ENVIRONMENTAL PERMIT TO CONSTRUCT A DESIGNATED PROJECT

Pursuant to Section 10 of the Environmental Impact Assessment Ordinance, the Director of Environmental Protection (the Director) grants this environmental permit to the MTR Corporation (the "Permit Holder") to construct the designated project described in Part B subject to the conditions described in or attached to Part C. The issue of this environmental permit is based on the documents, approvals or permissions described below: -

Scale and Scope of Designated Project
指 定 工 程 項 目 的 規 模 和 範 圍
Dredging operations to remove the siltation over the existing MTR tunnel at the Wanchai and Tsim Sha Tsui landfalls to reduce surcharge loads to the tunnel and to prevent blockage of the salt water pumping facilities. The dredging operation is estimated to remove approx. 25,500 cu.m. of likely Class C contaminated sediment. The full details are given in the Project Profile [Register No. PP060/1999].
挖 泥 作 業 以 清 除 位 於 灣 仔 的 現 有 地 鐵 隧 道 和 尖 沙 咀 近 岸 陸 地 的 淤 泥 , 減 少 隧 道 淤 泥 負 荷 過 重 和 預 防 鹹 水 泵 水 設 施 淤 塞 。 估 計 挖 泥 作 業 可 清 除 約 25,500立 方 米 相 當 可 能 屬 丙 類 的 受 污 染 沉 積 物 。 有 關 詳 情 全 載 於 工 程 項 目 簡 介 [登 記 冊 編 號 PP060/1999]。

PART C (PERMIT CONDITIONS)

1. General Conditions

1.1. The Permit Holder shall ensure full compliance with all conditions of this permit. Any non-compliance may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499) and shall be definite ground for enforcement action or permit cancellation where applicable.

1.2. This permit shall not remove the responsibility of the Permit Holder to comply with any legislation currently in force such as the Noise Control Ordinance (Cap.400), Air Pollution Control Ordinance (Cap.311), Water Pollution Control Ordinance (Cap.358), Dumping at Sea Ordinance (Cap.466), the Waste Disposal Ordinance (Cap.354) and others.

1.3. The Permit Holder shall make copies of this permit available at all times for inspection by the Director at all sites covered by this permit.

1.4. The Permit Holder shall give a copy of this permit to the person(s) in charge of the site(s).

1.5. The Permit Holder shall display a copy of this permit at the construction site(s) at all vehicular site entrances/ exits or at a convenient location(s) such as the nearest seafront for public information at all times. The Permit Holder shall ensure that the most updated information about the environmental permit, including any amended permit, is displayed at such locations. If the Permit Holder surrenders a part or the whole of the permit, the notice he sends to the Director shall also be displayed at the same location(s) as the original permit.

1.6. The Permit Holder shall pursue the work in accordance with the project descriptions in Part B of this permit and the details in the Project Profile.

1.7. All deposited submissions, as required under this permit, shall be rectified in accordance with the comments, if any, made by the Director, within 1 month of the receipt of the Director's comments or otherwise as specified by the Director.

1.8. All finalized submissions, as required under this part of the permit, shall be released to the public by depositing copies in the Environmental Impact Assessment Ordinance Register Office or any other places or by any other means as specified by the Director for public inspection. For this purpose, the Permit Holder shall provide sufficient copies of submission.

1.9. The Permit Holder shall notify the Director the commencement of dredging works 2 weeks in advance.

2. Submissions before Commencement of Construction

2.1 The Permit Holder shall, no later than 3 weeks before the commencement of the dredging at the site, deposit details of silt curtains to be used, including the dimensions, the locations, or the method of installation, and the method of removal. The silt curtains shall be properly provided around the dredgers at all times during the dredging operation so as to effectively mitigate the water quality impacts onto the nearby seawater intakes.

2.2. All measures described in the submissions deposited under Condition 2.1 of this Permit shall be carried out.

3. Specific Conditions

3.1 The dredging operation shall be carried out within the dredged areas as shown in Drawing No.2 and 3.

3.2 The dredging works in Wanchai and Tsim Sha Tsui areas shall be completed within 8 days and 18 days respectively, unless with the Director's prior approval.

3.3 A single grab dredger shall be used for the operation in each dredging area at any one time.

3.4 A closed grab shall be used for the dredging.

3.5 The daily rate of dredging shall not exceed 1,000 m3 per day.

3.6 The total in-situ dredging volume shall not exceed 25,500 m3, unless with the Director's prior approval.

3.7 Silt curtains shall be installed in accordance with the details set out in the submission deposited under Condition 2.1 of this Permit. The installed silt curtains shall be properly maintained during dredging and associated works.

Remarks:

1. This environmental permit consists of three parts, namely, PART A (Main Permit), PART B (Descriptions of Designated Project) and PART C (Permit Conditions).

2. The Permit Holder may apply under Section 13 of the Ordinance to the Director for a variation of this environmental permit. The Permit Holder shall replace the original permit displayed at the construction site(s), by the amended permit.

3. A person who assumes the responsibility for the whole or a part of the designated project may, before he assumes responsibility for the designated project, apply under Section 12 of the Ordinance to the Director for a further environmental permit.

4. Under Section 14 of the Ordinance, the Director with the consent of the Secretary for Planning, Environment and Lands, may suspend, vary or cancel this environmental permit. In that event, the environmental permit shall cease to be displayed at the construction site.

5. If this permit is cancelled or surrendered during the construction, an environmental permit must be obtained under the Ordinance before the construction of the Project could continue. It is an offence under Section 26(1) of the Ordinance to construct the designated project without an environmental permit.
