sediment basins before discharge into storm drains. Channels, earth bunds or sand bag barriers shall be provided on site to properly direct stormwater to such silt removal facilities.

建造工地的地面徑流須流經妥為設計的泥沙/淤泥清除設施(如在適當位置裝設隔沙池、隔泥池及沉澱池)才排入雨水渠。工地內須設排水道、土堤及沙包防護屏障,以便把雨水妥為導引排入這些淤泥清除設施。

(ii)        Catchpits and perimeter channels shall be constructed in advance of site formation works and earthworks.

須在進行工地平整工程和土木工事之前,先行建造截水井及周邊水道。

(iii)       Silt removal facilities, channels and manholes shall be suitably maintained with the deposited silt and grit being removed at least once a week, and at the onset of and after each rainstorm to ensure that these facilities are functioning properly at all times.

淤泥清除設施、排水道及沙井均須修護,至少1星期清理一次沉積的淤泥及砂礫,在暴雨開始落下和結束之後,都要確保這些設施在任何時間內能妥當發揮作用。

(iv)       Earthworks final surfaces shall be well compacted and the subsequent permanent work or surface protection shall be carried out immediately after the final surfaces are formed to prevent erosion caused by rainstorms. Appropriate intercepting channels shall be provided along the site boundary or at the locations agreed with the IEC. Rainwater pumped out from trenches or foundation excavations shall be discharged into silt removal facilities before discharge into storm drains.

土木工事最終表層須密封,其後的永久工程或表層保護工程,須在最終表層形後立即進行,以免受雨水侵蝕。須沿土地界線或環境查核人同意的地方敷設合適的截流渠。掘坑或挖掘地基工程所抽出的雨水須先流經淤泥清除設施後,才排入雨水渠。

(v)        Open stockpiles of construction materials (e.g. aggregates and sand) on site shall be covered with tarpaulin or similar fabric during rainstorms. Measures such as providing sand bag barriers shall be taken to prevent the washing away of construction materials, soil, silt or debris into any drainage system.

在暴雨期間,露天堆存的建築材料(如石料及沙),須用帆布或同類物料覆蓋。應採取措施如設沙包作屏障,以防止建築物料、泥土、淤泥或碎屑沖入任何排水系統。

(vi)       All generators, fuel and oil storage shall be within bunded areas. Drainage from the areas shall be connected to storm drains via a petrol interceptor. Tunnel discharges shall be connected to oil interceptors prior to discharging to the stormdrains.

所有發電機、燃料及油均須貯存在堤圍範圍內。這些地方的排水系統須先接上截油器然後才接駁至雨水渠。隧道排放的污水須先流經截油器,然後才排入雨水渠。

 

(b)               General Construction Activities

一般建造作業活動

At all parts of all works areas and construction sites, and throughout the full duration of the construction contract(s), debris and rubbish on site shall be handled and disposed of to avoid entering the water column and causing water quality impacts. Temporary on-site storage of excavated materials from construction works shall be covered with tarpaulin or similar fabric during rainstorms. Any washout of construction or excavated materials should be diverted to the drainage system via sediment traps. Stockpiling of the excavated material shall be minimised by scheduling the construction programme in a way that one section of the alignment can be constructed and completed before the excavation works of the next section commence.

在各工地和建造工地的所有範圍,以及在整段建造合約期間,工地的碎屑和垃圾必須妥為處理及處置,以免混入水中,造成水質影響。建造工程的挖出物料的臨時實地存放地方,在暴雨期間須用帆布或同類物料覆蓋。任何來自建造或挖出物料的沖刷物應經沉積物捕集裝置導流至排水系統。妥善編排建造工程的程序,先建造及完成一段路線,才展開下一段路線的挖掘工作,便可減少挖出物料的堆存量。
