Pursuant to Section 10 of the Environmental Impact Assessment Ordinance (the Ordinance), the Director of Environmental Protection (the Director) granted the Environmental Permit (No. EP-057/2000) to the NEW TERRITORIES EAST DEVELOPMENT OFFICE, TERRITORY DEVELOPMENT DEPARTMENT ( now known as CIVIL ENGINEERING AND DEVELOPMENT DEPARTMENT ) (hereinafter referred to as the "Permit Holder") on 10 May 2000.  Pursuant to Section 13 of the Ordinance, the Director amends the Environmental Permit No. EP-057/2000 based on the Application No. VEP-146/2004.  The amendments described below, are incorporated into this Environmental Permit No. EP-057/2000/A.  This Environmental Permit as amended is for the construction and operation of the designated project described in Part B of this Permit subject to the conditions specified in and attached to Part C of this Permit.

 

 

根據環境影響評估條例(條例)10條的規定,環境保護署署長(署長)2000510日將環境許可證編號EP-057/2000批予拓展署新界東拓展處(現稱土木工程拓展署)(下稱"許可證持有人")。根據條例第13條的規定,署長因應更改環境許可證的申請編號VEP-146/2004修訂環境許可證編號EP-057/2000。以下修訂已包含在本環境許可證編號EP-057/2000/A 內。本經修訂的環境許可證,只適用於建造及營辦本許可證B部所說明的指定工程項目﹐並須遵守本許可證C部所說明及附載的條件

Hereunder is the description of the designated project mentioned in Part A of this environmental permit (hereinafter referred to as the “Permit”):

Scale and Scope of Designated Project

Construction and operation of a new road including:-

建造和營辦一條新路包括:

 

i)            Construction of 3.2km dual-2 lane trunk road with a grade separated junction at Ma On Shan Road and a grade separated interchange at Sai Sha Road;

建造一條3.2公里長的雙程雙線幹道,在馬鞍山路設置一個分層路口和在西沙路設置一個分層道路交匯處;

 

ii)  Construction of a 1.2 km 2-lane access road from Ma On Shan / Hang Hong Street roundabout to existing access road to Ma On Shan Tsuen;

建造一條1.2公里長的雙線通道,由馬鞍山/恆康街迴旋處連接至馬鞍山村的現有通道;

 

iii)  Construction of a 0.2 km 2-lane carriageway extension of Nin Fung Road at Cheung Muk Tau;

在樟木頭年豐路擴建一條0.2公里長的雙線行車道;

 

iv)  Construction of noise mitigation measures ; and

執行消減噪音措施;及

 

v)   Associated road and drainage works and slope and landscaping works.

PART C (PERMIT CONDITIONS)
C
( 許可證條件)

 

1.                  General Conditions

一般條件

 

1.1       The Permit Holder shall ensure full compliance with all conditions of this environmental permit.  Any non-compliance may constitute a contravention of the EIAO and may become subject of appropriate action being taken under the Ordinance.

許可證持有人必須確保完全符合本環境許可證的全部條件。如有不符合本許可證的情況,可能構成違反環境影響評估條例(下稱環評條例”)的規定,而當局可根據條例採取適當行動。

 

1.2              The Permit Holder shall ensure full compliance with all legislation from time to time in force such as the Noise Control Ordinance (Cap. 400), Air Pollution Control Ordinance (Cap. 311), Water Pollution Control Ordinance (Cap. 358), Waste Disposal Ordinance (Cap. 354) and others.  This Permit does not of itself constitute any ground of defence against any proceedings instituted under any legislation.

許可證持有人須時常確保完全符合現行法例的規定,例如:噪音管制條例(400);空氣污染管制條例(311);水污染管制條例(358);廢物處置條例(354);及其他條例。本許可證本身不會就根據任何法例提起的法律程序構成任何抗辯理由。

 

1.3       The Permit Holder shall make copies of this Permit together with all documents referred to in this Permit or the documents referred to in Part A of the Permit readily available at all times for inspection at all sites / offices covered by this Permit.  Any reference to the Permit shall include all documents referred to in the Permit and also the relevant documents in the Register.

許可證持有人須印製本許可證的複本,連同本許可證所述的所有文件或本許可證A部所述文件,以供署長任何時間內在本許可證所涵蓋的所有工地/辦事處查閱。凡提述本許可證,須包括本許可證所述的所有文件和登記冊內的相關文件。

 

1.4       The Permit Holder shall give a copy of this Permit to the person(s) in charge of the site(s) and ensure that such person(s) fully understands all conditions and all requirements incorporated by the Permit.

許可證持有人須將本許可證的一份複本交予有關工地的負責人,並確保這些人士完全明白本許可證的所有條件與規定。

 

1.5       The Permit Holder shall display a copy of this Permit on the construction site at the entrances /exits or at a convenient location for public’s information at all times.  The Permit Holder shall ensure that the most updated information about the environmental permit, is displayed at such locations.  If the Permit Holder surrenders a part or the whole of the Permit, the notice he sends to the Director shall also be displayed at the same locations as the original Permit. The suspended, varied or cancelled Permit shall be removed from the display at the construction site.


許可證持有人須在有關建造工地的所有進出口或一處方便地點,展示本許可證的複本,以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於環境許可證的最新資料。如果許可證持有人交回許可證的部分或全部,須將其送交署長的通知書,在備有原本許可證的各處相同地點展示。遭暫時吊銷、更改或取消的環境許可證必須在建造工地除下,不再展示。

 

1.6       The Project shall be constructed and operated as described in Part B of this Permit.

工程項目須依據本許可證B部的說明建造及營辦。

 

1.7              The Project shall be designed, constructed and operated in accordance with the information and all recommended mitigation measures in the EIA Report (Register no. EIA-137/BC) and the information contained in the applications (no. AEP-057/2000 and no. VEP-146/2004) and attached documents, or mitigation measures to be submitted or deposited with the Director as a result of the Permit conditions or on going surveillance and monitoring measures during all stages of the Project referred to, by incorporation or otherwise, in the Permit and documents in the Register.  Where recommendations referred to in the documents of the Register are not expressly referred to in this Permit, such recommendations are nevertheless to be implemented unless expressly excluded or impliedly amended in this Permit.

工程項目的設計、建造及營辦,須按照下述資料及措施辦理:環評報告(登記冊編號:EIA-137/BC)內載的資料及所有建議緩解措施和申請書(編號AEP-057/2000和編號VEP-146/2004) 附件所載資料;依據許可證條件向署長提交或存放的緩解措施;或本許可證和登記冊內的文件所指(不論收納與否)工程項目各階段進行的持續監察和監測措施。如登記冊文件所述建議沒有在本許可證明確表示,則仍須實施這些建議,除非獲本許可證明確豁除或默示修訂。

 

1.8              All deposited submissions as required under this Permit, shall be rectified in accordance with the comments, if any, made by the Director, within one month of the receipt of the Director’s comments, unless otherwise specified by the Director.

所有按本許可證規定存放的文件,須在接獲署長的意見(如有者)後一個月內(除非署長另行指定),根據署長的意見加以修正。

 

1.9              All submissions approved by the Director, all submissions deposited without comments by the Director, or all submissions rectified in accordance with comments by the Director under this Permit shall be construed as part of the Permit conditions described in Part C of this Permit.  Any variation of the submissions shall be approved by the Director in writing or as prescribed in the relevant permit conditions.  Any non-compliance with the submissions may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap.499).  All submissions or variations of the submissions shall be verified and certified by the Environmental Team (ET) Leader referred to in Conditions 2.1 and 2.2 below, before submitting to the Director under this Permit.

署長批准的所有提交文件、署長沒有給予意見的所有存放文件,或根據本許可證規定由署長給予意見修訂的所有提交文件,均須詮釋為本許可證C部說明的許可證條件的一部分。提交文件如有任何修訂,均須獲署長的書面批准或符合有關許可證條件訂明的規定。如有不符合提交文件的情況,可能構成違反環境影響評估條例(499)的規定。所有提交的文件或提交文件的修訂本,均須由下文條件第2.12.2項所指的環境小組組長核實和核證,然後才根據本許可證的規定提交署長。

 

 

1.10          The Permit Holder shall release all finalized submissions, as required under this Permit, to the public by depositing copies in the Environmental Impact Assessment Ordinance Register Office, or in any other places, or any internet websites as specified by the Director, or by any other means as specified by the Director for public inspection.  For this purpose, the Permit Holder shall provide sufficient copies of the submissions.

許可證持有人須把所有按本許可證規定提交的文件定稿公開給公眾人士知道,方法是將有關文件複本存放於環境影響評估條例登記冊辦事處,或署長指定的任何其他地方,或署長指定的任何互聯網網站,或採取其指定的任何其他方法,以供公眾查閱。因此,許可證持有人須提供足夠數量的複本。

 

1.11          The Permit Holder shall notify the Director the commencement date of construction of the Project at least 2 weeks prior to the commencement of construction of the Project. The Permit Holder shall notify the Director immediately if there is any change of the commencement date of the construction.

許可證持有人須在展開建造工程之前,至少提早兩星期把建造工程的施工日期通知署長。如施工日期有任何更改,許可證持有人必須立即通知署長。

 

1.12          All submissions as required under this Permit shall be deposited in the Environmental Impact Assessment Ordinance Register Office (currently at 27/F of Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong).

本許可證規定提交的所有文件,均須存放於環境影響評估條例登記冊辦事處(現址為香港灣仔軒尼詩道130號修頓中心27)

 

 

2.                  Submissions or Measures before or after Commencement of Construction of the Project or Certain Sections of the Project

在展開工程項目或工程項目某些路段的建造工程前或後提交的文件或採取的措施

 

2.1              An ET shall be established before commencement of construction.  The ET Leader shall be responsible for the implementation of the environmental monitoring and audit (EM&A) programme in accordance with the EM&A requirements as contained in the approved EM&A Manual and the information contained in the applications (no. AEP-057/2000 and no. VEP-146/2004) and attached documents.

在展開建造工程之前須先成立一個環境小組。環境小組組長須根據核准環境監察及審核手冊所載的環境監察及審核規定和申請書(編號AEP-057/2000和編號VEP-146/2004) 附件所載資料,實施有關環境監察及審核計劃。

 

2.2              The Permit Holder shall employ an ET before the commencement of construction of the Project.  The ET Leader shall have at least 7 years experience in EM&A or environmental management.  The ET Leader shall be responsible for duties defined in the approved EM&A Manual, and shall audit the overall EM&A programme including the implementation of all environmental mitigation measures, submissions relating to EM&A, and any other submission required under this Permit.  In addition, the ET Leader shall be responsible for verifying and certifying the environmental acceptability of permanent and temporary works, relevant design plans and submissions under this Permit.


 

在展開建造工程之前,許可證持有人須聘用一名環境小組組長。該名環境小組組長須在環境監察及審核或環境管理方面至少有7年經驗。環境小組組長須執行核准環境監察及審核手冊所界定的職務,並須審核整體的環境監察及審核計劃,包括實施所有環境緩解措施、提交有關環境監察及審核的文件,以及提交本許可證所要求的其他文件。此外,環境小組組長須核實和核證永久及臨時工程在環境上的可接受程度、相關的設計圖則和根據本許可證提交的文件。

 

2.3              No less than 5 ha landscaped area within the site boundary shall be designed and planted with trees for the loss of trees arising from the Project. No more than 2 months after commencement of construction of the Project, the Permit Holder shall deposit to the Director three sets of landscape and tree felling plan(s), of scale 1 to 1000 or other appropriate scale as agreed by the Director.  The drawings shall show the detailed landscape and tree felling proposals during the construction and operation stages of the Project, and shall include an implementation programme of landscape and tree felling works.  The submission shall be verified and certified by the ET Leader as conforming to the information and recommendations contained in the EIA Report and information contained in the application (no. AEP-057/2000).  Additional copies may be required by the Director.  All measures recommended in the approved landscape and tree felling plan(s) shall be fully implemented in accordance with the details and time schedule set out in the submission.

在工地範圍內不少於5公頃的景觀美化地方,須加以設計和栽種樹木,以補償工程項目所引致的樹木損失。在建造工程展開後不超出2個月,許可證持有人須把1:1000比例或署長所同意的其他適當比例的3套景觀美化及砍樹圖則,向署長存放。這些圖則須顯示工程項目各建造及營辦階段的詳細景觀美化及砍樹建議,並須包括景觀美化及砍樹工程的執行計劃。提交的文件須由環境小組組長核實及核證,證明其符合環評報告內載的資料及建議和申請書(編號AEP-057/2000)所載資料。署長可要求額外複本。核准景觀美化及砍樹圖則所建議的各項措施,須按照提交文件載述的詳情和時間表完全執行。

 

2.4              Three sets of Waste Management Plan for the construction stage of the Project shall be deposit to the Director within 2 months after the commencement of the construction of the Project. The Plan shall be certified by the ET Leader and verified by the ET Leader as conforming to the information and recommendations contained in the EIA Report. The Plan shall describe the arrangement for avoidance, reuse, recovery ad recycling, storage, collection, treatment and disposal of different categories of waste to be generated from the construction activities and shall include the recommended mitigation measures on waste management in Chapter 6 of the EIA Report. Such a management plan shall include the designation of areas for segragation and temporary storage of reusable and recyclable materials and disposal location of different categories of wastes. All measures in the approved Water Management Plan shall be fully implemented throughout the construction period.

在建造工程展開後2個月內,須把3套工程項目建造階段的廢物管理計劃向署長存放。計劃須由環境小組組長核證並由環境小組組長核實,證明其符合環評報告所載的資料及建議。計劃須說明建造作業所產生的各類廢物的避免產生、再使用、回收、循環再造、貯存、收集、處理和棄置安排,並須包括環評報告第6章所建議的廢物管理緩解措施。這管理計劃須包括定出可再使用和循環再造物料的分隔和臨時貯存地方,以及各類廢物的棄置地點。獲批准的廢物管理計劃的所有措施,均須在整段建造期間完全執行。

 

2.5              To minimize the visual intrusion arising from the noise barriers and enclosures, three sets of drawings showing detailed arrangements of the barriers and enclosures shall be deposited with the Director within 2 months after the commencement of the construction of the Project.

為減少隔音屏障和隔音罩妨礙視野的情況,在建造工程展開後2個月內,須把3套顯示隔音屏障和隔音罩詳細建造安排的圖則,向署長存放。

 

 

3.                  Submissions or Measures during the Construction Period

建造工程期間提交的文件或採取的措施

 

3.1        The Permit Holder shall design, construct and operate the project in accordance with the road alignment shown in Figure 1 attached to this Permit.

許可證持有人須按照本許可證附圖1所示的道路路線,設計、建造及營辦工程項目。

 

3.2        All designs and measures described in the deposited submissions under Conditions 2.3, 2.4 and 2.5 shall be fully implemented.

根據條件第2.32.42.5項規定存放的文件說明的所有設計和措施,必須完全執行。

 

3.3              To mitigate the traffic noise impact arising from the Project, the noise barriers and enclosures shall be constructed as shown in Figure 1, Figure 2 and Table 1 attached to this Permit and in accordance with the submission under Condition 2.5, prior to the operation of the Project.

為緩解工程項目所造成的交通噪音影響,須如本許可證夾附的圖1圖2表1所示,並按照條件第2.5項的規定,建造隔音屏障和隔音罩,然後才營辦工程項目。

 

3.4              To mitigate water quality impact arising from site run-off and dredging, measures described in Appendix A shall be fully implemented throughout the construction period.

為緩解工地徑流和疏浚工程造成的水質影響,附錄A說明的措施均須在整段建造工程期間完全執行。

 

3.5       To mitigate noise impacts arising from construction activities, measures described in Appendix B shall be fully implemented throughout the construction period.

為緩解建造作業造成的噪音影響,附錄B說明的措施均須在整段建造工程期間完全執行。

 

3.6              To protect the woodland along the hillside of the Project, no construction activities shall be carried out beyond the site boundary as shown in Figure 1.

為保護工程項目的山邊林地,圖1所示工地範圍以外的地方均不得進行建造作業。

 

3.7              To prevent flying rocks and reduce fugitive dust generation; wire mesh, gunny sack and sandbags shall be used on top of the blast area on each shot.

 

 

為免造成石頭和塵埃四散,爆破地方每一堆炸藥之上均須設置鐵絲網、麻包袋和沙包。

 

3.8              To reduce the dust impact arising from blasting activities, the blast area shall be watered in order to increase the moisture content.

為減少爆破活動造成的塵埃影響,須在爆破地方灑水,以增加濕度。

 

3.9              To contain dust debris arising from the tunneling works, dust filters shall be placed around the portals and a blast door shall be fitted at the portals.

為阻隔挖掘隧道工程引致的塵埃碎屑,須圍繞隧道入口裝設隔塵網,並在隧道入口安裝一道爆破防護門。

 

3.10          Any change to environmental mitigation measures shall be verified and certified by the ET Leader as conforming to the information and recommendations in the EIA Report and the information contained in the applications (no. AEP-057/2000 and no. VEP-146/2004) and attached documents before implementation. The verified and certified changes shall be documented in the immediately following monthly EM&A report required under the approved EM&A Manual.

環境緩解措施如有更改,須由環境小組組長核實和核證,證明其在執行前符合環評報告內載的資料及建議和申請書(編號AEP-057/2000和編號VEP-146/2004)和附件所載資料。經核實和核證的更改須依據核准環境監察及審核手冊的規定,立即在下一份每月環境監察及審核報告中記載。

 

 

4                    Submissions or Measures during the Operation of the Project

營辦工程項目期間提交的文件或採取的措施

 

4.1              Measures described in Condition 3.3 above shall be in place and maintained during the operation of the Project.

在營辦工程項目期間,上文條件第3.3項所說明的措施均須備妥和持續執行。

 

4.2              To collect and discharge road runoff, a stormwater drainage system shall be designed and implemented on site.

為收集及排放路面徑流,須在原地設計及執行雨水排放系統。

 

4.3              Before the stormwater is diverted to the stormwater drainage system, oil and grit interceptors shall be incorporated in area where spills may occur.

把雨水導流至雨水排放系統之前,須於有可能溢泄的地方設置截油及截砂裝置。

 

4.4              Contents in oil interceptors shall be removed to an appropriate disposal facility on a regular basis.

截油裝置所收集的廢物須定期清理並送往合適的處置設施。

 

4.5              To remove suspended solid from run-off, silt traps or sedimentation tanks shall be designed and installed and regularly maintained.

為清除徑流的懸浮固體,須設計和裝設隔泥池或沉澱池,並定期加以維修。

 

 

 

5.            Environmental Monitoring and Audit

環境監察及審核

 

5.1        The EM&A programme shall be implemented as set out in the EM&A Manual and information contained in the applications (no. AEP-057/2000 and no. VEP-146/2004) and attached documents.  Any change to the programme shall be justified by the ET Leader as conforming to the requirements set out in the EM&A Manual and information contained in the applications (no. AEP-057/2000 and no. VEP-146/2004) and attached documents before submission to the Director for approval.

環境監察及審核計劃須按照環評報告的環境監察及審核手冊的規定和申請書(編號AEP-057/2000和編號VEP-146/2004)和附件所載資料執行。有關計劃如有任何更改,須由環境小組組長提出充分理由,證明其符合環評報告的環境監察及審核手冊的規定和申請書(編號AEP-057/2000和編號VEP-146/2004)和附件所載資料,然後才提交署長批准。

 

5.2        The actions described in the Event/Action Plans of the EM&A Manual shall be carried out, in accordance with the time frame set out in the Event/Action Plans, or as agreed by the Director.

環境監察及審核手冊的事件/行動計劃所說明的行動,須按照事件/行動計劃所訂明的時限或如署長所同意執行。

 

5.3        The Permit Holder shall, at least 6 months before the operation of the project, deposit with the Director a monitoring plan for the purpose of assessing the accuracy of traffic noise predictions, by comparing the project noise impact predictions with the actual impacts.  The monitoring plan shall contain monitoring locations, monitoring schedules, methodology of noise monitoring including noise measurement procedures, traffic counts and speed checks, and methodology of comparison with the predicted levels.  At least one monitoring location at the noise sensitive receivers protected by noise mitigation measures shall be proposed.  At least three sets of measurements shall be conducted and the monitoring shall be done within the first year of operation of the project.  Monitoring shall be conducted in accordance with the deposited monitoring plan unless with prior justification.  Monitoring details and results, including the comparison between the measured noise levels and the predicted levels, shall be recorded in a report.  The report shall be certified by the Permit Holder before it is deposited with the Director, within one month after the completion of the monitoring.

在本工程項目營辦之前,許可證持有人須至少提早6個月向署長存放一份監察計劃,藉著比較工程項目的噪音預測與實際影響,以評估交通噪音預測的準確程度。這項監察計劃須列明監察地點、監察時間表、噪音監測方法﹝包括噪音量度步驟﹞、交通統計和車速偵察,以及與預測水平的比較。須在受噪音緩解措施保護下噪音感應強的地方,建議至少一個監察地點。監察工作須在工程項目營辦的首年內進行至少三組噪音量度。除非預先提出充份理據,監察工作須按照已存放的監察計劃進行。監察工作的詳情與結果﹝包括量度得到的噪音水平與預測水平的比較﹞,須記綠在一份報告內。在監察工作完成後一個月內,這份報告向署長存放之前須由許可證持有人證明。

 


Notes:

1.          This environmental permit consists of three parts, namely, PART A (Main Permit), PART B (Description of Designated Project) and PART C (Permit Conditions). Any person relying on this Permit should obtain independent legal advice on the legal implications under the Ordinance, and that the following notes are for general information only.

本環境許可證共有3部,即:A部(許可證主要部分)B部(指定工程項目的說明);及C部(許可證條件)。任何援引本許可證的人士須就條例的法律含意徵詢獨立法律意見,下述註解只供一般參考用。

 

2.          The Permit Holder may apply under section 13 of the Ordinance to the Director for a variation of the conditions of this environmental permit. The Permit Holder shall replace the original Permit displayed on the construction site by the amended Permit.

許可證持有人可根據條例第13條的規定向署長申請更改本環境許可證的條件。許可證持有人須將經修改的許可證,替換在建造工地內展示的原有許可證。

 

3.          A person who assumes the responsibility for the whole or a part of the designated project may, before he assumes responsibility of the designated project, apply under section 12 of the Ordinance to the Director for a further environmental permit.

承擔指定工程項目的整項或部分工程的責任的人,在承擔指定工程項目責任之前,可根據條例第12條的規定向署長申請新的環境許可證。

 

4.          Under section 14 of the Ordinance, the Director may with the consent of the Secretary for the Environment, Transport and Works suspend, vary or cancel this environmental permit.  The Permit shall be removed from the display on the construction site.

根據條例第14條的規定,署長可在環境運輸及工務局局長的同意下暫時吊銷、更改或取消環境許可證。該許可證必須從建造工地除下,不再展示。

 

5.          If this Permit is cancelled or surrendered during the construction or operation, an environmental permit must be obtained under the Ordinance before the construction or operation of the project could be continued.  It is an offence under section 26(1) of the Ordinance to construct or operate a designated project listed in Part I of Schedule 2 of the Ordinance without a valid environmental permit.

如果本許可證在工程項目建造或營辦期間取消或交回,則在繼續進行建造或營辦工程項目之前,必須先根據條例規定取得環境許可證。根據條例第26(1)條的規定,任何人在沒有有效環境許可證的情況下建造或營辦條例附表2I部所列明的指定工程項目,即屬犯罪。

 

6.          Any person who constructs or operates the designated project contrary to the conditions in this Permit, and is convicted of an offence under the Ordinance, is liable-

如任何人在違反本許可證的條件下建造及營辦指定工程項目,根據環評條例,即屬犯罪—

 

(i)              on a first conviction on indictment to a fine of $ 2 million and to imprisonment for 6 months;

一經循公訴程序首次定罪,可處罰款200萬元及監禁6個月;

 

 

 

 

 

(ii)            on a second or subsequent conviction on indictment to a fine of $ 5 million and to imprisonment for 2 years;

一經循公訴程序第二次或其後每次定罪,可處罰款500萬元及監禁2年;

 

(iii)           on a first summary conviction to a fine at level 6 and to imprisonment for 6 months;

一經循簡易程序首次定罪,可處第6級罰款及監禁6個月;

 

(iv)          on a second or subsequent summary conviction to a fine of $1 million and to imprisonment for 1 year; and

一經循簡易程序第二次或其後每次定罪,可處罰款100萬元及監禁1年;及

 

(v)            in any case where the offence is of a continuing nature, the court or magistrate may impose a fine of $ 10,000 for each day on which he is satisfied the offence continued.

在任何情況下如該罪行屬持續性質,則法院或裁判官可就其信納該罪行持續的每天另處罰款10,000元。

 

 

7.          The Permit Holder may appeal against any condition of this Permit under Section 17 of the Ordinance within 30 days of receipt of this Permit.

Measures to Mitigate Environmental Impacts due to Site Run-off and Other Potential Water Pollution During Construction

(a)    Surface Runoff  

地面徑流

 

(I)            At all parts of all works areas and construction sites, and throughout the full duration of the construction contract(s), the following shall be implemented :

在各工地和建造工地的所有範圍,以及在整段建造合約期間,必須執行下述措施:

 

(i)       sediment tanks of sufficient capacity to handle the predicted water flows shall be provided within the works areas for settling out waste water prior to its disposal. All site run-off and water pumped out from wells or excavated trenches shall be directed into the sediment tanks prior to discharging into public drainage system. The sediment tanks shall be regularly cleaned and maintained in good working condition;

廢水應先經沉澱才可排放,而在工地範圍內的沉澱池容量要足以處理預計的廢水流量。從井或挖掘溝槽泵出的所有工地徑流及水均須導引至沉澱池,然後才排入公共排水系統。沉澱池須定期清理及保養,確保運作良好;

 

(ii)            all drainage facilities and erosion and sediment control structures shall be regularly inspected and maintained to ensure proper and efficient operation at all times and particularly following rainstorms.  Deposited silt and grit shall be removed regularly and disposed of by spreading evenly over stable, vegetated areas;

所有排水設施和控制侵蝕及沉積物的構築物均須定期檢查和修護,尤其在暴雨之後,以確保在任何時間內運作妥善而有效。沉積的淤泥和砂礫須經常清除,處置的方法是把其平均鋪散於種有植物的穩固地方;

 

(iii)          all stockpiles of construction materials (for example, aggregates, sand and fill material) of more than 50 m3 shall be covered with tarpaulin or similar fabric during rainstorms;

在暴雨期間,所有堆存而面積超逾50立方米的建築材料(如石料、沙及填料),須用帆布或同類物料覆蓋;

 

(iv)          dry cement material delivered to the works area  shall be stored in sealed water-proof containers or bags, any cement that is unused shall be temporarily stored in a warehouse and removed  from the site at the end of the construction works, spent cement mix or other unused paving materials shall be collected in a separated collection system for  either cleaning and reuse or disposal to the landfill;

送往工地範圍的乾水泥物料須貯存於密封防水的盛載器或袋內;任何未經使用的水泥須暫時存放於貨倉內,並在建造工程完成時搬離工地;已使用的水泥混合物或其他未經使用的鋪築物料均須以獨立收集系統收集,以便清理後再用或運往堆填區棄置;

 

(v)           no open stockpiling of construction material shall be allowed;

(vi)          exposed soil areas shall be hydroseeded to reduce the potential for increased siltation and contamination of runoff;

(vii)         no solid material, litter or waste to the stream or drainage channels shall be allowed;

不得在河流或排水道棄置固體物料、垃圾或廢物;

 

(viii)       all fuel tanks and storage areas shall be locked and sited on sealed areas, within bunds of a capacity equal to 110% of the storage capacity of the largest tank, or 20% of the total volume stored (whichever is larger); and

所有油缸及貯存地方均須設於可上鎖和密封的地方,並在堤圍之內,容量相等於最大油缸貯存量的110%,或貯存總量的20%(以較大者為準);及

 

(ix)          on-site portable toilet or septic tanks shall be provided for the construction workforce, sewage shall be collected by a reputable sewage collector for disposal at a appropriate sewage treatment works.

須在工地內為建築工人設置流動廁所或化糞池,污水須由信譽良好的污水收集商負責收集,並送往合適的污水處理廠處置。

 

 

(II)           At all parts of the works areas and construction sites that may potentially experience spillage of oil or fuel associated with construction works, and throughout the full duration of the construction contract(s), oil interceptors shall be provided in the drainage system downstream of any oil/fuel pollution sources associated with construction.  The oil interceptors shall be regularly emptied to prevent the release of oil and grease into the storm water drainage system after accidental spillage.  The interceptor shall have a bypass to prevent flushing during periods of heavy rain.

在所有可能因進行建造工程而出現油或燃料溢泄情況的施工範圍或建造工地內,以及在整段建造合約期間,須在有關建造工程的任何油/燃料污染源頭下游的排水系統設置截油器。截油器須經常清理,以防止在發生意外溢泄後,油和油脂流入雨水排放系統。截油器須裝有旁管,以防止大雨期間出現泛濫。

 

(III)          At all parts of all works areas and construction sites, and throughout the full duration of the construction contract(s), existing drainage arrangements shall not be adversely affected during construction works, and any flow from the construction site must be diverted to settling traps/ponds before being discharged into the public drainage system.

在所有施工範圍和建造工地內,以及在整段建造合約期間,現有的排水安排不得因建造工程而受不良影響,任何工地徑流必須導引至沉積物捕集裝置或沉澱池,才排入公共排水系統。

 

 

 

(b)    General Construction Activities

一般建造作業活動

 

At all parts of all works areas and construction sites, and throughout the full duration of the construction contract(s), debris and rubbish on site shall be handled and disposed of to avoid entering the water column and causing water quality impacts.  Temporary on-site storage of excavated materials from station and depot construction works shall be covered with tarpaulin or similar fabric during rainstorms.  Any washout of construction or excavated materials should be diverted to the drainage system via sediment traps.  Stockpiling of the excavated material can be minimized by scheduling the construction programme in a way that one section of the alignment can be constructed and completed before the excavation works of the next section commence.

在所有施工範圍和建造工地,以及在整段建造合約期間,工地的碎屑和垃圾必須清理及處置,以免混入水中,造成水質影響。車站及車廠建造工程的挖出物料的臨時原地存放地方,在暴雨期間須用帆布或同類物料覆蓋。被雨水沖刷的建築材料或挖出物料,應經沉積物捕集裝置導引至排水系統。須妥善編排建造工程的施工時間,先建造及完成一段路線,才展開下一段路線的挖掘工作,便可減少挖出物料的堆存量。

Measures to Mitigate Environmental Impacts due to Construction Noise During Construction

建造工程期間建築噪音的環境影響緩解措施

 

Throughout the construction period of the Project, the following mitigation measures for construction activities shall be implemented:-

在整段建造工程期間,必須執行下列措施,以緩解建造作業對環境造成的影響:

 

i)            only well-maintained plant shall be operated on-site and plant shall be serviced regularly during the construction;

在建造工程期間,工地內只准使用保養良好的設備,且須定期維修;

 

ii)           all construction equipment shall be fitted with silencers which shall be properly maintained during the construction works;

須在建造工程期間為所有建築設備安裝滅聲器,並須加以妥善保養;

 

iii)         mobile plant shall be sited as far away from the noise sensitive receivers as possible;

活動設備的裝設位置,要盡量遠離噪音感應強的地方;

 

iv)         material stockpiles and other structures shall be effectively utilized where practicable, to screen noise form on-site construction activities;

須盡可能有效利用堆存的材料或其他構築物,以阻隔工地內進行建造作業所產生的噪音;

 

v)          only plant that have sound power levels rating lower than those specified in the relevant part of the EPD’s “Technical Memorandum on Noise from Construction Work in Designated Areas” shall be used;

所採用設備的聲動率級,須較環境保護署發出的《管制指定範圍的建築工程噪音技術備忘錄》相關部分所指定設備的聲功率級為低。

 

vi)         temporary barriers in the form of site hoardings to achieve at least 5dB(A) reduction shall be provided. All noisy equipment including generators and compressors shall be completely enclosed by temporary mobile screen to achieve noise reduction of 10dB(A); and

須裝設工地圍板作為臨時屏障,以減少至少5分貝(A)的噪音。所有高噪音設備(包括發電機和壓縮機)須以臨時活動屏障完全圍封,以減少10分貝(A)的噪音;及

 

vii)       mitigation options 1 and 2 in accordance with sections 3.5.31 to 3.5.34 of the EIA Report shall be followed to minimize the potential noise impacts in road construction.
