4. Environmental Monitoring and Audit during Construction
建造期間內的環境監察及審核

4.1 Any changes to the Environmental Monitoring and Audit arrangement as required under the Environmental Schedule contained in the EIA Report (hereinafter referred to as the "Environmental Schedule") or under the Implementation Schedule submitted shall be justified, and verified by the Independent Environmental Checker in the Environmental Monitoring and Audit Reports and submitted for the approval of the Director.
所提交的環境計劃或實施時間表如有需要對環境監察及審核安排作任何更改,須經由環境監察及審核報告載明的獨立環境查核人提供充分理由支持並加以核證,然後提交署長批准。

4.2 The Environmental Monitoring and Audit requirements shall be implemented as set out in the Environmental Schedule of the EIA Report and the monthly Environmental Monitoring and Audit Reports unless the changes are justified in the monthly Environmental Monitoring and Audit Reports submission, verified by the Independent Environmental Checker and approved by the Director.
環境監察及審核的規定,須按環評報告中環境計劃及每月環境監察及審核報告訂明的要求執行,除非擬議的更改在提交的每月環境監察及審核報告獲得充分理由支持並經由獨立環境查核人核證,以及獲得署長批准。

4.3 Samples and measurements for noise, air quality and water quality monitoring shall be taken in accordance with the requirements of the Environmental Schedule of the EIA Report:
噪音、空氣質素及水質監測的樣本及量度結果,須按照環境計劃的規定抽取或進行:

  1. conducting baseline air, noise and water quality monitoring at the specified locations and frequencies;
    在指定地點進行指定次數的基線空氣、噪音及水質監測;

  2. conducting, impact air quality, water quality, noise quality monitoring at the specified locations and frequencies;
    在指定地點進行指定次數的空氣質素、水質、噪音影響監測;

  3. in cases where specified criteria in the Environmental Schedule are exceeded, carrying out remedial actions in accordance with the Action Plan, as set out in the Environmental Schedule ; and
    如果超逾了環境計劃所指定的準則,須按照環境計劃載明的行動計劃,採取補救行動;及

  4. logging and keeping records of the details of a) to c) above, within 3 working days of the collection of data or completion of remedial action, for the purposes of preparing and submitting the Environmental Monitoring and Audit Reports and Independent Environmental Checker’s Report, and to make available the information for inspection on site.
    在收集數據或完成補救行動3個工作天內記錄上述a)至c)項的詳情,用作擬備及提交環境監察及審核報告及獨立環境查核人的報告,並備妥有關資料使在工地也可查閱。

4.4 Ten copies of the Baseline Monitoring Report verified by the Independent Environmental Checker shall be submitted to the Director before the commencement of any major construction works that would affect the monitoring results.
在任何會影響監測結果的大型建造工程展開前,須向署長提交10份由獨立環境查核人核證的基線監測報告。

4.5 Ten copies of monthly Environmental Monitoring and Audit Reports verified by the Independent Environmental Checker shall be submitted to the Director within 10 working days from the end of the reporting month.
在報告月份最後的10個工作天內,須向署長提交10份由獨立環境查核人核證的每月環境監察及審核報告。

4.6 The submitted reports as required in condition 4.4 and 4.5 shall be rectified in accordance with the comments made by the Director within one month of receipt of the Director's comments, or otherwise specified by the Director.
條件第4.4及4.5項所規定提交的報告,須在一個月或署長指定的時間內,按照署長的意見作出修改。

4.7 The actions described in the action plans of the Environmental Schedule shall be properly carried out, in accordance with the time frame set out in the action plans, or as agreed by the Director.
環境計劃的行動計劃須按照行動計劃內訂明的時限,或署長同意的時限執行。

5. Measures during the Operation Period
運作期間內的措施

5.1 All design or operational measures described in the submissions approved or deposited under section 2 above, shall be properly implemented.
所有在獲批准的提交文件或根據上文第2條存放的文件內說明的設計或運作措施,必須妥善執行。

5.2 The Permit Holder shall ensure the measures to mitigate odour impact associated with the operational maintenance dredging of the drainage channels are implemented, and shall include:
許可證持有人須確保因排水道運作維修挖泥而產生的難聞氣味,有採取緩解措施以減輕影響,而措施包括:

  1. any odorous permitted stockpiled material shall be placed remote from air sensitive receivers; and
    任何帶有難聞氣味的容許堆存物料,須放於遠離易受空氣污染影響的地方;及

  2. any odorous stockpiled material left in excess of two days shall be covered with plastic tarpaulin sheets.
    任何帶有難聞氣味的物料,堆存多於2天,必須以防水帆布蓋好。

5.3 The Permit Holder shall submit to the Director for approval within a month of the operation of the Projects a proposal to monitor the avifauna use of the constructed channel and implement the approved monitoring proposal.
許可證持有人須在工程項目運作的一個月內,向署長提交一個監察在已建造渠道上鳥類活動的建議,供署長批准,以及執行獲得批准的監察建議。


Notes:
註:

  1. This environmental permit consists of three parts, namely, PART A (Main Permit), PART B (Description of Designated Projects) and PART C (Permit Conditions).
    本環境許可證共有3部,即:A部(許可證主要部分);B部(指定工程項目的說明);及C部(許可證條件)。

  2. The Permit Holder may apply under Section 13 of the Ordinance to the Director for a variation of the conditions of this environmental permit. The Permit Holder shall replace the original permit displayed on the construction site, by the amended permit.
    許可證持有人可根據條例第13條的規定向署長申請更改本環境許可證的條件。許可證持有人須將經修改的許可證,替換在建造工地內展示的原有許可證。

  3. A person who assumes the responsibility for the whole or a part of the designated project may, before he assumes responsibility for the designated project, apply under Section 12 of the Ordinance to the Director for a further environmental permit.
    承擔指定工程項目的整項或部分工程的責任的人,在承擔解除指定工程項目責任之前,可根據條例第12條的規定向署長申請新的環境許可證。

  4. Under Section 14 of the Ordinance, the Director with the consent of the Secretary for Planning, Environment and Lands, may suspend, vary or cancel this environmental permit. The permit shall be removed from the display on the construction site.
    根據條例第14條的規定,署長可在規劃環境地政局局長的同意下暫時吊銷、更改或取消環境許可證。該許可證必須從建造工地除下,不再展示。

  5. If this permit is cancelled or surrendered during the construction or operation, an environmental permit must be obtained under the Ordinance before the construction or operation of the project could continue. It is an offence under Section 26(1) of the Ordinance to construct or operate a designated project without an environmental permit.
    如果本許可證在工程項目建造或營辦期間取消或交回,則在繼續進行建造或營辦工程項目之前,必須先根據條例規定取得環境許可證。根據條例第26(1)條的規定,任何人在沒有環境許可證的情況下建造或營辦指定工程項目,即屬違法。

  6. In response to the application for variation of an environmental permit (AVEP-002/1998), Conditions 1.8 has been added in Part C, Conditions 2.3, 2.4, 2.5, 2.6, 2.7, 2.8, 2.9, 3.2 and 5.2(b) of Part C have been amended and Conditions 2.11, 3.23, 4.8 and 5.4 in Part C of the permit EP-003/1998 have been replaced by a new Condition 1.9.
    因應更改環境許可證申請(AVEP-002/1998),環境許可證EP-003/1998的C部已加入條件1.8﹑條件2.3,2.4,2.5,2.6,2.7,2.8,2.9,3.2 及 5.2(b) 經已修改﹑而條件2.11,3.23,4.8 及 5.4 已被新的條件 1.9 替代。

To reduce noise impact
減少噪音影響

  1. Bored piling shall be used for the pumping station and bridges for the Projects.
    鑽孔式打樁應用於工程項目中的抽水站和橋。

  2. Dredging operations will be carried out in the ponds to ensure that contaminated sediments are not inadvertently allowed into the new drainage channel. As the ponds are quite small and not very deep, it has been proposed that a single grab dredger be used for the operation.
    池塘會進行挖泥作業,確保受污染的沉積物不會因疏忽而流入新的排水道。由於池塘面積較小而且水不太深,已建議在操作時使用單抓斗挖泥機。

  3. The first level mitigation for construction activities is the use of quiet equipment. There are specific Powered Mechanical Equipment (PME) with sound power lower than those specified in Technical Memorandum on Noise from Construction other than Percussive Piling (TM1). Examples of such silenced PME known to exist are given below:

  4. The second level mitigation activities is the use of permanent or movable noise barriers of 3.5 to 4 metres high in addition to the use of quiet equipment. It should be noted that a barrier with sufficient height but insufficient length will significantly reduce its noise attenuation effectiveness. This is avoidable by arranging the barriers to encircle the noise source.
    第二級緩解措施是除了使用低噪音設備外,還採用3.5至4米高的固定或流動隔聲屏障。須要注意的是,一個高度足夠但長度不足的屏障,會大大削弱其消減噪音的效用。要避免上述情況出現,可安排以屏障圍繞噪音源頭。

  5. If further noise reduction is required, the following on-site measures should be considered
    如果需要進一步減低噪音,可考慮原地採取下列的措施:
    • use of noise enclosures;
    • 使用隔音罩;

    • reduction in the number of noisy plant operating simultaneously;
    • 減少同時啟動的高噪音設備的數目;

    • maintenance of noisy equipment so as to minimise noise;
    • 修護高噪音的設備,以盡量減低所噪音;

    • siting mobile plant away from NSRs;
    • 流動的設備裝設位置使遠離噪音感應強的地方;

    • turning off noisy plant when not in use; and
    • 關掉不需使用的高噪音設備;及

    • effective use of material stock piles and other structures for noise screening on-site.
    • 有效地利用堆存物料或其他構築物作為原地噪音屏障。

    The contractors may also consider to use alternative working methods which are quieter than those assumed in this noise assessment.
    承辦商也可以考慮使用其他所產生噪音水平較本噪音評估內採用的為低的工作方法。

  6. For the main construction activities, the measures listed in Table 1 below should be adopted:
