Pursuant to Section 10 of the Environmental Impact Assessment Ordinance (the Ordinance), the Director of Environmental Protection (the Director) granted the Environmental Permit No. EP-349/2009 to MTR Corporation Limited (hereinafter referred to as the ¡§Permit Holder¡¨) on 16 October 2009.  Pursuant to Section 13 of the Ordinance, the Director amends the Environmental Permit No. EP-349/2009/J based on the Application No. VEP-420/2013.  The amendments, described below, are incorporated into this Environmental Permit No. EP-349/2009/K.  This Environmental Permit as amended is for the construction and operation of the designated project described in Part B of this Permit subject to the conditions specified in Part C of this Permit.

The Project is a designated project (DP) under the Ordinance with the following DP elements:

-          A railway and its associated stations (Item A.2 of Part I of Schedule 2 of the Ordinance);

-          ÅK¸ô¤Î¨ä¬ÛÁp¨®¯¸(±ø¨Òªþªí2²ÄI³¡A.2¶µ)¡F

-          A railway siding and maintenance workshop (Item A.4 of Part I of Schedule 2 of the Ordinance);

-          ÅK¸ô°¼½u¤Îºû­×¤u³õ(±ø¨Òªþªí2²ÄI³¡A.4¶µ)¡F

-          A railway tunnel more than 800m in length between portals (Item A.7 of Part I of Schedule 2 of the Ordinance); and

-          Project includes works partly or wholly in a country park or special area, a conservation area, and a site of special scientific interest (Item Q.1 of Part I of Schedule 2 of the Ordinance).

Scale and Scope of Designated Project(s)

Construction and operation of the following key elements:

 «Ø³y©MÀç¿ì¥H¤Uªº¥D­n³¡¥÷¡G

-          Approximately 26km of underground railway running from the terminus in West Kowloon to the boundary at Huanggang;

-          ªø¬ù26¤½¨½ªº¦a¤UÅK¸ô¡A±q¦è¤EÀsªºÁ`¯¸¦ù©µ¦Ü¬Ó±^Ãä¬É¡F

-          A terminus in West Kowloon, and its associated building elements such as ventilation facilities, public transport interchange, traction sub-station, and seawater cooling facility;

-          ¦ì©ó¦è¤EÀsªºÁ`¯¸¤Î¨äªþÄÝ«Ø¿vª«¡A¨Ò¦p³q­·³]¬I¡B¤½¦@¥æ³q¥æ¶×³B¡BÅܹq¯¸©M®ü¤ô§N«o³]¬I¡F

-          Seven tunnel ventilation buildings at Mai Po, Ngau Tam Mei, Pat Heung, Shing Mun, Kwai Chung, Nam Cheong and Mong Kok West respectively; and an Emergency Access Point (EAP) at Tai Kong Po;

-          ¤C®yÀG¹D³q­·¼Ó¡A¤À§O³]©ó¦Ì®H¡B¤û¼æ§À¡B¤K¶m¡B«°ªù¡B¸ª¯F¡B«n©÷©M©ô¨¤¦è¡A¥H¤Î³]©ó¤j¦¿®Hªººò«æ±Ï´©¤J¤f¡F

-          Stabling sidings and maintenance facilities located at Shek Kong (Shek Kong Stabling Sidings (SSS)) to provide for train stabling, minor maintenance and cleaning;

-          ¦ì©ó¥Û±^ªº¦C¨®°±©ñ³B¤Îºû­×³]¬I(¥Û±^¦C¨®°±©ñ³B)¡A¬°ÅK¸ô´£¨ÑÁ{®É°±ªy¡B¤p«¬ºû­×©M²M¼äªA°È¡F

-          An emergency rescue sidings (ERS) located next to the SSS; and

-          ¦ì©ó¥Û±^¦C¨®°±©ñ³B®Çªººò«æ±Ï´©³B(¥Û±^ºò«æ±Ï´©³B)¡F¤Î

-          Supporting works areas, access roads, barging facilities, site explosive magazine and nursery sites during the construction of the Project.

PART C (PERMIT CONDITIONS)
C³¡¡]³\¥iÃÒ±ø¥ó¡^

 

1.         General Conditions

           ¤@¯ë±ø¥ó

 

1.1       The Permit Holder and any person working on the Project shall comply with all conditions set out in this Permit. Any non-compliance by any person may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499) and may become the subject of appropriate action under the Ordinance.

            ³\¥iÃÒ«ù¦³¤H¤Î¥ô¦ó±q¨Æ¤uµ{¶µ¥Øªº¤H¤h¥²¶·§¹¥þ²Å¦X¥»³\¥iÃÒ¸ü¦Cªº¥þ³¡±ø¥ó¡C¥ô¦ó¤H¤h¦p¦³¤£²Å¦X¥»³\¥iÃÒªº±¡ªp¡A¥i¯à¹H¤ÏÀô¹Ò¼vÅTµû¦ô±ø¨Ò (²Ä499³¹) ªº³W©w¡A¦Ó·í§½¥i®Ú¾Ú±ø¨Ò±Ä¨ú¾A·í¦æ°Ê¡C

 

1.2              The Permit Holder shall ensure full compliance with all legislation from time to time in force including but without limitation to the Noise Control Ordinance (Cap. 400), Air Pollution Control Ordinance (Cap. 311), Water Pollution Control Ordinance (Cap. 358), Waste Disposal Ordinance (Cap. 354), Occupational Safety and Health Ordinance (Cap. 509), Factories and Industrial Undertakings Ordinance (Cap. 59) and Dangerous Goods Ordinance (Cap.295).  This Permit does not of itself constitute any ground of defence against any proceedings instituted under any legislation.

1.3    The Permit Holder shall give a copy of this Permit to the person(s) in charge of the Project site(s) and ensure that such person(s) fully understands all conditions and all requirements incorporated by the Permit. The Project site(s) refers to site(s) of construction and operation of the Project and shall mean the same hereafter.

1.4    The Permit Holder shall make copies of this Permit together with all documents referred to in this Permit or the documents referred to in Part A of the Permit readily available at all times for inspection by the Director or his authorised officers at all Project site(s) covered by this Permit.  Any reference to the Permit shall include all documents referred to in the Permit and also the relevant documents in the Register.

1.5         The Permit Holder shall display conspicuously a copy of this Permit on the Project site(s) at all vehicular site entrances or at a convenient location for public¡¦s information at all times.  The Permit Holder shall ensure that the most updated information about the Permit, including any amended permit, is displayed at such locations. If the Permit Holder surrenders a part or the whole of the Permit, the notice he sends to the Director shall also be displayed at the same locations as the original Permit. The suspended, varied or cancelled Permit shall be removed from display at the Project site(s).

1.6              The Permit Holder shall construct and operate the Project in accordance with the project descriptions in Part B of this Permit.

  ³\¥iÃÒ«ù¦³¤H¶·¨Ì¾Ú¥»³\¥iÃÒB³¡ªº»¡©ú¡A«Ø³y¤ÎÀç¿ì¤uµ{¶µ¥Ø¡C

 

1.7              The Permit Holder shall ensure that the Project is designed, constructed and operated in accordance with the information and all recommendations described in the EIA Report (Register No.: AEIAR- 143/2009), the application documents for an environmental permit including all attached documents (Application No. AEP-349/2009), the applications for variation of an environmental permit including all attached documents (Application Nos. VEP-323/2010, VEP-334/2010, VEP-336/2011, VEP-346/2011, VEP-352/2012, VEP-358/2012, VEP-360/2012, VEP-373/2012, VEP-377/2012, VEP407/2013 and VEP-420/2013), other relevant documents in the Register, the information or mitigation measures described in this Permit, mitigation measures to be recommended in submissions that shall be deposited with or approved by the Director as a result of permit conditions contained in this Permit, and mitigation measures to be recommended under on going surveillance and monitoring activities during all stages of the Project. Where recommendations referred to in the documents of the Register are not expressly referred to in this Permit, such recommendations are nevertheless to be implemented unless expressly excluded or impliedly amended in this Permit.

1.8       All deposited submissions, as required under this Permit, shall be rectified and resubmitted in accordance with the comments, if any, made by the Director within one month of the receipt of the Director¡¦s comments or otherwise as specified by the Director.

1.9              All submissions approved by the Director, all submissions deposited without comments by the Director, and all submissions rectified in accordance with comments by the Director under this Permit shall be construed as part of the permit conditions described in Part C of this Permit. Any variation of the submissions shall be approved by the Director in writing or as prescribed in the relevant permit conditions. Any non-compliance with the submissions may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499).

1.10          All submissions or any variation of the submissions shall be certified by the Environmental Team (ET) Leader and verified by the Independent Environmental Checker (IEC) referred to in Conditions 2.1 and 2.3 below, before submitting to the Director under this Permit.

1.11          The Permit Holder shall release all finalised submissions as required under this Permit, to the public by depositing copies in the Environmental Impact Assessment Ordinance Register Office, or in any other places, or any Internet websites as specified by the Director, or by any means as specified by the Director, for public inspection. For this purpose, the Permit Holder shall provide sufficient copies of the submissions.

1.12     All submissions to the Director required under this Permit shall be delivered either in person or by registered mail to the Environmental Impact Assessment Ordinance Register Office (currently at 27/F, Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong). Electronic copies of all finalised submissions required under this Permit shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF) (version 1.3 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hardcopies.

1.13     The Permit Holder shall notify the Director in writing the commencement date of construction of the Project no later than one month prior to the commencement of construction of the Project. The Permit Holder shall notify the Director in writing immediately if there is any change of the commencement date of the construction.

1.14     For the purpose of this Permit, ¡§commencement of construction¡¨ does not include works related to site clearance and preparation, or other works as agreed by the Director.

1.15     The Permit Holder shall notify the Director in writing the commencement date of operation of the Project no later than two months prior to the commencement of operation of the Project. The Permit Holder shall notify the Director in writing immediately if there is any change of the commencement date of the operation.

Employment of Environmental Monitoring and Audit (EM&A) Personnel

2.1       An Environmental Team (ET) shall be established by the Permit Holder no later than one month before the commencement of construction of the Project. The ET shall not be in any way an associated body of the Independent Environmental Checker (IEC) for the Project. The ET shall be headed by an ET Leader. The ET Leader shall be a person who has at least 7 years of experience in environmental monitoring and auditing (EM&A) or environmental management.

2.2       The ET and the ET Leader shall be responsible for the implementation of the EM&A programme in accordance with the EM&A requirements as contained in the EM&A Manual of the Project. The ET Leader shall keep a contemporaneous log-book of each and every instance or circumstance or change of circumstances, which may affect the compliance with the recommendations of the EIA Report and this Permit. The ET Leader shall notify the IEC within one working day of the occurrence of any such instance or circumstance or change of circumstances. The ET Leader¡¦s log-book shall be kept readily available for inspection by all persons assisting in supervision of the implementation of the recommendations of the EIA Report and this Permit or by the Director or his authorized officers. Failure to maintain records in the log-book, failure to discharge the duties of the ET Leader as defined in the EM&A Manual or failure to comply with this Condition would entitle the Director to require the Permit Holder by notice in writing to replace the ET Leader. Failure by the Permit Holder to make replacement, or further failure to keep contemporaneous records in the log-book despite the employment of a new ET Leader may render the Permit liable to suspension, cancellation or variation.

2.3       An Independent Environmental Checker (IEC) shall be employed by the Permit Holder no later than one month before commencement of construction of the Project. The IEC shall not be in any way an associated body of the Contractor or the ET for the Project. The IEC shall be a person who has at least 7 years of experience in EM&A or environmental management.

            ¦b¤uµ{¶µ¥Øªº«Ø³y¤uµ{®i¶}«e¡A³\¥iÃÒ«ù¦³¤H¶·¦Ü¤Ö´£¦­¤@­Ó¤ë¸u¥Î¤@¦W¿W¥ßÀô¹Ò¬d®Ö¤H¡C¿W¥ßÀô¹Ò¬d®Ö¤H¤£±o»P¤uµ{¶µ¥Øªº©Ó¿ì°Ó©ÎÀô¹Ò¤p²Õ¦³¥ô¦óÁpô¡C¿W¥ßÀô¹Ò¬d®Ö¤H¶·¦bÀôºÊ©ÎÀô¹ÒºÞ²z¤è­±¦Ü¤Ö¦³7¦~¸gÅç¡C

 

2.4              The IEC shall be responsible for duties defined in the EM&A Manual and shall audit the overall EM&A performance, including the implementation of all environmental mitigation measures, submissions required in the EM&A Manual, and any other submissions required under this Permit. In addition, the IEC shall be responsible for verifying the environmental acceptability of permanent and temporary works, relevant design plans and submissions under this Permit. The IEC shall verify the log-book(s) mentioned in Condition 2.2 of this Permit. The IEC shall notify the Director by fax, within one working day of receipt of notification from the ET Leader of each and every occurrence, change of circumstances or non-compliance with the EIA Report and/or this Permit, which might affect the monitoring or control of adverse environmental impacts from the Project. In the case where the IEC fails to so notify the Director of the same, fails to discharge the duties of the IEC as defined in the EM&A Manual or fails to comply with this Condition, the Director may require the Permit Holder by notice in writing to replace the IEC. Failure to replace the IEC as directed or further failure to so notify the Director despite employment of a new IEC may render the Permit liable to suspension, cancellation or variation. Notification by the Permit Holder is the same as notification by the IEC for the purpose of this Condition.

Management Organization of Main Construction Companies

2.6              The Permit Holder shall, no later than one month before the commencement of construction of the Project, inform the Director in writing the management organization of the main construction companies and/or any form of joint ventures associated with the construction of the Project.  The submitted information shall include at least an organization chart, names of responsible persons and their contact details.

Community Liaison Groups

ªÀ°ÏÁpµ¸¤p²Õ

 

2.7       The Permit Holder shall set up Community Liaison Groups comprising of representatives from the relevant concerned and affected parties, including owners¡¦ corporations, management offices, local committees and schools of affected areas, to facilitate communication, enquiries and complaints handling on all environmental issues. The Permit Holder shall set up Community Liaison Groups before the commencement of construction of the Project and maintain the Community Liaison Groups up to the first 12 months of the operation of the Project. The Permit Holder shall notify the Director the date of setting up the Community Liaison Groups, the membership, the terms of reference and the contact details.

2.8       The Permit Holder shall set up a designated complaint hotline for the Project to address the environmental concerns and complaints in an efficient manner before the commencement of construction of the Project and maintain the designated complaint hotline up to the first 12 months of the operation of the Project.

Submission of Works Schedule

2.9              The Permit Holder shall, no later than one month before the commencement of construction of the Project, deposit with the Director a construction programme showing the commencement and completion dates of major items of construction works, including dates of taking possession of and subsequent exit from the works sites. The Permit Holder shall inform the Director in writing in case of any subsequent changes of items contained in this submitted construction programme.

Measures to Mitigate Ecological, Landscape and Visual Impact

2.10   Before the commencement of any tunneling or soil excavation works, the Permit Holder shall deposit with the Director an updated hydrogeological impact assessment to reaffirm the findings of the EIA Report with respect to the extent of the environmental impacts as a result of the potential hydrology and groundwater level changes. Before, during and after the soil excavation or tunneling works, the Permit Holder shall conduct groundwater level monitoring, in particular in the ecologically sensitive areas, in consultation with relevant stakeholders to verify the predictions in the EIA Report.

2.11   Before the commencement of any tunneling or soil excavation works, the Permit Holder shall deposit with the Director a contingency plan to deal with any unforeseeable incidents which might affect the groundwater level.

2.12   The Permit Holder shall, no later than one month before the commencement of construction at the respective works areas of the Project, deposit with the Director the following submissions:

(i)                 An Ecological Habitat Management Plan agreed by the Director of Agriculture, Fisheries and Conservation. The Ecological Habitat Management Plan shall contain the details of implementation schedule and construction programme of the mitigated stream habitat to be provided in-situ within the works area of the SSS and the ERS;

(iii)             A Vegetation Survey Report conducted for the magazine site at Tai Shu Ha Road West for formulating effective mitigatory planting proposal in the site.

2.13     Vegetation located within the Project site(s) shall be protected and preserved as far as practicable. No more than 5,500 trees shall be felled. Detailed tree felling application and compensatory planting proposal shall be submitted to seek approval from other authorities.

2.14          No later than one month before any tree felling, the Permit Holder shall submit a Tree Planting and Landscape Plan, including the compensatory woodland, in consultation with the Planning Department and Agriculture, Fisheries and Conservation Department, for approval by the Director.

2.15     The Permit Holder shall appoint a Certified Arborist for the Project to advise on, monitor and ensure proper implementation of measures for protecting trees affected by the Project. Before the commencement of any work which may affect any tree, the Permit Holders shall deposit with the Director a Tree Protection Plan prepared by the Certified Arborist, detailing the requirements and measures for the proper protection and monitoring of trees affected by the construction of the Project. The Tree Protection Plan prepare by the Certified Arborist shall cover all Project site(s) and shall include:

2.16   The Permit Holder shall maintain continuous discussions with the West Kowloon Cultural District Authority and in consultation with the Planning Department so as to further refine the scale, location, disposition, design and integration strategies of the ventilation shafts within the West Kowloon Cultural District to minimize their visual impacts.

2.17     The Permit Holder shall consult relevant government departments including Planning Department on the reprovisioning and restoration of the public open space affected by the Project. The Permit Holder shall, no later than two months after the commencement of operation of the Project, deposit with the Director the record of the public open space reprovisioning and restoration.

Waste Management

2.18   Inert construction and demolition (C&D) materials shall be separated from non-inert C&D waste on site. The Permit Holder shall prohibit the disposal of any C&D materials generated by the Project at the landfills, with the exception of the non-inert C&D wastes and the small amount of properly treated contaminated wastes.

2.19     Inert C&D materials shall be reused on site as far as possible, in order to minimize the disposal of such materials to public fill reception facilities. The Permit Holder shall deposit with the Director an updated C&D Material Management Plan within three months of the commencement of the construction works.

2.20   The Permit Holder shall control the disposal of C&D materials through a trip ticket system. The Permit Holder shall take action to restore any fly-tipping sites found to be dumped with C&D materials generated by the Project.

2.21          The Permit Holder shall carry out further site investigation regarding potential land contamination in accordance with the EIA Report. Site inspection shall be carried out when individual site access is granted to ascertain contaminative sources and hotspots of contamination. The Permit Holder shall submit to the Director for approval a revised Contamination Assessment Plan (CAP) with sampling and testing schedule updated based on respective site condition. If contamination is found, the Permit

Holder shall submit to the Director for approval a Remediation Assessment Plan (RAP). No work on the identified potentially contaminated sites shall be carried out unless and until the CAP and RAP submitted under this condition are approved by the Director.

2.23     The construction stage ground-borne noise impact at the time of tunnel boring machine operation shall be monitored to confirm the ground-borne noise levels.  If it is envisaged that the noise criteria will be exceeded at the nearby sensitive receivers, reducing rotational speed and scheduling of works or other alternatives shall be adopted to reduce noise impact in consultation with the affected parties.

Measures to Mitigate Operational Ground-borne Noise Impact

2.24    Within six months of the commencement of the construction of the Project, the Permit Holder shall deposit with the Director a Performance Test Plan for the verification of the Line Source Response assumed in the EIA Report. The Performance Test Plan shall include the result of the vibration borehole testing to be carried out at two carefully selected locations along the tunnel alignment before the commencement of the construction of the Project and the knowledge of the ground vibration conditions to be obtained during the construction stage of the Project.

2.25    The Permit Holder shall arrange testing of the Force Density Levels of the trains for the Project as soon as possible, but in no case later than six months before the commencement of operation of the Project.

2.37   The Permit Holder shall, no later than one month before the commencement of construction at the works area of SSS, Tai Kong Po Emergency Access Point (TPP) or Tse Uk Tsuen (TUW), deposit with the Director an Archaeological Action Plan agreed by the Antiquities and Monuments Office. The Archaeological Action Plan shall include:

2.40     The Permit Holder shall ensure that the To Kau Wan Works Area is only used for proper stockpiling of fill materials generated from the Project suitable for use by the Hong Kong - Zhuhai - Macao Bridge project office. The stockpiling height shall not exceed 8m from ground level. The stockpiling amount shall not exceed 350,000m3.

2.46     Samples, measurements and necessary remedial actions shall be taken in accordance with the requirements of the EM&A Manual by:

            ¨ú¼Ë¡B´ú¶q¤Î±Ä¨ú©Ò»Ýªº¸É±Ï¦æ°Ê¡A§¡¶·«ö·ÓÀôºÊ¤â¥Uªº³W©w¶i¦æ¡G

 

(a)                conducting baseline environmental monitoring;
¶i¦æÀô¹Ò°ò½uºÊ¹î¡F

(b)               conducting impact monitoring;
¶i¦æ¼vÅTºÊ¹î¡F

(c)                carrying out remedial actions described in Event/Action Plans of the EM&A Manual in accordance with the time frames set out in Event/Action Plans, or as agreed by the Director, in case where specified criteria in the EM&A Manual are exceeded; and
¦p¶W¹OÀôºÊ¤â¥U¤º«ü©wªº¼Ð·Ç¡A«h«ö·ÓÀôºÊ¤â¥U¤ºªº¨Æ¥ó/¦æ°Ê­p¹º©Ò­q©úªº®É­­©Î¸pªø©Ò¦P·Nªº®É­­¡A°õ¦æ¨Æ¥ó/¦æ°Ê­p¹º©Ò»¡©úªº¸É±Ï¦æ°Ê¡F¥H¤Î

(d)               logging and keeping records of details of (a) to (c) above for all parameters within 3 working days of collection of data or completion of remedial action(s), for the purpose of preparing and submitting the monthly EM&A Reports and to make available for inspection on site.

2.47     The Permit Holder shall deposit with the Director six hard copies and one electronic copy of the Baseline Monitoring Report at least one month before commencement of construction of the Project. Additional copies of the submission shall be made available to the Director upon his request.

2.48     The Permit Holder shall deposit with the Director six hard copies and one electronic copy of monthly EM&A Report within 10 working days after the end of the reporting month. The EM&A Reports shall include a summary of all non-compliance (exceedances) of the environmental quality performance limits (Action and Limit Levels). A summary and progress update of the Project Implementation Schedule (Table 18.1 of the EIA Report) shall also be included in each EM&A Report. Additional copies of the submission shall be provided to the Director upon request by the Director.

2.49   The Permit Holder shall, no later than three months after the commencement of operation of the Project, deposit with the Director an Environmental Monitoring and Audit report on the implementation of the mitigation measures for operation stage of the Project in accordance with the EIA Report and the submissions required under of this Permit.

2.50     To facilitate public inspection of the documents to be submitted or deposited as required under this Permit, the Baseline Monitoring Report and EM&A Reports via the Environmental Impact Assessment Ordinance Internet Website and at the Environmental Impact Assessment Ordinance Register Office, the Permit Holder shall prepare electronic copies of these documents and Reports in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF) (version 1.3 or later) or other format agreed by the Director, and shall submit the electronic copies at the same time as the hardcopies. For the HTML version, a content page capable of providing hyperlink to each section and sub-section of these documents and Reports shall be included in the beginning of the document. Hyperlinks to all figures, drawings and tables in these documents and Reports shall be provided in the main text from where the respective references are made. All graphics in these documents and Reports shall be in interlaced GIF format unless otherwise agreed by the Director. The content of the electronic copies of these documents and Reports must be the same as the hardcopies.

2.51    The Permit Holder shall set up a dedicated Internet website and notify the Director in writing the Internet address where the environmental monitoring and project data are to be placed, within six weeks after the commencement of construction of the Project. All environmental monitoring data described in Conditions 2.45 to 2.49 above shall be made available to the public via a dedicated Internet website to be set up by the Permit Holder in the shortest possible time and in no event later than 2 weeks after the relevant environmental monitoring data are collected or become available, unless otherwise agreed with the Director.

2.52     The Internet website as described in Condition 2.51 above shall enable user-friendly public access to the monitoring and project data including the EIA Report, the amended pages of the EIA Report submitted in accordance with the Approval Condition (8), the environmental permit(s) and the project profile of the Project. Unless otherwise agreed with the Director, the Internet website shall have features capable of:

1.        This Permit consists of three parts, namely, PART A (Main Permit), PART B (Description of Designated Project) and PART C (Permit Conditions).  Any person relying on this permit should obtain independent legal advice on the legal implications under the Ordinance, and the following notes are for general information only.

2.        If there is a breach of any conditions of this Permit, the Director or his authorized officer may, with the consent of the Secretary for the Environment, order the cessation of associated work until the remedial action is taken in respect of the resultant environmental damage, and in that case the Permit Holder shall not carry out any associated works without the permission of the Director or his authorized officer.

3.        The Permit Holder may apply under Section 13 of the Ordinance to the Director for a variation of the conditions of this Permit.  The Permit Holder shall replace the original permit displayed on the Project site(s) by the amended permit.

4.        A person who assumes the responsibility for the whole or a part of the designated project may, before the person assumes responsibility of the designated project, apply under Section 12 of the Ordinance to the Director for a further environmental permit.

5.        Under Section 14 of the Ordinance, the Director may with the consent of the Secretary for the Environment, suspend, vary or cancel this Permit.  The suspended, varied or cancelled Permit shall be removed from display at the Project site(s).

6.        If this Permit is cancelled or surrendered during construction or operation of the Project, another environmental permit must be obtained under the Ordinance before the Project could be continued.  It is an offence under section 26(1) of the Ordinance to construct or operate a designated project listed in Part I of schedule 2 of the Ordinance without a valid environmental permit.

7.        Any person who constructs or operates the Project contrary to the conditions in the Permit, and is convicted of an offence under the Ordinance, is liable:-

       ¦p¥ô¦ó¤H¦b¹H¤Ï¥»³\¥iÃÒªº±ø¥ó¤U«Ø³y©ÎÀç¿ì¤uµ{¶µ¥Ø¡A®Ú¾Ú±ø¨Ò¡A§YÄݥǸo ¡V

 

(i)           on a first conviction on indictment to a fine of $ 2 million and to imprisonment for 6 months;
¤@¸g´`¤½¶Dµ{§Ç­º¦¸©w¸o¡A¥i³B»@´Ú200¸U¤¸¤ÎºÊ¸T6­Ó¤ë¡F

(ii)         on a second or subsequent conviction on indictment to a fine of $ 5 million and to imprisonment for 2 years;
¤@¸g´`¤½¶Dµ{§Ç²Ä¤G¦¸©Î¨ä«á¨C¦¸©w¸o¡A¥i³B»@´Ú500¸U¤¸¤ÎºÊ¸T2¦~¡F

(iii)       on a first summary conviction to a fine at level 6 and to imprisonment for 6 months;
¤@¸g´`²©öµ{§Ç­º¦¸©w¸o¡A¥i³B²Ä6¯Å»@´Ú¤ÎºÊ¸T6­Ó¤ë¡F

(iv)       on a second or subsequent summary conviction to a fine of $1 million and to imprisonment for 1 year; and
¤@¸g´`²©öµ{§Ç²Ä¤G¦¸©Î¨ä«á¨C¦¸©w¸o¡A¥i³B»@´Ú100¸U¤¸¤ÎºÊ¸T1¦~¡F¥H¤Î

(v)         in any case where the offence is of a continuing nature, the court or magistrate may impose a fine of $ 10,000 for each day on which he is satisfied the offence continued.

8.      The Permit Holder may appeal against any condition of this Permit under Section 17 of the Ordinance within 30 days of receipt of this Permit.
