ENVIRONMENTAL PERMIT TO CONSTRUCT AND OPERATE A DESIGNATED PROJECT

建造及營辦指定工程項目的環境許可證

Pursuant to Section 10 of the Environmental Impact Assessment Ordinance, the Director of Environmental Protection (the Director) grants this environmental permit to the REGIONAL HIGHWAYS ENGINEER/NEW TERRITORIES, HIGHWAYS DEPARTMENT (the "Permit Holder") to construct and operate the designated project described in Part B subject to the conditions described in or attached to Part C. The issue of this environmental permit is based on the documents, approvals or permissions described below :

根據環境影響評估條例第10條的規定﹐環境保護署署長 (署長) 將本環境許可證批予路政署助理署長/新界以建造及營辦B部所說明的指定工程項目﹐但須遵守C部所說明或附載的條件。本環境許可證的發出﹐乃以下表所列的文件、批准或許可作為根據﹕-

Hereunder is the description of the designated project mentioned in Part A of this environmental permit (the Permit):

Scale and Scope of Designated Project

  1. construction of a dual two-lane trunk road of approximately 1,100 metres in length connecting Pok Oi Flyover and Yuen Long Highway near Shap Pat Heung Interchange;
    建造一條約1,100米長的雙程雙線分隔主幹路,以連接十八鄉交匯處附近的博愛行車天橋及元朗公路;

  2. construction of two two-lane vehicular bridges each of approximately 30 metres in length at the Shap Pat Heung Interchange;

  3. construction of an about 25 metres long by 11 metres wide combined vehicular/pedestrian underpass at Sheung Yau Tin Tsuen connecting directly with the existing underpass underneath the district distributors;

  4. construction of an about 55 metres long by 4 metres wide pedestrian underpass at Tai Kei Leng connecting directly with the existing underpass underneath the district distributors;

  5. construction of an about 35 metres long by 4 metres wide pedestrian underpass of at Sheung Yau Tin Tsuen connecting directly with the existing underpass underneath the district distributors;

  6. removal of the two existing temporary roads between Pok Oi Flyover and the district distributors; and

PART C (PERMIT CONDITIONS)

1. General Conditions

1.1 The Permit Holder shall ensure full compliance with all conditions of this environmental permit. Any non-compliance may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap.499) and shall be definite ground for enforcement action or permit cancellation where applicable.

1.2 This Permit shall not remove the responsibility of the Permit Holder to comply with any legislation currently in force such as the Noise Control Ordinance (Cap.400), Air Pollution Control Ordinance (Cap.311), Water Pollution control Ordinance (Cap.358), Dumping at Sea Ordinance (Cap.466), the Waste Disposal Ordinance (Cap.354), and others.

1.3 The Permit Holder shall make copies of this Permit available at all times for inspection by the Director at all the sites covered by this Permit.

1.4 The Permit Holder shall give a copy of this Permit to the person(s) in charge of the site(s).

1.5 The Permit Holder shall display a copy of this Permit on the construction site(s) at all vehicular site entrances/exits or at a convenient location for public information at all times. The Permit Holder shall ensure that the most updated information about the environmental permit, including any amended Permit, is displayed at such locations. If the Permit holder surrenders a part or the whole of the Permit, the notice he sends to the Director of Environmental Protection shall also be displayed at the same locations as the original permit.

1.6 A copy of the EIA Report shall be kept in the Resident Engineer's office and another copy shall be kept in the Contractor's office on site for reference.

1.7 The Permit Holder shall construct and operate the Project in accordance with the project descriptions in Part B of this Permit.

1.8 The Permit Holder shall ensure that the Project is designed, constructed and operated in accordance with the information and recommendations contained in the EIA Report.

1.9 All deposited submissions, as required under this Permit, shall be rectified in accordance with the comments, if any made by the Director within one month of the receipt of the Director's comments or otherwise specified by the Director.

1.10 All finalised submissions, as required under this Permit, shall be released to the public if requested by the Director, by depositing copies in the Environmental Impact Assessment Ordinance Register Office or any other places or by any other means as specified by the Director for public inspection. For this purpose, the Permit Holder shall provide sufficient copies of submissions.

2. Submissions or Measures before Commencement of Construction

2.1 An Environmental Team shall be established before the commencement of construction of the Project and shall not be in any way an associated body of the Contractor. The Environmental Team shall be supervised by an Environmental Manager (EM) who has at least 7 years experience in environmental monitoring and auditing (EM&A) or environmental management. Pursuant to the EM&A Manual of the Project, the Engineer shall be responsible for the overall implementation and management of the EM&A programme in accordance with the EM&A requirements as contained in the EIA Report and the EM&A Manual. The EM shall be responsible for reviewing the EIA, the detailed designs of the Project and the incorporation and implementation of measures recommended in the EIA Report.

2.2 The Permit Holder shall deposit with the Director 3 sets of 1 to 1000 scale design drawings and explanatory statements showing the use of friction course road surfacing material for the whole length of the flyover and truck road, and the locations and details of the sound-absorptive noise barriers as stipulated in Annex B of this Permit before the commencement of construction of the relevant sections of the Project. The submission shall be verified by the EM as conforming to the information and recommendations contained in the EIA Report. Any changes to the barrier designs shall be verified by the EM as complying with the environmental performance requirements contained in the EIA Report. All measures detailed in the submission shall be fully implemented. Additional copies of the design drawings may be required by the Director.

2.3 The Permit Holder shall deposit with the Director 3 sets of 1 to 1000 scale layout drawings and detailed plans showing the details of the landscape proposals of the Project before the commencement of construction of the relevant sections of the Project. Additional copies of the layout drawings and the detailed plans may be required by the Director.

3. Measures for Construction and Operation of the Project

3.1 The friction course road surfacing material and the sound-absorptive noise barriers shall be constructed in accordance with the deposited design drawings required under condition 2.2

3.2 Boundaries of earthworks shall be protected by temporary drainage.

3.3 Silt traps and oil/grease separators shall be provided to prevent contamination of surface water courses.

3.4 Foul water effluent shall be directed to foul sewer or to sewage treatment facilities.

3.5 In accordance with ProPECC Note (PN1/94) and the EIA Report, Best Management Practices (BMPs) shall be adopted to reduce potential water quality impacts.

3.6 Native species shall be used for re-vegetation.

3.7 All mitigation measures described in EIA Report and the EM&A Manual or in the submissions arising from Section 2 above shall be properly constructed and implemented. Any changes to the measures shall be verified by the EM as complying with the environmental performance requirements contained in the EIA Report before implementation. The verified changes shall be documented in the immediately following monthly EM&A report.

4. Environmental Monitoring and Audit

4.1 he EM&A programme shall be implemented as set out in the EM&A Manual of the EIA Report. Any changes to the programme shall be justified by the EM as conforming to the requirements set out in the EM&A Manual of the EIA Report before submission to the Director for approval.

4.2 Samples and measurements for noise, air quality and water quality monitoring shall be taken in accordance with the requirements of the EM&A Manual of the EIA Report by :

  1. conducting baseline noise, air and water quality monitoring at the specified locations and frequencies;

  2. conducting impact monitoring on noise, air quality and water quality at the specified locations and frequencies;

  3. in cases where specified criteria in the EM&A Manual are exceeded, carrying out remedial actions in accordance with the Event/Action Plan, as set out in the EM&A Manual; and

  4. logging and keeping records of the details of (a) and (b) above, within 3 working days of the collection of data or completion of remedial action, for the purposes of preparing and submitting the EM&A Reports and to make available the information for inspection on site.

4.3 Ten copies of the Baseline Monitoring Report verified by the EM shall be submitted to the Director before the commencement of any major construction works that would affect the monitoring results. Additional copies of the Baseline Monitoring Report may be required by the Director.

4.4 Ten copies of monthly EM&A Report verified by the EM shall be submitted to the Director within 10 working days from the end of the reporting month or by other means as specified by the Director. Additional copies of the monthly EM&A Report may be required by the Director.

4.5 The submitted reports as required in this part of the permit shall be rectified in accordance with the comments made by the Director within one month of receipt of the Director's comments, or otherwise specified by the Director.

4.6 The actions described in the Event/Action Plans of the EM&A Manual shall be carried out, in accordance with the time frame set out in the Event/Action Plans, or as agreed by the Director.

4.7 The Permit Holder shall, at least six months before the operation of the project, deposit to the Director a monitoring plan for the purpose of assessing the accuracy of traffic noise predictions by comparing the project noise impact predictions with the actual impacts. The monitoring plan shall contain monitoring locations, monitoring schedules, methodology of noise monitoring including noise measurement procedures, traffic counts and speed checks, and methodology of comparison with the predicted levels. At least one monitoring location at the noise sensitive receivers protected by noise mitigation measures shall be proposed. At least three sets of measurements shall be conducted and the monitoring shall be done within the first year of operation of the project. Monitoring shall be conducted in accordance with the deposited monitoring plan unless with prior justification. Monitoring details and results including the comparison between the measured noise levels and the predicted levels shall be recorded in a report to be deposited with the Director within one month of the completion of the monitoring. The report shall be certified by the Permit Holder before deposit with the Director.


Notes:

  1. This environmental permit consists of three parts, namely, PART A (Main Permit), PART B (Description of Designated Project) and PART C (Permit Conditions).

  2. The permit holder may apply under section 13 of the Ordinance to the Director for a variation of the conditions of this environmental permit. The permit holder shall replace the original permit displayed on the construction site by the amended permit.

  3. A person who assumes the responsibility for the whole or a part of the designated project may, before he assumes responsibility of the designated project, apply under section 12 of the Ordinance to the Director for a further environmental permit.

  4. Under section 14 of the Ordinance, the Director with the consent of the Secretary for Planning, Environment and Lands, may suspend, vary of cancel this environmental permit. The permit shall be removed from the display on the construction site.

  5. If this permit is cancelled or surrendered during the construction or operation, an environmental permit must be obtained under the Ordinance before the construction or operation of the project could be continued. It is an offence under section 26(1) of the Ordinance to construct or operate a designated project without an environmental permit.

C部 (許可證條件)

1. 一般條件

1.1 許可證持有人必須確保完全符合本環境許可證的全部條件。如有不符合本許可證的情況,可能構成違反環境影響評估條例(第499章)的規定,並可按適用情況作為採取執法行動或取消許可證的確切理由。

1.2 本許可證並不免除許可證持有人須符合現行生效的法例的責任,例如:噪音管制條例(第400章);空氣污染管制條例(第311章);水污染管制條例(第358章);海上傾倒物料條例(第466章);廢物處置條例(第354章);及其他條例。

1.3 許可證持有人須複印本許可證的副本,以供署長任何時間內在本許可證所涵蓋的所有工地查閱。

1.4 許可證持有人須將本許可證的一份副本交予有關工地的負責人。

1.5 許可證持有人須在有關建造工地的所有車輛進出口或一處方便的地點展示本許可證的副本,以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於環境許可證的最新資料,包括經修改的許可證。如果許可證持有人交回許可證的部分或全部,須將其送交署長的通知書,在備有原本許可證的各處相同地點展示。

1.6 須確保在駐工地工程師的辦事處與承建商的辦事處各存放一份環評報告的副本以供參考。

1.7 許可證持有人須依據本許可證B部的工程項目說明來建造及營辦有關工程項目。

1.8 許可證持有人須確保工程項目的設計、建造及營辦,符合環評報告所載的資料及建議。

1.9 所有按本許可證規定存放的文件,須在接到署長的意見(如有者)後一個月內或按署長另行指定,根據署長的意見加以修正。

1.10 所有按本許可證規定提交的文件定稿,在署長要求下須公開給公眾人士知道,方法是將有關文件副本存放於環境影響評估條例登記冊辦事處或署長所指定的任何其他地方或採取其指定的任何其他方法,以供公眾查閱。因此,許可證持有人須提供足夠數量的文件副本。

2. 展開建造工程前提交的文件或採取的措施

2.1 在展開建造工程之前須先成立一個環境小組,而環境小組在任何方面均不得為承建商的相聯機構。環境小組須由一名在環境監察及審核或環境管理方面至少有7年經驗的環境經理督導。根據工程項目的環境監察及審核手冊,工程師須按環評報告及環境監察及審核手冊內載的環境監察及審核規定,負責有關環境監察及審核計劃的整體實施及管理。環境經理須負責審閱環評報告、工程項目的詳細設計、以及收納和實施環評報告所建議的措施。

2.2 在展開本工程項目各有關部分的建造工程之前,許可證持有人須向署長存放3套1:1000比例的設計圖則及解釋說明,顯示本許可證附件A>訂明的使用多孔面層路面物料鋪建整條行車天橋及主幹路,以及可吸音的隔聲屏障的位置和細節。有關文件須由環境經理核實,以確定符合環評報告內載的資料及建議。有關隔聲屏障的任何更改,須由環境經理核證以確保符合環評報告內載的環境表現規定。署長可要求設計圖則的額外副本。

2.3 在展開本工程項目各有關部分的建造工程之前,許可證持有人須向署長存放3套1:1000比例的設計圖則及詳細規劃圖,顯示本工程項目的景觀美化建議書的細節。署長可要求設計圖則及詳細規劃圖的額外副本。

3. 建造及營運工程項目期間採取的措施

3.1 須根據按第2.2項條件規定存放的設計圖則鋪設多孔面層路面物料及建造可吸音的隔聲屏障。

3.2 須沿土木工事的界線築建臨時排水渠加以保護。

3.3 須設置淤泥捕集器及油/油脂分隔器,以防止地面水道受污染。

3.4 污水須導引至污水渠或污水處理設施。

3.5 根據《專業人士環保事務諮詢委員會專業守則》(PN1/94)及環評報告,須採用最佳管理辦法以減少潛在的水質影響。

3.6 重新植被時須採用本地的植物品種。

3.7 所有在環評報告及環境監察及審核手冊內或按上文第2條提交的文件內所說明的緩解措施,必須妥善建造及執行。有關措施的如有任何更改,須先由環境經理核證其符合環評報告內載的環境表現規定,才可實行。經核證的更改須立即在下一份每月環境監察及審核報告中記載。

4. 環境監察及審核

4.1 須按環境監察及審核手冊及環評報告訂明的要求,執行環境監察及審核計劃。有關計劃如有任何更改,須由環境經理提出充分理由證明其符合環評報告的環境監察及審核手冊所訂明的規定,然後才提交署長批准。

4.2 須按照環評報告的環境監察及審核手冊內對噪音、空氣質素及水質監測的規定進行抽樣及測量:

  1. 在指定地點進行指定次數的噪音、空氣及水質基線監測;

  2. 在指定地點進行指定次數的噪音、空氣質素及水質影響監測;

  3. 如果超逾了環境監察及審核手冊所指定的標準,須按照環境監察及審核手冊載明的事件/行動計劃,採取補救行動;及

  4. 在收集數據或完成補救行動3個工作天內記錄上列(a)至(b)項的詳情,用作擬備和提交環境監察及審核報告,並備妥有關資料以便在工地查閱。

4.3 在任何會影響監察結果的大型工程展開之前,須向署長提交5份由環境經理核證的基線監察報告。署長可要求基線監察報告的額外副本。

4.4 在須提交報告月份結束後的10個工作天內或按署長指定的其他方法,須向署長提交5份由環境經理核證的每月環境監察及審核報告。署長可要求每月環境監察及審核報告的額外副本。

4.5 上文第4.3及4.4項條件所規定提交的報告,須在接到署長意見後的一個月內或按署長另行指定,根據署長的意見作出修改。

4.6 環境監察及審核手冊的事件/行動計劃所說明的行動,須按照事件/行動計劃所訂明的時限或如署長所同意執行。

4.7 至少在本工程項目營運六個月前,許可證持有人須向署長存放一份監察計劃,藉著比較工程項目的噪音預測與實際影響,以評估交通噪音預測的準確性。此監察計劃須列明監察地點,監察時間表,噪音監測方法﹝包括噪音量度步驟,交通流量及車速的點算及與預測水平的比較﹞。須在受噪音緩解措施保護下噪音感應強的地方,建議至少一個監察地點。監察工作須在工程項目營運的首年內進行至少三組噪音量度。除非預先提出充份理據,監察工作須按已存放的監察計劃進行。監察工作的詳情與結果﹝包括量度得到的噪音水平與預測水平的比較﹞,須記綠在一份報告內並在監察工作完成後一個月內向署長存放。此報告在存放予署長之前須由許可證持有人證明。


註:

  1. 本環境許可證共有3部,即:A部(許可證主要部分);B部(指定工程項目的說明);及C部(許可證條件)。

  2. 許可證持有人可根據環境影響評估條例第13條的規定向署長申請更改本環境許可證的條件。許可證持有人須將經修改的許可證,替換在建造工地內展示的原有許可證。

  3. 承擔指定工程項目的整項或部分工程的責任的人,在承擔指定工程項目責任之前,可根據條例第12條的規定向署長申請新的環境許可證。

  4. 根據條例第14條的規定,署長可在規劃環境地政局局長的同意下暫時吊銷、更改或取消環境許可證。該許可證必須從建造工地除下,不再展示。

  5. 如果本許可證在工程項目建造或營辦期間取消或交回,則在繼續進行建造或營辦工程項目之前,必須先根據條例規定取得環境許可證。根據條例第26(1)條的規定,任何人在沒有環境許可證的情況下建造或營辦指定工程項目,即屬犯罪。
