The Basel Ban Amendment

The Ban Amendment was first adopted by the third meeting of the Conference of the Parties in 1995. Recognizing that transboundary movements of hazardous wastes, especially to developing countries, have a high risk of not constituting an environmentally sound management as required by the Convention, the Ban Amendment requires that each Party member of the developed countries listed in Annex VII shall prohibit all transboundary movements of hazardous wastes to Party members not listed in the Annex.

The Waste Disposal Ordinance, Cap 354 (WDO), as amended in 2006, provides that the EPD, as the control authority, will not issue import permits to hazardous waste shipments from developed countries (see Part IVA and the 9th Schedule of the WDO), in line with the Ban Amendment.
