Appeals
A formal appeal
mechanism has also been provided for the Ordinance in the form of
the Environmental Impact Assessment (Appeal Board) Regulation. Any
applicant or permit holder may lodge an appeal against the decision
of the Director on matters listed in section 17(1) of the Ordinance.
During any appeal,
the Chair, who is a qualified district court judge, may convene
an Appeal Board consisting of no less than three members.
