Pursuant to Sections 10 and 12 of the Environmental Impact Assessment Ordinance (EIAO), the Director of Environmental Protection (the Director) grants this further environmental permit to the Fish Marketing Organization (hereinafter referred to as the “Permit Holder”) to operate the designated project described in Part B subject to the conditions specified in Part C. The issue of this further environmental permit is based on the documents, approvals or permissions described below:

根據環境影響評估條例(環評條例) 1012條的規定,環境保護署署長(署長)將本新的環境許可證批予魚類統營處 (下稱許可證持有人”),以營辦B所說明的指定工程項目,但須遵守C列明的條件。新的環境許可證是依據下列文件、批准或許可而簽發﹕

Hereunder is the description of the designated project mentioned in Part A of this environmental permit (hereinafter referred to as the “Permit”):

PART C (PERMIT CONDITIONS)

C (許可證條件)

 

1.         General Conditions

一般條件

 

1.1       The Permit Holder and any person working on the Project shall comply with all conditions set out in this Permit.  Any non-compliance by any person may constitute a contravention of the Environmental Impact Assessment Ordinance (EIAO) (Cap. 499) and may become the subject of appropriate action being taken under the EIAO.

許可證持有人及任何從事工程項目的人士必須符合本許可證載列的全部條件。任何人士如有不符合本許可證的情況,可能違反環境影響評估條例(「環評條例」) (499) 的規定,而當局可根據環評條例採取適當行動。

 

 1.2      The Permit Holder shall ensure full compliance with all legislation from time to time in force including without limitation to the Noise Control Ordinance (Cap. 400), Air Pollution Control Ordinance (Cap. 311), Water Pollution Control Ordinance (Cap. 358) and Waste Disposal Ordinance (Cap. 354).  This Permit does not of itself constitute any ground of defence against any proceedings instituted under any legislation or imply any approval under any legislation.

許可證持有人須經常確保完全符合現行法例的規定,包括但不限於噪音管制條例 (400);空氣污染管制條例 (311);水污染管制條例 (358);以及廢物處置條例 (354)。本許可證本身不會就根據任何法例提出的訴訟構成任何抗辯理由,或根據任何法例默示任何批准。

 

1.3       The Permit Holder shall make copies of this Permit together with all documents referred to in this Permit or the documents referred to in Part A of the Permit readily available at all times for inspection by the Director or his authorised officers at all sites/offices covered by this Permit. Any reference to the Permit shall include all documents referred to in the Permit and also the relevant documents in the Register.

許可證持有人須印製本許可證的複本,連同本許可證所述的所有文件及本許可證A所述文件,以供署長或獲授權人員於任何時間內在本許可證所涵蓋的所有工地 / 辦事處查閱。凡提述本許可證,須包括本許可證所述的所有文件及登記冊內的相關文件。

 

1.4       The Permit Holder shall give a copy of this Permit to the person(s) in charge of the site(s) and ensure that such person(s) fully understands all conditions and all requirements incorporated by the Permit. The site(s) refers to site(s) of operation of the Project and shall mean the same hereafter.

許可證持有人須把本許可證的複本交予有關工地的負責人,並確保這些人士完全明白本許可證的所有條件與規定。工地是指營辦工程項目的工地,下文所提及的工地亦屬同一意思。

 

 

1.5       The Permit Holder shall display conspicuously a copy of this Permit on the Project site(s) at all vehicular site entrances/exits or at a convenient location for public information at all times. The Permit Holder shall ensure that the most updated information about the Permit, including any amended Permit, is displayed at such locations. If the Permit Holder surrenders a part or the whole of the Permit, the notice he sends to the Director shall also be displayed at the same locations as the original Permit.  The suspended, varied or cancelled Permit shall be removed from display at the site(s).

許可證持有人須在工程項目的工地的所有車輛進出口或一處方便地點,顯眼地展示本許可證的複本,以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於本許可證 (包括任何經修訂的許可證) 的最新資料。許可證持有人如交回許可證的部分或全部,必須把其送交署長的通知書,在備有原有許可證的相同地點展示。遭暫時吊銷、更改或取消的許可證必須從工地除下,不再展示。

 

1.6       The Permit Holder shall operate the Project in accordance with the project descriptions in Part B of this Permit.

許可證持有人須依據本許可證B的工程項目說明營辦工程項目。

 

1.7       The Permit Holder shall ensure that the Project is designed and operated in accordance with the information and all recommendations described in the EIA Report (Register No.: AEIAR-070/2003), other relevant documents in the Register, the information and mitigation measures described in this Permit, mitigation measures recommended in submissions deposited with or approved by the Director as a result of permit conditions contained in this Permit, and mitigation measures to be recommended under on going surveillance and monitoring activities of the Project. Where recommendations referred to in the documents of the Register are not expressly referred to in this Permit, such recommendations are nevertheless to be implemented unless expressly excluded or impliedly amended in this Permit.

許可證持有人須確保工程項目的設計及營辦,按照下述資料及措施辦理:環評報告 (登記冊編號:AEIAR-070/2003)所說明的資料及所有建議;登記冊內的其他相關文件;本許可證所說明的資料及緩解措施;根據本許可證內載的條件向署長存放或獲署長批准的提交文件所建議的緩解措施;以及在工程項目進行的持續監察及監測工作所建議的緩解措施。登記冊文件所述建議如沒有在本許可證明確表示,則仍須實施這些建議,除非獲本許可證明確豁除或默示修訂。

 

1.8       All submissions, as required under this Permit, shall be rectified and resubmitted in accordance with the comments, if any, made by the Director within one month of the receipt of the Director’s comments or otherwise as specified by the Director.

所有按本許可證規定提交的文件,須在接獲署長的意見 (如有者) 1個月內(除非署長另行指定),根據署長的意見加以修正並再向署長提交。

 

1.9       All submissions approved by the Director, all submissions deposited without comments by the Director, or all submissions rectified in accordance with comments by the Director under this Permit shall be construed as part of the permit conditions described in Part C of this Permit. Any variation of the submissions shall be approved by the Director in writing or as prescribed in the relevant permit conditions. Any non-compliance with the submissions may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499). All submissions or any variation of the submissions shall be certified by the Environmental Team Leader and verified by the Independent Environmental Checker referred to in Conditions 2.1 and 2.2 below before submitting to the Director under the Permit.

所有獲署長批准的文件、署長沒有給予意見的所有存放文件或根據本許可證規定由署長給予意見修正的所有提交文件,均須詮釋為本許可證C說明的許可證條件的一部分。提交文件如有任何修訂,均須獲署長的書面批准,或符合有關許可證條件訂明的規定。如有不符合提交文件的情況,則可能違反環境影響評估條例 (499) 的規定。所有提交文件或提交文件的任何修訂本,均須按下文條件第2.12.2項所述由環境小組組長核證及獨立環境查核人核實,然後才按本許可證規定向署長提交。

 

1.10     The Permit Holder shall release all finalized submissions, as required under this Permit, to the public by depositing copies in the EIAO Register Office, or in any other places, or any internet websites as specified by the Director, or by any other means as specified by the Director for public inspection. For this purpose, the Permit Holder shall provide sufficient copies of the submissions.

許可證持有人須把所有按本許可證規定提交的文件定稿公開給公眾人士知道,方法是把有關文件複本存放於環評條例登記冊辦事處,或署長指定的任何其他地方,或署長指定的任何互聯網網站,或採取署長指定的任何其他方法,以供公眾查閱。因此,許可證持有人須提供足夠數量的複本。

 

1.11     All submissions to the Director required under this Permit shall be delivered either in person or by registered mail to the EIAO Register Office (currently at 27/F, Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong). Electronic copies of all finalized submissions required under this Permit shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF version 1.3 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hard copies.

本許可證規定向署長提交的所有文件,須親身送交或以掛號方式郵寄至環評條例登記冊辦事處 (現址為:香港灣仔軒尼詩道130號修頓中心27)。所有按本許可證規定提交的文件定稿的電子版本,均須以超文本標示語言 (HTML) (4.0或較後版本) 和便攜式文件格式 (PDF) (1.3或較後版本) 製作,除非另獲署長同意,並須與硬複本同時提交。

 

1.12     The Director shall be notified in writing the commencement date of operation of the Project at least two weeks before the commencement of operation of the Project. The Director shall be notified in writing immediately if there is any change of the commencement date of the operation.

在開始營辦工程項目前,須至少提早2個星期以書面方式把開始營辦工程項目的日期通知署長。營辦日期如有任何更改,須立即以書面方式通知署長。

 

2.         Specific Conditions

     特定條件

 

Environmental Monitoring and Audit (EM&A) Personnel

環境監察及審核(環監)人員

 

2.1       An Environmental Team (ET) shall be established before the commencement of operation of the Project. The ET shall not be in any way an associated body of the Contractor or the Independent Environmental Checker (IEC) for the Project. The ET shall be headed by an ET Leader. The ET Leader shall be a person who has at least 7 years of experience in environmental monitoring and audit (EM&A) or environmental management. The ET and the ET Leader shall be responsible for the implementation of the EM&A programme in accordance with the EM&A requirements as contained in the EM&A Manual. The ET Leader shall keep a contemporaneous log-book of each and every instance or circumstance or change of circumstances which may affect the environmental impact assessment and each and every non-compliance with the recommendations of the EIA Report (Register No.: AEIAR-070/2003) or this Permit. The ET Leader shall notify the IEC within one working day of the occurrence of any such instance or circumstance or change of circumstances. The ET Leader’s log-book shall be kept readily available for inspection by all persons assisting in supervision of the implementation of the recommendations of the EIA Report (Register No.: AEIAR-070/2003) and this Permit or by the Director or his authorized officers. Failure to maintain records in the log-book, failure to discharge the duties of the ET Leader as defined in the EM&A Manual or failure to comply with this Condition would entitle the Director to require the Permit Holder by notice in writing to replace the ET Leader. Failure by the Permit Holder to make replacement, or further failure to keep contemporaneous records in the log-book despite the employment of a new ET Leader may render the Permit liable to suspension, cancellation or variation.

          在工程項目的營辦展開前成立一個環境小組。環境小組不得與工程項目的承辦商或獨立環境查核人有任何聯繫。環境小組須由一名環境小組組長帶領。環境小組組長須在環監或環境管理方面至少有7年經驗。環境小組及環境小組組長須按環監手冊內載的環監規定,執行環監計劃。環境小組組長須保存一本記錄冊,同時記載可能會影響環境評估的每件事項、每種情況或每次情況變化,以及每次不符合核准環評報告(登記冊編號:AEIAR-070/2003) 的建議或本許可證的情況。環境小組組長須在發生任何類似事件、情況或情況變化後1個工作天內通知獨立環境查核人。存放環境小組組長的記錄冊的地方,須可供協助督導執行環評報告 (登記冊編號:AEIAR-070/2003) 的建議或本許可證的所有人士、署長或獲授權人員隨時查閱。環境小組組長如未能在記錄冊保存記錄、未能執行環監手冊所列明的環境小組組長職務,或未能符合本條件的規定,署長有權以書面要求許可證持有人撤換環境小組組長。許可證持有人如未能安排人選替補,或在聘用新環境小組組長後仍未能在記錄冊保存同期的記錄,或會導致許可證遭暫時吊銷、取消或更改。

 

 

2.2       An IEC shall be employed before the commencement of operation of the Project. The IEC shall not be in any way an associated body of the Contractor or the ET for the Project. The IEC shall be a person who has at least 7 years of experience in EM&A or environmental management. The IEC shall be responsible for the duties defined in the EM&A Manual and shall audit the overall EM&A programme, including the implementation of all environmental mitigation measures, submissions required in the EM&A Manual, and any other submissions required under this Permit. In addition, the IEC shall be responsible for verifying the environmental acceptability of permanent and temporary works, relevant design plans and submissions under this Permit. The IEC shall verify the log-book(s) mentioned in Condition 2.1 of this Permit. The IEC shall notify the Director by fax, within one working day of receipt of notification from the ET Leader of each and every occurrence, change of circumstances or non-compliance with the EIA Report (Register No.: AEIAR-070/2003) and this Permit, which might affect the monitoring or control of adverse environmental impacts from the Project. In the case where the IEC fails to so notify the Director of the same, fails to discharge the duties of the IEC as defined in the EM&A Manual or fails to comply with this Condition, the Director may require the Permit Holder by notice in writing to replace the IEC. Failure to replace the IEC as directed or further failure to so notify the Director despite employment of a new IEC may render the Permit liable to suspension, cancellation or variation. Notification by the Permit Holder is the same as notification by the IEC for the purpose of this Condition.

在工程項目的營辦展開前聘用一名獨立環境查核人。獨立環境查核人不得與工程項目的承辦商或環境小組有任何聯繫。獨立環境查核人須在環監或環境管理方面至少有7年經驗。獨立環境查核人須執行環監手冊所列明的職務,以及審核整體環監計劃,包括實施所有環境緩解措施、提交環監手冊規定的文件,以及提交本許可證所要求的其他文件。此外,獨立環境查核人須核實永久及臨時工程在環境上的可接受程度、相關的設計圖則和根據本許可證提交的文件,並須核實本許可證條件2.1項所述的記錄冊。在每次出現事故、情況變化或不符合環評報告(登記冊編號:AEIAR-070/2003) 的建議或本許可證的情況,而可能會妨礙工程項目所造成不良環境影響的監察或控制工作時,獨立環境查核人須在接獲環境小組組長通知後1個工作天內以傳真方式通知署長。獨立環境查核人如未能通知署長有關情況,未能執行環監手冊所列明的獨立環境查核人職務,或未能符合本條件的規定,署長可以書面要求許可證持有人撤換獨立環境查核人。如未能按指示撤換獨立環境查核人,或在聘用新獨立環境查核人後仍未能通知署長有關情況,則或會導致許可證遭暫時吊銷、取消或更改。為執行本條件,許可證持有人的通知等同獨立環境查核人的通知。

 

Design of the Wholesale Fish Market

魚類批發市場的設計

 

2.3       To minimise noise and odour impacts, the building of the Wholesale Fish Market shall be a fully-enclosed design with openings only along the waterfront to allow for loading of fish stocks from marine vessels and associated activities.

為盡量減低噪音及氣味的影響,魚類批發市場大樓須採用完全密封式設計,只於臨海一面設出入口供漁船下卸漁獲及相關活動之用。

 

2.4       To minimise noise and odour impacts, the external wall of the Wholesale Fish Market along Wu Shan Road shall be a blank façade with no opening.  Pedestrian entrance at street level along Wu Shan Road, if any, shall be designed with double doors and a lobby. 

            為盡量減低噪音及氣味的影響,魚類批發市場沿湖山路的外牆須為密封外牆,不設其他出入口。湖山路路旁的行人入口處(如有者)須採用雙門的設計,並附設大堂。

 

2.5       To minimise noise and air quality impacts, a minimum of 40 lorry parking spaces shall be provided inside the Wholesale Fish Market with access from the northern side of the building to allow for parking, loading and unloading activities to take place inside the building of the Wholesale Fish Market as shown in Figure 2. 

            為盡量減低噪音及對空氣質素的影響,魚類批發市場內須提供至少40個貨車停泊位,而車輛入口將設於大樓北面,讓貨車可停泊在魚類批發市場大樓內裝卸貨物(2所示)

 

2.6       To minimise road traffic noise impact, the junction at Wu Shan Road for vehicle access to the Wholesale Fish Market shall be designed to prohibit traffic entering and leaving the building from the south of Wu Shan Road as shown in Figure 3.

            為盡量減低道路交通噪音的影響,從湖山路通往魚類批發市場的交匯處的設計,須禁止車輛從湖山路南面進出大樓(3所示)

 

2.7       To minimise noise impact, the Wholesale Fish Market building shall be installed with a noise canopy of at least 5 m wide and 90 m long projected from the façade of the Wholesale Fish Market along the waterfront to screen off the noise emitted from loading and unloading activities and berthed vessels as shown in Figure 2.

            為盡量減低噪音的影響,魚類批發市場大樓沿海傍一帶須設置一個至少5闊和90長的隔音簷蓬,從大樓的外牆向外伸出,以阻隔上落貨及漁船泊岸所發出的聲音(2所示)

 

2.8       To minimise noise impact, acoustic louvers and silencers with a minimum insertion loss of 15dB(A) shall be installed at plantroom ventilation openings and mechanical ventilation systems respectively. 

            為盡量減低噪音的影響,機房通風口及機械通風系統須分別安裝隔音百葉簾及滅聲器,並至少具減低15分貝(A)噪音的效能。

 

2.9       To minimise odour impact, an induced draft ventilation system with extraction points located at the fish handling areas and lorry parking area shall be installed.  The exhausts of the ventilation system shall be vented from the waterfront side of the building of the Wholesale Fish Market as shown in Figure 4.  The induced draft ventilation system shall be operated at a rate of no less than 10 air changes per hour throughout the peak operating hours of the Wholesale Fish Market from 3:00 am to 6:30 am.

            為盡量減低氣味的影響,在魚類批發市場處理魚類的地方及貨車停泊處須裝設引風通風系統,並經由魚類批發市場大樓向海一面排出廢氣(4所示)。在凌晨三時至上午六時半魚類批發市場的運作高峰期間,該引風通風系統每小時換氣次數不得少於十次。

 

2.10     To minimise odour impact, a de-odorised scrubber system or equivalent de-odorising system shall be installed for the Wholesale Fish Market on mezzanine floor as shown in Figure 4 to remove odour prior to discharging outside the Wholesale Fish Market.

            為盡量減低氣味的影響,魚類批發市場須在閣樓裝置除臭滌氣系統或等效的除臭系統(4所示),將氣味消除後才把空氣排出魚類批發市場。

 

2.11     To minimise odour impact, fresh air intakes of the mechanical ventilation system provided to the community hall shall be located at level above 15mPD and fitted with odour removal systems such as carbon filters to remove odour.

            為盡量減低氣味的影響,提供予社區會堂的機械通風系統的新鮮空氣入氣口,須設於主水平基準15以上的位置,並內置除臭系統,例如碳精過濾器,以消減氣味。

 

2.12     To minimise odour impact, building materials used associated with the operation of the Wholesale Fish Market shall be impervious, durable and easy to clean to avoid build-up of odour from organic material carried in washing water.

            為盡量減低氣味的影響,與魚類批發市場運作有關的部分,須採用不透氣、耐用及容易清潔的建築物料,以避免洗滌水含有的有機物積聚異味。

 

            Measures to Mitigate Environmental Impacts during Maintenance Works

            維修工程環境影響緩解措施

 

2.13     To minimise air quality impact, solid hoarding of at least 2.4 m high shall be erected along the maintenance works site boundary, except at the site entrance and exit, during maintenance works of the Project.

            盡量減低對空氣質素的影響,在工程項目維修期間,除工地的出入口外,維修工地的邊界須豎立至少2.4高的堅固圍板。

 

2.14     To minimise air quality impact, any stockpile of dusty materials shall be covered entirely by impervious sheeting; placed in an area sheltered on the top and the three sides; or sprayed with water or a dust suppression chemical so as to maintain the entire surface wet.

            盡量減低對空氣質素的影響,易生塵埃的物料須堆存在設有上蓋及三面密封的地方,並以不透氣隔塵布全面覆蓋,或在表面灑水或噴上塵埃抑制化學劑,以保持表面濕潤

 

2.15     To minimise air quality impact, vehicle washing facilities including a high pressure water jet shall be provided at vehicle exit points and vehicles immediately before leaving the maintenance works site shall be washed to remove any dust material from their wheels and bodies.

            盡量減低對空氣質素的影響,車輛出口處須設置車輛清洗設施,包括高壓噴水器,車輛須先清洗車輪及車身的塵埃,方可駛離維修工地。

 

2.16     To minimise noise impact, no percussive piling shall be used for the maintenance works of the Project.

            盡量減低噪音的影響,工程項目的維修工程不得採用撞擊式打樁

 

2.17     To minimise noise impact, silencers or mufflers on maintenance works equipment shall be utilised and shall be properly maintained during maintenance works of the Project.

            盡量減低噪音的影響,在工程項目維修期間,維修設備均須採用滅聲器或減音器,以及進行適當的保養。

 

2.18     To minimise water quality impact, surface run-off from the maintenance works site shall be directed to silt traps or sedimentation basins before reuse or discharge with the help of channels, earth bunds or sand bag barriers for removal of suspended solids prior to discharging into stormwater drainage system.  No discharge of surface runoff into foul sewers shall be allowed.

            盡量減低對水質的影響,維修工地的地面徑流須利用水渠、土堤或沙包防護屏障清除水中的懸浮固體後,先引流至沙井或沉澱池,方可循環再用或排放至雨水排放系統。地面徑流不得直接排放到污水渠。

 

2.19     To minimise air and water quality impacts, main haul roads, vehicle washing areas and the sections of roads between the washing facilities and the vehicle exit points shall be paved with concrete, bituminous materials, hardcore or metal plates.

            盡量減低對空氣及水質的影響,主要運料路、車輛清洗區及介乎清洗設施和車輛出口處之間的路段,均須以混凝土、瀝青物料、硬填料或金屬板鋪砌。

2.20     To monitor environmental impacts of the operation of the Wholesale Fish Market, an Environmental Management Committee (EMC), including representatives from the market management, market users and the nearby residents, shall be set up before the commencement of operation of the Project to closely supervise the operation of the Wholesale Fish Market.  The EMC shall advise on and monitor the effectiveness of the proposed mitigation measures and the environmental performance of the Wholesale Fish Market according to the EIA Report (Register No.: AEIAR-070/2003) and this Permit, and to follow-up on environmental complaints about the operation of the Wholesale Fish Market.

            為監察魚類批發市場的營辦對環境的影響,須在開始營辦工程項目前成立一個環境管理委員會,成員包括市場管理層、市場使用者及附近居民的代表,以便密切監督魚類批發市場的營辦情況。環境管理委員會須根據環評報告(登記冊編號:AEIAR-070/2003)及本許可證的規定,就建議採取的緩解措施的成效及魚類批發市場的環境表現,提出意見及進行監察,以及跟進與魚類批發市場營辦有關的環境問題的投訴。

 

2.21     The Permit Holder shall place all minutes of meeting, the relevant documents and the associated papers of the EMC on the dedicated website set up by the Permit Holder under Condition 4.2, within one month of the day of the meeting.

許可證持有人須把所有環境管理委員會會議紀錄及有關文件及資料,由會議日期起計1個月內存於許可證持有人按條件第4.2項設立的特定網站內。

 

          Routing Arrangement of Marine Vessels

船隻航行路線安排  

 

2.22     To further minimise and monitor noise impact during operational stage, a routing arrangement of marine vessels associated with the operation of the Wholesale Fish Market shall be submitted to and approved by the Director before the commencement of operation of the Wholesale Fish Market.  All recommendations of the approved submission shall be followed and implemented.

為進一步減低及監察魚類批發市場在營辦期間的噪音影響,在開始營辦魚類批發市場前,須就涉及運作的船隻的航行路線安排向署長提交文件,並獲署長批准。許可證持有人須遵守及實施獲核准文件中載述的所有建議。

 

Maintenance of the Design of the Wholesale Fish Market

維持魚類批發市場的設計

 

2.23     To minimise the environmental impacts, the design of the Wholesale Fish Market specified in Conditions 2.3 to 2.12 shall be properly implemented and maintained throughout the operation of the Project:

            為盡量減低對環境的影響,許可證持有人須在營辦工程項目整段期間,妥善執行及維持條件第2.3項至2.12項所指定的魚類批發市場的設計:

 

(i)                   the building of the Wholesale Fish Market shall be fully-enclosed with openings only along the waterfront to allow for loading of fish stocks from marine vessels and associated activities.

魚類批發市場大樓須採用完全密封式設計,只於臨海一面設出入口供漁船下卸漁獲及相關活動之用。

 

(ii)                 the external wall of the Wholesale Fish Market along Wu Shan Road shall be a blank façade with no opening.  Pedestrian entrance at street level along Wu Shan Road, if any, shall be designed with double doors and a lobby.

魚類批發市場沿湖山路的外牆須為密封外牆,不設其他出入口。湖山路路旁的行人入口處(如有者)須採用雙門的設計,並附設大堂。

 

(iii)                a minimum of 40 lorry parking spaces shall be provided inside the Wholesale Fish Market with access from the northern side of the building to allow for parking, loading and unloading activities to take place inside the building of the Wholesale Fish Market as shown in Figure 2.

魚類批發市場內須提供至少40個貨車停泊位,而車輛入口將設於大樓北面,讓貨車可停泊在魚類批發市場大樓內裝卸貨物(2所示)

 

(iv)               the junction at Wu Shan Road for vehicle access to the Wholesale Fish Market shall be designed to prohibit traffic entering and leaving the building from the south of Wu Shan Road as shown in Figure 3.

從湖山路通往魚類批發市場的交匯處的設計,須禁止車輛從湖山路南面進出大樓(3所示)

 

(v)                 the Wholesale Fish Market building shall be installed with a noise canopy of at least 5 m wide and 90 m long projected from the façade of the Wholesale Fish Market along the waterfront to screen off the noise emitted from loading and unloading activities and berthed vessels as shown in Figure 2.

(vi)               acoustic louvers and silencers with a minimum insertion loss of 15dB(A) shall be installed at plantroom ventilation openings and mechanical ventilation systems respectively.

機房通風口及機械通風系統須分別安裝隔音百葉簾及滅聲器,並至少具減低15分貝(A)噪音的效能。

 

(vii)              an induced draft ventilation system with extraction points located at the fish handling areas and lorry parking area shall be installed.  The exhausts of the ventilation system shall be vented from the waterfront side of the building of the Wholesale Fish Market as shown in Figure 4.  The induced draft ventilation system shall be operated at a rate of no less than 10 air changes per hour throughout the peak operating hours of the Wholesale Fish Market from 3:00 am to 6:30 am.

魚類批發市場處理魚類的地方及貨車停泊處須裝設引風通風系統,並經由魚類批發市場大樓向海一面排出廢氣(4所示)。在凌晨三時至上午六時半魚類批發市場的運作高峰期間,該引風通風系統每小時換氣次數不得少於十次。

 

(viii)            a de-odorised scrubber system or equivalent de-odorising system shall be installed for the Wholesale Fish Market on mezzanine floor as shown in Figure 4 to remove odour prior to discharge outside the Wholesale Fish Market.

魚類批發市場須在閣樓裝置除臭滌氣系統或等效的除臭系統(4所示),將氣味消除後才把空氣排出魚類批發市場。

 

(ix)               fresh air intakes of the mechanical ventilation system provided to the community hall shall be located at level above 15mPD and fitted with odour removal systems such as carbon filters to remove odour.

提供予社區會堂的機械通風系統的新鮮空氣入氣口,須設於主水平基準15以上的位置,並內置除臭系統,例如碳精過濾器,以消減氣味。

 

(x)                 building materials used associated with the operation of the Wholesale Fish Market shall be impervious, durable and easy to clean to avoid build-up of odour from organic material carried in washing water.

與魚類批發市場運作有關的部分,須採用不透氣、耐用及容易清潔的建築物料,以避免洗滌水含有的有機物積聚異味。

 

            Measures to Mitigate Environmental Impacts during Operation of the Project

營辦工程項目期間的環境影響緩解措施

 

2.24     To minimise marine traffic noise impact, the Permit Holder shall require marine vessels associated with the operation of the Wholesale Fish Market to use the eastern entrance of the Tuen Mun Typhoon Shelter when they approach and leave the Wholesale Fish Market.

            為盡量減低海上交通噪音的影響,許可證持有人須規定與魚類批發市場運作有關的船隻使用屯門避風塘東面的入口進出魚類批發市場。

 

2.25     To minimise marine traffic noise impact, no more than nine fishing vessels and two sampans shall be allowed to approach and leave the Wholesale Fish Market per hour.

            為盡量減低海上交通噪音的影響,每小時不得多於9艘漁船及2艘舢舨進出魚類批發市場。

 

2.26     To minimise noise impact, no loudhailer shall be used by fish traders and market users within the Wholesale Fish Market.

            為盡量減低噪音的影響,魚販及市場使用者在魚類批發市場範圍內不得使用擴音器。

 

2.27     To minimise noise impact, the Permit Holder shall require marine vessels visiting the Wholesale Fish Market not to use any loudhailer and horn, except under emergency.

            為盡量減低噪音的影響,許可證持有人須規定使用魚類批發市場的船隻,除緊急情況外,不得使用擴音器及喇叭。

 

2.28     To minimise road traffic noise and air quality impacts, vehicles/lorries associated with the operation of the Wholesale Fish Market shall only be parked inside the carpark of the Wholesale Fish Market with access from the northern side of the building as shown in Figure 2.  The Permit Holder shall ensure no on-street parking and on-street loading and unloading activities associated with the operation of the Wholesale Fish Market.

            為盡量減低交通噪音及對空氣質素的影響,與魚類批發市場運作有關的車輛/貨車,只可從大樓北面進入及停泊在魚類批發市場的停車場內(2所示)。許可證持有人須確保涉及運作的車輛,不會在魚類批發市場外的路旁停泊及裝卸貨物。

 

2.29     To minimise road traffic noise impact, no traffic shall be allowed to enter and leave the Wholesale Fish Market from the south of Wu Shan Road as shown in Figure 3.

            為盡量減低交通噪音的影響,車輛不得從湖山路南面進出魚類批發市場(3所示)

 

2.30    To minimise odour impact, the fish market areas shall be cleaned at least daily.  Organic waste from the Wholesale Fish Market shall be sealed in collection bags or containers for daily disposal out of the Wholesale Fish Market.

            為盡量減低氣味的影響,魚市場的範圍須至少每日進行清洗。魚類批發市場產生的有機廢物,須用收集袋或收集箱密封後每日從市場運走棄置。

 

 

3.         Environmental Monitoring and Audit (EM&A) Requirements

     環境監察及審核(環監)規定

           

3.1       The EM&A programme shall be implemented in accordance with the procedures and requirements as set out in the EM&A Manual.  Any changes to the EM&A programme shall be justified by the ET Leader and verified by the IEC as conforming to the requirements set out in the EM&A Manual before submission to the Director for approval.

            環監計劃須按照環監手冊所載的程序及規定執行。環監計劃如有更改,須由環境小組組長核證,並由獨立環境查核人核實,證明其符合環監手冊所載規定,方可提交署長徵求批准。

 

3.2       Samples, surveys, measurements and necessary remedial actions shall be taken in accordance with the EM&A Manual by:

            取樣、調查、測量及所需的補救行動,均須按照環監手冊所載的規定進行:

 

(i)                   conducting odour, operational noise and marine traffic noise monitoring at least during the peak operating hours from 3:00 am to 6:30 am at a frequency of no less than once a week throughout the first 12 months of the operation of the Wholesale Fish Market;

在魚類批發市場營辦的首12個月期間,每週至少一次在市場的運作高峰期,即凌晨三時至上午六時半,就氣味、運作噪音及海上交通噪音進行監測;

 

(ii)                carrying out remedial actions described in the Event/Action Plans of the EM&A Manual fully and properly in accordance with the time frames set out in the Event/Action Plans, or as agreed by the Director; and

按照環監手冊內的事件 / 行動計劃所訂明的時限或署長所同意的時限,執行事件 / 行動計劃所說明的補救行動;以及

 

(iii)              logging and keeping records of details of (i) to (ii) above for all parameters within 3 working days of the collection of data or completion of remedial action(s), for the purpose of preparing and submitting the monthly EM&A reports and to make available the information for inspection on site.

在收集數據或完成補救行動3個工作天內,須記錄及備存上述(i)(ii)各參數的詳情,用作擬備並提交每月環監報告,並備妥有關資料以供在工地查閱。

 

3.3       Four hard copies and one electronic copy of the monthly EM&A Report shall be submitted to the Director within two weeks after the end of the reporting month.  The EM&A Reports shall include a summary of all non-compliances (exceedances) of the environmental quality performance limits (Action and Limit Levels). The submission shall be certified by the ET leader and verified by the IEC before submission to the Director.  Additional copies of the submission shall be provided upon request by the Director.

            在規定提交報告的月份結束後2個星期內,須向署長提交每月環監報告的4份硬複本及1份電子版本。每月環監報告須包括各種不符合 (超出) 環境質素表現規限 (行動及極限水平情況的摘要。文件提交署長前,須由環境小組組長核證及獨立環境查核人核實。如署長要求,則須提交額外複本。

 

3.4       All environmental monitoring and audit results submitted under this Permit shall be true, valid and correct.

            根據本許可證提交的所有環境監察及審核結果,均須有效及真實無誤。

 

3.5       To ensure high degree of transparency regarding the monitoring data and results of the Project, all environmental monitoring and audit data and results and all submissions and all performance test data and results required by this Permit shall be made available by the Permit Holder to the public through a dedicated website set up under Condition 4.2 below, in the shortest practicable time and in no event later than two weeks after such information is available.

            為確保工程項目的監察數據和結果具高透明度,許可證持有人須盡快把各項環境監察及審核數據和結果、本許可證規定的所有提交文件及各項表現測試數據和結果,透過按下文條件第4.2項設立的特定網站供公眾閱覽,在任何情況下均不得遲於這些資料可供閱覽後的2個星期。

 

Visual Monitoring by Web Cameras

3.6       Before the commencement of operation of the Wholesale Fish Market, a system of web cameras covering the Project site shall be installed and thereafter maintained for the first 12 months of the operation of the Wholesale Fish Market.  The system shall provide real time visual monitoring of the site condition covering at least the peak operating hours of the Wholesale Fish Market from 3:00 am to 6:30 am each day and shall be accessible by public through the dedicated website set up under Condition 4.2 below.  The Permit Holder shall review and consult the Environmental Management Committee before seeking the agreement from the Director on the need to continue to maintain the system of web cameras covering the Project site after the first 12 months of the operation of the Project.

            在營辦魚類批發市場前,須安裝及於營辦魚類批發市場首12個月內,維持一個網絡攝影機系統,拍攝工程項目的範圍。系統須至少可供即時監察魚類批發市場的運作高峰期,即每日凌晨三時至上午六時半的營運情況,並可供公眾透過按以下條件第4.2項設立的特定網站瀏覽。許可證持有人須在營辦工程項目首12個月後,就是否需要繼續維持網絡攝影機系統拍攝工程項目的範圍進行檢討,先徵詢環境管理委員會的意見,然後徵求署長批准。

 

 

4.         Electronic Reporting of EM&A Information

     環監資料的電子匯報

 

4.1       To facilitate public inspection of the monthly EM&A Reports via the EIAO Internet Website and at the EIAO Register Office, electronic copies of these Reports shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF version 4.0 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hard copies as described in Condition 3.3 of this Permit.  For the HTML version, a content page capable of providing hyperlink to each section and sub-section of these Reports shall be included in the beginning of the document. Hyperlinks to all figures, drawings and tables in these Reports shall be provided in the main text from where the respective references are made. All graphics in these Reports shall be in interlaced GIF format unless otherwise agreed by the Director. The content of the electronic copies of these Reports must be the same as the hard copies.

            為方便公眾透過環評條例互聯網網站及在環評條例登記冊辦事處查閱每月環境監察及審核報告,以超文本標示語言 (HTML) (4.0或較後版本) 及便攜式文件格式(PDF) (4.0或較後版本) 製作的報告的電子版本,除非另獲署長同意,須與本許可證條件第3.3項所說明的硬複本同時提交。關於HTML的版本方面,可與報告各節及小節作出超文本連結的目錄須在文件開端加入。環境監察及審核報告內各類圖表須在載有相關資料的正文內作出超文本連結。除非另獲署長同意,報告內所有圖形均須以交錯存取的GIF格式制定。報告的電子版本內容,必須與硬複本的內容一致。

 

4.2      A dedicated website shall be set up for placing the environmental monitoring and project data. All environmental monitoring data described in Condition 4.1 above shall be made available to the public via a dedicated website set up in the shortest possible time and in no event later than two weeks after the relevant environmental monitoring data are collected or become available, unless otherwise agreed with the Director.

            設立特定網站存放環境監察及工程項目的數據。上文條件第4.1項說明的所有環境監察結果及按本許可證規定提交的所有文件,均須盡快透過設立的特定網站供公眾閱覽,在任何情況下均不得遲於有關環境監察數據收集或可供閱覽後的2個星期,除非另獲署長同意。

 

4.3       The Internet website as described in Condition 4.2 above shall enable user-friendly public access to the monitoring and project data including the EIA Report and the environmental permit(s) and the project profile of the Project. The Internet website shall have features capable of:

            上文條件第4.2項說明的互聯網網站,必須方便用戶使用,讓公眾容易接達監察數據及工程項目資料,當中包括工程項目的環評報告、環境許可證及工程項目簡介。除非另獲署長同意,互聯網網站須具備部件,提供下述功能:

 

(i)                          providing access to all environmental monitoring data collected since the commencement of works and all submissions under this Permit;

接達在工程展開後所收集的全部環境監察數據,及根據本許可證提交的所有文件;

 

(ii)                searching by date;

按日期搜尋;

 

(iii)               searching by types of monitoring data; and

按監察數據類別搜尋;以及

 

(iv)              hyperlinks to relevant monitoring data after searching;

            or otherwise as agreed by the Director.

        

 

 

Notes:

 

1.         This Permit consists of three parts, namely, Part A (Main Permit), Part B (Description of Designated Project) and Part C (Permit Conditions).  Any person relying on this permit should obtain independent legal advice on the legal implications under the EIAO, and the following notes are for general information only.

本許可證共有3部,即A (許可證主要部分)B (指定工程項目的說明) C (許可證條件)。任何援引本許可證的人士須就環評條例的法律含意徵詢獨立法律意見,下述註解只供一般參考用。

 

2.         If there is a breach of any condition of this Permit, the Director or his authorized officer may, with the consent of the Secretary for the Environment, order the cessation of associated work until the remedial action is taken in respect of the resultant environmental damage, and in that case the Permit Holder shall not carry out any associated works without the permission of the Director or his authorized officer.

            如違反本許可證的任何條件,署長或獲授權人員徵得環境局局長的同意後可勒令停止相關工程,直至許可證持有人為所造成的環境損害採取補救行動為止。在此情況下,許可證持有人未經署長或獲授權人員同意,不得進行任何相關工程。

 

3.         The Permit Holder may apply under Section 13 of the EIAO to the Director for a variation of the conditions of this Permit. The Permit Holder shall replace the original permit displayed on the Project site by the amended permit.

            許可證持有人可根據環評條例第13條的規定向署長申請更改本許可證的條件。許可證持有人須把經修改的許可證替換在工程項目工地內展示的原有許可證。

 

4.         A person who assumes responsibility for the whole or a part of the Project may, before he assumes responsibility of the Project, apply under Section 12 of the EIAO to the Director for a further environmental permit.

            承擔指定工程項目整項或部分工程的責任的人,在承擔責任之前,可根據環評條例第12條的規定向署長申請新的環境許可證。.

 

 

5.         Under Section 14 of the EIAO, the Director may with the consent of the Secretary for the Environment, suspend, vary or cancel this Permit.  The suspended, varied or cancelled Permit shall be removed from display at the Project site.

            根據環評條例第14條的規定,署長可在環境局局長的同意下暫時吊銷、更改或取消本許可證。遭暫時吊銷、更改或取消的許可證必須從工程項目的工地除下,不再展示。

 

6.         If this Permit is cancelled or surrendered during operation of the Project, another environmental permit must be obtained under the EIAO before the Project could be continued.  It is an offence under Section 26(1) of the EIAO to operate a designated project listed in Part I of Schedule 2 of the EIAO without a valid environmental permit.

            如本許可證在工程項目營辦期間取消或交回,則在繼續營辦工程項目之前,必須先根據環評條例規定取得另一份環境許可證。根據環評條例第26(1)條的規定,任何人在沒有有效環境許可證的情況下營辦環評條例附表21部所列明的指定工程項目,即屬犯罪。

 

7.         Any person who operates the Project contrary to the conditions in the Permit, and is convicted of an offence under the EIAO, is liable:

            如任何人在違反本許可證的條件下營辦工程項目,根據環評條例,即屬犯罪

 

(i)                  on a first conviction on indictment to a fine of $2 million and to   imprisonment for 6 months;

一經循公訴程序首次定罪,可處罰款200萬元及監禁6個月;

 

(ii)                on a second or subsequent conviction on indictment to a fine of $5 million and to imprisonment for 2 years;

一經循公訴程序第二次或其後每次定罪,可處罰款500萬元及監禁2年;

 

(iii)               on a first summary conviction to a fine at level 6 and to imprisonment for 6 months;

一經循簡易程序首次定罪,可處第6級罰款及監禁6個月;

 

(iv)              on a second or subsequent summary conviction to a fine of $1 million and to imprisonment for 1 year; and

一經循簡易程序第二次或其後每次定罪,可處罰款100萬元及監禁1年;及

 

(v)                in any case where the offence is of a continuing nature, the court or magistrate may impose a fine of $10,000 for each day on which he is satisfied the offence continued.

在任何情況下如該罪行屬連續性質,法院或裁判官可就其信納該罪行連續的每一天另處罰款10,000元。

 

 

8.         The Permit Holder may appeal against any condition of this Permit under Section 17 of the EIAO within 30 days of receipt of this Permit.

            許可證持有人可在接獲本許可證後30天內,根據環評條例第17條就本許可證的任何條件提出上訴。

 

9.         The Notes are for general reference only and that the Permit Holder should refer to the EIAO for details and seek independent legal advice.
