Pursuant to Section 10 of the Environmental Impact Assessment Ordinance (EIAO), the Director of Environmental Protection (the Director) grants this environmental permit to the DIRECTOR of ENVIRONMENTAL PROTECTION (hereinafter referred to as the “Permit Holder”) to construct and operate the designated project described in Part B subject to the conditions specified in Part C. The issue of this environmental permit is based on the documents, approvals or permissions described below:

 

根據環境影響評估條例(環評條例) 10條的規定,環境保護署署長(署長)將本環境許可證批予環境保護署署長 (下稱許可證持有人”)以建造營辦B所說明的指定工程項目,但須遵守C列明的條件。本環境許可證是依據下列文件、批准或許可而簽發﹕

Hereunder is the description of the designated project mentioned in Part A of this environmental permit (hereinafter referred to as the “Permit”):

 

下列為本環境許可證(下稱許可證”)A所提的指定工程項目的說明﹕

(i)                  An incinerator with an installed capacity of more than 50 tonnes per day

(ii)                A waste disposal facility for refuse

(iii)               A waste disposal facility for pulverized fuel ash or furnace bottom ash

(iv)              Public utility electricity power facility

(v)                Reclamation works (including associated dredging works) of more than 5 ha in size

(vi)              An activity for the reuse of treated sewage effluent from a treatment plant

Location of Designated Project

Located near the south-western coast of Shek Kwu Chau, an island between the southwest of Cheung Chau and the south of Chi Ma Wan Peninsula.  The location of the Project is shown in Figure 1 of this Permit.

Scale and Scope of Designated Project

指定工程項目的規模和範圍

 

The Project is mainly to:

(i)                 reclaim 15.9 hectares of land;

      填海供地15.9公頃;

(ii)                construct and operate an incinerator with design capacity of 3,000 tonnes per day for treating municipal solid wastes;

      建造及營辦一所設計處理能力達每日3,000公噸的焚化爐以供處理都市固體廢物;

(iii)              construct and operate a mechanical sorting and recycling plant with design capacity of 200 tonnes per day;

      建造及營辦一所設計處理能力達每日200公噸的機械式分類及回收廠;

(iv)              construct and operate an on-site wastewater treatment plant for the reuse of treated sewage effluent;

      建造及營辦一所污水處理廠以供重新使用經過處理的污水;

(v)               construct and operate an on-site desalination plant;

      建造及營辦一所海水化淡廠;

(vi)              construct and operate an electricity power plant for the heat recovered from the incineration process;

      建造及營辦一所電廠以供回收焚化過程中所產生的熱能;

(vii)            construct submarine cables for exporting surplus electricity to the power grid;

      建造海底電纜以供輸送剩餘的電力至電網;

(viii)           construct and operate a berthing area; and

      建造及營辦碼頭區;

(ix)              construct and operate an environmental education centre, supporting and community facilities.

PART C (PERMIT CONDITIONS)

C (許可證條件)

1.         General Conditions

        一般

 

1.1       The Permit Holder and any person working on the Project shall comply with all conditions set out in this Permit. Any non-compliance by any person may constitute a contravention of the Environmental Impact Assessment Ordinance (EIAO) (Cap. 499) and may become the subject of appropriate action being taken under the EIAO.

            許可證持有人及任何從事工程項目的人士必須符合本許可證載列的全部條件。任何人士如有不符合本許可證的情況,可能違反環境影響評估條例 (「環評條例」) (499) 的規定,而當局可根據條例採取適當行動。

 

1.2       The Permit Holder shall ensure full compliance with all legislation from time to time in force including, without limitation to, the Noise Control Ordinance (Cap. 400), Air Pollution Control Ordinance (Cap. 311), Water Pollution Control Ordinance (Cap. 358), and Waste Disposal Ordinance (Cap. 354). This Permit does not of itself constitute any ground of defence against any proceedings instituted under any legislation or imply any approval under any legislation.

            許可證持有人須經常確保完全符合現行法例的規定,包括但不限於噪音管制條例(400);空氣污染管制條例(311);水污染管制條例(358);以及廢物處置條例(354)。本許可證本身不會就根據任何法例提起的法律程式構成任何抗辯理由,或根據任何法例默示任何批准。

 

1.3       The Permit Holder shall make copies of this Permit together with all documents referred to in this Permit and the documents referred to in Part A of the Permit readily available at all times for inspection by the Director or his authorised officers at all sites/offices covered by this Permit. Any reference to the Permit shall include all documents referred to in the Permit and also the relevant documents in the Register.

            許可證持有人須印製本許可證的複本,連同本許可證所述的所有文件及本許可證A所述文件,以供署長或獲授權人員任何時間內在本許可證所涵蓋的所有工地 / 辦事處查閱。凡提述本許可證,須包括本許可證所述的所有文件及登記冊內的相關文件。

                             

1.4       The Permit Holder shall give a copy of this Permit to the person(s) in charge of the site(s) and ensure that such person(s) fully understands all conditions and all requirements incorporated in the Permit. The site(s) refers to site(s) of construction and operation of the Project and shall mean the same hereafter.

            許可證持有人須把本許可證的複本交予有關工地的負責人,並確保這些人士完全明白本許可證的所有條件與規定。工地是指建造及營辦工程項目的工地,下文所提及的工地亦屬同一意思。

 

1.5       The Permit Holder shall display conspicuously a copy of this Permit on the Project site(s) at all vehicular site entrances/exits or at a convenient location for public’s information at all times. The Permit Holder shall ensure that the most updated information about the Permit, including any amended Permit, is displayed at such locations.  If the Permit Holder surrenders a part or the whole of the Permit, the notice he sends to the Director shall also be displayed at the same locations as the original Permit.  The suspended, varied or cancelled Permit shall be removed from display at the Project site(s).

            許可證持有人須在工程項目的工地的所有車輛進出口或一處方便地點,顯眼地展示本許可證的複本,以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於本許可證 (包括任何經修訂的許可證) 的最新資料。許可證持有人如交回許可證的部分或全部,必須把其送交署長的通知書,在備有原有許可證的相同地點展示。遭暫時吊銷、更改或取消的許可證必須從工程項目的工地除下,不再展示。

 

1.6       The Permit Holder shall construct and operate the Project in accordance with the project description in Part B of this Permit.

            許可證持有人須依據本許可證B的工程項目說明,建造及營工程項目。

 

1.7       The Permit Holder shall ensure that the Project is designed, constructed and operated in accordance with the information and all recommendations described in the EIA Report (Register No.: AEIAR-163/2012), the application documents including all attachments (Application No. AEP-429/2011), other relevant documents in the Register; and the information or mitigation measures described in this Permit, and mitigation measures to be recommended in submissions that shall be deposited with or approved by the Director as a result of permit conditions contained in this Permit, and mitigation measures to be recommended under on going surveillance and monitoring activities during all stages of the Project. Where recommendations referred to in the documents of the Register are not expressly referred to in this Permit, such recommendations are nevertheless to be implemented unless expressly excluded or impliedly amended in this Permit.

            許可證持有人須確保工程項目的設計、建造及營辦,按照下述資料及措施辦理:環評報告(登記冊編號:AEIAR-163/2012) 所說明的資料及各項建議、申請文件包括所有附件(申請書編號: AEP-429/2011);登記冊內的其他相關文件;本許可證所說明的資料及緩解措施;根據本許可證內載的條件須向署長存放或獲署長批准的提交文件所建議的緩解措施;以及在工程項目各階段進行的持續監察及監測工作所建議的緩解措施。登記冊文件所述建議如沒有在本許可證明確表示,則仍須實施這些建議,除非獲本許可證明確豁除或默示修訂。

 

1.8       All deposited submissions, as required under this Permit, shall be rectified and resubmitted in accordance with the comments, if any, made by the Director within one month of the receipt of the Director’s comments or otherwise as specified by the Director.

            所有按本許可證規定存放的文件,須在接獲署長的意見 (如有者) 1個月內 (除非署長另行指定),根據署長的意見加以修正並再向署長提交。

 

1.9       All submissions approved by the Director, all submissions deposited without comments by the Director, or all submissions rectified in accordance with comments by the Director under this Permit shall be construed as part of the permit conditions described in Part C of this Permit. Any variation of the submissions shall be approved by the Director in writing or as prescribed in the relevant permit conditions. Any non-compliance with the submissions may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499).  All submissions or any variation of the submissions shall be certified by the Environmental Team (ET) Leader and verified by the Independent Environmental Checker (IEC) referred to Conditions 2.1 and 2.2 below, before submitting to the Director under the Permit.

            署長批准的所有提交文件、署長沒有給予意見的所有存放文件及根據本許可證規定由署長給予意見修正的所有提交文件,均須詮釋為本許可證C 說明的許可證條件的一部分。提交文件如有任何修訂,均須獲署長的書面批准,或符合有關許可證條件訂明的規定。如有不符合提交文件的情況,則可能違反環境影響評估條例 (499) 的規定。所有提交文件或提交文件的任何修訂本,均須按下文條件第2.12.2項所述由環境小組組長核證及獨立環境查核人核實,然後才按本許可證規定向署長提交。

 

1.10     The Permit Holder shall release all finalized submissions as required under this Permit, to the public by depositing copies in the EIAO Register Office, or in any other places, or any internet websites as specified by the Director, or by any other means as specified by the Director for public inspection. For this purpose, the Permit Holder shall provide sufficient copies of the submissions.

            許可證持有人須把所有按本許可證規定提交的文件定稿公開給公眾人士知道,方法是把有關文件複本存放於環境影響評估條例登記冊辦事處,或署長指定的任何其他地方,或署長指定的任何互聯網網站,或採取署長指定的任何其他方法,以供公眾查閱。因此,許可證持有人須提供足夠數量的複本。

 

1.11     All submissions to the Director required under this Permit shall be delivered either in person or by registered mail to the EIAO Register Office (currently at 27/F, Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong). Electronic copies of all finalized submissions required under this Permit shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF version 4.0 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hard copies.

            本許可證規定向署長提交的所有文件,須親身送交或以掛號方式郵寄至環境影響評估條例登記冊辦事處 (現址為:香港灣仔軒尼詩道130號修頓中心27)。所有按本許可證規定提交的文件定稿的電子版本,均須以超文本標示語言 (HTML) (4.0或較後版本) 和便攜式文件格式 (PDF) (4.0或較後版本) 製作,除非另獲署長同意,並須與硬複本同時提交。

 

1.12     The Permit Holder shall notify the Director in writing the commencement date of construction of the Project at least 1 month prior to the commencement of construction of the Project. The Permit Holder shall notify the Director in writing immediately if there is any change of the commencement date of the construction.

            許可證持有人須在工程項目的建造工程展開前,至少提早1個月以書面方式把建造工程的施工日期通知署長。建造工程的施工日期如有任何更改,許可證持有人必須立即以書面方式通知署長。

 

1.13     For the purpose of this Permit, “commencement of construction” does not include works related to site clearance and preparation, or other works as agreed by the Director.

            為執行本許可證,「建造工程的展開」不包括有關工地清理和預備的工程,或署長同意的其他工程。

 

2        Specific Conditions

特定條件

 

Submissions or Measures before Commencement of Construction

施工前須提交的文件或採取的措施

Employment of Environmental Monitoring and Audit (EM&A) Personnel

聘用環境監察及審核(環監)人員

2.1               An Environmental Team (ET) shall be established by the Permit Holder no later than 1 month before the commencement of construction of the Project.  The ET shall not be in any way an associated body of the Contractor or the Independent Environmental Checker (IEC) for the Project.  The ET shall be headed by an ET Leader. The ET Leader shall be a person who has at least 7 years of experience in environmental monitoring and auditing (EM&A) or environmental management.  The ET and the ET Leader shall be responsible for the implementation of the EM&A programme in accordance with the EM&A requirements as contained in the EM&A Manual of the Project.  The ET Leader shall keep a contemporaneous log-book of each and every instance or circumstance or change of circumstances, which may affect the compliance with the recommendations of the EIA Report (Register No.: AEIAR-163/2012) and this Permit.  The ET Leader shall notify the IEC within one working day of the occurrence of any such instance or circumstance or change of circumstances.  The ET Leader’s log-book shall be kept readily available for inspection by all persons assisting in supervision of the implementation of the recommendations of the EIA Report (Register No.: AEIAR-163/2012) and this Permit or by the Director or his authorized officers.  Failure to maintain records in the log-book, failure to discharge the duties of the ET Leader as defined in the EM&A Manual or failure to comply with this Condition would entitle the Director to require the Permit Holder by notice in writing to replace the ET Leader.  Failure by the Permit Holder to make replacement, or further failure to keep contemporaneous records in the log-book despite the employment of a new ET Leader may render the Permit liable to suspension, cancellation or variation.
在工程項目的建造工程展開前,許可證持有人須至少提早1個月成立一個環境小組。環境小組不得與工程項目的承辦商或獨立環境查核人有任何聯繫。環境小組須由一名環境小組組長帶領。環境小組組長須在環境監察及審核 (「環監」) 或環境管理方面至少有7年經驗。環境小組及環境小組組長須按工程項目的環監手冊內載的環監規定,執行環監計劃。環境小組組長須保存一本記錄冊,同時記載可能會影響環評報告 (登記冊編號:AEIAR-163/2012) 的建議及本許可證的符合情況的每宗事件、每種情況或每次情況變化。環境小組組長須在發生任何類似事件、情況或情況變化後1個工作天內通知獨立環境查核人。存放環境小組組長的記錄冊的地方,須可供協助督導執行環評報告 (登記冊編號:AEIAR-163/2012) 的建議及本許可證的所有人士、署長或獲授權人員隨時查閱。環境小組組長如未能在記錄冊保存記錄、未能執行環監手冊所列明的環境小組組長職務或未能符合本條件的規定,署長有權以書面要求許可證持有人撤換環境小組組長。許可證持有人如未能安排人選替補,或在聘用新環境小組組長後仍未能在記錄冊保存同期的記錄,或會導致許可證遭暫時吊銷、取消或更改。

 

2.2               An IEC shall be employed by the Permit Holder no later than 1 month before the commencement of construction of the Project.  The IEC shall not be in any way an associated body of the Contractor or the ET for the Project.  The IEC shall be a person who has at least 7 years of experience in EM&A or environmental management.  The IEC shall be responsible for duties defined in the EM&A Manual and shall audit the overall EM&A performance, including the implementation of all environmental mitigation measures, submissions required in the EM&A Manual, and any other submissions required under this Permit.  In addition, the IEC shall be responsible for verifying the environmental acceptability of permanent and temporary works, relevant design plans and submissions under this Permit.  The IEC shall verify the log-book(s) mentioned in Condition 2.1 of this Permit.  The IEC shall notify the Director by fax, within one working day of receipt of notification from the ET Leader of each and every change of circumstances or non-compliance with the recommendations of the EIA Report (Register No.: AEIAR- 163/2012) and this Permit, which might affect the monitoring or control of adverse environmental impacts from the Project.  In case the IEC fails to so notify the Director of the same, fails to discharge the duties of the IEC as defined in the EM&A Manual or fails to comply with this Condition, the Director may require the Permit Holder by notice in writing to replace the IEC.  Failure to replace the IEC as directed or further failure to so notify the Director despite employment of a new IEC may render the Permit liable to suspension, cancellation or variation.  Notification by the Permit Holder is the same as notification by the IEC for the purpose of this Condition.
在工程項目的建造工程展開前,許可證持有人須至少提早1個月聘用一名獨立環境查核人。獨立環境查核人不得與工程項目的承辦商或環境小組有任何聯繫。獨立環境查核人須在環監或環境管理方面至少有7年經驗。獨立環境查核人須執行環監手冊所列明的職務,以及審核整體環監工作的表現,包括實施所有環境緩解措施、提交環監手冊規定的文件,以及提交本許可證所要求的其他文件。此外,獨立環境查核人須核實永久及臨時工程在環境上的可接受程度、相關的設計圖則和根據本許可證提交的文件,並須核實本許可證條件第2.1項所述的記錄冊。在每次出現事故、情況變化或不符合環評報告 (登記冊編號:AEIAR- 163/2012)的建議及本許可證的情況,而可能會妨礙工程項目所造成不良環境影響的監察或控制工作時,獨立環境查核人須在接獲環境小組組長通知後1個工作天內以傳真方式通知署長。獨立環境查核人如未能通知署長有關情況、未能執行環監手冊所列明的獨立環境查核人職務或未能符合本條件的規定,署長可以書面要求許可證持有人撤換獨立環境查核人。如未能按指示撤換獨立環境查核人,或在聘用新獨立環境查核人後仍未能通知署長有關情況,則或會導致許可證遭暫時吊銷、取消或更改。為執行本條件,許可證持有人的通知等同獨立環境查核人的通知。

 

 

Management Organization of Main Construction Companies

主要建造公司的管理架構

2.3               The Permit Holder shall, no later than 2 weeks before the commencement of construction of the Project, inform the Director in writing the management organization of the main construction companies and/or any form of joint ventures associated with the construction of the Project.  The submitted information shall include at least an organization chart, names of responsible persons and their contact details.
許可證持有人在工程項目的建造工程展開前,須至少提早2個星期把主要建造公司及  或以任何形式與建造工程相關的合營企業的管理架構,以書面通知署長。提交的資料須至少包括一份組織圖、負責人的姓名及聯絡資料。

 

Setting up of Community Liaison Group

成立社區聯絡小組

 

2.4               To enhance transparency and communication with the public, the Permit Holder shall, at least 3 months before the commencement of construction of the Project, set up a Community Liaison Group comprising representatives of concerned and affected parties, including the fishery sector, to facilitate communications, enquires and complaints handling on all environmental issues. The Community Liaison Group shall take a proactive approach to disseminate information to the local community, promote community cooperation and participation and implement suitable local environmental enhancement works.  All relevant information of the project including the detailed design, the progress of construction and operation and environmental monitoring and audit results shall be provided to the Community Liaison Group.  The Permit Holder shall inform the Director in writing the membership and terms of reference of the Community Liaison Group.  The Permit Holder shall make the minutes of the Community Liaison Group meetings and all papers and documents available to the public through a website.
為提高透明度和加強與公眾溝通,在工程項目的建造工程展開前至少提早3個月,許可證持有人須成立一個由相關及受影響團體代表,包括漁業界組成的社區聯絡小組,以方便有關人士就所有環境問題進行溝通、查詢及處理投訴。社區聯絡小組須採取積極主動的做法,向當地社區傳遞信息、推廣社區合作和參與,並進行適當的地區環境改善工程。工程項目的所有相關資料,包括詳細設計、建造及營辦進度、環境監察及審核結果,均須提供予社區聯絡小組。許可證持有人須將社區聯絡小組的成員名單及職權範圍以書面通知署長,並須把社區聯絡小組的所有會議記錄及相關文件,上載至網站供公眾閱覽。

 

Submission of Works Schedule and Location Plan

提交施工時間表及位置圖

 

2.5               The dredging and filling works together with seawall construction of the Project shall be carried out in stages.  At least 1 month before the commencement of the above marine works of the Project, 3 hard copies and 1 electronic copy of works schedule and location plan in the scale of 1:1000 or other appropriate scales shall be deposited with the Director.  The works schedule and location plan shall include an update works programme with dates of commencement of construction activities, dredging and filling works together with seawall construction with reference to the sequence and locations as shown in Figure 2 of this Permit.

工程項目的挖泥和填土工程,以及海堤建造工程須分期進行。須在以上的海事工程展開前,至少提早1個月向署長存放施工時間表及用1:1 000或其他合適比例繪製的位置圖的3份複本及1份電子版本。施工時間表及位置圖須包括最新的工程計劃,並參照本許可證2所示的施工次序及位置,顯示建造工程、挖泥及填土工程,以及海堤建造工程分別的施工日期。

 

Before submission to the Director, the works schedule and location plan shall be certified by the ET Leader and verified by the IEC as conforming to the recommendations contained in the approved EIA report (Register No.: AEIAR-163/2012).

施工時間表及位置圖在提交署長前,須由環境小組組長核證及獨立環境查核人核實,證明其符合核准環評報告(登記冊編號:AEIAR-163/2012)內載的有關建議。

 

The recommendations in the works schedule and location plan shall be fully and properly implemented for the Project.

施工時間表及位置圖內載的有關建議均須在工程項目徹底及妥善執行。

 

Any subsequent changes to the construction sequences and/or arrangements shall be deposited with the Director at least two weeks before implementation of such changes.   Before submission to the Director, the proposed changes shall be certified by the ET Leader and verified by the IEC as conforming to the requirements set out in the “Technical Memorandum on Environmental Impact Assessment Process”.

施工次序及/或安排其後如有任何修改,許可證持有人須在實施有關修改前,至少提早2個星期向署長存放修改詳情。建議的修改在提交署長前,須由環境小組組長核證及獨立環境查核人核實,證明其符合環境影響評估程序技術備忘錄訂明的要求。

 

Submission of Silt Curtain Deployment Plan

提交隔泥幕設置計劃

 

2.6               At least 1 month before the commencement of the marine works of the Project, 3 hard copies and 1 electronic copy of a silt curtain deployment plan shall be deposited with the Director.  The silt curtain deployment plan shall include the construction programme and details on the design, operation and maintenance of silt curtain(s) for dredging and filling works.

2.7               At least 3 months before the commencement of construction of the Project, 3 hard copies and 1 electronic copy of detailed proposal on enhancement of air quality monitoring in Cheung Chau shall be submitted to the Director for approval.  The proposal shall include setting up of air quality monitoring station(s) and devising air quality monitoring programme(s) to keep track of the air quality baseline and impacts of the Project and their respective frequencies.  The monitoring shall cover various air quality parameters including, but not be limited to, dioxins, Air Quality Objectives parameters and heavy metals.  The monitoring station(s) shall be in operation at least 1 month before the commencement of construction of the Project.  The air quality monitoring results shall be made available to the public through a dedicated web site as required in Condition 3.6 below.

2.8               At least 1 month before the commencement of construction of the Project, 3 hard copies and 1 electronic copy of detailed design of the marine park shall be submitted to the Director for approval.  The detailed design shall include at least the following information/specifications:

(ii)         details of the marine park including proposed location and size, deployment of artificial reefs, release of fish fry, management plan and construction programme;

2.9               At least 1 month before the commencement of construction of the Project, 3 hard copies and 1 electronic copy of a detailed monitoring programme on Finless Porpoise during construction and operation phases shall be submitted to the Director for approval.  The detailed monitoring plan shall include monitoring frequency and mitigation measures to be taken to avoid disturbance to Finless Porpoise.

2.13           At least 1 month before the commencement of marine works of the Project, 3 hard copies and 1 electronic copy of Marine Mammal Watching Plan shall be deposited with the Director.  The Plan shall include regular inspection of silt curtains, visual inspection of the waters surrounded by silt curtains, and an action plan shall be devised to cope with any unpredicted incidents such a the case that any marine mammal including, but not limited to, Finless Porpoise is found within the waters surrounded by silt curtains.

2.14           To minimize the chance of vessel collision and disturbance to the Finless Porpoise and White-bellied Sea Eagle arising from frequent vessel traffic, at least 1 month before the commencement of construction of the Project, 3 hard copies and 1 electronic copy of regular marine travel routes of vessels moving to and from the Project site during construction and operation stages shall be deposited with the Director.  Any subsequent changes to the regular routes shall be certified by the ET Leader and verified by the IEC as conforming to the requirements in the approved EIA report (Register No.: AEIAR-163/2012) and deposited with the Director at least 2 weeks before changing the routes.

Submission of Detailed Plan on Wastewater Treatment Plant

2.15           At least 1 month before the commencement of construction of the Project, 3 hard copies and 1 electronic copy of a detailed plan on the wastewater treatment plant shall be submitted to the Director for approval.  The detailed plan shall be based on realistic assessment of various sources of sewage, including those generated from the sanitary facilities of the proposed Education Centre and potential surface runoff.  The plan shall also include schematic drawing(s) showing the treatment process and deodourisation system.

2.16           At least 1 month before the commencement of construction of the Project, 3 hard copies and 1 electronic copy of a waste management plan (WMP) for the construction stage of the Project shall be deposited with the Director. The WMP shall describe the arrangements for avoidance, reuse, recovery and recycling, storage, collection, treatment and disposal of different categories of waste to be generated from the construction activities and shall include the recommended mitigation measures on waste management in the EIA Report.  The WMP shall indicate the disposal location(s) of all surplus excavated spoil and other wastes.  A trip ticket system shall be included in the WMP.  Surplus excavated spoil and other wastes shall only be disposed of at designated disposal locations unless otherwise approved by the Director.

2.17           Dredging shall only be carried out at breakwaters and seawalls as shown in Figure 3.

2.18           Dredging shall only be carried out by closed grab dredger(s), each with grab size of not more than 2m3.  No more than 15 grabs per hour with a maximum daily dredging rate of 380 m3 shall be carried out.

挖泥工程只可採用密封式抓斗挖泥機進行,每部挖泥機的抓斗容量不得超過2立方米。每小時抓斗挖泥次數不得超過15次,最高挖泥量每日不得超過380立方米

 

 

2.19           Each grab shall be enclosed by a frame-type silt curtain as shown in Figure 4 of this Permit.

每個抓斗須如本許可證4所示,用框架式隔泥幕圍封。

 

2.20           No dredging shall be carried out within 100m to the nearest non-translocatable coral colony/colonies.

在不可移植的珊瑚群落附近100範圍內,不得進行任何挖泥工程。

 

2.21           All barges for transporting dredged/waste materials shall be fitted with tight bottom seals to prevent leakage of materials during loading and transportation.

2.22           To minimize loss of sediment affecting the water quality due to filling works:

(i)          the filling works for seawall construction shall be carried out behind silt curtain(s); and

(ii)         any seawall gap that needs to be provided for marine access shall be sealed by silt curtain(s) as detailed in the finalized silt curtain deployment plan deposited under Condition 2.6 of this Permit.

任何需提供作海上通道的海堤間隙,須圍上隔泥幕,詳情載於按本許可證條件第2.6項存放的隔泥幕設置計劃的最終定稿。

 

2.23           The filling materials shall only consist of public fill, rock and sand.  To reduce the elevation in suspended solids, the filling works shall be carried out in accordance with the filling composition and filling rates shown in Table 1 and Figure 5 of this Permit.

填土物料只可由公眾填料、石和沙組成。為減少懸浮固體上升,填土工程須按本許可證表15所示的填土成分和填土速度進行。

 

2.24           The dredging/reclamation works shall not be carried out simultaneously with the laying of submarine cables within the same location.  For works close to each other, the construction programme shall be arranged in such a way that the dredging/reclamation works within areas bounded by the breakwaters and the laying of submarine cables shall not be carried out within a distance of 80 m away from each other to avoid cumulative impacts on the environment.

不得在同一地點同時進行挖泥/填海工程和海底電纜敷設工程。如工程地點互相靠近,施工計劃須作適當安排,以令在防波堤圍封範圍內進行的挖泥/填海工程,與海底電纜敷設工程之間,相距不少於80 米的距離,從而避免對環境造成累積影響。

 

Measures to Minimize Disturbance to Marine Mammals

減低對海洋哺乳動物造成滋擾的措施

 

2.25           A marine mammal exclusion zone of 250m radius from silt curtain(s) shall be implemented during the installation or re-installation or relocation of floating type silt curtain(s).  Prior to the commencement of the installation/re-installation/relocation works, the marine mammal observer(s) shall scan the exclusion zone for at least 30 minutes.  If a marine mammal is observed within the exclusion zone during the installation/re-installation/relocation works, the relevant part of the works shall cease until the marine mammal has left the area.  The marine mammal observer(s) shall have the relevant training on detection of marine mammals and shall be independent of the construction contractor.  The marine mammal observer(s) shall form part of the Environmental Team.

在安裝、重置或遷移浮動式隔泥幕工程期間,須在四周250範圍設立海洋哺乳動物管制區。在有關安裝/重置/遷移工程展開前,海洋哺乳動物觀察員須視察管制區至少30分鐘。如在安裝/重置/遷移工程期間發現海洋哺乳動物在管制區內出沒,則須暫停工程的有關部分,直至海洋哺乳動物離開該範圍為止。海洋哺乳動物觀察員須曾接受偵測海洋哺乳動物的相關訓練,並須獨立於建造工程的承辦商。海洋哺乳動物觀察員須為環境小組的成員。

 

2.26           Once the floating silt curtain(s) as mentioned in Condition 2.6 above are installed/re-installed/relocated, the Marine Mammal Watching Plan as required to be deposited under Condition 2.13 of this Permit shall be implemented as part of the EM&A programme.

當上文條件第2.6項所述的浮動式隔泥幕完成安裝/重置/遷移後,須實施本許可證條件第2.13項規定存放的海洋哺乳動物觀察計劃,作為環監計劃的一部分。

 

2.27           To minimize the acoustic disturbance to marine mammals:

為減低對海洋哺乳動物造成的聲音滋擾:

 

(i)          construction works that may produce underwater acoustic disturbance shall be restricted within June to November to avoid peak season of Finless Porpoise occurrence;

可能產生水底聲音滋擾的建造工程,須禁止在6月至11月期間進行,以避開江豚出沒的高峰期;

 

(ii)         silence piling equipment such as vibratory or hydraulic impact hammers shall be used for the installation of sheet piling into the seabed; and

(iii)       no underwater percussive piling shall be used for the Project.

2.28           All vessels within the works areas shall not travel at a speed higher than 10 knots.

2.29           A surface water drainage system shall be provided to manage runoff during the construction and operation stages.  The system shall consist of the following features:

(i)         Channels shall be constructed around the perimeter of the site area to direct surface water to silt removal facilities such as sand/silt traps and sediment basins to remove sand/silt particles from runoff before discharge; and

(ii)        Oil interceptors shall be provided in the drainage system of any potentially contaminated areas (such as truck parking area and maintenance workshop) and regularly cleaned to prevent the release of oil products into the storm water drainage system in case of accidental spillages.

2.30           The Project shall treat:

(i)       a maximum of 3,000 tonnes of municipal solid waste daily by the incinerator; and

2.31          Reception of wastes on site shall only be limited from 8:00am to 8:00pm daily.

Measures to Mitigate Air Quality Impact during Operation of the Project

2.32          To minimize air quality impacts during operation of the Project:

(i)          an advanced air pollution control system, including selective catalytic reduction for removal of nitrogen oxides, activated carbon for removal of dioxins and a continuous emission monitoring system, shall be installed; and

須安裝先進的空氣污染控制系統,包括清除氮氧化物的選擇性催化還原器、清除二噁英的活性碳,以及排放物持續監察系統;以及

 

(ii)         the chimney height shall be 150m above ground with six flues, each with a diameter of 0.83m.

Measures to Mitigate Odour Emissions

2.33    The wastewater treatment plant, waste reception halls, waste storage areas and mechanical sorting and recycling plant shall be maintained at a negative pressure.

污水處理廠、廢物接收大堂、廢物存放區和機械式分類及回收廠均須維持在負氣壓下運作。

 

2.34    The wastewater treatment plant, waste reception halls and waste storage areas shall be fully enclosed and odorous air shall be incinerated.

污水處理廠、廢物接收大堂和廢物存放區須採用全封閉的設計,而有味空氣須予以焚化。

 

2.35    A deodorizing unit with odour removal efficiency of at least 95%, or otherwise agreed by the Director, shall be installed for the mechanical sorting and recycling plant before commencement of operation of the Project.

在工程項目展開營辦前,機械式分類及回收廠須安裝除臭效率達95%(或署長同意的除臭效率)的除臭系統。

 

2.36    All wastes shall be stored in enclosed containers during transportation to and from the Project boundary.

所有進入及離開工程項目範圍的廢物在運送期間須存放於密封的貨櫃。

 

Measures to Mitigate Water Quality Impacts during Operation of the Project

2.37    No wastewater effluent, except the saline water from desalination plant, arising from the Project shall be discharged to the coastal waters of southern water control zone.

除海水化淡廠的鹽水外,工程項目產生的污水,不得排入南區水質管制區的近岸海域。

 

2.38    The treated effluent from the wastewater treatment plant shall be reused.

經污水處理廠處理過的水,須予重新使用。

 

2.39    Maintenance dredging shall only be carried out within the area shown in Figure 6 of this Permit to avoid dredging too close to coral communities.

維修挖泥只可在本許可證6所示範圍內進行,以避免挖泥工程太接近珊瑚群落。

 

2.40    Maintenance dredging shall only be carried out by closed grab dredger(s), each with grab size of not more than 2m3.  No more than 15 grabs per hour with a maximum daily dredging rate of 380 m3 shall be carried out.

維修挖泥只可採用密封式抓斗挖泥機進行,每部挖泥機的抓斗容量不得超過2立方米。每小時抓斗挖泥次數不得超過15次,最高挖泥量每日不得超過380立方米

 

2.41           Each grab to be used for maintenance dredging shall be enclosed by as frame-type curtain as shown in Figure 4 of this Permit.

每個用作維修挖泥的抓斗須如本許可證圖4所示,用框架式隔泥幕圍封。

 

2.42           No maintenance dredging shall be carried out within 100m to the nearest non-translocatable coral community.

在不可移植的珊瑚群落附近100範圍內,不得進行任何維修挖泥工程。

 

2.43           All barges for transporting dredged materials from maintenance dredging shall be fitted with tight bottom seals to prevent leakage of materials during loading and transportation.

所有運載維修挖泥挖出物料的躉船,均須在船底加上緊密的封邊,以避免在裝卸和運載期間洩漏物料。

 

2.44           Floating refuse shall be collected and removed at regular intervals on a daily basis to keep the water within the Project site boundary and the neighbouring waters free from floating refuse.

須每日定時收集及清除漂浮垃圾,以確保工程項目工地範圍內的水域及鄰近水域沒有漂浮垃圾。

 

Measures to Mitigate Noise Impacts

2.45           The stack of the incinerator and the ventilation system shall be equipped with silencer or other acoustic treatment equipment.

焚化爐的煙囪和通風系統均須裝設滅聲器或其他隔音設備。

 

2.46           The exhaust of the ventilation system and any opening of the building shall be located away from noise sensitive receivers.

通風系統的排氣口及樓宇的開口須設於遠離噪音敏感受體。

 

Handling of Incineration By-product

處理焚化過程的副產品

 

2.47           The fly ash and air pollution control residues generated from incineration shall be treated by cement solidification or chemical stabilization prior to disposal to designated landfill sites.

焚化過程產生的飛灰和空氣污染控制殘渣,在運往指定的堆填區棄置前,須進行水泥固化或化學穩定化等處理程序。

 

2.48           The treated fly ash and air pollution control residues shall be tested to conform to the Incineration Residue Pollution Control Limits and leachability criteria shown in Table 2 of this Permit before disposal to designated landfill sites.

經處理的飛灰和空氣污染控制殘渣須進行測試,確認符合本許可證表 2所示的焚化殘渣污染控制上限和滲濾污水標準後,方可運往指定的堆填區棄置。

 

2.49           The incineration by-product including fly ash, air pollution control residues and bottom ash arising from the Project shall be:

工程項目焚化過程產生的副產品,包括飛灰、空氣污染控制殘渣及爐底灰,均須:

 

(i)          handled in closed systems fully segregated from the ambient environment; and

於封閉系統內處理,外圍環境完全隔離;以及

(ii)         transported in covered trucks or containers to the designated landfill sites.

使用有蓋貨車或貨櫃運往指定的堆填區。

 

 

3        Environmental Monitoring and Audit Requirements

環境監察及審核規定

           

3.1         The EM&A programme shall be implemented in accordance with the procedures and requirements as set out in the approved EM&A Manual or as approved by the Director. Any changes to the programme shall be justified by the ET Leader and verified by the IEC as conforming to the information and requirements contained in the EM&A Manual before submission to the Director for approval.       

環監計劃須按照核准的環監手冊或署長同意的程序及規定執行。計劃如有更改,須由環境小組組長提出充分理由,並由獨立環境查核人核實,證明其符合環監手冊內載的資料及規定,然後才提交署長批准。

 

3.2       Samples, measurements and necessary remedial actions shall be taken in accordance with the requirements of the EM&A Manual by:

 

(i)                  conducting baseline environmental monitoring;

(ii)                conducting impact monitoring;

(iii)               carrying out remedial actions described in the Event/Action Plans of the EM&A Manual in accordance with the time frame set out in the Event/Action Plans, or as agreed by the Director, in case where specified criteria in the EM&A Manual are exceeded; and

(iv)              logging and keeping records of the details of (i) to (iii) above for all parameters within 3 working days of the collection of data or completion of remedial action(s), for the purpose of preparing and submitting the monthly  EM&A Reports and to make available the information for inspection on site.

   取樣、測量及採取必要的補救行動時,均須按照環監手冊的規定進行:

(i)    進行環境基線監測;

(ii)   進行影響監測;

(iii)  如超逾環監手冊內指定的標準,則按照環監手冊內的事件 / 行動計劃所訂明的時限或署長所同意的時限,執行事件 / 行動計劃所說明的補救行動;以及

(iv)  在收集數據或完成補救行動3個工作天內,須記錄及備存上文(i)(iii)項各參數的詳情,用作擬備並提交每月環監報告,並備妥有關資料以供在工地查閱。

           

3.3       3 hard copies and 1 electronic copy of Baseline Monitoring Report shall be submitted to the Director at least 2 weeks before the commencement of construction of the Project.  The submissions shall be certified by the ET Leader and verified by the IEC as having complied with the requirements as set out in the EM&A Manual before submission to the Director.  Additional copies of the Baseline Monitoring Report shall be provided upon request by the Director.

            在工程項目建造工程展開前,須至少提早2個星期向署長提交基線監測報告的3份硬複本及1份電子版本。文件在提交署長前,須由環境小組組長核證及獨立環境查核人核實,證明符合環監手冊所載的規定。如署長要求,則須提交基線監測報告的額外複本。

 

3.4       3 hard copies and 1 electronic copy of Monthly EM&A Reports for the construction stage of the Project shall be submitted to the Director, within 2 weeks after the end of the reporting month.  The monthly EM&A Reports shall include a summary of all non-compliance (exceedances) of the environmental quality performance limits (Action and Limit Levels).  The submissions shall be certified by the ET Leader and verified by the IEC as having complied with the requirements as set out in the EM&A Manual before submission to the Director.  Additional copies of the Monthly EM&A Reports shall be provided upon request by the Director.

            在規定提交報告的月份結束後2個星期內,須向署長提交工程項目建造階段的每月環監報告的3份硬複本及1份電子版本。每月環監報告須包括各種不符合(超出)環境質素表現規限(行動及極限水平)情況的摘要。文件在提交署長前,須由環境小組組長核證及獨立環境查核人核實,證明符合環監手冊所載的規定。如署長要求,則須提交每月環監報告的額外複本。

 

3.5     All environmental monitoring and audit data submitted under this Permit shall be true, valid and correct.

          根據本許可證提交的所有環監數據,均須有效及真實無誤。

 

3.6     To ensure a high degree of transparency regarding the monitoring data and results in view of the public concern about the Project, all environmental monitoring and audit data and results and all submissions and all performance test data and results required by this Permit shall be made available by the Permit Holder to the public through a dedicated web site to be set up by the Permit Holder under Condition 4.2 below, in the shortest practicable time and in no event later than 2 weeks after such information is available.

          基於公眾對工程項目的關注,為確保監察數據和結果具高透明度,許可證持有人須盡快把各項環境監察及審核數據和結果、本許可證規定的所有提交文件及各項表現測試數據和結果,透過按下文條件第4.2項由許可證持有人設立的特定網站供公眾閱覽,在任何情況下均不得遲於這些資料可供閱覽後的2個星期。

 

 

4        Electronic Reporting of EM&A Information

環監資料的電子匯報

 

4.1       To facilitate public inspection of the Baseline Monitoring Report and Monthly EM&A Reports via the EIAO Internet Website and at the EIAO Register Office, electronic copies of these Reports shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF version 1.3 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hard copies as described in Conditions 3.3 and 3.4 above of this Permit.  For the HTML version, a content page capable of providing hyperlink to each section and sub-section of these Reports shall be included in the beginning of the document. Hyperlinks to all figures, drawings and tables in these Reports shall be provided in the main text from where the respective references are made.  All graphics in these Reports shall be in interlaced GIF format unless otherwise agreed by the Director.  The content of the electronic copies of these Reports must be the same as the hard copies.

為方便公眾透過環評條例互聯網網站及在環評條例登記冊辦事處查閱基線監測報告及每月環監報告,以超文本標示語言(HTML)(第4.0或較後版本)及便攜式文件格式(PDF)(第1.3或較後版本)製作的報告的電子版本,除非另獲署長同意,須與本許可證條件第3.33.4項所說明的硬複本同時提交。關於HTML的版本方面,可與報告各節及小節作出超文本連結的目錄須在文件開端加入。報告內各類圖表須在載有相關資料的正文內作出超文本連結。除非另獲署長同意,報告內所有圖形均須以交錯存取的GIF格式制定。報告的電子版本內容,必須與硬複本的內容一致。

 

4.2       The Permit Holder shall, within 6 weeks after the commencement of construction of the Project, set up a dedicated Internet web site and notify the Director in writing the Internet address where the environmental monitoring data and project information is to be placed.  All environmental monitoring data described in Condition 4.1 above shall be made available to the public via the abovementioned dedicated Internet web site in the shortest possible time and in any event no later than 2 weeks after the relevant environmental monitoring data are collected or become available, unless otherwise agreed with the Director. 

許可證持有人須在工程項目的建造工程展開後6個星期內,設立特定網站存放環境監察數據及工程項目資料,並以書面通知署長互聯網網址所在。除非另獲署長同意,上文條件第4.1項說明的所有環境監察數據及報告,均須盡快透過由許可證持有人設立的特定網站供公眾閱覽,在任何情況下均不得遲於有關資料在收集或可供發放後的2個星期內上載至該特定網站。

 

4.3               The Internet web site as described in Condition 4.2 above shall enable user-friendly public access to the environmental monitoring data and project information including the Project Profile and this Environmental Permit.  The Internet web site shall have features capable of: 

(i)          providing access to all environmental monitoring data of this Project collected   since the commencement of construction;

(ii)        searching by date;

(iii)       searching by types of monitoring data (air and water quality); and

(iv)      hyperlinking to relevant monitoring data after searching;

or otherwise as agreed by the Director.

文條件第4.2項說明的互聯網網站,必須方便用戶使用,讓公眾容易接達環境監察數據及工程項目資料,當中包括工程項目簡介及本環境許可證。除非另獲署長同意,互聯網網站須具備部件,提供下述功能:

(i)      接達建造工程展開後所收集的全部環境監察數據;

(ii)      按日期搜尋;

(iii)     按監察數據類別 (空氣質素及水質) 搜尋;以及

(iv)     在搜尋後與相關的監察數據作出超文本連結。

1.         This Permit consists of three parts, namely, Part A (Main Permit), Part B (Description of Designated Project) and Part C (Permit Conditions).  Any person relying on this permit should obtain independent legal advice on the legal implications under the EIAO, and the following notes are for general information only.

            本許可證共有3部,即A (許可證主要部分)B (指定工程項目的說明) C (許可證條件)。任何援引本許可證的人士須就環評條例的法律含意徵詢獨立法律意見,下述註解只供一般參考用。

 

2.         If there is a breach of any condition of this Permit, the Director or his authorized officer may, with the consent of the Secretary for the Environment, order the cessation of associated work until the remedial action is taken in respect of the resultant environmental damage, and in that case the Permit Holder shall not carry out any associated works without the permission of the Director or his authorized officer.

            如違反本許可證的任何條件,署長或獲授權人員徵得環境局局長的同意後勒令停止相關工程,直至許可證持有人為所造成的環境損害採取補救行動為止。在此情況下,許可證持有人未經署長或獲授權人員同意,不得進行任何相關工程。

 

3.         The Permit Holder may apply under Section 13 of the EIAO to the Director for a variation of the conditions of this Permit. The Permit Holder shall replace the original permit displayed on the Project site by the amended permit.

            許可證持有人可根據環評條例第13條的規定向署長申請更改本環境許可證的條件。許可證持有人須將經修改的許可證替換在建造工地內展示的原有許可證。

 

4.         A person who assumes the responsibility for the whole or a part of the Project may, before he assumes responsibility of the Project, apply under Section 12 of the EIAO to the Director for a further environmental permit.

承擔工程項目整項或部分工程的責任的人,在承擔責任之前,可根據環評條例第12條的規定向署長申請新的環境許可證。

 

5.         Under Section 14 of the EIAO, the Director may with the consent of the Secretary for the Environment, suspend, vary or cancel this Permit.  The suspended, varied or cancelled Permit shall be removed from display at the Project site.

根據環評條例第14條的規定,署長可在環境局局長的同意下暫時吊銷、更改或取消環境許可證。遭暫時吊銷、更改或取消的環境許可證必須從工程項目工地除下,不再展示。

6.         If this Permit is cancelled or surrendered during construction or operation of the Project, another environmental permit must be obtained under the EIAO before the Project could be continued.  It is an offence under Section 26(1) of the EIAO to construct or operate a designated project listed in Part 1 and 2 of Schedule 2 of the EIAO without a valid environmental permit.

如果本許可證在工程項目建造或營辦期間取消或交回,則在繼續營辦工程項目之前,必須先根據環評條例規定取得另一份環境許可證。根據環評條例第26(1)條的規定,任何人在沒有有效環境許可證的情況下建造或營辦環評條例附表212部所列明的指定工程項目,即屬犯罪。

 

7.         Any person who constructs or operates the Project contrary to the conditions in the Permit, and is convicted of an offence under the EIAO, is liable:

(i)                  on a first conviction on indictment to a fine of $2 million and to   imprisonment for 6 months;

(ii)                on a second or subsequent conviction on indictment to a fine of $5 million and to imprisonment for 2 years;

(iii)               on a first summary conviction to a fine at level 6 and to imprisonment for 6 months;

(iv)              on a second or subsequent summary conviction to a fine of $1 million and to imprisonment for 1 year; and

(v)                in any case where the offence is of a continuing nature, the court or magistrate may impose a fine of $10,000 for each day on which he is satisfied the offence continued.

如任何人在違反本許可證的條件下建造或營辦工程項目,根據環評條例,即屬犯罪—

(i)       一經循公訴程序首次定罪,可處罰款200萬元及監禁6個月;

(ii)      一經循公訴程序第二次或其後每次定罪,可處罰款500萬元及監禁2年;

(iii)    一經循簡易程序首次定罪,可處第6級罰款及監禁6個月;

(iv)    一經循簡易程序第二次或其後每次定罪,可處罰款100萬元及監禁1年;及

(v)      在任何情況下如該罪行屬持續性質,則法院或裁判官可就其信納該罪行持續的每天另處罰款10,000元。

 

8.         The Permit Holder may appeal against any condition of this Permit under Section 17 of the EIAO within 30 days of receipt of this Permit.

許可證持有人可在接獲本許可證後30天內,根據環評條例第17條就本許可證的任何條件提出上訴。

 

9.         The Notes are for general reference only and that the Permit Holder should refer to the EIAO for details and seek independent legal advice.
