Pursuant to Section 10 of the Environmental Impact Assessment Ordinance (the Ordinance), the Director of Environmental Protection (the Director) granted the Environmental Permit to CIVIL ENGINEERING AND DEVELOPMENT DEPARTMENT (hereinafter referred to as the "Permit Holder") on 1 March 2002. Pursuant to Section 13 of the Ordinance, the Director amends the Environmental Permit (EP-121/2002) based on the Application No. VEP-284/2009. The amendments, described below, are incorporated into this Environmental Permit (EP-121/2002/A). This Environmental Permit as amended is for the decommission of the designated project described in Part B of this Permit subject to the conditions described in or attached to Part C of this Permit.

The demolition of a municipal incinerator including remediation of contaminated soil, and contaminated ash within an ash bunker, and subsequent disposal of remediated contaminants.

Scale and Scope of Designated Project(s)

Demolition of a municipal incinerator within an area of 1.4 ha. comprising:

(a) demolition of main plant building, measuring
90m x 70m x 45m high;

(b) demolition of a
150 m high chimney;

(c) demolition of 2-storey high administrative/storage buildings, and other ancillary structures; and

(d) remediation of contaminated soil, and contaminated ash within an ash bunker, and subsequent disposal of remediated contaminants.

拆卸一個面積1.4公頃的市政焚化爐包括 :

拆缷一個九十米長七十米寬及四十五米高的主要廠房 ;

PART C (PERMIT CONDITIONS)

1.         General Conditions

 

1.1        The Permit Holder and any person working on the Project shall comply with all conditions set out in this environmental permit.  Any non-compliance by any person may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap.499) and may become the subject of appropriate action being taken under the Ordinance.

許可證持有人及任何從事工程項目的人士必須符合本許可證載列的全部條件。任何人士如有不符合本許可證的情況,可能違反環境影響評估條例 (「環評條例」) (499) 的規定,而當局可根據條例採取適當行動。

 

1.2        The Permit Holder shall ensure full compliance with all legislation from time to time in force including without limitation the Noise Control Ordinance (Cap.400), Air Pollution Control Ordinance (Cap.311), Water Pollution control Ordinance (Cap.358), Dumping at Sea Ordinance (Cap.466), the Waste Disposal Ordinance (Cap.354).  This Permit does not of itself constitute any ground of defense against any proceedings instituted under any legislation or imply any approval under any legislation.

許可證持有人須經常確保完全符合現行法例的規定,包括但不限於噪音管制條例(400);空氣污染管制條例(311);水污染管制條例(358);海上傾倒物料條例(第466章);以及廢物處置條例(354)。本許可證本身不會就根據任何法例提起的法律程式構成任何抗辯理由,或根據任何法例默示任何批准。

 

1.3        The Permit Holder shall make copies of this Permit together with all documents referred to in this Permit or the documents referred to in Part A of the Permit readily available at all times for inspection by the Director or his authorized officers at all sites/offices covered by this Permit.  Any reference to the Permit shall include all documents referred to in the Permit and also the relevant documents in the Register.

許可證持有人須印製本許可證的複本,連同本許可證所述的所有文件及本許可證A所述文件,以供署長或獲授權人員任何時間內在本許可證所涵蓋的所有工地 / 辦事處查閱。凡提述本許可證,須包括本許可證所述的所有文件及登記冊內的相關文件。

 

1.4       The Permit Holder shall give a copy of this Permit to the person(s) in charge of the site(s) and ensure that such person(s) fully understands all conditions and all requirements incorporated by the Permit.  The site(s) refers to the site(s) of the decommissioning of the Project and should mean the same hereinafter.

許可證持有人須把本許可證的複本交予有關工地的負責人,並確保這些人士完全明白本許可證的所有條件與規定。工地是指解除工程項目運作的工地,下文所提及的工地亦屬同一意思。

 

1.5       The Permit Holder shall display conspicuously a copy of this Permit on the construction site(s) at all vehicular site entrances/exits or at a convenient location for public information at all times.  The Permit Holder shall ensure that the most updated information about the Permit, including any amended permit, is displayed at such locations.  If the Permit Holder surrenders a part or the whole of the Permit, the notice he sends to the Director shall also be displayed at the same locations as the original Permit.  The suspended, varied or cancelled Permit shall be removed from display at the construction site.

許可證持有人須在工程項目的工地的所有車輛進出口或一處方便地點,顯眼地展示本許可證的複本,以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於本許可證 (包括任何經修訂的許可證) 的最新資料。許可證持有人如交回許可證的部分或全部,必須把其送交署長的通知書,在備有原有許可證的相同地點展示。遭暫時吊銷、更改或取消的許可證必須從工程項目的工地除下,不再展示。

 

1.6       The Permit Holder shall decommission the Project in accordance with the project descriptions in Part B of this Permit.

許可證持有人須依據本許可證B的工程項目說明,解除工程項目的運作。

 

1.7       The Permit Holder shall ensure that the Project is designed and decommissioned in accordance with the information and all recommendations described in the EIA Report (Register No. AEIAR-049/2002),and other relevant documents in the Register; the information and mitigation measures described in this Permit, and mitigation measures to be recommended in submissions that shall be deposited with or approved by the Director as a result of permit conditions contained in this Permit, and mitigation measures to be recommended under on going surveillance and monitoring activities during all stages of the Project.  Where recommendations referred to in the documents of the Register are not expressly referred to in this Permit, such recommendations are nevertheless to be implemented unless expressly excluded or impliedly amended in this Permit.

許可證持有人須確保工程項目的設計及解除運作,按照下述資料及措施辦理:環評報告(登記冊編號:AEIAR-049/2002)所說明的資料及所有建議;登記冊內的其他相關文件;本許可證所說明的資料及緩解措施;根據本許可證內載的條件須向署長存放或獲署長批准的提交文件所建議的緩解措施;以及在工程項目各階段進行的持續監察及監測工作所建議的緩解措施。登記冊文件所述建議如沒有在本許可證明確表示,則仍須實施這些建議,除非獲本許可證明確豁除或默示修訂。

 

1.8       All submissions, as required under this Permit, shall be rectified and resubmitted in accordance with the comments, if any, made by the Director within one month of the receipt of the Director's comments or otherwise as specified by the Director.

            所有按本許可證規定存放的文件,須在接獲署長的意見 (如有者) 1個月內 (除非署長另行指定),根據署長的意見加以修正並再向署長提交。

 

1.9       All submissions approved by the Director, all submissions deposited without comments by the Director, and all submissions rectified in accordance with comments by the Director under this Permit shall be construed as part of the permit conditions described in Part C of this Permit.  Any variation of the submissions shall be approved by the Director in writing or as prescribed in the relevant permit conditions.  Any non-compliance with the submissions may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499).  All submissions or any variation of the submissions shall be certified by the Environmental Team (ET) Leader and verified by the Independent Environmental Checker (IEC) referred to in Condition 2.1 & 2.2 below, before submitting to the Director under this Permit.

            署長批准的所有提交文件、署長沒有給予意見的所有存放文件及根據本許可證規定由署長給予意見修正的所有提交文件,均須詮釋為本許可證C 說明的許可證條件的一部分。提交文件如有任何修訂,均須獲署長的書面批准,或符合有關許可證條件訂明的規定。如有不符合提交文件的情況,則可能違反環境影響評估條例 (499) 的規定。所有提交文件或提交文件的任何修訂本,均須按下文條件第2.12.2項所述由環境小組組長核證及獨立環境查核人核實,然後才按本許可證規定向署長提交。

 

1.10     The Permit Holder shall release all finalized submissions, as required under this Permit, to the public by depositing copies in the Environmental Impact Assessment Ordinance Register Office, or in any other places, or any internet websites as specified by the Director, or by any other means as specified by the Director for public inspection.  For this purpose, the Permit Holder shall provide sufficient copies of the submissions.

            許可證持有人須把所有按本許可證規定提交的文件定稿公開給公眾人士知道,方法是把有關文件複本存放於環境影響評估條例登記冊辦事處,或署長指定的任何其他地方,或署長指定的任何互聯網網站,或採取署長指定的任何其他方法,以供公眾查閱。因此,許可證持有人須提供足夠數量的複本。

 

1.11     The Permit Holder shall notify the Director in writing the commencement date of decommissioning of the Project at least one month before commencement of decommissioning of the Project. The Permit Holder shall notify the Director in writing immediately if there is any change of the commencement date of the construction.

            許可證持有人須在工程項目的解除運作工程展開前,至少提早一個月前以書面方式把解除運作工程的施工日期通知署長。施工日期如有任何更改,許可證持有人必須立即以書面方式通知署長。

 

1.12     All submissions to the Director required under this Permit shall be delivered either in person or by registered mail to the Environmental Impact Assessment Ordinance Register Office (currently at 27/F, Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong). Electronic copies of all finalized submissions required under this Permit shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and Portable Document Format (PDF version 1.3 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hardcopies.

            本許可證規定向署長提交的所有文件,須親身送交或以掛號方式郵寄至環境影響評估條例登記冊辦事處 (現址為:香港灣仔軒尼詩道130號修頓中心27)。所有按本許可證規定提交的文件定稿的電子版本,均須以超文本標示語言 (HTML) (4.0或較後版本) 和便攜式文件格式 (PDF) (1.3或較後版本) 製作,除非另獲署長同意,並須與硬複本同時提交。

 

2.                  Submissions for the Decommissioning of the Project

 

解除工程項目運作須提交的文件

 

2.1               An Environmental Team (ET) shall be established by the Permit Holder no later than two months before the commencement of decommissioning of the Project. The ET shall be headed by an ET Leader. The ET Leader shall be a person who has at least 7 years' experience in environmental monitoring and auditing (EM&A) or environmental management. The ET team and the ET Leader shall be responsible for the duties defined in the EM&A Manual of the EIA Report. The ET Leader shall be responsible for the implementation of the EM&A programme in accordance with the EM&A requirements as contained in the EM&A Manual. The ET Leader shall keep a contemporaneous log-book of each and every instance or circumstance or change of circumstances which may affect the compliance with the recommendations of the EIA Report (Register No. AEIAR-049/2002) and this Permit(including any subsequent approved submissions). The ET Leader shall notify the IEC within one working day of the occurrence of any such instance or circumstance or change of circumstances. This log-book shall be kept readily available for inspection by all persons assisting in supervision of the implementation of the recommendations of the EIA Report (Register No. AEIAR-049/2002) and this Permit (including any subsequent approved submissions) or by the Director or his authorized officers. Failure to maintain records in the log-book, failure to discharge the duties of the ET Leader as defined in the EM&A Manual or failure to comply with this Condition would entitle the Director to require the Permit Holder by notice in writing to replace the ET Leader. Failure by the Permit Holder to make replacement, or further failure to keep contemporaneous records in the log-book despite the employment of a new ET Leader may render the Permit liable to suspension, cancellation or variation. The ET shall not be in any way an associated body of the Contractor or the IEC for the Project.  

 

在工程項目的解除運作工程展開前,許可證持有人須至少提早2個月成立一個環境小組。環境小組須由一名環境小組組長帶領。環境小組組長須在環境監察及審核(環監)或環境管理方面至少有7年經驗。環境小組及環境小組組長須執行環評報告內環監手冊所列明的職務。環境小組組長須按環監手冊內載的環監要求,執行環監計劃。環境小組組長須保存一本記錄冊,同時記載可能會影響環評報告(登記冊編號:AEIAR-049/2002)及本許可證(包括任何其後提交的核准文件)的符合情況的每宗事件、每種情況或每次情況變化。環境小組組長須在發生任何類似事件、情況或情況變化後1個工作天內通知獨立環境查核人。存放這本記錄冊的地方,須可供協助督導執行環評報告(登記冊編號:AEIAR-049/2002)的建議及本許可證(包括任何其後提交的核准文件)的所有人士、署長或獲授權人員隨時查閱。環境小組組長如未能在記錄冊保存記錄、未能執行環監手冊所列明的環境小組組長職務,或未能符合本條件的規定,署長有權以書面要求許可證持有人撤換環境小組組長。許可證持有人如未能安排人選替補,或在聘用新環境小組組長後仍未能在記錄冊保存同期的記錄,或會導致許可證遭暫時吊銷、取消或更改。環境小組不得與工程項目的承辦商或獨立環境查核人有任何聯繫。

 

2.2               An Independent Environmental Checker (IEC) shall be employed by the Permit Holder no later than two months before the commencement of decommissioning of the Project. The IEC shall be a person who has at least 7 years' experience in environmental monitoring and audit (EM&A) or environmental management. The IEC shall be responsible for the duties defined in the EM&A Manual of the EIA Report (Register No. AEIAR-049/2002), and shall audit the overall EM&A programme described in the EIA Report, including the implementation of all environmental mitigation measures, submissions required in the EM&A Manual, and any other submissions required under this Permit. In addition, the IEC shall be responsible for verifying the environmental acceptability of permanent and temporary works, relevant design plans and submissions under this Permit. The IEC shall verify the log-book(s) mentioned in Condition 2.1 of this Permit. The IEC shall notify the Director by fax, within 24 hours of each and every occurrence, change of circumstances or non-compliance with the EIA Report (Register No. AEIAR-049/2002) and this Permit, which might affect the monitoring or control of adverse environmental impact. In the case where the IEC fails to so notify the Director of the same, fails to discharge the duties of the IEC as defined in the EM&A Manual or fails to comply with this Condition, the Director may require the Permit Holder by notice in writing to replace the IEC. Failure to replace the IEC as directed or further failure to so notify the Director despite employment of a new IEC may render the Permit liable to suspension, cancellation or variation. Notification by the Permit Holder is the same as notification by the IEC for the purpose of this Condition. The IEC shall not be in any way an associated body of the Contractor or the Environmental Team for the Project.

在工程項目的解除運作工程展開前,許可證持有人須至少提早2個月聘用一名獨立環境查核人。獨立環境查核人須在環境監察及審核(環監)或環境管理方面至少有7年經驗。獨立環境查核人須執行環評報告(登記冊編號:AEIAR-049/2002內環監手冊所列明的職務,以及審核環評報告內載述的整體環監計劃,包括實施所有環境緩解措施、提交環監手冊規定的文件,以及提交本許可證所要求的其他文件。此外,獨立環境查核人須核實永久及臨時工程在環境上的可接受程度、相關的設計圖則和根據本許可證提交的文件,並須核實本許可證條件第2.1項所述的記錄冊。在每次發生事件、出現情況變化或不符合環評報告(登記冊編號:AEIAR-049/2002及本許可證的情況,而可能會妨礙就不良環境影響而進行的監察或控制工作時,獨立環境查核人須在24小時內以傳真方式通知署長。獨立環境查核人如未能通知署長有關情況,未能執行環監手冊所列明的獨立環境查核人職務,或未能符合本條件的規定,署長可以書面要求許可證持有人撤換獨立環境查核人。如未能按指示撤換獨立環境查核人,或在聘用新獨立環境查核人後仍未能通知署長有關情況,則或會導致許可證遭暫時吊銷、取消或更改。為執行本條件,許可證持有人的通知等同獨立環境查核人的通知。獨立環境查核人不得與工程項目的承辦商或環境小組有任何聯繫。

2.3        All submissions for approval and deposition under Sections 2.10, 2.16 and 3 of this Permit shall be verified and certified by the IEC as conforming to the information and recommendations contained in the EIA Report before submission to the Director.

所有根據本許可證條件第2.10、第2.16及第3項規定提交以供批准及存放的文件,須由獨立環境查核人核實及核證,證明符合環評報告所載資料及建議,然後才向署長提交。

 

2.4        The Permit Holder shall, within 4 weeks after commencement of decommissioning of the Project, inform the Director in writing of the management organization of the main decommissioning companies and/or any form of joint ventures associated with the decommissioning of the Project.  The submitted information shall include at least an organization chart, names of responsible persons and their contact details. 

 

            許可證持有人須在工程項目的解除運作工程展開後4個星期內,把主要進行解除運作工程公司及 / 或以任何形式與解除運作工程相關的合營企業的管理架構,以書面通知署長。提交的資料須至少包括一份組織圖、負責人的姓名及聯絡資料。

 

          Method of Demolition

 

          拆卸方法

 

2.5       The Permit Holder shall use non-blasting methods for the demolition of all of the structures including main plant building, chimney and administrative/storage buildings.

            許可證持有人須以非爆破方式拆卸所有建築物,包括主要廠房、煙囪及行 政/貯存大樓。

 

2.6       The Permit Holder shall demolish all structures and building in accordance with the recommendations and findings of the EIA Report, including but not limited to the following requirements:

            許可證持有人須根據環評報告的建議及結果,拆卸各座建築物及大樓,包 括但不限於下列規定:

 

(a) all structures and buildings shall be demolished and removed prior to demolition of chimneys; and

 

(a) 所有建築物及大樓均須在拆卸煙囪之前全部拆卸及移走;及

 

(b) all Asbestos Containing Materials (ACM) shall be removed prior to commencement of demolition works unless the ACM could only be removed when access is gained to particular areas as the demolition progresses.

 

(b) 所有含石棉物料均須在拆卸工程展開前移走,除非在拆卸過程中須先行進入某些地方才能把含石棉物料移走。

 

Measures to Mitigate Landfill Gas Hazard

堆填區氣體風險的緩解措施

2.7       The Permit Holder shall implement the recommended precautionary measures in Section 5.9 and Appendix D of the EIA Report to mitigate landfill gas hazard throughout the site investigation, demolition and remediation phases. These measures shall include, but are not limited to the following requirements:

在整段工地勘察、拆卸工程及整治行動進行期間,許可證持有人須執行環評報告第5.9段及附錄D所建議的預防措施,以減輕堆填區氣體的風險。這些措施須包括但不限於下列規定:

(a) training to workers and site personnel on the recommended measures to prevent landfill gases hazard;

(a) 就預防堆填區氣體風險的建議措施,向工人及工地人員提供培訓;

(b) smoking not allowed on site;

(b) 工地內嚴禁吸煙;

(c) using spark free mechanical ventilation and spark arrestors for electrical equipment for underground works;

(c) 地下工程使用的電動設備,須設有不會產生火花的機動通風裝置及火花制止器;

(d) provision of breathing apparatus; and

(d) 設置呼吸器具;及

(e) monitoring of methane, carbon dioxide and oxygen below ground level and implementing the actions in accordance with Table 5.3 and Section 5.9.12 of the EIA Report. In particular, the Permit Holder shall immediately stop all the works below ground level when the concentration of:

(e) 須根據環評報告表5.3及第5.9.12段的規定,監察地底下甲烷、二氧化碳及氧的含量,並採取相關行動,尤其當下列情況出現時,許可證持有人須立即停止在地下進行的所有工程:

(i) Oxygen is less than 18 % by volume;

 

(i)  含氧量少於18%

(ii) Methane is greater than 20 % Lower Explosive Limit (see notes); and

(ii) 甲烷含量較爆炸濃度下限(見註)超出20%;及

(iii) Carbon Dioxide is greater than 1.5 by volume.

(iii) 二氧化碳含量超過1.5

 

Measures to Mitigate Waste Impacts

廢物影響緩解措施

2.8       The Permit Holder shall submit 6 sets of Waste Management Plan (WMP) 8 weeks before the commencement of the decommissioning of the Project to the Director for approval. The WMP shall take account of the findings and recommendations of the waste management section of the EIA, including but not limited to the following:

            許可證持有人須在工程項目的解除運作工程展開前,至少提早8個星期把6份廢物管理計劃提交署長批准。廢物管理計劃須考慮到環評報告廢物管理章節所載結果及建議,包括(但不限於)下列各點:

(a) location of the disposal site(s);

 

(a) 卸泥場的位置;

(b) transportation routing(s) of the removal of excavated and/or demolished materials from the project site to the disposal site(s);

(b) 把挖出物料及/或拆卸物料從工程項目工地運往卸泥場的路線;

(c) details on the types, quantities, level of contaminants, treatment and disposal methods;

(c) 廢物的類別和數量、污染物水平、處理和處置方法的細節;

(d) timings for disposal of wastes;

(d) 處置廢物的時間安排;

(e) responsibilities for implementation;

(e) 執行措施的責任;

(f) possible recycling and reuse of materials; and

(f) 可作循環再造及重用的物料;及

(g) trip-ticket system for waste transfer/disposal operations.

(g) 運送/處置廢物的運載記錄制度。

 

2.9       The Permit Holder shall fully implement all the measures recommended in the approved WMP in accordance with the requirements and time schedule(s) set out in the WMP.

許可證持有人須根據廢物管理計劃所載的規定及時間表,徹底執行經核准 的廢物管理計劃建議的各項措施。

2.10     The Permit Holder shall conduct reassurance and confirmatory testings to verify the actual extent of contaminated soil before the remediation is carried out and to determine any additional areas for remedial action after initial remediation.

許可證持有人須先進行再保證測試及確定測試,以核實泥土受污染的實際 程度,然後才進行整治行動,並在初步進行整治行動後,決定是否有其他額外地方須予整治。

2.11      The Permit Holder shall carry out remediation for contaminated soil in accordance with assessment results obtained by applying the methodology and standards based on the relevant published Practice Note for Professional Persons or guidelines issued by the Director e.g. “Guidance Manual for Use of Risk-Based Remediation Goal (RGRBs) for Contaminated Land Management” with standards as attached at Annex A. The Contaminated Assessment Report (CAR)/Remediation Action Plan (RAP) shall be submitted for approval by the Director prior to commencement of remediation works. A Remediation Report (RR) shall be submitted for approval by the Director within 3 months of completion of remediation works.     

許可證持有人須根據評估結果為受污染的泥土進行整治工程,而有關評佑結果是根據已公布的專業人士專業守則或署長發出的指引,例如「按風險釐定的土地污染整治標準的使用指引」,應用所載述的方法及標準而得出。有關標準夾附於附錄A。污染評估報告/整治計劃書須在整治工程展開前提交署長批准。整治報告則須在整治工程完成後3個月內提交署長批准。

 

Disposal of Ash contaminated by Dioxins and/or Furans

處置受二噁英及/或喃污染的灰塵

2.12     The Permit Holder shall conduct reassurance and confirmatory testing to verify the actual extent of Dioxins and Furans contaminated ash deposits before remediation is carried out and to determine any additional areas for remedial action after initial remediation.

許可證持有人須先進行再保證測試及確定測試,以核實積存灰塵受二噁英及喃污染的實際程度,然後才進行整治行動,並在初步進行整治行動後,決定是否有其他額外地方須予整治。

2.13     The Permit Holder shall treat ash contaminated with Dioxins and/or Furans with cement in accordance with Section 4.7 of the EIA Report including but not limited to the following:

許可證持有人須根據環評報告第4.7段的規定,以水泥處理受二噁英及/ 喃污染的灰塵,包括但不限於下列各點:

(a) conduct pilot tests including TCLP tests to determine the appropriate cement to ash ratio for the purpose of compliance with the 1 part per billion toxicity equivalent (1 ppb TEQ) criteria;

 

(a) 進行試驗測試(包括毒性滲濾測試),以決定合適的水泥與灰塵比例,使符合相等於十億分之一(1 ppb TEQ)的含毒性標準;

(b) submit the test results to the Director for confirmation of the disposal site;

(b) 向署長提交測試結果,以確定卸泥場的地點;

(c) if the pilot test criteria in condition 2.13 (a) are met, seal the treated ash into steel drums lined with plastic sheeting; and

(c) 如能符合條件第2.13(a)項的試驗測試標準,把經處理的灰塵放入內襯膠布的密封鋼鼓;及

(d) dispose of the drummed material in condition 2.13 (c) above to a Government landfill agreed by the Director.

(d) 把上文第2.13(c)項放入鼓內的物料運往署長所同意的政府堆填區處置。

 

2.14     Disposal at the Chemical Waste Treatment Centre, Tsing Yi, should be considered as a fall back option if the pilot test criteria cannot be met.

把灰塵運往青衣化學廢物處理中心處置,應視作在未能符合測試試驗標準時的後備方案。

 

Mitigation Measures to prevent Decommissioning Nuisances

防止解除運作工程造成滋擾的緩解措施

 

2.15     The Permit Holder shall implement mitigation measures to prevent decommissioning related nuisances throughout the site investigation, demolition and remediation phases, in accordance with the EIA Report, including but not limited to the following:

            許可證持有人須根據環評報告的規定,在整段工地勘察、拆卸工程及整治行動期間執行緩解措施,以防止解除運作工程造成滋擾,包括但不限於下列各點:

(a) water haul roads at least 4 times per day by a water bowser or otherwise;

 

(a) 至少每天4次以水車或其他方式清洗運料路;

(b) provide wheel washing facilities at all exits and divert all wash water to sediment pit(s) or equivalent;

(b) 在各出口提供車輪清洗設施,並把所有廢水導引至沉積池或同等地方;

(c) cover all access roads with gravel;

(c) 以砂礫覆蓋各通路;

(d) provide covers for dusty stockpiles;

(d) 為滿布塵埃的堆存物料設置上蓋

(e) use sediment traps, temporary channels, temporary diversion and oil interception facilities to mitigate site run-off impacts;

(e) 採用沉積物捕集裝置、臨時渠道、臨時導流及截油設施,以減輕工地徑流所造成的影響;

(f) divert all clean surface water around the site; and

(f) 導引工地四周的所有清潔地面水;及

(g) provide bunded areas for the treatment operations on contaminated soil and ash, for generators, and for storage of fuel, oil and chemical wastes.

(g) 為處理受污染泥土及灰塵的工序、發電機,以及貯存燃料、油及化學廢物的設施,設置堤壆保護區。

 

2.16     The IEC shall verify and certify the compliance of the requirements under conditions 2.5, 2.6, 2.7, 2.8, 2.9, 2.10, 2.11, 2.12, 2.13, 2.14 and 2.15.

            獨立環境查核人須核實及核證條件第2.52.62.72.82.92.102.112.122.132.142.15項規定的符合情況。

 

3.        Environmental Monitoring and Audit (EM&A) during the Decommissioning Period

            解除運作工程期間的環境監察及審核(環監)工作

3.1       The EM&A programme shall be implemented as set out in the EM&A Manual of the EIA Report. Any change to the changes to the programme shall be justified by the IEC as conforming to the requirements set out in the EM&A Manual and shall be approved by the Director.

            許可證持有人須按環評報告內環監手冊所載規定,執行環監計劃。計劃如有更改,須由獨立環境查核人提出充分理由,證明其符合環監手冊所載規定,然後才提交署長批准。

3.2       The Permit Holder shall set up a complaint investigation procedure at least 2 weeks before the commencement of decommissioning works. The complaint investigation procedure shall follow the requirements set out in the EM&A programme.

            許可證持有人須在解除運作工程展開前,至少提早2個星期設立投訴調查程序。投訴調查程序須符合環監計劃所載規定。

3.3        All environmental monitoring and audit data submitted under this Permit shall be true, valid and correct.

            根據本許可證提交的所有環境監察及審核數據,均須真實無誤。

3.4       Two hard copies and one electronic copy of the Baseline Monitoring Report shall be submitted to the Director at least 2 weeks before the commencement of any decommissioning works. Additional copies of the submission shall be provided to the Director upon request from the Director.

            在解除運作工程展開前,許可證持有人須至少提早2個星期向署長提交基 線監測報告的兩份硬複本和一份電子版本。如署長要求,須把提交文件的 額外複本送交署長。

3.5       Two hard copies and one electronic copy of monthly EM&A Report shall be submitted to the Director within 2 weeks after the end of the reporting month. Additional copies of the submission shall be provided to the Director upon request from the Director.

            在規定提交報告的月份結束後2個星期內,許可證持有人須向署長提交每月環監報告的兩份硬複本和一份電子版本。如署長要求,須把提交文件的額外複本送交署長。

3.6       The actions described in the Event/Action Plans of the EM&A Manual shall be fully and properly carried out, in accordance with the time frame(s) set out in the Event/Action Plan, or as agreed by the Director.

            環監手冊的事件/行動計劃所說明的行動,須按照事件/行動計劃所訂 明的時限或如署長所同意的時限,徹底及妥善執行。

4.        Electronic Reporting of EM&A Information

            環監資料的電子匯報

4.1       To facilitate public inspection of the Baseline Monitoring Report and monthly EM&A Reports via the EIAO Internet Website and at the EIAO Register Office, electronic copies of these Reports shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF version 4.0 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hard copies as described in Conditions 3.5 and 3.6 of this Permit. For the HTML version, a content page capable of providing hyperlinks to each section and sub-section of these Reports shall be included at the beginning of the document. Hyperlinks to all figures, drawings and tables in these Reports shall be provided in the main text where the respective references are made. All graphics in these Reports shall be in interlaced GIF format unless otherwise agreed by the Director. The content of the electronic copies of these Reports shall be the same as the hard copies.

            為方便公眾透過環評條例互聯網網站和在環評條例登記冊辦事處查閱基線監測報告及每月環監報告,以超文本標示語言(HTML) (4.0或較後版本)和便攜式文件格式(PDF) (4.0或較後版本)製作的報告的電子版本,除非另獲署長同意,須與本許可證條件第3.53.6項所說明的硬複本同時提交。關於HTML的版本方面,可與報告各節及小節作出超文本連結的目錄須在文件開端加入。報告內各類圖表須在載 有相關資料的正文內作出超文本連結。除非另獲署長同意,報告內所有圖形均須以交錯存取的GIF格式制定。報告的電子版本內容,必須與硬複本的內容一致。

4.2        All environmental monitoring data described in Condition 4.1 above shall be made available to the public via internet access in the shortest possible time and in no event later than 2 weeks after the relevant environmental monitoring data are collected or become available, unless otherwise agreed with the Director. The Permit Holder shall notify the Director in writing, within 6 weeks after the commencement of decommissioning, the internet address where the environmental monitoring data are to be placed. The internet address and the relevant environmental monitoring data shall be made available to the public via the EIAO Internet Website and the EIAO Register Office.

            上文條件第4.1項所說明的所有環境監察數據,均須盡快以設立網站方式供公眾透過互聯網接達,在任何情況下均不得遲於有關環境監察數據收集 或可供閱覽後的2個星期,除非另獲署長同意。許可證持有人須在解除運作工程展開後6個星期內,以書面通知署長存放環境監察數據的網址所在。網址和有關的環境監察數據,須透過環評條例互聯網網站和環評條例登記冊辦事處,供公眾查閱。

4.3       The internet website as described in Condition 4.2 above shall enable user-friendly public access to the monitoring data with features capable of:

            上文條件第4.2項說明的互聯網網站,必須方便用戶使用,讓公眾容易接達監察數據。除非另獲署長同意,互聯網網站須具備部件,提供下述功能:

(a) providing access to all environmental monitoring data collected since the commencement of decommissioning;

 

(a) 在解除運作工程展開後,接達所收集的全部環境監察數據;

(b) searching by date;

(b) 按日期搜尋;

(c) searching by types of monitoring data (air quality and construction waste); and

(c) 按監察數據類別(空氣質素及建築廢物)搜尋;以及

(d) hyperlinking to relevant monitoring data after searching;

(d) 在搜尋後對相關監察數據作出超文本連結。

Notes :

註:

 

1.        This Permit consists of three parts, namely, PART A (Main Permit), PART B (Description of Designated Project) and PART C (Permit Conditions). Any person relying on this permit should obtain independent legal advice on the legal implications under the Ordinance, and the following notes are for general information only.

 

            本許可證共有3部,即 A(許可證主要部分);B(指定工程項目的說明)及 C(許可證條件)。任何援引本許可證的人士須就條例的法律含意徵詢獨立法律意見,下述註解只供一般參考用。

 

2.        If there is a breach of any conditions of this Permit, the Director or his authorized office may, with the consent of the Secretary for the Environment, order the cessation of associated works until the remedial action is taken in respect of the resultant environmental damage and in that case the Permit Holder shall not carry out any associated works without the permission of the Director or his authorized officer.

 

            如違反本許可證的任何條件,署長或獲授權人員徵得環境局局長的同意後可勒令停止相關工程,直至許可證持有人為所造成的環境損害採取補救行動為止。在此情況下,許可證持有人未經署長或獲授權人員同意,不得進行任何相關工程。

 

3.         The Permit Holder may apply under Section 13 of the Ordinance to the Director for a variation of the conditions of this Permit. The Permit Holder shall replace the original permit displayed on the construction site by the amended permit.

 

            許可證持有人可根據條例第13條的規定向署長申請更改本許可證的條件。許可證持有人須把經修改的許可證替換在工程項目工地內展示的原有許可證。

 

4.         A person who assumes the responsibility for the whole or a part of the designated project may, before he assumes responsibility of the designated project, apply under Section 12 of the Ordinance to the Director for a further environmental permit.

 

            承擔指定工程項目整項或部分工程的責任的人,在承擔責任之前,可根據條例第12條的規定向署長申請新的環境許可證。

 

5.        Under Section 14 of the Ordinance, the Director may with the consent of the Secretary for the Environment, suspend, vary or cancel this Permit. The suspended, varied or cancelled Permit shall be removed from display at the construction site.

 

            根據條例第14條的規定,署長可在環境局局長的同意下暫時吊銷、更改或取消本許可證。遭暫時吊銷、更改或取消的許可證必須從工地除下,不再展示。

 

6.        If this Permit is cancelled or surrendered during decommissioning of the Project, another environmental permit must be obtained under the Ordinance before the Project could be continued. It is an offence under Section 26(1) of the Ordinance to decommission a designated project listed in Part II of Schedule 2 of the Ordinance without a valid environmental permit.

            如果本許可證在工程項目解除運作期間取消或交回,則在繼續進行工程項目之前,必須先根據條例規定取得另一份環境許可證。根據條例第26(1)條的規定,任何人在沒有有效環境許可證的情況下解除條例附表2II部所列明的指定工程項目的運作,即屬犯罪。

 

7.        Any person who decommissions the Project contrary to the conditions in the Permit, and is convicted of an offence under the Ordinance, is liable: -

 

            如任何人在違反本許可證的條件下解除工程項目的運作,根據條例,即屬犯罪: -

 

(i)                  on a first conviction on indictment to a fine of $ 2 million and to imprisonment for 6 months;

一經循公訴程序首次定罪,可處罰款200萬元及監禁6個月;

 

(ii)       on a second or subsequent conviction on indictment to a fine of $ 5 million and to imprisonment for 2 years;

            一經循公訴程序第二次或其後每次定罪,可處罰款500萬元及監禁2年;

 

(iii)       on a first summary conviction to a fine at level 6 and to imprisonment for 6 months;

            一經循簡易程序首次定罪,可處第6級罰款及監禁6個月;

 

(iv)      on a second or subsequent summary conviction to a fine of $1 million and to imprisonment for 1 year; and

            一經循簡易程序第二次或其後每次定罪,可處罰款100萬元及監禁1年;及

(v)       in any case where the offence is of a continuing nature, the court or magistrate may impose a fine of $ 10,000 for each day on which he is satisfied the offence continued.

 

            在任何情況下如該罪行屬連續性質,法院或裁判官可就其信納該罪行連續的每一天另處罰款10,000元。

 

8.        The Permit Holder may appeal against any condition of this Permit under Section 17 of the Ordinance within 30 days of receipt of this Permit.

 

            許可證持有人可在接獲本許可證後30天內,根據條例第17條就本許可證的任何條件提出上訴。

 

9.         The Notes are for general reference only and that the Permit Holder should refer to the EIA Ordinance for details and seek independent legal advice.

 

            上述註解只供一般參考用,欲知有關詳情,許可證持有人須參閱環評條例及徵詢獨立法律意見。

 

10.        Occupational safety and health issues are governed by the Occupational Safety and Health Ordinance (Cap. 509), and Factories and Industrial Undertakings Ordinance (Cap.59). The Permit Holder is advised to contact the Labour Department for requirements relating to occupational safety and health issues.

            職業安全及健康事宜受《職業安全及健康條例》(第509章)及《工廠及工業經營條例》(第59章)所規管。有關職業安全及健康事宜的規定,許可證持有人宜聯絡勞工處。

11.       Methane will burn when mixed with air between approximately 5 % by volume and 15 % by volume, that is, the Lower Explosive Limit and Upper Explosive Limit respectively.

 

當甲烷含量約介乎5% (爆炸下限)與15%(爆炸上限)之間並與空氣混合時,便會燃燒。
